Dans les rapports familiaux, les mécanismes de la responsabilité paraîssent s’appliquer plus difficilement qu’ailleurs. Qu’il s’agisse d’engager la responsabilité des époux, ou bien celle d’un parent envers son enfant, ou même encore de juger un délinquant passionnel, il peut être malaisé de déterminer les parts de responsabilité et de culpabilité qui reviennent à chacun. L’élément affectif, qui n’est pas regardé en principe comme un objet possible du droit, est susceptible d’expliquer cette difficulté. L’objet de cette thèse est donc de découvrir ce que peut être cet affect, et s’il intervient effectivement de façon significative dans les responsabilités familiales. Dans la pensée classique, l’affect n’a pas d’autonomie, en ce sens qu’il est toujours assimilé et réduit à d’autres notions, telles que l’émotion ou la volonté. En le dégageant de ces réductions, pourtant, l’affect peut être un élément isolable, qui est clairement identifiable dans le lien conjugal ou dans la filiation. L’affect est ainsi un élément concret, mais aussi dynamique, en ce sens qu’il est doté d’une valeur normative. Il est donc capable, non seulement d’éclairer des situations familiales pour lesquelles la responsabilité, civile ou pénale, doit être mise en oeuvre, mais encore de porter une valeur, que le droit peut découvrir et protéger. / In family relations, responsibility mechanism seems to apply themselves with much more difficulty then elsewhere. Whether it engages the responsibility of the married couple, or the one of a parent towards his child, or even to judge a crime of passion, it can be difficult to determine the responsibility or guilt of each party. The affectif element, that is usually not considered like a text of law, is likely to explain this difficulty. Therefore, the purpose of this thesis is to discover what can be this affect, and if it indeed intervenes in a significant way in family responsibilities. In the classical thought, the affect has no autonomy, in a way that it is always assimilated and reduced to other notions such as emotion or free will. Removing these simplifications, the affect can be an element which can be isolated and clearly identified in the conjugal link or in filiation. Consequently, the affect is a concret element, but also dynamic, in the way it is doted by a normative value. It is therefore able, not only to enlighten family situations for which, civil or penal responsibility must be applied, but must also carry a value, that law may discover and protect.

Previous issue date: 2007-04-27 / The researches in Brazil and around the world evidence that the sexual abuse perpetrated for fathers against their daughters is a practical which outstrips the limits of geographic or cultural borders. Our studies aimed to comprehend, through a case s analysis, the generation, maintenance and transmission of the elements that perpetuate the intrafamilial violence, concerning to abusive incest father-daughter. Utilizing the help of professionals who worked at an ONG however, without any personal or institutional bond of them with the contacted family we could find our research s subject. It s a qualitative research, based on nuclear family s scenes, in a perspective of the generations transmission, from the analysis of the content supplied by the protagonist. In this way, it was utilized the not-directive interview. Our study evidenced that, between the perverse web which characterizes the relationships in intrafamilial violence, the incestuous sexual abuse is distinguished like this universe s cruelest face and reaffirms its condition of maximum exponent as pathologic factor inside this set of subjects dynamic known as abusive family, nowadays causing many damages to the individual and group mental functioning of its members. Leaving of psychoanalysis theoretic concepts, we search the comprehension of the interchange between subjective experience and objective reality into the aggressor s psyche, his victim s responsive attitude, family s contribution and culture s role in the phenomenon s perpetuation. We verify, therefore, it concerns to an amalgam formed for elements of philogenesis, ontogenesis and culture. Because of it, the Édipo s complex appeared as the nodal point, surrounded for all the dynamic of incestuous abuse father-daughter that had became