NIRA JAKO KONCEPČNÍ OMYL. PŘÍČINY SELHÁNÍ KORPORATIVISTICKÉHO PROJEKTU / NIRA As A Conceptual Fallacy. The Causes of A Failure of A Corporativist Project

In this thesis I am analyzing the causes of failure of the recovery program resulting from the National Industrial Recovery Act (NIRA) the implementation of which the National Recovery Administration (NRA) ensured. I am searching for the act's ideological roots and directions of thought which had projected themselves into it, first. Further on, I deal with the content, process of drafting and approving of the codes of fair competition, as well as the facts which were determining them. In the next part I am scrutinizing the procedures of enforcing the codes and code compliance, including the twists in development of these. For the understanding of these procedures is what I regard as necessary for grasping the increasing hostility towards the NRA of part of business. In the last two chapters I deal with the NRA's failure's causes proper. I divide these causes into, first, which I think do not result from the NIRA conception and which could have revealed themselves during any other program's implementation. And, second, which result from the legislation's real essence directly. These I am dividing, further on, into causes (defects) emanating from the NIRA just as a result of concrete historical circumstances of time and place and causes emanating from the act's conception necessarily, disregard of circumstances. My central idea, to the advantage of which I am setting forth the arguments in this thesis, is that the NIRA must have ended up unsuccessful, exactly because of the inherent problems it contained, even if there was no Supreme Court's Schechter decision. In accordance with Mises's idea of any interventionist model's necessary instability I utter the hypothesis that the NIRA had but two ways ahead of it. One led to the state before the act's passage, the other one led in the direction of central planning, in any form, which only could have, although for a short time, deal with the problems resulting from the missing inter-industrial coordination in the state of the fragmented order of market.

Orientador: Fernando Andrade Fernandes / Resumo: Considerando que o delito de corrupção é favorecido pelo mundo globalizado, em que as atividades econômicas encontram-se interligadas numa rede de interdependência dos mercados, gerando uma maior complexidade da sociedade e consequente relativização de valores, das regras morais e jurídicas, o presente trabalho tem como objetivo realizar uma análise do problema pela ótica do Sistema Integral de Direito Penal, considerando-se o entendimento de que apenas nessa perspectiva mais abrangente será possível uma melhor compreensão do fenômeno frente à mencionada complexidade. Registre-se, inicialmente, a hipótese de que se trata de uma manifestação do fenômeno delitivo, que possui raízes em uma perspectiva criminológica a qual passou a enfatizar a relevância penal também de alguns fatos realizados por determinados sujeitos de elevado status social (powerfull), com destaque para certas práticas no mundo dos negócios. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: Considering that the crime of corruption is fomented by the globalized world, in which economic activities are interconnected in a network of interdependence of the markets, generating a greater complexity of society and consequent relativization of values, of moral and juridical rules, the present article has as an objective to carry out an analysis of the problem from the perspective of the Comprehensive Criminal Law System, considering the understanding that only in this more comprehensive perspective will a better understanding of the phenomenon be possible in the face of this complexity. The hypothesis is initially that this is a manifestation of the delirium phenomenon that has roots in a criminological perspective that began to emphasize the criminal relevance also of some facts carried out by certain subjects of high social status (powerfull) for certain practices in the business world. 商標權侵害行為刑事責任之研究 —以「混淆誤認之虞」的解釋為中心 / Research on criminal liability of trademark right infringement-focusing on the Interpretation of "Likelihood of Confusion"

