Servidão doméstica : uma análise do caso Siwa-Akofa Siliadin à luz das normas da organização internacional do trabalhoMartins, Renata Duval January 2017 (has links)
O presente estudo tem por escopo analisar o caso da jovem Siwa-Akofa Siliadin, aliciada no Togo, em 1994, para prestar serviços na França como doméstica. Ao chegar no país foi submetida à servidão, impedida de completar os seus estudos e sem receber qualquer remuneração pelos serviços prestados, tampouco direitos laborais mínimos como o limite da jornada de trabalho diária, o descanso semanal remunerado e a habitação adequada lhe foram fornecidos. Trata-se de um leading case que aborda as práticas de tráfico humano, de trabalho forçado e de servidão doméstica. A escravidão contemporânea ocorre através do trabalho forçado, este se dividindo em espécies dentre as quais estão o trabalho escravo, a servidão e a servidão por dívida. Com quaisquer destas práticas pode ocorrer simultaneamente o tráfico de pessoas. A prática da escravidão doméstica, também chamada de servidão doméstica, inclui-se no rol de trabalhos forçados, verificando-se no caso concreto a qual das espécies de servidão pertence. Ocorre tanto em países ricos quanto em países emergentes e tem como grupo de pessoas mais vulnerável aos aliciadores as mulheres, os menores de idade, os migrantes, os pobres, os de baixa escolaridade. Normas internacionais laborais proíbem a escravidão contemporânea em todas as suas formas e obrigam os Estados a legislar a fim de coibir tenazmente em seu território tais condutas. Quando um Estado falha em prestar a necessária proteção ao trabalhador, não sendo possível a este se socorrer sequer no Poder Judiciário, pode a vítima pleitear alguma reparação nas Cortes Internacionais de Direitos Humanos. No caso ora analisado, as decisões das cortes nacionais francesas poderiam ter sido proferidas com base em normas da Organização Internacional do Trabalho internalizadas pela França, bem como normas não ratificadas poderiam ter sido utilizadas em caráter interpretativo da vaga e escassa legislação pátria. Em âmbito internacional, o Tribunal Europeu de Direitos Humanos não é o único órgão dotado de capacidade punitiva, a própria Organização Internacional do Trabalho pode ser acionada por meio de reclamação ou queixa contra Estados Membros que ratificam normas e as descumprem ou negligenciam sua efetividade, podendo esta punição ser aplicada concomitantemente à proferida pela supracitada Corte. O estudo é dividido em três partes: a primeira aborda as especificidades do caso Siliadin, conceitos pertinentes aos fatos narrados, estudo do processo judicial em âmbito francês e análise da decisão do Tribunal Europeu de Direitos Humanos; a segunda analisa as normas da Organização Internacional do Trabalho como normas de jus cogens laboral e núcleo duro de direito laboral, ressaltando como consequências à violação das referidas normas as reclamações e as queixas à Organização Internacional do Trabalho; a terceira analisa a incorporação e aplicação do direito internacional no âmbito interno dos Estados, frisando a possibilidade do emprego de normas da Organização Internacional do Trabalho na solução do litígio entre Siliadin e os empregadores.O método utilizado no presente trabalho é o indutivo, bem como se valeu da análise de caso com base em normas específicas da Organização Internacional do Trabalho sobre trabalho forçado (nº 29 e nº 105), discriminação (nº 100 e nº 111), trabalho doméstico (nº 189), trabalho infantojuvenil (nº 138 e nº 182) e trabalho do migrante (nº 143). Por fim, conclui-se pela necessária aplicação do direito internacional laboral na esfera processual interna dos Estados e a maior ingerência dos organismos internacionais trabalhistas a fim de garantir a efetividade das normas internacionais laborais. / This study aims to analyze the case of Siwa-Akofa Siliadin, a teenager enticed in the Togo, in 1994, into providing services as a domestic servant in France. Upon arriving in the country she was subjected to bondage, could not go to school and received neither payment for her services nor the minimum labor rights, such as limit to daily working hours, weekly paid rest and an adequate housing. It is a leading case which deals with human trafficking practices, forced labor and domestic servitude. Contemporary slavery takes place through forced labor, comprised into species among which are slave labor, servitude and debt bondage. With any of these practices trafficking of persons can occur simultaneously. The practice of domestic slavery, also called domestic servitude, is included in the list of forced labor, verifying to which species of bondage each case belongs. It occurs both in rich countries and emerging countries and the most vulnerable persons are women, minors, migrants, the poor, and the less educated. International labor standards prohibit contemporary slavery in all its forms and require states to legislate to curb such conduct tenaciously in their territory. When