Daar word gekonsentreer op ·die ontwikkeling van 'n algemene verweer van niepatologiese ontoerekeningsvatbaarheid. Die konstitusionele reg, vennoedens en ontoerekeningsvatbaarheid word aan die hand van Suid-Afrikaanse regspraak en die Interim Grondwet bespreek. Daar word na buitelandse reg gekyk ten einde 'n aanbeveling te kan maak wat grondwetlik nie sal indruis op die reg van die individu tot onskuld nie. Die arbitrere ouderdomsgrens vir vasstelling van toerekeningsvatbaarheid by kinders word gekritiseer en 'n verhoorbaarheidvasstellingseenheid word aanbeveel. / A short elementological discussion of criminal responsibility is followed by concepts of law of evidence that is applicable to presumptions of accountability. The historical legal position as well as the development in the current South African law and the present legal position with reference to the mentally disturbed children and persons with a defence of non-pathological unaccountability are included and discussed. The constitutional law, presumptions and unaccountablility are discussed with reference to the South African case law and the Interim Constitution. Foreign law is perused so that a recommendation could be made that would not interfere with the rights of the individual to be deemed innocent. A general defence of non-pathological unaccountability is supported if it is treated with the necessary circumspection by the courts. Multiomics study of Pochonia chlamydosporia tritrophic lifestyle

En esta tesis doctoral se estudia el modo de vida tritrófico del hongo nematófago Pochonia chlamydosporia utilizando técnicas "multiómicas". Pochonia chlamydosporia (= Metacordyceps chlamydosporia) (Goddard) Zare y Gams es un hongo nematófago usado para el control de nematodos agalladores de la raíz (Meloidogyne spp.) (Forghani and Hajihassani, 2020), entre otros. P. chlamydosporia se distribuye por todo el mundo y tiene un modo de vida tritrófico, pudiendo también adoptar estilos de vida endófito y saprófito. El mecanismo que utiliza P. clamydosporia para infectar huevos de nematodo comprende la desacetilación de la quitina de su pared celular a quitosano para facilitar su degradación por quitosanasas (Aranda-Martinez et al., 2016). El quitosano es un biopolímero derivado de la quitina que también se encuentra en el exoesqueleto de artrópodos y crustáceos. El genoma de P. chlamydosporia codifica un elevado número de quitosanasas, gracias a las cuales es resistente a quitosano y puede utilizarlo como fuente de nutrientes (Palma-Guerrero et al., 2010). Ambos pueden combinarse para el control de plagas. En este trabajo de tesis doctoral se pretende estudiar mediante metabolómica, transcriptómica y genómica el modo de vida tritrófico de P. chlamydosporia añadiendo quitosano, para determinar los mecanismos de interacción del hongo en ese entorno. En último término, se pretende sentar las bases para desarrollar un sistema para reducir plagas y enfermedades de forma sostenible.

Psykologiska försvar och långvarig smärta : En studie om psykologiska strategier för hantering av livet med smärta / Psychological defences and chronic pain : A study on psychological strategies for managing life with pain

Långvarig smärta innebär ofta stora påfrestningar för individen med konsekvenser på många livsområden vilket utgör en utmaning för hälso- och sjukvården gällande bemötande utifrån ett helhetsperspektiv. En central aspekt av att leva med långvarig smärta är hur stress och påfrestningar hanteras exempelvis genom användning av psykologiska försvar. Syftet med denna studie var att bidra till ökad kunskap om psykologiska försvar hos personer med långvarig smärta utifrån frågeställningen:  vilka psykologiska försvar och psykologiska försvarsstrukturer framkommer när vuxna personer med långvarig smärta intervjuas om personligt relevanta områden. Datainsamlingen bestod av tio telefonintervjuer som transkriberades och analyserades med Defense Mechanism Rating Scales (DMRS). Resultaten visade på en varians av psykologiska försvar i deltagargruppen. Mest förekommande var högadaptiva försvar, särskilt humor och anknytning.  Utmärkande var även förekomsten av flertalet medeladaptiva försvar såsom annullering, samt det lågadaptiva försvaret nedvärdering av sig själv. Resultaten kan bidra till ökad förståelse om omedvetna hanteringsstrategier som kan påverka upplevelsen av smärta och även vara av vikt för hälso- och sjukvårdens bemötande av patienter med långvarig smärta. Vidare forskning inom området behövs för att undersöka samband mellan psykologiska försvar och andra relevanta faktorer såsom smärtdiagnos, smärtsymtom och behandlingsutfall. / Chronic pain is associated with extensive distress for the individual with consequences on several areas of life and constitutes a challenge for the healthcare system in approaching chronic pain from a holistic perspective. How individuals cope with distresses for example by using psychological defences is of significance for the chronic pain condition. The purpose of this study was to contribute to the body of knowledge regarding psychological defences that are used by individuals with chronic pain. The research question was: what psychological defences and structures of psychological defences appear when adults with chronic pain are being interviewed on personally relevant topics.  Ten telephone interviews were conducted, the material from interviews was transcripted and analysed using Defense Mechanism Rating Scales (DMRS). The results showed a variety of different psychological defences used by participants. High adaptive defences such as humour and affiliation were the most appearing. Furthermore, the occurrence of middle adaptive defences such as undoing was also detected in the material. Among the low adaptive defences devaluation of self stood out the most. The results contribute to the understanding of involuntary coping-strategies that may influence the experience of chronic pain. In addition, the results are important for the treatment of chronic pain patients within the healthcare. Further research in this field is needed to study links between defence mechanisms and other relevant aspects such as pain diagnosis, pain symptoms and treatment outcome.

