La gestion des risques portés par le client en banque et assurance : comportements et éthique des acteurs / The risk management borne by the customer in bank and insurance : actors's behaviors and ethics

Notre recherche consiste à étudier les comportements des professionnels dans les secteurs de la banque de détail et des compagnies d’assurance, des dirigeants aux conseillers, et des clients, qui ont des incidences sur les risques portés par ces derniers. Les législateurs et superviseurs se sont concentrés sur la réglementation et les normes, notamment prudentielles, comptables et techniques, mais ont sous-estimé le rôle et l’impact des comportements de chaque acteur qui peuvent être inappropriés et déloyaux malgré le nouveau cadre réglementaire. La compréhension, la prise en compte et le contrôle des comportements de chaque acteur sont nécessaires pour permettre un équilibre entre une efficience saine de l’entreprise et le respect des intérêts des clients de manière pérenne.Cette étude s’est déroulée en immersion durant trois années au sein de l’Autorité de contrôle prudentiel et de résolution (ACPR), ce qui a permis de voir, analyser et comprendre parallèlement les problématiques des superviseurs et des sujets de leurs contrôles. L’analyse de divers rapports nationaux et internationaux, des procédures et rapports de contrôle, des questionnaires à destination des professionnels ainsi que des entretiens semi-directifs avec toutes les parties prenantes en lien avec notre sujet de recherche, ont permis d’avoir les éléments pertinents, fiables et concrets pour répondre à notre problématique centrale.Les activités financières reposent sur la confiance et dans ce contexte de crise persistant, la nécessité d’une surveillance et d’une régulation est croissante. Les secteurs de la banque et de l’assurance étant complexes, techniques et difficilement intelligibles pour le plus grand nombre, les comportements des acteurs de la finance doivent être exemplaires dans leurs interactions avec les clients, particulièrement quand ils présentent et expliquent les produits financiers.Depuis le début de la crise fin 2007, de nombreux scandales au niveau international ont mis en évidence un grand nombre d’erreurs humaines liées à des comportements non éthiques en matière de protection des consommateurs. Au-delà des failles concernant les risques financiers ou opérationnels, les pratiques commerciales de certaines entités financières ont été clairement mises en cause conduisant à la sanction du superviseur national pour certaines banques et compagnies d’assurance.Se pose ainsi la question essentielle de la place de l’éthique au sein de l’organisation et des effets des comportements de chaque partie prenante à la relation commerciale. L’éthique implique les notions de responsabilisation, de respect et de courage, elle doit être prise en considération et mise en pratique afin d’atteindre un double objectif : la performance humaine et économique de l’entreprise.Les législateurs et régulateurs, à travers les directives CRD4, Solvabilité2, MIF2, IMD2 et Prips focalisent principalement leurs exigences sur les règles comptables, techniques et liées aux pratiques commerciales. Même si les nombreux scandales financiers, notamment depuis 2007, ont montré de graves dérives comportementales dans la finance, les moyens mis en place (outils de gestion, méthodes ou dispositifs) pour décrypter et contrôler les comportements au sein des entreprises financières sont encore peu développés et utilisés, particulièrement pour les risques portés par le client.Notre étude décrit et analyse les comportements des professionnels et des clients, la place des émotions dans les prises de décisions financières, l’influence des normes et de leurs contrôles sur les comportements des professionnels afin de comprendre ce qui va à l’encontre d’un fonctionnement organisationnel interne vertueux et de pratiques commerciales responsables. Nous nous interrogeons sur la gestion des risques portés par le client au sein de l’organisation et des moyens alloués à la protection de la clientèle, et proposons une série de préconisations afin d'atténuer ces risques à l'avenir. / Our research consists of studying the behavior of professionals, leaders, advisors, and customers, in the areas of retail banking and insurance that have implications for the risk borne by clients. Legislators and supervisors focused on regulations and standards, in particular in prudential, accounting and technical areas but underestimated the role and impact of the behavior of each actor that may be inappropriate and unfair despite the new regulatory framework. Understanding, recognition and control of the behavior of each actor are necessary for a healthy balance between efficiency of the company and respect of the interests of customers in a sustainable manner.This study was conducted in immersion during three years within the Autorité de Contrôle Prudentiel et de Résolution, allowing to see, analyze and understand in parallel the issues of supervisors and the subjects of their controls. The analysis of various national and international reports, procedures and monitoring reports, questionnaires for professionals and semi-structured interviews with all stakeholders related to our research subject, allowed to have relevant, reliable and practical elements to address our central problem.The financial activities are based on trust and in this context of continuing crisis, the need for monitoring and regulation is increasing. Banking and insurance sectors are complex, technical and hardly intelligible to the general public, the behavior of financial actors must be exemplary in their interactions with customers, especially when they present and explain financial products.Since the beginning of the crisis at the end of 2007, many international scandals have highlighted a large number of human errors related to unethical behavior in the field of consumer protection. Beyond the loopholes regarding financial or operational risks, the business practices of some financial institutions have been challenged leading to penalties by the national supervisor for certain banks and insurance companies.This raises the essential question of ethics within financial institutions and the effects of each stakeholder’s behavior in the business relationship. Ethics involves the concepts of accountability, respect and courage, it must be taken into consideration and put into practice to achieve a double objective: the human and economic performances of companies.Legislators and regulators through the directives CRD4, Solvency 2, MIF2, IMD2 PRIPs and their requirements focus mainly on accounting rules, technical and related business practices. Although many financial scandals, particularly since 2007, have shown serious behavioral excesses in finance, the measures implemented (management tools, methods or devices) to decrypt and control the behavior within financial firms are underdeveloped and underused, particularly for the risks borne by the customer.Our study describes and analyzes the behavior of professionals and clients, the role of emotions in financial decisions, the influence of standards and their controls on the behavior of professionals to understand what is contrary to a virtuous organizational functioning and responsible business practices. We question the management of risks borne by the customer within the organization and resources allocated to the protection of customers, and we propose a set of recommandations in order to reduce these risks in the future.