a state fails to provide the necessary protection to workers, not making possible for them even to seek help from the judiciary power, the victim can claim some compensation in the international human rights courts. In the case under analysis, the decisions of the French national courts could have been rendered based on standards of the International Labour Organization internalized by France, and unratified standards could have been used to interpret vague and scarce national legislation. Internationally, the European Court of Human Rights is not the only body with punitive capacity, the International Labour Organization itself can be activated by means of complaint or claim against member states that ratify standards and then violate or neglect their effectiveness, and this punishment may be applied simultaneously to that decided by the above cited court. The study is divided into three parts: the first one dealing with the specificities of the Siliadin case, concepts related to the facts narrated, the study of the judicial process in French courts and analysis of the decision of the European Court of Human Rights; the second examining the norms of the International Labor Organization as labor jus cogens and labor law hard core, highlighting as consequences to the violation of these rules complaints and claims to the International Labor Organization; the third analyzing the incorporation and application of international law in the domestic sphere of the States, emphasizing the possibility of the use of International Labor Organization rules in resolving the dispute between Siliadin and the employers. The method used in this work is the inductive, and also the case analysis based on specific standards of the International Labour Organization on forced labor (no. 29 and no. 105), discrimination (no. 100 and no. 111), domestic service (no. 189), child labor (no. 138 and no. 182) and migrant labor (no. 143). Finally, it is concluded by the necessary application of international labor law in the domestic procedures of the States and the greater interference of international labor organizations in order to ensure the effectiveness of international labor standards.

The crime of human trafficking is a crime of complex nature and presents problems in its interpretation in the Peruvian law and jurisprudence. These problems require the author to study the legally protected goods behind this criminal prohibition, the consent of minors, analysis of the previous domain relationship above the victim or caused by the perpetrator, and the evidential approach that this reinterpretation of the crime of trafficking assumes. According to the previous legal framework, the author stands his proposal, which is characterized by criticism and being contrary to the Peruvian supreme jurisprudence. / El delito de trata de personas es un delito de naturaleza compleja y presenta problemas dentro de su interpretación en la jurisprudencia peruana. Estos problemas obligan al autor a estudiar la delimitación del bien jurídico protegido detrás de este delito, el consentimiento de menores de edad, el análisis de la relación de dominio que antecede o es provocada por el agresor sobre la víctima y el enfoque probatorio que supone esta reinterpretación del delito de trata de personas. De acuerdo con el marco jurídico anterior, el autor analiza casos observados por la Corte Suprema peruana y las diversas posturas doctrinales para finalmente emitir una postura propia, la cual se caracteriza por ser crítica y contraria a la interpretación presente en la jurisprudencia suprema peruana.

This paper provides a study about human trafficking with sexual motives performed in European states and the measures taken from national, international and Non-Governmental organizations with the purpose to oppose human trafficking. According to the UN human trafficking has increased and shows tendencies to continue escalating, regardless of the measures taken by various organisations. In this study, four countries with associations to human trafficking have been chosen and organisations related to these countries are studied. The purpose is to inquire into how these organisations work against human trafficking and which objectives and guidelines these organisations strive for together with their values. The aim is to find out which result the organizations efforts gets and if, according to my hypothesis, the efforts oppose themselves. If so, what could be a possible explanation? The central conclusions after performing this study is that the policies from international organisations given to institutions at state level are not always implemented. There are also difference in the measures taken by each state and their valuations. Every actor’s behaviour in a network is important and scarcity in one actors behaviour leads to a weakened result. One of the studied states has shown tendencies of disregarding the issue which effects collaboration between the studied organizations.