A mosaic of induced and non-induced branches promotes variation in leaf traits, predation and insect herbivore assemblages in canopy trees

Forest canopies are complex and highly diverse environments. Their diversity is affected by pronounced gradients in abiotic and biotic conditions, including variation in leaf chemistry. We hypothesised that branch-localised defence induction and vertical stratification in mature oaks constitute sources of chemical variation that extend across trophic levels. To test this, we combined manipulation of plant defences, predation monitoring, food-choice trials with herbivores and sampling of herbivore assemblages. Both induction and vertical stratification affected branch chemistry, but the effect of induction was stronger. Induction increased predation in the canopy and reduced herbivory in bioassays. The effects of increased predation affected herbivore assemblages by decreasing their abundance, and indirectly, their richness. In turn, we show that there are multiple factors contributing to variation across canopies. Branch-localised induction, variation between tree individuals and predation may be the ones with particularly strong effects on diverse assemblages of insects in temperate forests.

The additional tax ("penalties") imposable in terms of section 76(1) of the Income Tax Act (No 58 of 1962) when a taxpayer is in default, can be very harsh (up to 200% of the tax properly chargeable). The Commissioner may, in terms of section 76(2)(a), remit any penalty imposed, as he sees fit. However, when there was intent on the part of the taxpayer to evade the payment of tax, the Commissioner may not remit any portion of the 200% penalty imposable, unless he is of the opinion that "extenuating circumstances" exist. This dissertation examines the meaning of "extenuating circumstances", as interpreted by the judiciary, and lists the factors and defences that a taxpayer may plead to justify a remission of penalties, both in the case of an intention by the taxpayer to evade tax and in cases where the taxpayer is merely in default of section 76(1). / Accounting / MCOM (Accounting)

The systems psychodynamic role analysis of the 21st century leader

The 21st century is characterised by globalisation, turbulent change, an information explosion and an electronic revolution. The result is organisations with decentralised structures, increased employee empowerment and growth alliances. This changing landscape calls for a more holistic, collaborative outlook on leadership, placing the emphasis on relationships, context and transformation where leadership occurs at multiple levels in organisations. While organisations work towards future sustainability in response to the demands of this landscape, leaders are faced with their own personal transition within their roles. Leadership is a socially constructed process that is co-created amidst pressure from self-expectations, follower expectations and organisational requirements. Leadership as a boundary-keeping role that functions on the periphery between the organisation and the external environment, evokes anxiety. The researcher sought to explore, describe and analyse the lived leadership role experience of 21st century leaders as it plays out above and below the surface of consciousness. At the conscious level, the normative role refers to job description and content. At the unconscious level, the existential role deals with the role in the mind of the individual, while the phenomenal role relates to what others perceive and project onto the individual fulfilling the role. The level of congruence between these three roles and its consequent impact on the individual leadership experience were explored. Hermeneutic phenomenology, using the systems psychodynamic perspective as a theoretical framework, enabled the researcher to apply in-depth description and interpretation. A case study research approach was adopted where individual cases were analysed and then consolidated into a cross-case analysis of findings. The study revealed the underlying mental activity and irrational behaviour relating to anxiety, conflict and defences that manifest for 21st century leaders. By integrating the findings with both systems psychodynamic literature and leadership literature, nine themes emerged, namely anxiety, leadership identity, boundaries, authority, role, task, containment, valence and perceived performance. L'objectif de ce travail est d'appréhender les processus de la formation du tissu urbain de l'agglomération de Châteauneuf, créée autour de la collégiale Saint-Martin au cours du Moyen Âge à l'ouest de la cité de Tours. La complexité de cet espace, la densité et la diversité de la population à cette période ainsi que la richesse architecturale identifiée dans cette zone en font un terrain privilégié d'analyse de la fabrique urbaine, c'est-à-dire des relations entre l'espace urbain et les sociétés qui l'ont produit. L'étude des vestiges architecturaux médiévaux en pierre, associée à celle de sources complémentaires comme les sources textuelles, permet de proposer à la fois une synthèse typologique sur les constructions médiévales et une réflexion à l'échelle du parcellaire et de l'agglomération, pour mettre en évidence les formes urbaines et leurs transformations du 10e au 14e siècle / The purpose of this thesis is to understand the processes of the urban fabric in the town of Châteauneuf, created in the Middle Ages around the St-Martin's basilica, near the city of Tours. The complexity and density of the settlement together with the diversity of the inhabitants make this place a preferential area in order to study urban fabric and relations between space and societies which created it. The architectural analysis of stone buildings, combined with other data such as historical sources, allows the creation of a typological synthesis of the medieval buildings but also the analysis of the urban forms and their evolution between the 10th and the 14th centuries