The Effects of the Ethic of Care in an All-Boys School from 1903-1974

Nel Noddings’ 1984 publication, Caring: A Feminine Approach to Ethics and Moral Education was the first formal introduction of the concept of an “ethic of care”. It is a concept that stresses the importance of compassion in any relationship. For the purpose of this dissertation, the ethic of care was studied in a specific educational community. This research focused on the role of care ethics in a secondary school (The Ransom School for Boys) from 1903 to 1974. The researcher identified this school as one that operated with an ethic of care and collected and analyzed data from historical school documents as well as from 60-90 minute individual interviews with six alumni, five retired faculty, and two administrators. The case study addressed how students and faculty experienced care ethics within the school and how it has been maintained throughout the adult lives of alumni. An a priori coding rubric was used to examine the presence of care ethics at the Ransom School for Boys and in the adult lives of its alumni. This rubric was generated using information taken from the literature review and encompasses 36 different words to identify the presence of care ethics. The primary research question was: How have alumni incorporated care ethics into their personal and professional lives? Secondary questions included: How did the ethic of care present itself over the span of 71 years? Was character education part of the formal curriculum at the Ransom School? Was character education part of the hidden curriculum at the Ransom School? Did the presence of care ethics support the values being taught in the home? While there has been research done on the importance of care ethics in an educational institution, the research is void of direct evidence associated with care ethics in a school community, specifically, an all-boys, private school. Through deductive analysis, care ethics was found to be present and utilized at the school. The interviews and historical documents suggested that moral education was an integral part of the informal curriculum and helped to integrate the ethic of care within the community.