the cruelest way of symbolic filicide. The sexual abuse, according to our understanding, will allow an effective intervention in terms of the cultural code just by the victim s and her family s side, since by the aggressor s side we will find, even with giant gradation, the psychopathology, that is, the incapacity to contain the desire, the impulses dominium, the not being susceptible to the moral and ethics, at last, the perversion. And, in this case, the interventions go of isolation to chemical castration, crossing the psychotherapy without, however, encouraging results. We consider that the formation of the character s structure is a learning process s product, and this process means the conformation of the subject to the culture, having as basis the behavior s social and biological factors. Therefore, we believe that education is the propeller instrument of the paradigm s changes we need to think and work the family. However, it s relevant to observe that, as structural factor of the mental functioning, the applicability of Edipo s law to the new familiar configurations can be object of this theme s posterior deepening, as well as for studies with other themes inherent to the family / As pesquisas no Brasil e no mundo constatam que o abuso sexual perpetrado por pais contra filhas é uma prática que ultrapassa os limites das fronteiras geográficas ou culturais. Nossa pesquisa teve por objetivo compreender, através de um estudo de caso, a geração, manutenção e transmissão dos elementos que perpetuam a violência intrafamiliar, no que concerne ao incesto abusivo pai-filha. Chegamos ao sujeito de nossa pesquisa por intermédio de profissionais que atuam junto a uma ONG, sem contudo ter existido, durante o período em que se desenvolveu a pesquisa, qualquer vínculo pessoal ou institucional desses profissionais com a família contatada. Trata-se de uma pesquisa qualitativa, desenvolvida com base em cenários de família nuclear, numa perspectiva transgeracional, a partir da análise de conteúdo do material fornecido pela protagonista-relatora. Nesse sentido, o instrumento utilizado foi a entrevista não-diretiva. Nosso estudo constatou que em meio à teia perversa que caracteriza as relações interpessoais na violência intrafamiliar, o abuso sexual incestuoso se sobressai como a face mais dura desse universo e reafirma o seu estatuto de expoente máximo enquanto fator patológico na dinâmica desse conjunto de sujeitos - hoje denominado família abusiva - comprometendo o psiquismo individual e grupal de seus membros. A partir de pressupostos teóricos da psicanálise, buscamos compreender o intercâmbio que se estabelece entre experiência subjetiva e realidade objetiva no psiquismo do agressor, a atitude responsiva de sua vítima, a contribuição do entorno familiar e o papel da cultura na perpetuação do fenômeno. Verificamos, portanto, tratar-se de um amálgama formado por elementos da filogênese, da ontogênese e da cultura. Por isso mesmo o complexo de Édipo apareceu como o ponto nodal em torno do qual gravita toda a dinâmica do abuso incestuoso pai-filha que se configurou como a forma mais cruel do filicídio simbólico. O abuso sexual intrafamiliar, segundo nossa compreensão permitirá, a curto prazo uma intervenção efetiva em termos do código cultural apenas pelo lado da vítima e de sua família, uma vez que do outro lado, isto é, do agressor, vamos encontrar, ainda que com enorme gradação, a psicopatologia, isto é, a indomesticação do desejo, o domínio dos impulsos, uma impermeabilidade à moral e à ética, enfim, a perversão. E, nesses casos, as intervenções vão do isolamento à castração química, passando pela psicoterapia sem que, entretanto, os resultados sejam animadores. Acreditamos que a formação da estrutura de caráter seja fruto do processo de aprendizagem, e este se traduz na conformação do sujeito à cultura, tendo como base os condicionantes sociais e psicobiológicos do comportamento. Por essa razão, entendemos que a educação é também um importante instrumento propulsor das mudanças paradigmáticas que necessitamos para pensar e trabalhar a família. Entretanto, ainda observamos aqui que, na qualidade de fator estruturante do psiquismo, a aplicabilidade da lei do Édipo às novas configurações familiares poderá ser objeto para o futuro aprofundamento deste tema, bem como para o estudo de outros temas inerentes à família

