Por dentro da caixa-preta das políticas públicas municipais de resíduos sólidos urbanos: os arranjos institucionais e a implementação da Política Nacional de Resíduos Sólidos / Inside the black box of municipal solid waste policies: the institutional arrangements and implementation of the Nacional Policy Solid Waste

A aprovação da Lei Federal nº 12.305, de 02 de agosto de 2010 Política Nacional de Resíduos Sólidos (PNRS) tem como uma das diretrizes fundamentais a gestão integrada, que inclui a ordem de prioridade ou hierárquica na gestão dos resíduos sólidos e a inclusão dos catadores de materiais recicláveis. Considerando que a consolidação dessas diretrizes demanda colocar a PNRS na agenda governamental e, ainda, da capacidade estatal para a implementação de políticas públicas, o objetivo deste trabalho foi analisar a inter-relação dos arranjos institucionais municipais das políticas de resíduos sólidos urbanos (RSU) e a implementação da PNRS. A estratégia metodológica adotada incluiu a pesquisa bibliográfica e documental sobre o contexto histórico nacional e local das políticas de resíduos sólidos e saneamento básico. Também foram analisadas as transferências voluntárias de recursos fiscais do governo federal para ações sobre resíduos sólidos, por meio da consulta de fontes como Portal da Transparência e dos Planos Plurianuais da União. Para a análise da implementação da PNRS no nível local, utilizou-se estudo de casos múltiplos em Salesópolis, Mogi das Cruzes e São Paulo. A coleta de dados secundários incluiu os Planos de Gestão Integrada de Resíduos Sólidos (PGIRS), leis, documentos e dados oficiais. Para a obtenção de dados primários, foram utilizados questionário, realização de entrevistas e registros fotográficos, posteriormente analisados por meio de indicadores sobre os resultados e desempenho das políticas públicas de limpeza urbana e gestão de resíduos sólidos, à luz das diretrizes da PNRS. Os principais limites à capacidade estatal na implementação da PNRS revelaram-se em Salesópolis pela restrição orçamentária e baixa densidade populacional, enquanto que em Mogi das Cruzes e São Paulo esses limites estão diretamente associados com a transferência do manejo de RSU para o setor privado. Ao mesmo tempo, esses arranjos municipais apontam, em maior ou menor escala, para a consolidação do aterro sanitário como destinação prioritária dos RSU, uma tendência nacional. Entretanto, justamente a dependência tecnológica da solução pelos aterros sanitários tem se mostrado como a principal barreira no cumprimento da ordem hierárquica da gestão de resíduos sólidos postulada pela PNRS / The enactment of Federal Law No. 12,305, August 2, 2010 Nacional Solid Waste Policy (NSWP) has the fundamental principle of integrated management, which includes the order of priority or hierarchy for solid waste management and inclusion of collectors of recyclable materials in partnership with the government. Considering that the consolidation of these guidelines demands to regard NSWP in the governmental agenda and of the state capacity for the implementation of public policies, the objective of this work was to analyze the interrelationship of the municipal institutional arrangements of municipal solid waste (MSW) policies and the implementation of NSWP. The methodological strategy adopted included bibliographical and documentary research on the national and local historical context of solid waste and basic sanitation policies. Voluntary transfers of fiscal resources from the federal government to actions on solid waste were also analyzed, through the consultation of sources such as the Transparency Portal and the Pluriannual Plans of the Union. For the analysis of the implementation of the NSWP at the local level, a multiple case study was used in Salesópolis, Mogi das Cruzes and São Paulo. Secondary data collection included the Integrated Solid Waste Management Plan (ISWMP), laws, documents and oficial data. To obtain primary data, questionnaire, interviews and photographic records were used, later analyzed through indicators on the results and performance of the public policies of urban cleaning and solid waste management in light of NSWP guidelines. The main limits on state capacity in implementation of the NSWP were revealed in Salesópolis by budget constraint and low population density, while in Mogi das Cruzes and São Paulo these limits are directly associated with the transfer of MSW management to the private sector. At the same time, these municipal arrangements point, to a greater or lesser degree, to the consolidation of the landfill as a priority destination for MSW, a national trend. However, the technological dependence of the solution by the landfills has proved to be the main barrier in the hierarchical order of solid waste management postulated by the PNRS