Globalisation, technology and identity : a feminist study of work cultures in the localisation industry

This work is a feminist study that aims to address a gap in knowledge about the working lives and learning of those employed in electronic, globalising industries, such as localisation. While much is known generally about the under-representation of women in SET (Science, Engineering and Technology), there has been less detailed study that explores the gendering of working lives in electronic knowledge industries which are a crucial part of the technological globalising process. Taking the localisation industry as a case, the present work addresses this lack. Localisation involves making an electronic product or website linguistically and culturally appropriate for people to use in another country/region and language. Workers in the industry adapt printed and electronic texts (and products) for distribution in overseas markets. The study is based on interviews with 10 workers and company owners from the UK, continental Europe, Ireland and South America. A critical feminist approach supports the analysis of interview data using CDA (Critical Discourse Analysis), and participant observation at a conference to reveal power relations which are seemingly hidden in the virtual sphere. Remote forms of working, mediated through the use of ICTs (Information and Communications Technologies) predominate in the industry. The findings are presented in three areas of analysis. Firstly, in relation to workers’ identities the study revealed that technology was a discursive resource used symbolically. While technology represented quality, domestication was used antithetically to indicate its lack. In the analysis this constituted a technologisation of identities. Secondly, workers’ learning trajectories revealed tensions in between knowledge work and accreditation. In relation to technology per se, image creation was central to localisation and the separation of the image from work practices concealed workers’ contributions. In this way the emotional labour invested in the production of the localised image was hidden. Thirdly, the study revealed ways in which global structures interacted with industry boundaries and intersected gendered cultures with implications for professional learning.

This thesis addresses the growing privatization of the US forces through the Revolution in Military Affairs and the War in Iraq and its implications for the purpose of mobilization and individual military commitment conceptualize by the US warrior ethos. Creating a dialogue between the literature on Private Military Companies and the US warrior ethos, this thesis aims at providing a comprehensive understanding of the values sustaining the warrior ethos and how they are jeopardized by the emergence of new actors in the battlespace. I argue that this commercial turn in the US military erode the warrior ethos by placing business consideration ahead of great personal risk and ultimately raises doubts about civic responsibilities and democratic control of US military affairs.

PREDICTORS OF TYPICAL AND MAXIMUM PERFORMANCE:

This dissertation examined the relationship between personality, individual values, work values and conditions of performance. The objective of this study was to determine what motivational constructs predict a smaller differential between performance outcomes under typical conditions of performance versus maximum conditions of performance. This study examined four research questions. 1) Is there a relationship between personality traits and conditions of performance? 2) Is there a relationship between individual values and conditions of performance? 3) Is there a relationship between work values and conditions of performance? 4) Which of the overall relationships are more highly correlated? Sackett et al. (1988) characterized maximum performance as evidenced when three conditions are met: 1) there must be explicit awareness that one is being evaluated, 2) there must be awareness of and acceptance of implicit or explicit instructions to maximize effort, and 3) performance must be measured over a short enough duration that the performer's attention remains focused on achieving maximum performance. Conversely, typical performance would be characterized by situations in which individuals were not cognizant of any performance evaluation, were not attempting to perform to the best of their ability, and in which performance was monitored over an extended period of time (Sackett et al., 1988). In this study, FFM personality traits of were proposed to correlate with a differential in performance outcomes between the two conditions of performance. Similarly, individual values of conformity, stimulation, hedonism, benevolence and achievement were proposed to correlate with a similar differential in performance. A specific set of work Values drawn from the Protestant Work Ethic were also proposed to correlate with a performance differential. The results of this research suggested performance outcomes do significantly vary under each performance condition, but that the results are highly correlated (.620 with p-value < .05). Individuals who perform at a superior level under conditions of typical performance also perform at a higher level under conditions of maximum performance as well. The study did not find support for the expected relationships between personality traits, individual values or work values and outcomes between conditions of typical and maximum performance.