On assiste dans les sociétés occidentales à une évolution importante de la reconnaissance, de la condamnation morale et de la répression judiciaire des violences sexuelles faites aux enfants et aux jeunes, en particulier filles mais aussi garçons. C’est dans ce cadre général que s’inscrit cette recherche. A partir de deux enquêtes, l’une de sociologie législative, l’autre de sociologie judiciaire, elle propose de mettre au jour la place cruciale accordée désormais à la référence à l'âge dans l’évolution des normes et représentations du permis et de l’interdit sexuels.La première enquête de sociologie historique et législative porte sur l’évolution du droit pénal français de la Révolution à aujourd’hui, et est centrée sur les mutations des catégories d'incrimination au fur et à mesure que le consentement (et non plus le statut matrimonial) devient le critère majeur séparant le permis et l'interdit. La seconde enquête de sociologie judiciaire a été menée au sein de deux tribunaux correctionnels et deux tribunaux pour enfants dans le sud de la France. Elle porte sur un corpus d’archives de 81 affaires jugées en 2010 pour délits sexuels sur des mineurs, et vise à éclairer la façon dont interviennent dans la qualification pénale des faits, non seulement les problèmes de preuve mais les changements de normes juridiques et sociales. Le point commun aux deux enquêtes est la mise au jour et l'exploration de deux formes de consentement sexuel : situationnel et statutaire.Tout au long de cette recherche sont analysés sous différents angles, le traitement sociojuridique des statuts d’âge (mineur/majeur et mineur/mineur), le sens accordé aux seuils d’âge (consentement, discernement), les embarras du droit face à l’inceste, et enfin les asymétries de genre tant du côté des victimes que des auteurs. / We are witnessing an important evolution in Western society of the condemnation and legal justice as regard to sexual violence towards children, teenager especially girls, but also young boys. It is in this context that my research has been carried out. There has been a double inquiry; legislative sociology; and judicial sociology. They put up to date the important placing of age reference, the evolution as regarding sexual norms and representations of illicit sexual relations.The firs investigation of legislative historic sociology carries on the evolution of French penal codes dating from the French Revolution to today. It is censed on slow mutations of categories of incrimination that consent (no longer the matrimonial state) becomes the major point that separates permission and the forbidden. The second inquiry of judicial sociology was carried out int the archives of two correctional courts, two children correctional courts in the South of France. It carries upon the documentation of eighty-one judged cases from 2010 for sexual offences against minors. The aim is to put light upon penal qualification of facts, not only the problem of legal proof but also changes as regard to social and judicial norms. The point these two inquiries have in common i the update of two forms of sexual consent: statuary and situation.Throughout this research, the facts were analyzed from different angles: the social-juridical treatment of ages status (minors vs of age and minors vs minors). The meaning given to the age of consent, and legal responsibility; the legal difficulties as regard to incest and finally gender discrepancies between victims and aggressors.

With more than 70 000 cases of rape and sexual violence reported in a year in South Africa,
and estimations that this may reflect one ninth of the actual number only, South Africa has
been labelled the “rape capital” of the world. The study seeks to explain the root causes of
rape, its ontological make-up and possibilities for resolving the issue by identifying cultural
aspects, factors and manifestations that either justify or sanction rape.
Four concepts, namely, rape, masculinity, culture and rage, serve as the thematic lens for
identifying and interrogating cultural conditions through multidisciplinary and Africancentred
perspectives. The analyses contained in the study are based on a mapping process
involving comparing the data from a wide range of literature and also focus group interviews.