The goal of this master's thesis is to understand the link between legalization of prostitution and human trafficking. The thesis is divided into three major sections. The theoretical part defines major terms, such as human trafficking and prostitution. This section also describes the issue of human trafficking and prostitution in the context of the Czech Republic and in the context of Germany. The empirical part/section is based on interviews with a number of social workers in Germany, and its primary goal is to elicit whether legalization of prostitution in Germany caused an increase in the number of victims of human trafficking. The findings are based on the observation of several international organizations working in the field of migration and crime/security, tracing their role in the construction of a new discourse of migration governance, related to the use of human rights rhetoric. The second part of the thesis is comprised of the analysis of how the policies linking migration and security have been received and interpreted by the Brazilian State and society. En 2019, le trafic humain à des fins d’exploitation sexuelle continue de générer une importante polarisation des opinions sur les places publiques et politiques.
Même si les écrits entourant ce phénomène sont nombreux, celui-ci reste mal défini. Le manque de recherches bâties sur une méthodologie rigoureuse demeure une entrave importante à l’élaboration de connaissances fiables autant en ce qui concerne le paradigme du passage à l’acte que celui de la réaction sociale. Pourtant, la gravité des impacts de ce crime sur la vie des victimes mérite de s’y attarder consciencieusement.
La présente recherche souhaite poursuivre l’exploration empirique du phénomène. L’objectif est de décrire le processus du trafic humain à des fins d’exploitation sexuelle. Pour ce faire, l’approche des scripts a été retenu comme cadre théorique. C’est une approche utilisée dans de nombreuses études de phénomènes complexes et pourtant rarement appliquée au trafic humain.
L’approche du script nous permet de considérer le trafic humain à des fins d’exploitation sexuelle dans sa globalité tout en permettant de mettre en lumière les éléments spécifiques nécessaires qui composent le processus.
Vingt-deux cas, tirés de jugements canadiens ayant des accusations sous l’article 279.01 du Code criminel, ont été retenus pour créer le script général du trafic humain à des fins d’exploitation sexuelle. Le résultat est un script en huit étapes, du recrutement à la distribution des bénéfices. Deux étapes additionnelles ont été ajoutées. En amont, le contexte initial est soulevé pour, notamment, établir les motivations individuelles des travailleuses et, en aval, la fin de la carrière est décrite pour aborder les causes du désengagement. Le script identifié rapporte un trafic national, peu structuré et opportuniste. / In 2019, human trafficking for sexual exploitation still generate important public and political debates. Even if the literature is growing on the subject, the latter stays ill-defined. Indeed, the lack of researches based on a rigorous methodology is, still today, a major impediment to the development of reliable knowledge on the phenomenon itself as well as on the social reaction to it.
This research aims at pursuing the empirical exploration of the human trafficking for sexual exploitation. The objective is to describe the global process from the recruitment up to the sexual exploitation and beyond. In order to achieve this, the script methodological approach will be applied. It is an efficient approach that has been used in numerous studies to improve the understanding of complex phenomenon yet, it has been rarely applied to human trafficking.
The script enables the researchers to consider the whole process of human trafficking for sexual exploitation while highlighting the key elements that are required to allow the chain of events that build up to the exploitation.
Twenty-two individual cases from Canadian judgments having accusations under the article 279.01 of the Criminal Code were retained to create the general script of the human trafficking for sexual exploitation.
The result is a script in eight steps, from the recruitment of the sex worker to the distribution of the gains. Two steps were added in order to expand the knowledge around the process of the phenomenon. Before the process, the initial context is presented in order, notably, to raise the individual motivations of the workers. After the process, the end of the career is also added to explore the factors that bring them to quit the sex work. Moreover, the general script exposes a national, loosely structured and opportunistic traffic.

