Human Trafficking as A Brand Within the Framework of Human Rights: Case Studies in the U.S

Recent concern in the United States about human trafficking has been directed primarily on the foreign victims that are brought into the United States rather than on U.S. citizenship who become involved. However, the topic has broadened and has significant impact on the daily lives of U.S citizens. Taking a human rights perspective, this dissertation explores how human trafficking has been used as a “brand” to achieve political and/or economic objectives. Human trafficking has taken away the human rights for individuals and threatens their security. This dissertation is grounded in Critical Theory and uses narrative analysis as a methodological framework. Using 99 public documents from Global Report on Trafficking in Persons by the United Nations Office on Drugs and Crime, International Labor Organization, and Office for Victims of Crime and other Departments of the U.S working on human trafficking issues, with the support of Nvivo software, the dissertation insists that human trafficking violates human rights, has no capacity to support human emancipation, and causes human beings to be treated as animals or objects or commodified a brand. Even though a brand is a mark and logo in economic development and refers to objects, not human beings. Human development is the objective that everyone wants to achieve. Human Trafficking Crime Awareness Among Remote Communities in Central Vietnam

Human trafficking crime is rising globally at an alarming rate, and Vietnam is one of the nations with the highest prevalence of trafficking female victims for forced sex services and forced marriages. This study explored human trafficking awareness in remote communities of central Vietnam and the factors for young girls dropping out of school for work at an early age. The study also investigated the link between gender inequality and the child labor problem in these communities. There is no extant empirical research pertaining to human trafficking awareness in the remote communities of central Vietnam. This research fills this gap and highlights the importance of awareness strategies to combat human trafficking. Gender inequality, human motivation theory, vulnerability, and victimology provided theoretical constructs to explain the findings of this research study. The data collection process was conducted through semistructured face-to-face interviews with 19 villagers, mothers of the child labor victims, teachers, human services workers, members of the Vietnam Women's Union, and village leaders in the research sites. The coding technique was used for the data analysis process. Participants had (a) little knowledge about human trafficking crime; (b) no awareness of the ramifications; and (c) the effects of a culture of gender inequality on the lives of people in the remote communities of central Vietnam. Findings of this study have implications for assisting policy makers and law enforcement officials and offer guidance that may help to protect people in the communities and bring offenders to justice. The findings also encourage the Vietnamese government to bridge the gender inequality divide so that young girls in these remote communities can achieve an equal voice and equal justice that they deserve.

abstract: Interviews of nine managers within the U.S. Department of Labor's Wage and Hour Division's Western Region were conducted by a researcher who also works as a Wage and Hour Investigator. The intention of this research was to survey the differences in trafficking-related training and experience throughout the region, to examine the role of the Wage and Hour Division in human trafficking casework, and to explore potential areas for growth. A presente dissertação, pautada no direito penal mínimo e no princípio da dignidade humana, discorre sobre o tráfico internacional de pessoas para fim de exploração sexual, tendo em vista o consentimento da vítima maior e capaz. Para tanto, foi feita uma análise introdutória do direito penal sexual e da prostituição, buscando identificar o bem jurídico tutelado hodiernamente sem a influência de conteúdo estritamente moral, pois no tráfico de pessoas deve prevalecer a proteção da liberdade sexual. Foram examinados os principais acordos internacionais afeitos à matéria, em especial o Protocolo de Palermo, e também a legislação de países como Alemanha, Portugal, Espanha, Itália, Estados Unidos e Argentina. Neste contexto, fez-se uma leitura crítica da legislação brasileira (mormente o art. 231 do Código Penal), que está em falta com a agenda internacional por se limitar a tutelar o tráfico internacional quando se trata de exploração de índole sexual. Além disso, o dispositivo se mostra falho em sua essência, por não enxergar o tráfico como um fenômeno, um processo delitivo complexo e multifacetado. À ineficácia legislativa se soma a insuficiência das políticas públicas nesta seara para o efetivo enfrentamento do tráfico de pessoas, visando a sua prevenção, punição e também a proteção às vítimas. / This paper which is based on the principles of minimum criminal law and human dignity, talks about the international human trafficking for sexual purposes, considering the consent of the adult and capable victim. For this, a preliminary analysis of the criminal sex and prostitution law was made, in order to identify the legal protected property, without the influence of the strictly moral context, because the protection of sexual freedom shall prevail in human trafficking. This paper also evaluates the more important international treaties with regard to this issue, with special regard to the Palermo Protocol as well as the legislation of countries such as Germany, Portugal, Spain, Italy, United States of America and Argentina. A comparative analyses of the Brazilian law was developed (Article 231 of the Brazilian Criminal Code), concluding that the Brazilian law is more restricted than the international rules, because it legislates that Human trafficking is only for sexual purposes and does not consider any other. Besides that, the aforementioned article has a flaw as it does not consider the traffic as a phenomenon, a complex and multifaceted wrongful process. The inefficient Brazilian legislative process is attributed to the insufficiency of public policies in this area to effectively face human trafficking, focusing on its prevention and punishment as well as the protection of the victims.

Human trafficking in Eastern Cape Province, South Africa

Human trafficking has been reported to be on the increase in the Eastern Cape Province of South Africa with girls as young as ten years old being trafficked from and within the Province for sexual and labour purposes, and marriage. Human traffickers operate in rural areas, small towns and cities such as Port Elizabeth and East London. However, research on the role of the law enforcement authorities and the civil society organisations in the fight against trafficking in Eastern Cape Province is largely unknown. Situated within the Security Governance Theory, and using the intensive research design, this research reports on the role of the law enforcement authorities and the civil society organisations in the fight against human trafficking in Eastern Cape Province with emphasis on rural-urban differentiation. The challenges which law enforcement authorities and the civil society organisations faced are also discussed. The study, among other things, found that both the law enforcement sector and civil society organisations in the Province ensured that security, criminal justice, physical, emotional, psychological, health and spiritual needs of rescued victims of trafficking were met. The study further established that there was little progress in the fight against human trafficking, more especially in the rural areas of the Province, due to inadequate cooperation among anti-trafficking organisations and the lack of resources.