自古以來,人們就有使用標記的習慣,而對於標記使用的開端,已難以考證,此外,使用商標的行為對於現代社會具有重要的意義,欠缺商標的經濟市場難以運行,消費者無從區別、選購商品,生產者則欠缺提升產品品質的動力,不僅經濟市場機制無法運行,更可能導致經濟競爭機制的崩塌,有鑒於商標的重要性,各國相互簽訂國際條約,制定相關制度規範、保障商標,並對於仿冒商標的行為制訂民事和刑事責任。我國商標法對於仿冒商標的行為,原本只有民事侵權責任之規範,然而,因應當時代的國際情勢和國際條約之需求,我國商標法納入刑事規範處罰仿冒商標及販賣仿冒品的行為,在經過幾次修法後,現今我國商標刑罰的條文主要是以消費者的角度,判斷係爭行為是否成立商標罪責,亦即,藉由「混淆誤認之虞」作為商標刑責成立的門檻,除此之外,現行我國商標刑罰的條文尚包含商標使用行為的判斷及行為人主觀要件的具備。 然而,綜觀我國商標法刑事責任的條文,不僅條文內容多為不確定法律概念,與我國商標法民事侵權責任之條文內容幾近相同。民事責任和刑事責任於其本質上大有不同,基於刑罰手段的嚴厲性,對於人民權利的侵害程度非民事責任所能比擬,故有刑法最後手段性原則的出現,但是,我國現行商標法的民事侵權責任和刑罰規範內容幾近相同,則似有違刑法的謙抑性,因此,似有重新對我國現行商標刑罰條文重新檢視之必要,而探究刑法存在的目的,現行多數見解認為是刑法法益,故將探究商標法的保護法益為何,再從確立的法益重新解釋商標刑罰的條文,又商標法第95條為最典型和最原始的仿冒商標行為規範,因此,將專注於商標法第95條的檢討和反思。 / Since ancient times, people have had the habit of using marks, yet the beginning of the use of the mark has been hard to verify. In addition, the use of trademark has important meaning for the modern society. Without trademark, the economic market would be hard to operate. Consumers would not be able to distinguish one product from another, let alone buying the product. As for producers, they would lack the motivation to promote the quality of the product. It might not only stop the operation of the economic market, but also lead to the collapse of the economic competition mechanism. In light of the importance of the trademark, most of the countries signed international treaties, made relevant norms to protect trademarks and formulated civil and criminal liability for counterfeiting trademarks. Originally, there was only civil liability in our trademark law, however, due to the international situation of that time and the needs of the international treaties, our trademark law has brought in criminal punishment for counterfeiting trademarks and selling counterfeit goods. After several amendments to the trademark law, our trademark penalty is mainly based on the view of consumers to determine whether the conduct is found guilty, that is, by using the concept of " the likelihood of confusion" as the threshold of the establishment of the trademark criminal liability. Apart from that, our trademark penalties also require the use of trademark and the subjective elements. However, if we look through our trademark penalties, there are full of uncertain legal concepts, and the content of the provision is same as the trademark civil liability. But there is great difference between the nature of the civil liability and criminal liability, so it is necessary to review our trademark penalty again, and from the view of Rechtsgut. Therefore, after defining the Rechtsgut of our trademark penalty, I would reinterpret Article 95 of the trademark law from the point of view of Rechtsgut, as Article 95 is the typical and the original norms for the conduct of counterfeiting trademarks.

爭議性行銷方式之公平交易法規研究-以比較廣告為例

每當承辦知名企業間因廣告行銷而發生不公平競爭的法律爭議時,作者最反覆思考的問題不外是:究竟一則比較廣告在什麼程度以內,與其他競爭對手間的產品比較以及資訊揭露,對消費者來說是最有利,而且對競爭者來說是最公平的?換句話說,就是使用「比較廣告」這樣的爭議性行銷方法,在什麼樣的限度內,是比較可以恰如其分地,一方面完成它原本行銷應達成的目的,帶給消費者充分且必要的消費資訊,另一方面也顧及了競爭法下的公平尺度,沒有用超過目的之手法損及競爭者;接著的問題是,現行國內的公平交易法規是不是已恰如其分地扮演了這樣一個尺度呢?   基於以上目的,本研究分別從行銷管理、公平交易及主要國家競爭法立法例的觀點,廣泛探討相關文獻,切入檢視過去與比較廣告有關的研究,發現過去文獻對比較廣告展現創意的「不安全領域」和「安全領域」之探討,確實不足。故本文採用質性研究中的個案法及文件分析,藉由觀察公平會自1992年至2007年間的相關案例,選出指標案例共十二則,希望對透過實際個案之處分書或不處分書的解析,探討我國公平會對比較廣告違法性的認定標準,進一步釐清不法比較廣告與創意比較廣告的分際。   藉由觀察公平會對該十二個指標案例作成決定時所示的見解,本研究發現公平會對於其持以處分或不處分比較廣告的準則,已衍然成形。首先,如果一個比較廣告有「真實性原則」、「客觀性原則」或「資訊充分揭露原則」三原則中,任一原則的違反,導致成為一個不真實、不客觀或資訊未充分揭露(或兼具其中二者或三者)的比較廣告時,即已經存在「不法元素」,可能構成違法,此形成本研究之命題一。其次,公平會也明白宣示了比較廣告內容或方式的「安全區域」,本研究將此一發現名為公平會的「愈抽象愈安全原則」,並且認為此處即為比較廣告應該盡情展現創意之所在,此形成本研究之命題二。作者並盼望繼起的有志之士,往後能嘗試大膽建立各種假設,小心驗證本研究已經建立的兩項命題,以檢視其周延性和正確性,俾供企業未來在行銷上運用比較廣告時,能大膽展現創意,但又不致於違法的參考,同時亦對公平會及業者分別提出建議。 / Every time when Author undertakes unfair competition disputes between well-known enterprises arisen out of advertising and marketing, the question the Author will ponder over and over is: with respect to the comparative advertising, in terms of product comparison and information disclosure with other rivals, to which extent the comparative advertising will be the most beneficial advertising to the consumers and the most impartial advertising to the rivals. In other words, to which extent can “comparative advertising” be used appropriately, on one hand complete goals the original marketing was intended to achieve, bring sufficient and necessary consumption information to the consumers, on the other hand take into account of fairness criterion under competition law without application of technique beyond its original purpose which would cause damage to the rivals. Then the next question is: whether the existing Fair Trade Law has adequately set forth said criterion? Based on the above goals, from respective viewpoints in marketing management, fair trade and legislation precedent of competition laws of major countries, the author, through extensive probing into past documentary records and reviews of past researches related to comparative advertising, realized that researches on “unsafe territory” and “safe territory” to show creativity of comparative advertising in past documentary records are not sufficient. Therefore, the author has adopted case method and document analysis used in qualitative research. From among the relevant cases handled by the Fair Trade Commission between 1992 and 2007, the author has chosen twelve distinctive cases, aiming to probe into criterion for determination of violation of comparative advertising by Fair Trade Commission of the ROC, and further verification of the differences between unlawful comparative advertising and creative comparative advertising through study and analysis of disposition or non-disposition decision of each individual case. Upon review of administrative interpretations rendered by the Fair Trade Commission towards said twelve distinctive cases, the author realized that rules governing disposition of comparative advertising by the Fair Trade Commission has taken shape. First of all, when a comparative advertising breaches either the “principle of truthfulness”, the “principle of objectiveness” or the “principle of information disclosure”, the comparative advertising will become an unreal, non-objective or non-disclosed comparative advertising (or both or all), some “illegal elements” have occurred, which may constitute violation of law, this forms the first proposition of this thesis. Secondly, the Fair Trade Commission has clearly announced “safety areas” of content or manner of the comparative advertising, the author names this discovery as “more abstract more safe principle”, and believe this is the area where comparative advertising shall exert its best effort to show its creativity, which forms the second proposition of this thesis. The author expects that future researchers will be able to create hypotheses, examine and verify two propositions this thesis have already built up, in order to investigate its thoroughness and correctness, so that enterprises could bravely demonstrate its creativity when applying comparative advertising for the marketing.