Highlighting the multi-layered complexities of rape as phenomena, the study then outlines
recommendations for transformative work in research, cultural institutions, communities,

La famille du XXIème siècle, héritière d’un idéal défini d’abord par l’Église puis par le Code civil, est née des bouleversements sans précédent qu’a connu la société dans son ensemble. Pendant des siècles, le rôle essentiel de la famille était lié à la transmission patrimoniale et culturelle entre générations. Aujourd’hui, la famille doit favoriser le développement individuel et la réalisation personnelle de chacun de ses membres. La famille est de moins en moins une institution normée, aux formes et aux codes prédéfinis, d’autant qu’elle doit composer avec le droit individuel à « une vie familiale normale » que consacre l’article 8 de la Convention européenne des droits de l’homme. L’influence des droits fondamentaux qui sont par nature des droits individuels dans la vie familiale confirme bien que la famille est davantage le lieu d’épanouissement individuel qu’une entité tournée vers un intérêt commun. Tout ou presque est devenu possible en termes de combinaisons familiales. On peut désormais choisir son sexe (transsexualisme), décider de créer une famille ou de vivre seul sans que la société ne s’en émeuve particulièrement.Les liens et les rôles de chacun dans la famille ne sont plus ni pérennes ni clairement définis. Les progrès scientifiques (qui ont surtout permis une contraception efficace) et la révolution sexuelle ont complètement transformé la sexualité, la vie de couple et la procréation. Il n’y a plus un seul modèle de couple fondé exclusivement sur le mariage d’un homme et d’une femme. Le couple est maintenant homosexuel ou hétérosexuel, libre de vivre ou non ensemble, d’être fidèle, de se marier, de se séparer, de conclure un pacs, de vivre en concubinage. La conjugalité est donc désormais plurielle et repose sur l’égalité entre ceux qui composent le couple et entre les différents modèles de couples possibles. Les relations entre les parents et les enfants ont également été bouleversées. La parentalité s’impose peu à peu à côté de la parenté. La filiation va devoir composer avec les nouvelles cuisines procréatives. La procréation médicalement assistée, la gestation pour autrui ou l’utérus artificiel doivent modifier l’établissement du lien de filiation qui ne peut se déduire du seul lien biologique. Le droit devra répondre, parfois contraint sous l’influence ou la pression internationale, aux nouvelles aspirations sociales et sociologiques et tenter de trouver un équilibre entre la liberté individuelle et la dimension institutionnelle de la famille. / While it was initially born out of the ideals set out first by the Church and then by the Civil Code, family in the 21st century is really the offspring of the unprecedented upheavals that have shaken society as a whole. For centuries, the essential role of family was linked with cross-generational patrimonial and cultural transmission. Nowadays, family must instead facilitate the individual development and self-realization of every single one of its members. The family is an institution that is decreasingly bounded by predetermined norms, forms, and codes, not least because it must align itself to the individual right to a “normal family-life”, to which Article 8 of the European Convention of Human Rights is dedicated. More or less everything is now possible in terms of family make-up. One can now choose one’s legal sex/gender (transgenderism), decide to establish a family, or live alone, without society being particularly affected by any of it. The ties and roles of each individual in the family are no longer perennial, no clearly defined. Scientific progress (through which efficient contraception became available) and the sexual revolution have completely transformed sexuality, romantic relationships, and procreation. There is no longer a single model for the romantic relationship, based on the marriage of a man to a woman. The couple is now homosexual or heterosexual, and individuals may choose whether they want to live together or be faithful. They can also choose if and when to get married, to separate, to be joined in a civil union (pacs), or to simply live under the same rooftop. In other words, conjugality is now pluralistic and rests on the equality both of the individuals constituting the couple, and between different models of romantic relationships. Relationships between parents and children have also been completely changed. Parenting is gradually gaining on kinship. Filiation will soon be forced to reckon with the different procreational recipes. Various assisted reproductive technologies, including artificial insemination, surrogacy, and the artificial uterus must change the ways in which kinship is established since it can no longer simply be deduced from biological ties. The law will have to respond to new social and sociological aspirations, and will sometimes even have to do so under international influence or pressure. It will, in fact, have to find a new equilibrium between individual freedoms, and the institutional dimensions of the family.