Syftet med denna studie har varit att undersöka det skydd och stöd svenska myndigheter kan erbjuda offer för människohandel för sexuella ändamål (MSÄ). Detta har uppnåtts genom en textanalys av utvalda myndighetsdokument vilka behandlar skydd och stöd för personer utsatta för MSÄ. I fokus har även varit att analysera huruvida arbetet som beskrivs i texterna, samt intentionerna som framkommer, bär prägel av empowerment, det vill säga bidrar till en process där personerna blir stärkta och får ökad egenmakt i sina liv. Empowermentteorin har således utgjort ett analysverktyg i studien. Studiens resultat visar att texterna uttrycker intentioner om hjälp på lång sikt. Dessa intentioner anser vi bär prägel av empowerment. Intentioner framkommer även om att skydd och stöd bör vara villkorslöst och baserat på mänskliga rättigheter. Det stöd och skydd som beskrivs i texterna innefattar både akut och långsiktig hjälp. Dock har inte alla offer för MSÄ tillgång till samma skydd och stöd då detta villkoras beroende på vilken sorts uppehållstillstånd personen har. Medverkan i en rättsprocess är ett villkor för tidsbegränsat uppehållstillstånd i Sverige. Av denna anledning kan det diskuteras huruvida skydd och stöd ges främst för att möta MSÄ-offers behov eller i ett brottsbekämpande syfte. / The purpose of this study has been to investigate the support and protection the Swedish government can offer victims of human trafficking for sexual purposes (HTSP). This has been accomplished through a textual analysis of selected governmental documents, which describe support and protection for victims of HTSP. A focal point of this study has been to analyse whether the procedures described in the documents, and also the intentions therein, bears resemblance to the empowerment-theory. This includes whether it adds to a process where the persons are empowered and receives more control over their own lives. The result of the study shows that the texts express intentions of long-term support. We view these intentions as bearing resemblance to the empowerment-theory. Also, the texts show intentions of offering support and protection unconditionally and based upon human rights. The support and protection described in the texts envelop both emergent and long-term support. All victims of HTSP, though, do not have access to the same support and protection since this is based on what sort of visa the person holds. It is demanded to be part of a court-process to receive a short-term visa in Sweden. Because of this, it might be discussed whether support and protection is given first and foremost to meet the needs of victims of HTSP, or with the goal of fighting crime.

This thesis is focused on the topic of human trafficking. The main aim is to find out the internal factors leading a person to become a victim of human trafficking. The term human trafficking is explained from many points of view such as social work, prevention and legislation. The chapters are focused on explaining what human trafficking is and how it is different from other similar terms which are really easy to confuse with it. This thesis is also about the mechanism of human trafficking and factors leading to the situation of human trafficking. I conducted interviews with some victims of human trafficking to explore the internal factors that led them to making their decision. The practical part of the thesis includes six interviews which I summarized and included three of them written word for word in the appendix of the thesis. I analyzed the interviews and set the codes and categories which I compared to the internal categories written in books that include the factors that lead people to human trafficking. From this comparison, I made new categories to work with. I interpreted the new categories and found new factors leading to the situation of human trafficking. This study seeks to employ Applied Theatre techniques to investigate community underdevelopment and youth under-empowerment with a view to discover why there is a prevalence of the human-trafficking plague in Africa, with South Africa and Nigeria as case study. On the assumption that this approach could possibly have a desolating effect through the way in which some community members would feel about their situations, field works in Mabopane (South Africa) and Eleyele (Nigeria) were conducted in order to examine the prevalence of the neglect of the youths of these communities as well as human-trafficking occurrences and possibilities. Through the results from field works, the study seeks to unveil possible relationships community and youth neglect share with the human- trafficking scourge in both regional leading countries, in particular, and the globalised world, in general. This thesis focuses on legal protection of victims of human trafficking in Sweden. Human trafficking involves the exploitation of often already vulnerable individuals and is a violation of their human rights. Human trafficking is also a threat to state security as a component of transnational organized crime and illegal migration, and has therefore long been a subject of international cooperation.      In this thesis international responses to human trafficking are categorized as being focused on two distinct and separately protected parties, namely the individual and the state. The implementation of these international responses have, in the case of Sweden, mainly led to new criminal regulation relating to human trafficking, and in this thesis international as well as Swedish legal measures against human trafficking are analyzed from a victimological perspective. The overall aim is to investigate and analyze whether victims of trafficking have received an enhanced legal protection through Swedish criminal law.      The thesis shows that human trafficking is not considered a problem in the Swedish legislative context, and that the international measures to protect victims of trafficking have not been regarded to any great extent. Few victims of trafficking in Sweden are even identified as victims, and measures against human trafficking have largely been associated with measures against prostitution. To legally connect human trafficking with prostitution is, however, problematic because these crimes have different primary protective interests and the victims have different roles in the investigation and litigation process. From a victim's perspective, the categorization of the crime is crucial because the status of plaintiff, as is required for the possibility for financial redress and other legal rights, is assessed in Sweden by how the offense is classified. It is therefore important for the victims of human trafficking to be identified and categorized correctly in order to be defined as plaintiffs and obtain protection under criminal law. As a result of all these factors, the intended enhanced legal protection for victims of trafficking in Sweden is lost.