A iniciativa é um marco no convívio com a seca, concepção desenvolvida por Organizações da Sociedade Civil locais que se estruturaram em torno da Articulação do Semiárido. Esses atores, além de terem concebido a proposta do Programa,são executores da política, em um modelo de governança que exige sinergia entre Estado e Sociedade Civil para sua operação. Referenciada na literatura do tema, foi feita relação de indicadores da existência de capacidades técnico-operacionais e político-relacionais que serviram de guia analítico à pesquisa. Os dados levantados permitiram o resgate do comportamento dos indicadores nas diferentes etapas da política e elucidações sobre as dificuldades de se estudar o tema – tanto pela complexidade do caso como por não se tratar de conceito estanque. Ao fim e ao cabo, o estudo de caso tratou de política geradora de inovações e cujas capacidades estatais se desenvolveram por meio de relação sinérgica junto à sociedade civil com a participação de atores chave na viabilização de sua habilidade de diálogo, com destaque aos órgãos participativos e de controle. / The following research analyzed how state capacities were built in the Cisterns Program, a federal public policy launched over fourteen years that seeks to promote water access and civic engagement to low income families from the Brazilian rural semiarid region. The initiative is a landmark of the drought conviviality, a conception developed by local Non-Governmental Organizations (NGOs) that have composed the greater Articulação do Semiárido organization. These actors, besides from conceiving the Programs proposal, are the policy’s executors, in a governance model that demands synergy between the State and civil society to operate. Referenced in the topic’s literature, a listing of indicators to identify the existence of technical and relational capacities served as an analytical guide to the research. Data raised gave the means to reconstitute the indicators’ behavior in the different phases the policy has been through, as well as elucidate difficulties to dive into the concept – both due to the case’s complexity and to the fact that the concept is not stanch. Finally, the study tackled a policy that generated innovations and whose capacities developed through a synergic relationship with civil society with the participation of key-actors the promoted dialogue abilities, especially participatory and control organs.

La responsabilité environnementale / Environmental responsability

L'objectif de cette thèse est de démontrer que le renforcement des institutions environnementales permet d'améliorer la responsabilité environnementale. Si des changements institutionnels sont mis en place favorisant la responsabilité environnementale alors une co-responsabilité des parties prenantes prend forme rendant la protection de l'environnement plus efficace et efficiente. Compte tenu de l'ampleur des dégradations environnementales et de leurs conséquences, la responsabilité environnementale devient la panacée à la crise écologique. La notion de développement durable s'en fait écho en s'ancrant cependant dans une dynamique plus vaste. Ce concept de développement durable se décline au niveau industriel par la responsabilité sociale des entreprises. Force est de constater que les réponses institutionnelles et industrielles sont loin d'être à la hauteur des défis environnementaux. Historiquement, les instruments réglementaires ont été mobilisés pour faire face aux dégradations irréversibles. Malgré les preuves théoriques et empiriques européennes, la fiscalité écologique française ne répond pas aux recommandations économiques. Les raisons à ces échecs résident dans les difficultés d'acceptabilité et d'ajustement. Ces éléments amènent à repenser les schémas de l'intervention de l'Etat en matière d'environnement. L'apport de cette thèse consiste à proposer la mise en place de nouveaux arrangements institutionnels fondés sur la mise en place d'institutions environnementales dotées de capacités d'expertise, d'enforcement et de conformité. / The aim of this thesis is to demonstrate that the strengthening of the environmental institutions enforces environmental responsibility. If institutional changes are setting up to promote environmental responsibility, then a co-responsibility takes form making environmental protection more efficient and more effective. Given the extent of environmental degradation and their consequences, environmental liability bccomes a panacea to the ecological crisis. The notion of sustainable development echoes to it. however anchoring in a larger dynamic. The concept ofsustainable development comes at industrial level by the corporate social responsibility. lt is clear that the answers given by the institutions and the industrial segment fall far short of responding to the environmental challenges. Historically, regulatory instruments have been mobilized to deal with irreversible damage. The recent issue of emission permits still experiences difficulties. Despite the European theoretical and empirical evidences, French ecological taxation doesn't comply with the economic recommendations. The reasons for these failures depend on the difficulties of acceptability. These considerations lead us to rethink the patterns of state intervention in environmental. The contribution of this thesis is to propose the establishment of new institutional arrangements based on the establishment of environmental institutions which have capacities of expertise, enforcement and compliance.

