Gender violence in Mexico is a problem that affects its society on a long- term basis. Its most extreme form known as feminicide, that is a gender- based murder of women, appears with so much frequency that it can be considered a structural problem yet. Mexico is one of the countries with most cases in Latin America, however, insufficient and ineffective measures taken by the state facilitate their perpetration which is often immune from prosecution. This thesis aims to approximate the issue to the reader and explain the concept of feminicide in given context within its complexity. For that purpose, a process tracing analysis of two selected cases is done; starting from their perpetration to their sentencing by judicial instances. The sentences of both cases became very important milestones. The factors that contributed to the outcome are tracked and afterwards a comparison of tracked causal mechanisms is done. As it was already mentioned, the cases were not selected randomly. Not only are they important for their sentences, but moreover they took place in two Mexican states with traditionally high numbers of committed feminicides, that is in Chihuahua and Mexico State. The author try to demonstrate that the action doesn t work as expected when its approval by The Brazilian Congress, in 1992, because still remain a lot of political scandals in Brazil, causing serious damages to the treasury, without the responsible people being punished for it. A historical tolerance on corruption, special courts for public officials and the own formal and structural deficiencies of the legal text of Act 8.429/92 favour a state of impunity. The paper begins with a short analysis about the corruption phenomenon, specially its ideological substratum, theories, effects and means of combat in brazilian law. The author thinks that this analysis is fundamental to situate correctly the question in brazilian constitutional ordainment, due to the axiological tension in constitutional rules about punishing corruption . The author also discuss the important and polemic question of special courts for public officials, having in mind decisions from Supreme Court in Brazil to demonstrate that this prerogative is one of the most serious causes of impunity in Brazil. Completing the dissertation, the author analyses procedures aspects of the action, identifying defections like lacunas, obscurities and bad compositions in the legal text, that contribute in order to difficult the punishing of bad conduct by public officials in their functions. After all, the author concludes that the judicial action on improbity will only workout properly if judges and lawyers are ready to assume the compromise towards the fight against corruption, including the elimination of the special courts for public officials. Still he concludes that the legal procedure needs corrections, to make its interpretations easier for the judges when applying it / O presente trabalho acadêmico tem como objetivo a análise crítica da ação por improbidade administrativa, disciplinada pela Lei 8.429/92, especialmente sua pouca efetividade na punição dos atos de improbidade praticados por agentes públicos. Busca-se defender a tese de que a citada ação não atendeu satisfatoriamente às expectativas geradas com o seu advento, pois ainda persistem muitas denúncias de escândalos políticos no Brasil, dos quais resultam sérios prejuízos ao Erário. Parte-se da premissa de que esta impunidade decorre de alguns fatores, como a histórica tolerância com os atos de corrupção, o foro privilegiado de que gozam os agentes políticos e a própria deficiência formal e estrutural da ação regulada pela Lei 8.429/92. É feita breve análise do fenômeno da corrupção, do seu substrato ideológico, teorias, conseqüências e formas de combate, no direito comparado e no direito brasileiro, como ponto fundamental do problema, a partir da tensão axiológica verificada nas normas constitucionais que tratam das formas e meios de punição da improbidade administrativa. É também discutida a controvertida questão do foro privilegiado, tendo como referência o julgamento da Reclamação 2.138 pelo Supremo Tribunal Federal, com a finalidade de demonstrar que ele é um dos graves fatores da impunidade no Brasil. Em complemento, procede-se a uma análise dos aspectos procedimentais da ação por improbidade, identificando lacunas, obscuridades e má redação no texto legal, que também contribuem sensivelmente para prejudicar a efetiva punição dos agentes públicos que cometem atos de improbidade. Ao final, conclui-se que a ação por improbidade surtirá os efeitos desejados quando houver maior compromisso dos operadores do direito com o combate à corrupção, passando pela eliminação do foro privilegiado para os agentes políticos e as necessárias correções legislativas na Lei 8.429/92, de modo a facilitar sua interpretação e aplicação

La compétence internationale pénale à la lumière du précédent Pinochet / International criminal jurisdiction in the light of the Pinochet precedent

L’application de la compétence internationale pénale dans l'affaire Pinochet à laissé un précédent important dans le domaine de la lutte contre l'impunité, comme le démontre la procédure mise en œuvre par l'Audiencia Nacional d'Espagne, ainsi que par la Cour d'Assises de Paris avec application du principe de la personnalité passive. En effet, avec le mandat d’arrêt international aux fins d'extradition émis par les autorités judiciaires espagnols, qui a permis l'arrestation de Pinochet à Londres, la négation de son immunité par la chambre des Lords et le jugement par défaut en France de son administration militaire, le droit international connait un avant et in après. Le droit international pénal est ainsi mis en exergue en tant que fondement juridique de la compétence extra-territoriale des Etats. Il permet d'utiliser tant le principe de la compétence universelle que celui. Il permet d'utiliser tant le principe de la compétence universelle que celui de la personnalité passive, toutes deux appliquées, dans cette affaire précise, dans le but d'exercer une justice internationale. / The application of the criminal international jurisdiction in the Pinochet case left an important precedent in the area of the fight against impunity, as shown by the procedure brought into play by the Spanish Audiencia Nacional and also by the Cour d'Assises of Paris, with the enforcement of the passive personality principle. Actually, with the international arrest warrant for extradition issued by the Spanish judicial authorities, which made possible the arrest of Pinochet in London; the denial of his immunity by the House of Lords and the judgment in absentia in France of his military organization, the international law has a before and an after. The international criminal law is under lined as the juridical foundation of the extraterritorial jurisdiction of the legal authorities of a state. It allows the application as well of the universal jurisdiction principle as of the passible personality principle, both used, in this precise case, with the objective to exercise an international justice.

