Dopady nového občanského zákoníku na životní pojištění / Impacts of the new Civil Code on Life Insurance

This diploma thesis deals with the impact of the new Civil Code on the Life Insurance in the Czech Republic. Since January 1, 2014, the new Civil Code regulates the existing legislation and in many ways introduces new insurance terms and requirements. The introduction of this legislation will affect the entire insurance market that will provide trends in Life Insurance in the coming years . Since this change will significantly transform the whole negotiation process of Life Insurance policies, several key themes were selected and analyzed which are most relevant to both insurers, policyholders and the insured. The new Civil Code will change the negotiations of Life Insurance contracts and the insurance broker business will be different from what so far has been customary. The insurance brokers will now have to collect the insurable interest during the contract negotiation with the applicant, analyze their needs and schedule records from the meeting. The thesis examines the current state of negotiated Life Insurance risk on the real Life Insurance data. The analysis concludes some recommendations which the insurers could use with regard to the introduced changes.

"Mémoire présenté à la Faculté des études supérieures en vue de l'obtention du grade de maîtrise en droit (LL.M.)" / La question à laquelle ce travail tente de répondre est la suivante: l'intérêt d'assurance doit-il être considéré comme un élément constitutif de la déclaration initiale du risque en assurance de dommages? Notre hypothèse de travail dans ce contexte est que l'intérêt doit être déclaré dans la mesure où il constitue un risque moral. Afin de soutenir notre argumentation, nous avons divisé notre étude en deux parties. Premièrement, nous avons examiné toutes les facettes de l'intérêt d'assurance. Tout d'abord son historique, ensuite sa définition et enfin l'interprétation qu'en ont donnée les tribunaux au fil des ans. Puis, nous avons fait de même avec la notion de déclaration initiale de risque. Plus particulièrement, nous avons examiné les conséquences d'une brèche à l'obligation de l'assuré à l'étape de la formation du contrat. Les conclusions que nous avons tirées de cette analyse sont les suivantes: 1. Il existe toujours un questionnement quant au moment précis où l'assuré doit remplir son obligation de détenir un intérêt d'assurance. L'intérêt d'assurance pourrait être examiné uniquement à l'arrivée du sinistre, alors que la déclaration initiale de risque doit être examinée au moment de la souscription de l'assurance; 2. Les différents intérêts qu'une personne peut avoir dans un bien n'influent pas directement sur le risque assurable, contrairement à la déclaration initiale qui sert justement à circonscrire le risque. Cette conclusion est par ailleurs conforme à l'historique de l'exigence de l'intérêt lui-même, quoique certains jugements affirment le contraire; 3. L'intérêt d'assurance peut être modifié en cours de contrat sans entacher la validité du contrat alors que la déclaration initiale de risque ne peut être modifiée sans encourir le risque de voir la prime d'assurance augmentée ou le risque d'assurance refusé: 4. Par contre, l'intérêt particulier qu'une personne détient dans une chose peut constituer un risque subjectif accru pour l'assureur dans certaines circonstances. / This work tries to answer one question: should the insurable interest be an element of the initial declaration of risk? Our main hypothesis is to prove that the interest must be declared when it constitutes a moral risk. To support our opinion, we divided our argument in two parts. The first one is dedicated to the insurable interest : its definition, its history and its interpretation given by the court through the years. ln the second part, we discuss the representation of risk. Particularly, we examine the consequences of a breach in the insured's obligation to divulgate ail the pertinent information to the insurer. Our conclusions are the following : 1. An interrogation still exists concerning the insured's obligation of having an insurable interest at the moment of the loss or also at the signing of the contract. Some authors consider that the insurable interest has to exist only at the loss; 2. The different interest which a person can have should not influence directly the risk, contrarily to the initial declaration which is used to identify and Iimit the risk. This conclusion is conform to the historie background of the insurable interest; 3. The insurable interest can be modify without changing the validity of the contract. On the contrary, the initial declaration of risk can not be modified without a raise in the premium or a refusaI; 4. The particular interest detained by an individual can constitute an increased subjective risk for the insurer in certain circumstances.

O presente trabalho tem por escopo o estudo jurídico do interesse segurável, elemento essencial do contrato de seguro, entendido como a relação existente entre o segurado e a coisa ou a pessoa sujeita ao risco. O tema é desenvolvido tendo por base a análise estrutural e funcional do interesse segurável, sua evolução legislativa no Brasil e consequências no contrato de seguro, no que tange tanto ao seguro de danos como ao seguro de pessoas. A análise pauta-se, em particular, no Código Civil brasileiro hodierno e no Código de 1916. Em razão da inexistência de literatura nacional específica sobre o assunto, o estudo é ilustrado, na medida do possível, com o tratamento da matéria na legislação estrangeira, na Jurisprudência nacional e no Projeto de Lei n. 3.555/2004. / The present work aims the legal study of the insurable interest, a essencial element of the insurance contract, understood as the relationship between a person and a thing or another person subject to risk. The subject will be developed from the structural and functional analysis of the insurable interest, its legislative developments in Brazil and its consequences in the insurance contract, both regarding indemnity and non-indemnity insurance contracts. The analysis is guided, in particular, by the Brazilian Civil Code and former Code of 1916. Considering the lack of specific national literature on the subject, the study is illustrated, as far as possible, with examples of foreign Law, case law and the Law Project n. 3.555/2004.

A research to develop English insurance law to accommodate Islamic principles

In recent years the popularity of Islamic insurance policies has grown rapidly with many companies across the world providing this service. London is said to be the hub for Islamic finance. It is well known for welcoming innovative financial methods. The FSA have already authorised the insurance company Salaam Halal to provide policies based on Shariah principles. The FSA, however, announced that they must operate within the same legal framework as all other insurance policies. Consequently English law has to be applied in Islamic policies taken in this country. However, in many aspects, Shariah principles contradict English insurance law. This thesis aims to discover how they contradict and recommend how the Islamic insurance policies can be applied in English law without breaking Shariah principles. As Shariah principles merely provide a wide boundary within which any law can be applied, this thesis analyses English insurance law first, and then discusses how Islamic insurance policies can operate within the English framework. In many cases, English insurance law crosses the boundary of Shairah principles due to its unfair consequences. Consequently making English insurance law fairer could be the best solution to allow the use of Islamic insurance policies under English law. Pragmatically, the thesis focuses mainly on problems within current English insurance law and recommends possible solutions. In many cases, the solutions suggested by the Law Commission are found to be incapable of establishing fairness. The majority part of this thesis is spent trying to establish a fairer framework for English insurance law. This fairer English insurance law is found to be Shariah compliant in most cases. In some cases it is not complaint due to operational differences between the two legal systems. In these cases, the thesis recommends that the Islamic insurer should incorporate certain terms to make policies Shariah compliant without breaching English insurance law.

With the rapid development of the Islamic banking and finance in South Africa, the legal regime of South Africa, must be able to progress at the same rate of development. The recognition of a foreign legal system such as Islamic law in South Africa is challenging and difficult. South Africa, has an interest based insurance legislative framework and this is not aligned with the principles of the Islamic financial system. As a result of this, regulators have taken various measures to develop and promote the Islamic Industry. The amendment to the South African Tax legislation has created an equitable and level playing field for Islamic law. The South African government also has a further obligation which is to develop a legislative framework to govern Islamic law, as well as to enhance the regulatory and supervisory framework. The study of the development of the Islamic legal regime is an important area that aids legal practitioners in identifying and resolving legal disputes.