集村興建農舍之制度經濟分析 / Institutional Economic Analysis of Cluster Farmhouse

自民國89年起政府將農地政策明訂為「落實農地農用」之方向,為配合此一目標而建立「集村農舍制度」,農舍議題遂成為各方矚目之焦點。由於農舍興建與「農地利用」、「農村景觀」與「農民生活」等議題關係密切,且實際的集村農舍制度規則與執行因涉及制度參與者互動情形,而影響制度執行與最後目標之實現。惟既有的集村農舍研究多以個別觀點,從管制與被管制者的政策、法律保留原則或住宅管制等面向切入,就制度實際運作情形甚少著墨,對於整體制度問 題亦無深入探討,而研究結果多僅表示贊同或反對意見,無法針對集村興建農舍制度獲得較完整的分析。爰此,本研究透過新制度經濟之觀點,探討集村興建農舍之主要制度理念、正式規則之制度環境、及主管農舍業務組織間制度安排問題,並以「新竹湖口」與「雲林斗六」兩個集村案例,進行案例分析與實地訪查,利用與相關承辦人員深度訪談等研究方法,檢驗目前制度之執行與其保護優良農地落實性。再者應用具動態性之制度變遷理論分析,探討我國加入WTO之調整與民國89年總統大選等重要政經因素對於集村農舍制度之影響。最後依據研究結論,對目前集村農舍制度問題提出對策與政策建議,希冀未來集村興建農舍之規則與執行更能落實保護優良農地之理念。本研究之主要結論與建議如下: 一、研究結論 (一) 集村農舍制度因加入WTO之調整與總統大選等政經因素影響,減弱保護優良農地之制度理念的落實性,呈現不合理的制度變遷趨勢。 (二) 規則欠缺農地利用面與引導農舍區位面之管制等制度環境問題,以及農地與農舍管理組織間業務重疊與職權模糊等制度安排問題,產生制度無效執行,甚至出現耗損優良農地資源之情形。 (三) 以「湖口」與「斗六」兩集村案例歸納其共同現象,目前集村興建農舍制度並未實質照顧農民,亦未能達到保護優良農地之制度目標,須加以研議調整。 二、政策建議 (一) 「落實制度理念」-降低建商介入炒作影響制度理念落實的可能、增加落實制度理念之依據、檢討「專案分割」對制度理念落實之影響。 (二) 「合理的制度環境」-使務農者成為制度主體、提升誘因機制之質量。 (三) 「有效的制度執行」-地方政府組成集村申請案審查小組、農地利用計畫報請農委會審查列管、加強地方審查人員對於集村制度理念之宣達與執行審查業務教育。 (四) 近程與中長程措施 1. 近程建議-明確釐清農舍之定位與推動「示範集村農舍」計畫 2. 中長程建議-調整制度方向為「以集村方式興建為主」 / Central government has defined the enforcement of farmland for agricultural use as the national farmland policy since 2000. In order to fit the objective of the policy, the central government adopts the institution of cluster farmhouse. The problems of farmhouse cause public attention because it raises other issues, such as ' utilization of farmland ', ' rural landscape ' and ' farmer's life. The enforcement of cluster farmhouse institution involves the interaction of the actors, which subsequently influence the realization of the ultimate goal. The existing studies on cluster farmhouse focus mainly on the viewpoints of the owners and regulators of farmland, the principal of law reservation or housing control. In contrast to existing studies, this study, based on the concept of Institutional Economics and deep interviews with the relevant officers who take charge of the cluster farmhouse, investigate the institutional environment; institutional arrangement and enforcement of cluster farmhouse. The political and economy factors that influence the institution will be explained. Finally, a prospective promise of improvement for cluster farmhouse will be provided. The main conclusions and policy suggestions are as follows: 1. The institutional change of cluster farmhouse is deeply influenced by the political economic factors such as to join WTO and to run presidential election which subsequently affects the implementation of the institution. 2. The institutional environment of cluster farmhouse which lacks the consideration of farmland use, location of farmhouses and its institutional arrangement results in its enforcement deviated from the original concept. 3. In essence, cluster farmhouse, from the two cases in this study, has not really looked after farmers. The institution also unable to reach its goal of protecting good farmland at present. 4. Policy recommendations: (1)To reduce the possibility for building traders becoming as a leading role in the process of cluster farmhouse . (2)To make the people who engage in farming become the subject of the institution, and enhance the quality of the incentive mechanism . (3) To promote the concept of cluster farmhouse more rigorously, and thoroughly educate people more on the regulation of enforcement and examination . (4)To clarify the role of farmhouse and to give an good example of cluster farmhouse, and then to modify the regulation for building the cluster farmhouse instead of individual farmhouse .

