Flexicurity: A Deliberate Ambiguity?

The aim of this thesis is to focus on the concept of flexicurity, accepted as the new labour market model balancing the needs of employers for greater flexibility in order to adapt to market forces, and the need of employees for security, which has recently been one of the most popular concepts of the debate on labour market reforms in the European Union. While doing so, this thesis discusses the position of key European institutions, especially of the Commission of the European Communities. The main argument is that the concept is still very open to alternative interpretations at the European Union level. Related to this openness is the fact that the Commission has deliberately instrumentalized the concept&rsquo / s ambiguity in order to absorb all the main actors into the debate in line with its own policy preferences.

Is Flexicurity Suitable For Turkish Labour Market Or Not?

Standard employment definitions have begun to change with the impact of globalization and new concepts such as part-time work, freelance, on-call work, temporary work, fixed-term labour contracts have started to be demanded in the labour market. These new definitions which were determined in order to keep pace with new competitive market environment paved the way of new trends in various countries. Flexicurity is one of these trends which is mostly favoured in European Union agenda. The purpose of this thesis is to study whether flexicurity is suitable for Turkish labour market or not while analyzing structure of it as well as Turkish labour market legislations with perceptions of social partners on flexicurity, which has been started to be argued with the accession process of Turkey to the European Union. The thesis observes that there is no homogenous system of flexicurity for European welfare states and if Turkey is analyzed in this framework it takes place in the Mediterranean Welfare Systems of flexicurity paradigm. Some policy recommendations necessary to make flexicurity suitable for Turkish labour market are also given in order to contribute to the conclusion part.

The purpose of this paper is to highlight the issue of preferential rights in relation to the increased practice of hiring temporary staff. The object is illuminated from a diversity perspective by seeing what a circumvention of the preferential rights may have consequences for vulnerable groups on the Swedish labor market.   The question of preferential rights to reinstatement is controlled in  The Employment Protection Act. The preferential right is for the protection of workers made redundant due to redundancy. The use of agency workers has increased significantly in the Swedish labor market since the industry's legalization in 1993. This has created some problems in terms of preferential rights.   To a circumvention of the law, shall exist requires that the measures constitute circumvention is justified, measures should have been sought to circumvent the law and been unfair in view of the particular case. Hiring of staff is not considered as a new employment, which is the requirement to invoke preferential rights, thus causing it to staff hiring is legitimate action under the preferential time.   To reduce the abuse of the right of priority, I believe that the application of law should be changed so that it takes into account the triangular available on today's labor market.

Daugybė priežasčių turi įtakos gyventojų užimtumui bei verčia darbdavius ir darbuotojus taikytis prie sparčiai besikeičiančių rinkos sąlygų. Pastaruoju metu tai ypač aktualu valstybėms siekiant likviduoti pasaulinės ekonominės krizės padarinius. Švedijai, kaip vienai stipriausių ekonomikos požiūriu ES valstybių, taipogi nepavyko išvengti pasaulinės ekonominės krizės. Svarbu išsiaiškinti ar Švedijoje egzistuoja darbo rinkos lankstumo ir užimtumo saugumo pusiausvyra, padedanti užtikrinti didesnį asmenį užimtumą šalyje. Magistro baigiamojo darbo tikslas - išanalizuoti Švedijos vykdomą darbo rinkos politiką ir situaciją darbo rinkoje, pateikiant galimus problemų sprendimus. Pateikiama darbo rinkos lankstumo ir užimtumo saugumo (flexicurity) samprata, komponentai, principai bei pavyzdžiu ES laikytinas Danijos „auksinio trikampio“ modelis. Nagrinėjamas darbuotojų mobilumas šalyje bei užimtumo apsauga. Aptariami įspėjimo apie darbo sutarties nutraukimą terminai turintys įtakos darbuotojų mobilumui ir darbo santykių lankstumui bei jo reglamentavimas teisės aktuose. This has recently been particularly pertinent to countries seeking to address the consequences of the world economic crisis. Sweden, which is one of the most powerful economic players in the EU, has also failed to avert the crisis. It is important to determine whether in Sweden there is flexicurity, which helps to ensure higher employment rates. The aim of the thesis is to analyse the Swedish labour market policy and the labour market situation and provide possible solutions to problems. The paper provides the concept, components and principles of flexicurity and the Danish “golden triangle” model, which is considered to be an example by the EU. The paper also examines the mobility of workers within the country and employment protection. Further, it discusses termination of employment contracts in respect of the notice period, which has influence over the mobility of workers and the flexibility of labour relations, and the regulation thereof. A possibilidade de se reduzir encargos de produção por meio da busca de insumos e mão de obra a custos menores promoveu o acirramento da concorrência e a necessidade cada vez maior de se apresentar no mercado produtos com boa qualidade a preços competitivos. Surge, então, a ideia da flexibilização como proposta de ferramenta a possibilitar maiores chances de concorrência mercadológica com alterações no sistema de regulamentação do Direito do Trabalho. Para alguns, a flexibilização enseja a possibilidade da geração de novas vagas de trabalho; para outros, não se pode associar dinamização da economia a regulamentação do trabalho, tampouco pode o Poder Público se curvar à competição mercadológica internacional. This master's dissertation deals with notice of termination of employment in three countries, specifically Czech Republic, Federal Republic of Germany and Great Britain, specifically England. The Federal Republic of Germany has been selected because Germany is a country with highly developed economy, however the social function of which is very fundamental that is also reflected in the notice of termination of employment legal regulation. Great Britain was selected because it represents different legal system to Czech republic or Germany, so called common law. British legal system can be further divided into legal systems of England and Wales, Northern Ireland and Scotland. This master's essay deals with the enactment in England. At the same time, it is also one of the economically most developed country in the framework of the European Union and a country in which a great number of Czech citizens seek their work opportunities. My diploma thesis is dealing with the legal issue of formation and termination of employment in the terms of flexicurity, focusing on the individual expressions of flexibility and employee protection in these legal institutes. The issue of flexibility and employee protection in the scope of formation and termination of employment is often discussed on the national as well as European level. Discussion emerges mostly due to the different preferences when the employer could rather benefit from flexibility, while for the employee the employee protection could be more important. To understand the institute of employment easily, the first chapter of my thesis describes Labour law in general and its subject. It slowly follows with the second chapter which is trying to give an explanation of flexicurity concept as well as a description of individual expressions of flexibility and employee protection. To illustrate the up-to-date and still higher importance of this strategy, including the European level, trends and attempts to integrate the flexicurity model into Member States' legislation are analysed. La flexicurité : approche du droit français / The flexicurity in french law