Les figures juridiques de la concurrence en droit de l'union Européenne : étude autour de la notion de loyauté de la concurrence / The legal aspects of competition : a research account on the fair competition

L’existence d’une multiplicité de figures juridiques de la concurrence pourrait conduire à un manque de cohérence et d’intelligibilité du régime européen de la concurrence. Ce dernier canalise d’ailleurs une partie des critiques relative au déclin du droit. Toutefois, l’étude de ses multiples traductions juridiques aboutit à un constat bien différent. Derrière un apparent désordre, l’approche européenne de la concurrence fait preuve d’une profonde cohérence. Dans chacune des figures juridiques de la concurrence, un même objectif officie au titre de standard. Il s’agit de la loyauté de la concurrence. Cette dernière intervient dans l’ensemble des régimes européens de la concurrence comme une notion autour de laquelle gravite un ensemble de solutions cohérentes par leur finalité et leur contenu. Cohérentes par leur finalité, tout d’abord, car les multiples traductions de l’ordre concurrentiel européen abordent la loyauté de la concurrence comme un moyen de protéger le bon fonctionnement du marché concurrentiel. Cohérentes par leur contenu, ensuite, car chacune des figures juridiques de la concurrence vise à assurer la loyauté de la concurrence en préservant l’égalité des chances entre les opérateurs économiques. De fait, le constat de la transversalité et de l’homogénéité de traitement de la loyauté de la concurrence révèle que l’objectif a, jusqu’alors, été largement sous-estimé. Cette mise à l’écart est regrettable car, en raison de sa neutralité axiologique, l’introduire dans les différents débats relatifs à l’approche européenne de la concurrence offre de véritables solutions en termes d’homogénéisation de la notion de concurrence et de meilleure intégration des figures juridiques de la concurrence. / The existence of various rules regarding competition could lead to a lack of coherence andintelligibility of the European system of competition. As a matter of fact, the latter channels a part of the criticisms relating to the decline of law. However, the study of its numerous legal translations results in a very different conclusion. Behind an apparent disorder, the European approach to competition shows profound coherence. In each legal aspects of competition, a common objective officiates as a standard. It is the fair competition. The latter intervenes in all European competition regulations as a notion around which revolve a set of solutions coherent by their finality and content.Coherent by their finality, firstly, because all the legal translations of the competitive order address fair competition as a way to protect competition and, more generally, public interest.Coherent by their content, secondly, because each legal aspects of competition ensures faircompetition by preserving the equality of opportunity between competitors.De facto, the observation of the transversality and homogeneity of the treatment of fair competition reveals that the objective has been, until now, widely underestimated. This sidelining is regrettable because, on the grounds of its axiological neutrality, introducing it into the different debates relating to the European approach to competition offers real solutions in terms of the homogenization of the notion of competition and better integration of the legal aspects of competition.