Este estudo pretendeu compreender como são vivenciadas a parentalidade e a conjugalidade na experiência de mulheres/mães cujos companheiros praticaram abuso sexual incestuoso em relação aos seus filhos/as. A metodologia utilizada foi qualitativa. Como instrumentos para a coleta de informações, construímos um álbum de fotografias que serviu como estímulo para introduzir, junto às colaboradoras, um assunto tão difícil para quem viveu a dor de tal experiência. Acrescentamos uma entrevista semidirigida, como meio de focarmos os conteúdos relacionados aos nossos objetivos. Procuramos observar as formas como essas
mulheres/mães se relacionam com os seus companheiros e com os/as filhos/as vítimas do abuso sexual incestuoso. Os resultados mostram que existe um ideal de família que se constituía de pai, mãe e filhos, que se quebra com a revelação do abuso sexual incestuoso. Podemos constatar que a violência perpassa as relações conjugais antes da revelação do incesto, expressando-se no domínio do
companheiro sobre essas mulheres de modo mais explícito com agressões físicas, controle econômico ou ainda, mais sutilmente, através de um ciúme possessivo. A
conjugalidade é idealizada como relação de afeto, companheirismo e respeito. Essa relação foi repensada após a revelação do abuso sexual incestuoso. Na experiência
da parentalidade, verificamos, em nossas análises, a ocorrência, no exercício e na prática, de relações de amorosidade entre mães e filhos e essas relações passaram
a se estabelecer de modo difícil em função das novas circunstâncias suscitadas, a partir da revelação de práticas abusivas. Em todas as mulheres entrevistadas,
constatamos o exercício e a prática da parentalidade como relação de afeto, sobrepondo-se às situações adversas vividas por elas, cuja maternidade representa um valor na constituição de suas identidades. Consideramos a importância desse estudo para enfatizar a necessidade de consolidação das políticas públicas já existentes e, também, da sociedade civil no sentido de incluir, no atendimento a vítimas de abuso sexual, um espaço de acolhimento a essas mulheres/mães que
denunciam os seus companheiros e passam a ter uma vida de privações no âmbito emocional, afetivo e econômico-material / This study is focused on trying to understand the experience of parenthood and conjugality lived by some women/mothers who have had their own men and kids
involved in incestuous relations. The methodology used here was the qualitative one. To collect the information/data needed, it was created a scrapbook. This photography album was developed in order to help introduce the sexual abuse issue to the women who have agreed to talk about and share this family drama they have all been through. Attempting to approach whatever subjects that could be
possibly related to the purposes of this work, it was also added a semi-guided interview. We tried to observe the various ways these women/mothers react whenever having their children sexually abused by their own men, as well as the kind of relationship they keep with these men/aggressors. The results go to show that there is an ideal concept of family: dad, mom and kids living altogether. This ideal concept, however, is left behind as soon as the incestuous abuse situations are
revealed. We were able to confirm that domestic violence is also a very important part of this whole perversion process (and when it comes to conjugal relationships, it can be expressed in many different ways, such as: physical aggressions, economic subordination or even possessive jealousy). Conjugality is commonly idealized as a
relation of affection, companionship and respect. But this kind of perception changes as the incestuous abuse cases are uncovered. Inside the the parenthood experience
itself, our analysis could verify that there are genuine love bonds between these moms and their children. These love bonds, inevitably, tend to become more fragile
(or even break) as a result of whatever new circumstances that might appear once the incestuous perversion is revealed. All women interviewed here expressed the
practice of parenthood as an affection relation, which seemed to be strong enough to overcome each and every adversity they have experienced. To these women,
motherhood itself represents a very important basis used to consolidate their own identities. We understand that this work is relevant to help emphasize our society
needs in terms of public administration and management. We also expect this study can contribute to stimulate the institutions and centers which support victims of
sexual abuse to offer some sort of aid to all those who have been involved in situations of incestuous perversion (including the women and mothers who decide to
denounce their men, once this being done, they are the ones who have their lives entirely changed emotionally, affectively and economically speaking)

Considerado um grave problema social e de saúde pública, a violência sexual contra crianças se expressa de diversas formas incluindo o abuso sexual intrafamiliar. A problemática deste estudo circunscreve-se em torno das questões sobre o abuso sexual perpetrado por pai contra filhos (as). Respaldadas em questões e inquietações provocadas pela escuta clínica de crianças e adolescentes envolvidos em situações de violência sexual e suas famílias objetivamos estudar, dentro da