INTRODUCCIÓN: La trata de personas es un delito que genera consecuencias físicas, psicológicas y sociales en las víctimas; por lo tanto, resulta crucial la atención institucional que brindan los profesionales a estas personas. Los abogados, psicólogos y trabajadores sociales poseen representaciones sociales sobre las víctimas que influyen en las decisiones y metodología que utilizan en el proceso de la atención. OBJETIVO: Describir las representaciones sociales de los abogados, psicólogos y trabajadores sociales sobre las personas víctimas de trata. MÉTODO: Se desarrolló un estudio cualitativo de diseño análisis temático aplicando la técnica de la entrevista semi estructurada a cinco psicólogos, cuatro abogados y tres trabajadores sociales que trabajen o hayan trabajado con víctimas de trata (por lo menos dos años). RESULTADOS: En función de las experiencias y el conocimiento adquirido, los participantes valoran a las víctimas de trata como personas carentes de afecto, desconfiadas, con una dinámica familiar disfuncional y como adolescentes vulneradas en busca de nuevas oportunidades. Con base en esto, abordan su trabajo desempeñando su práctica desde una posición empática, solidaria y comprometida. CONCLUSIONES: Las representaciones sociales determinan la práctica profesional en el proceso de atención a las víctimas de trata. Estas influyen en el significado que los profesionales le otorgan a su accionar y a las decisiones tomadas durante este proceso. / INTRODUCTION: Human trafficking is a crime that generates physical, psychological, and social consequences for the victims; therefore, the institutional care provided by professionals to these people is crucial. These professionals have social representations about the victims that influence the decisions and methodology used in the care process. OBJECTIVE: Describe the social representations of lawyers, psychologists and social workers, about human trafficking victims. METHOD: A qualitative study of thematic analysis design was developed applying the semi-structured interview technique to five psychologists, four lawyers and three social workers who work or have worked with victims of trafficking (at least two years). RESULTS: Based on the experiences and knowledge acquired, the participants value the victims of trafficking as people lacking affection, distrust, with dysfunctional family dynamics and as vulnerable adolescents in search of new opportunities. Based on this, they approach their work carrying out their practice from an empathic, supportive, and committed position. CONCLUSIONS: Social representations determine professional practice in the process of caring for victims of trafficking. These influence the meaning that professionals give to their actions and the decisions made during this process. / Tesis

Human trafficking as a security issue : selected case studiesIroanya, Richard Obinna January 2014 (has links)
This study examined and analysed human trafficking as a security issue using South Africa and Mozambique as country case studies. Information gathered through documentary analysis methodology is relied upon to develop a conceptual framework of human trafficking and security. The link between trafficking and security is evaluated based on the conceptualisation of trafficking in the Palermo Protocol as well as the criteria for declaring social phenomena security threats, as articulated by the UN and several scholars. Through global and national overviews of human trafficking, its patterns, extent and enabling conditions are identified and analysed. In South Africa and Mozambique, human trafficking has domestic and international dimensions and is facilitated by several factors. However, factors facilitating domestic trafficking do not necessarily facilitate international trafficking in South Africa. The opposite is however, the case in the Mozambican context. An analysis of global, regional, and national counter trafficking measures, shows that the national security implications of human trafficking are not explicitly addressed. Trafficking involves national border violations; organised crime; corruption, and physical violence which have implications for security at all levels. Consequently, recommendations are made for the explicit securitisation of trafficking as well as the demonstration of sufficient political will to combat it. Why is human trafficking excluded from the EU’s cybersecurity? : An explorative study about cybersecurity and human trafficking in the European UnionNieminen, Linda January 2021 (has links)
Combatting human trafficking is one of the top priorities in the European Union and Europol. Nonetheless, Europe is one of worlds’ leading regions for most trafficked human beings. Human trafficking is often connected to organised crime such as drug trafficking, cybercrime and child pornography and occurs across borders. 21st century’s digital age has broadly shifted human trafficking from the real-life to the cyberspace. However, human trafficking is not mentioned in any EU cybersecurity policies. This thesis aims to explore, using a feminist security approach, why human trafficking is overlooked in the European Union cybersecurity. By conducting an interpretive content analysis and using the method of deconstruction, I investigated the silences of human trafficking and gender. Leaning on feminist theories of securitisation, hegemonic masculinity and poststructural feminism, three significant assumptions were identified. The first assumption was that human trafficking is overlooked in the EU cybersecurity because of the non-human referent object of security. The second was that it is overlooked because of hegemonic masculinity. And lastly, because the issue is seen as private and therefore do not belong to cybersecurity. By analysing EU cybersecurity policies, I identified that the EU cybersecurity is dominated by norms of hegemonic masculinity and gendered social hierarchies. In the EU cybersecurity, threats related to non-human objects are constructed and gain hegemony over human rights and social policies. This study has raised important questions about the nature of cybersecurity in the EU, and greater efforts are needed to ensure women’s security in the cyberspace. These results suggest that if the EU aims to combat human trafficking wholehearted, it needs to start with acknowledging human trafficking as a threat in the cyberspace.