In this context, we realize it is essential that the clinician to recognize and accept the fundamental elements of the human condition- a clinic as a community of destiny anchored in Great Ethics, in the Great Aesthetics and in major Politics, as proposed in this work. A clinic founded in the state of tension constitutive of human, as a condition that allows the life pulsate and, at the same time and at the same time, who calls us to create and affirm a mode of being as possibility of venturing in bustling procedures of life. Finally, a clinic as a process of redemption of the opening State essential at a time of profound funcionalização of existence that transforms the beautiful in insurance, the dialog in a monologue and the diversity in disorder. A clinic understood, experienced and too committed to the existence, whose primary objective is to create conditions that allow what is prevented from having (the body, the senses and the world) find avenues of expression. There was a need for research that will extend this debate about this possibility to practice medicine, due to the scarcity of bibliographic material in psychology in relation to this issue. / Esta dissertação objetivou refletir, a partir de referenciais teóricos, a possibilidade de uma Clínica como Comunidade de Destino. Para tanto, abordamos questões relativas às transformações que vivenciamos na contemporaneidade, diante das quais são necessárias inovadas maneiras de compreensão da existência humana que possam dar suporte aos sofrimentos do homem nos dias de hoje. A esse respeito, observam-se, experiências geradoras de um profundo mal-estar, configurador de um sujeito marcado pela tripla tirania da tecnologia, do consumo e da informação, atravessado por uma lógica da utilidade-descartabilidadevelocidade, geradores de sentimento de desamparo e de dispepsia existencial, condição de profundo desenraizamento propulsor de fraturas éticas por mergulhar o humano em situações em que o outro falta assustadoramente e exacerba a experiência de estar à mercê. Condição que mergulha nossa época em dispositivos que visam administrar a vida por meio de estratégias de governo da vida, como a militarização, medicalização e judicialização que subtraem do sujeito o indizível e os mistérios de seu ser. Frente a esse contexto, percebemos ser fundamental que o clínico reconheça e acolha os elementos fundamentais da condição humanauma Clínica como Comunidade de Destino ancorada na Grande Ética, na Grande Estética e na Grande Política, tal como proposta nesse trabalho. Uma clínica fundada no acolhimento da tensão constitutiva do humano, como condição que permite a vida pulsar e, ao mesmo tempo e simultaneamente, que nos convoca a criar e afirmar um modo de ser como possibilidade de aventurar-se na processualidade fervilhante da vida. Enfim, uma clínica como um processo de resgate do estado de abertura fundamental numa época de profunda funcionalização da existência que transforma o belo em seguro, o diálogo em monólogo e a diversidade em transtorno. Uma clínica compreendida, experimentada e demasiadamente compromissada com a existência, cujo objetivo primordial é criar condições que permitam que aquilo que se encontra impedido de passar (ao corpo, aos sentidos e ao mundo) encontre vias de expressão. Constatou-se a necessidade de pesquisas que ampliem este debate acerca desta possibilidade de clinicar, devido a escassez de material bibliográfico em psicologia no que se refere a esta temática.

The doubt is: Is it possible do not give importance for the ethics teaching in the specific curse in administration area where prepare professionals that will work in administrative job ? Is a qualitative research, and had a philosophy method. For the reality analyze was used the bibliography theory reference, and institution regiment, discipline program and also the curriculum course. Was observed the school real phenomenon and that has lived a long time by the professors. And also was made a comparative of the two institutions curriculum. About the information got together the documents, the observations realized, evidenced that ethic question is not in the course, and the subject is not too. The results pointed for the necessity of the pedagogy project made thought the school, where focus the ethic necessity for the future managers graduation. / A pesquisa focaliza o curso de graduação de administração de empresa de uma instituição pública localizada no Paraná, que prepara profissionais para atuarem em empresas públicas e privadas e em outros setores administrativos. Tem por objetivo enfatizar a importância da dimensão ética no curso envolvendo a gestão da escola, os professores que ministram as disciplinas e as conseqüências éticas para a formação dos futuros administradores. Daí a pergunta: Por que a ética deve estar presente num curso específico da área de administração que forma pessoas que exercerão cargos em empresas? Trata-se de uma pesquisa qualitativa, de cunho filosófico. Para análise da realidade recorremos ao referencial teórico de uma bibliografia pertinente, além do regimento da instituição, do programa das disciplinas e da matriz curricular do curso. Foram observados os fenômenos concretos da escola e os vividos pelos professores. Também foi feito um paralelo da matriz curricular de outras duas escolas de administração. Dos dados coletados juntos dos documentos e das observações realizadas, constatou-se que a questão ética não faz parte do curso, nem da disciplina e nem do projeto do curso como um todo. Ao passo que nas outras duas escolas a ética é abordada em disciplina específica. Os dados coletados apontam para a necessidade de um projeto pedagógico construído pela escola, que focalize a necessidade da ética na formação dos futuros administradores.