La flexicurité est un concept qui tente de concilier deux objectifs. Ainsi elle associe un marché du travail flexible caractérisé par exemple par une protection du travail relativement faible contre le licenciement et une solide protection sociale contre le chômage avec des allocations chômage généreuses. Parallèlement à cela, la flexicurité promeut une politique d’emploi qui vise à raccourcir la période entre deux emplois. Ce concept qui est apparu dans les pays du nord de l’Europe est présenté par l’Union européenne comme modèle social de référence. En France l’adoption de ce concept s’est fait de manière hésitante après l’échec du Contrat première embauche. Mais depuis 2008, la construction de ce concept prend de plus en plus d’ampleur. En ce sens, la France a innové en instaurant de nouveaux procédés de rupture de la relation contractuelle avec par exemple la rupture conventionnelle. La loi du 14 juin 2013 s’inscrit dans la continuité de cette démarche en réduisant les délais des actions qui portent sur l’exécution ou la rupture du contrat. Mais pour autant l’impact de ces mesures sur le taux de chômage n’est pas convainquant. Il s’agira alors de savoir quelle est l’importance réelle des mécanismes d’importation de ce concept en France. / Flexicurity is a concept that attempts to join two objectives. It combines a flexible labor market characterized by the relatively labor law protection against dismissal and a strong social protection against unemployment with generous unemployment benefits. At the same time, flexicurity promotes an employment policy that aims to shorten the time between jobs. This concept derived from the northern Europe countries and was presented by the European Union as a social reference model. In France this concept was not really adopted due to the failure of First Employment Contract. But since 2008, the construction of this concept is becoming increasingly important. In this field, France has innovated by introducing a new process of out of the contractual relationship whose interesting example is the contractual termination. The 14th 2013 Act is a continuation of this approach to reduce the time of the procedure to the breach or execution of contract.However the impact of these measures on the rate of unemployment is not convincing. It would therefore be interesting to assess in the case of further studies the impact of this concept in the French context.

The diploma thesis is dealing with mutually linked relations between family and working sphere of working women, mothers in sense of dependency on availability and possibility to use the measures how to coordinate family and work. Such measures coordinating family and work are very important part of concept known as flexicurity, combining required flexibility of labor market and social securities. The goal of the thesis is to answer the question: Is effective implementation and working of concept of flexicurity under actual social and economic conditions of slovak labor market possible? The theoretical part describes the concept of flexicurity itself, its pillars, especially the measures how to coordinate family and work. These are the inevitable assumption of effective implementation and working of the concept in practice. To meet the objective the combination of quantitative and qualitative research is choosen. According to research findings the diploma thesis concludes, that even the availability and possibility to use the measures of family and work coordination up allow some level of organization of family and working time, actual social and economic conditions of slovak labor market are inadequate in order to effective implementation and further working of concept of flexicurity.