perspectiva psicanalítica, as repercussões na dinâmica da família, da revelação do abuso sexual intrafamiliar e as implicações para a criança. Participou da pesquisa a mãe de uma criança que sofreu abuso sexual praticado por seu pai biológico e revelou o fato à mãe depois de quase dois anos, encaminhadas à pesquisa pelo Centro de Referência Interprofissional na Atenção a Crianças e Adolescentes
Vítimas de Violência da Capital/Tribunal de Justiça de Pernambuco[TJPE]. Adotamos para a coleta de dados as entrevistas psicológicas semidirigidas, dentro da abordagem clínico-qualitativa, observando os cuidados éticos para a pesquisa com seres humanos; para a análise dos dados utilizamos a Análise de Conteúdo, agrupando os fragmentos da entrevista em eixos temáticos para, então,
compreendê-los em seus núcleos de sentido. A nossa investigação mostrou que a revelação do abuso sexual infantil é um processo lento e gradual, que demanda um intenso trabalho psíquico para a criança e se desdobra na sua narrativa. Verificamos que a revelação do abuso sexual incestuoso não necessariamente promove alívio de início, podendo ser vivida de ameaçadora e dolorosa para a criança/adolescente,associada às angústias e fantasias, sendo capaz de se tornar mais difícil do que a própria experiência do abuso. Tanto a criança como membros da família quando decidem pela denúncia, são solicitados a falar sobre o que aconteceu em diferentes
instâncias, em sua maioria desarticuladas, obrigando-os a contarem, inúmeras vezes, como se deu o abuso, configurando-se numa verdadeira via-crúcis para a criança, principalmente. Observamos também que os dados analisados na entrevista demonstram que em relação à família, o processo de revelação leva a um período
de desestabilização exigindo do grupo disposição emocional para a elaboração e transformação. É possível dizer que nosso estudo corrobora achados de pesquisas anteriores, no que se refere às reações maternas perante a revelação, ficando evidente o sofrimento psíquico que as mães apresentam ao tomar conhecimento do fato, sendo necessário que recebam igual atenção e cuidado no decurso da
revelação, lembrando que ocupam um lugar significativo neste processo. No que se refere à revelação no contexto clínico, destacamos a importância do trabalho clínico e da figura do terapeuta intermediando a relação da criança com sua experiência de abuso, oferecendo a ela um ambiente seguro para criação de sentidos. Dessa
forma, esperamos que esta pesquisa tenha contribuído de alguma forma, para ampliar o debate em torno da problemática do abuso sexual infantil intrafamiliar no campo da clínica e da academia. / Considered a serious social and public health problem, sexual violence against children is expressed in various ways including the domestic sexual abuse. The problem of this study is localized around the issues of sexual abuse perpetrated by father against children. Based on issues and concerns caused by the clinic listening to children and adolescents involved in situations of sexual violence and their families
aimed to study, within the psychoanalytic perspective, the impact on family dynamics, the development of intra-family sexual abuse and the implications for the child. Participated in the survey the mother of a child who suffered sexual abuse by her biological father and revealed the fact to mother after almost two years, referred to
research by the Interprofessional Reference Center on Attention to Children and Adolescents Victims of Violence of Capital / Court of Justice of Pernambuco [TJPE]. We adopted for the collection of data the semi-directed psychological interviews, within the clinical-qualitative approach, observing the ethical guidelines for research
with human beings; for the analysis of the data we use the Content Analysis[AC], grouping the interview fragments themes to then understand them in their core sense. Our research has shown that disclosure of child sexual abuse is a slow and gradual process that requires an intense psychic work for the child and unfolds in his
narrative. We found that the revelation of incestuous sexual abuse does not necessarily promote early relief and can be lived in a threatening and painful for the child / adolescent, associated with anxieties and fantasies, being able to be more difficult than the experience of abuse. Both the child and family members when
deciding the complaint, are asked to talk about what happened in different instances, mostly disjointed, forcing members to share, countless times, how was the abuse by setting up a true via-crucis for children mainly. We also note that the data analyzed in the interview show that in relation to the family, the process of revelation leads to a
destabilizing period requiring the emotional disposition group for the development and transformation. It can tell that our study corroborates findings from previous research, with regard to maternal reactions to the disclosure, evidencing the psychological suffering that mothers have to take notice of the fact, and must receive equal attention and care in the course of revelation, noting that occupy a significant place in this process. As regards the disclosure in the clinical context, we emphasize the importance of clinical work and Therapist figure mediating the child relationship with his experience of abuse, offering a safe environment for creating senses. Thus, we hope that this research has contributed in some way to broaden the discussion around the issue of child sexual abuse assistance in the field of clinical and academic circles.