A pesquisa examina a legitimidade do Sistema Penal, a partir da ação do próprio aparelho judicial no Rio Grande do Sul, ao decidir sobre os crimes praticados por membros da Brigada Militar (Polícia Militar). Buscou-se analisar se o Poder Judiciário estaria apto ou não a controlar a violência ilegítima praticada pelos agentes estatais encarregados da manutenção da ordem pública. Tal violência compreende a prática de crimes, tais como homicídios, lesões corporais e abuso de poder, tipificados, respectivamente nos artigos 121 e 129 do Código Penal, arts. 205 e 209 do Código Penal Militar e arts. 3º e 4º da Lei nº 4898, de 09.12.1965. A pesquisa analisou exclusivamente os processos de homicídios dolosos cometidos por policiais militares, no exercício da função, contra civis. Trata-se de um estudo comparativo entre a atuação da Justiça Militar e da Justiça Comum, no que concerne ao julgamento desses delitos, em dois períodos, sendo o primeiro de 15 anos, anterior à Lei 9.299/96 (Justiça Militar) e o segundo de 10 anos, posterior à mesma lei (Justiça Comum). / The research analyzes the legitimacy of the Penal System, through the perspective of the decisions of the State of Rio Grande do Sul judiciary regarding crimes committed by members of the Military Police. It aims to analyze if the judiciary is able to control the illegitimate violence carried out by state agents in charge of maintaining public order. This type of violence includes criminal offenses such as homicide, injuries and abuse of power, defined, respectively, by articles 121 and 129 of the Brazilian Criminal Code, 205 and 209 of the Military Criminal Code and articles 3rd and 4th of Law 4.898, of 12/09/1965. The research focused exclusively on intentional homicides committed by military policemen against civilians, while in duty. This is a comparative study between the Military Justice and the Civil Justice (Jury), regarding the trials of such crimes, in two specific periods of time. The first one comprehends 15 years before the enactment of Law 9.299/96 (Military Justice), and the second one comprehends 10 years after the enactment of such Law (Civil Justice).

Prosecution of grave violations of human rights in light of challenges of national courts and the International Criminal Court: the Congolese dilemma

"Although the United Nations (UN) has often been pivotal in forging the international response to serious human rights crimes in such settings, the justice gap in countries such as the Democratic Republic [of] Congo (DRC) (the focus of this study) underscores the need for more systematic UN efforts. The war in the DRC has resulted in one of the world's worst humanitarian crisis with over 3.4 million displaced persons scattered throughout the country. An estimated 3.5 million people have died as a result of the war. The armed conflict has been characterised by appalling widespread and systematic human rights violations, including mass killings, ethnic cleansing, rape and the destruction of property. The most pressing need to be addressed is the question of justice and accountability for these human rights atrocities in order to achieve a durable peace in the country and also in the Great Lakes region (Rwanda, Burundi, Uganda, Angola and the DRC, to name just a few). In this respect, this study will address the grave human rights violations committed in the DRC and the mechanisms for dealing with them. It is particularly true in post-conflict situations where justice systems have been either partially or completely destroyed, that national courts are not capapble of arriving at a uniform stance, or willing to provide justice for atrocities in the immediate future. As a result, international justice seems to be a crucial and last resort that must continue to be fortified against efforts to undermine it. ... Digital Threats Against Women Journalists in Mexico : Networks as a Coping Strategy

Mexico is currently one the most dangerous countries in the world to practice journalism, with one of the highest death rates in the world. Violence against Mexican journalists has received significant attention from researchers, most recently when it comes to digital threats. Research suggests that online harassment against journalists is not only related to the profession or topic covered, but also individual characteristics like gender, race and sexuality. Digital threats affect everyone, but the threats women are faced with are disproportionate. While digital technologies are useful in developing reporting practices, it has also been shown as detrimental. Through a semi-structured WhatsApp interview with a Mexican women journalists and coordinator in an International Journalist Network, this study attempts to identify the perceptions of online threats against women journalists and the use of Networks as a coping strategy. Through the use of digital testimonies, this study attempts to further amplify Mexican women journalists’ voices and experiences when it comes to using Networks as a coping strategy to confront online violence.  The importance here is to understand the Mexican context and the dimensions to digital violence, the possibilities of resilience and the coping strategies practiced by Mexican women journalists. Through analysing perceptions of the threat and their experiences with Networks, this study attemps to identify the strengths and possibilities of Networks as a coping strategy, when it comes to digital threats, but also its barriers and limitations. This study is important to the field of Communication of Development and Social Change as it underscores the importance of listening, understanding local contexts, perceptions and resilience. This is crucial when undertaking intitaves on a larger scale for social change.