En France, où les droits de pêches ne sont pas transférables, la gestion des quotas de pêche est essentiellement déléguée aux organisations de producteurs (OP), lesquelles se voient attribuer des allocations collectives et sont responsables de la gestion des possibilités de pêche de leurs adhérents. On peut ainsi s’interroger sur la manière dont la présence des OP au sein des institutions peut permettre d’améliorer les performances écologiques,économiques et sociales de la gestion des pêches en comparaison avec d’autres formes institutionnelles telles que les systèmes de quotas individuels transférables (QIT). Les recherches de thèse, comprenant une partie théorique et s’appuyant sur le cas de la pêcherie de sole du golfe de Gascogne pour les applications empiriques,sont organisées autour des questions suivantes : (1) Par quels mécanismes les OP peuvent-elles permettre d’améliorer le respect des réglementations et influencer l’émergence de normes sociales ? (2) Quels sont les effets redistributifs de la gestion des quotas par les OP ? (3) Comment les mécanismes de gestion des quotas par les OP peuvent-ils être intégrés dans la modélisation bio-économique pour l’évaluation d’impact de scénarios de gestion ? Les analyses développées établissent l’intérêt de prendre en compte des contraintes induites par différents arrangements institutionnels et les résultats sont notamment examinés au regard des trois dimensions (écologique, économique et sociale) nécessaires à la gestion durable des pêches. Les compromis entre ces différentes dimensions sont mis en évidence dans le cadre de scénarios prospectifs visant une meilleure compréhension des enjeux liés à la gestion des pêches. / In France, where fishing rights are non-transferable, the management of fishing quotas is essentially delegated to producer organizations (POs). POs are granted collective allocations based on the aggregate fishing rights of their members and are then responsible for managing their fishing opportunities. The goal of this research, which contains theoretical developments as well as empirical analyses applied to the Bay of Biscay sole fishery, is to determine how outcomes of fisheries management are altered by the presence of POs within institutions as compared to alternative governance systems such as individual transferable quotas (ITQs). This dissertation notably brings together bio-economic approaches and institutional analyses to better anticipate the ecological, economic and social impacts of potential governance options. The research questions are the following: (1) What mechanisms could ensure a high level of compliance and what are the potential gains of placing the POs between the regulator and the fishermen? (2) What are the distributional effects of catch share management by POs? (3) What is the added value of integrating institutional arrangements involving POs into bio-economic modelling for the impact assessment of catch share management options? The analyses that were developed establish the ability of institutional design to influence outcomes in catch share systems in terms of compliance, distribution, and ecological-socioeconomic trade-offs achieved by alternative management options.
