Busca-se, inicialmente, analisar os projetos modernos e universalizadores político-jurídicos e a natureza fundante desses projetos, ou seja, o horizonte de valores da Modernidade. É conferida a Modernidade uma natureza avessa às tradições, com pretensões universais, alicerçada na ideia de humanidade, liberdades, democracia e no modelo secular e procedimental de racionalidade. Porém, os seus valores são reproduções de uma contingência, de um processo histórico restrito ao espaço geográfico europeu, possuindo materialidade a exemplo do conceito de dignidade. Os modelos juscosmopolitas reproduzem as pretensões e os valores modernos. O modelo kantiano de paz perpétua, a grande referência do cosmopolitismo jurídico, pauta-se numa racionalidade lógico-epistêmica atrelada a autonomia da vontade (vontade racional), na auto-responsabilidade da pessoa (homo noumenon) e num regime republicano universal. Num segundo momento, busca-se demonstrar que o discurso universalista juscosmopolita apresenta-se na política externa americana, ao final da Primeira Guerra Mundial, com tradição de política externa wilsoniana. It seeks initially to analyze modern projects and political-legal universalizers and the founding nature of these projects, that is, the horizon of values of Modernity. Modernity is given to a nature that is contrary to tradition, with universal pretensions, based on the idea of humanity, liberties, democracy and the secular and procedural model of rationality. However, its values are reproductions of a contingency, of a historical process restricted to the European geographic space, possessing materiality such as the concept of dignity. Juscosmopolitan models reproduce modern pretensions and values. The Kantian model of perpetual peace, the great reference of legal cosmopolitism, is based on a logical-epistemic rationality tied to the autonomy of the will (rational will), the selfresponsibility of the person (homo noumenon) and a universal republican regime. In a second moment, it is tried to demonstrate that the universalistic juscosmopolita discourse appears in American foreign policy, at the end of World War I, with tradition of Wilsonian foreign policy. L’étude comparative des normes du droit islamique et du DIH révèle de nombreux points de convergences aussi bien en ce qui concerne le droit de La Haye que le droit de Genève. De plus, les Etats musulmans membres de l’OCI qui sont tous parties aux conventions de Genève de 1949 et en majorité aux PA de 1977, sont impliqués dans les actions de mise en œuvre du DIH initiées ou dirigées par le CICR, que ces actions relèvent de l’article 1 commun des Conventions de Genève ou du contrôle a priori et/ou a posteriori de la mise en œuvre du DIH. En outre, ces Etats ont adopté des textes favorisant l’application conjointe des droits de l’homme et du DIH tels que la Déclaration du Caire sur les droits de l’homme en Islam de 1990. La contribution des Etats musulmans concerne les mécanismes de mise en œuvre en période de paix et de conflits armés et se matérialise aussi bien par la coopération interétatique qu’à travers celle avec les ONG et notamment le CICR. Bien que le concept de jihad puisse soulever des difficultés, les motifs politiques, davantage que religieux, expliquent certaines réticences des Etats musulmans en matière de mise en œuvre du DIH. / The comparative study of the norms of the Islamic Law and the International Humanitarian Law (IHL) reveals numerous points of convergences with regards to both The Hague Law and Geneva Law, as it can be noticed in the works of the major authors of the Muslim Law of war. Furthermore, the Muslim member States of the Organization of Islamic Cooperation, member States of the 1949 four Geneva Conventions or/and the 1977 Additional Protocols, are involved in actions initiated or regulated by ICRC, whether these actions fall under the common Article 1 of the four 1949 Geneva Conventions, or concern the monitoring a priori or a posteriori of the IHL implementation. Besides, many instruments such as the 1990 Declaration of Cairo on Human Rights in Islam have been adopted by the Muslim States, thus favoring the simultaneous implementation of IHL and Human Rights. The contribution of the Muslim States concerns the mechanisms of implementation in periods of peace and armed Conflicts and is realized through both interstate and NGOs cooperation, in particular with ICRC. Although the concept of jihad can raise some difficulties, political motives, more than religious, give explanations for reluctances of the Muslim States as far as the Implementation of IHL is concerned.

Les chemins du jihad sont multiples et se dessinent largement par-delà le processus linéaire de radicalisation propre à la majorité des études sur le sujet à la recherche de causes. Cette thèse raconte les multiples enchevêtrements, allers-retours et bifurcations de ces voies empruntées par des Canadiens, Français et Belges, dont les lignes de fuite ont abouti ou pas à des devenirs-jihad. L’objectif étant de comprendre comment ces acteurs en arrivent-ils à désirer l'engagement jihadiste ? Comment en sont-ils affectés et donnent-ils sens à tout cela ? Un désir aux multiples (re)territorialisations qui, parfois, peut tourner en abolition mortuaire. L’émergence d’un moment où l’on perçoit les choses autrement lors de cette rencontre, virtuelle ou réelle, humaine ou non-humaine, qui affecte, et donne sens à une ligne de fuite. Par l’approche rhizomique et schizo-analytique de Deleuze et Guattari – une perspective fluide qui revient à penser l'humain non pas comme une entité fixe, mais un devenir – il est décrit les agencements de ces lignes qui traversent le champ social et les acteurs en une chorégraphie de ruptures, de bifurcations, d’enchevêtrements, de sauts, de dé-re-territorialisations, d’arrêts, etc., à partir des 25 récits de vie des participants. This thesis will provide readers with an in-depth understanding of the root causes and risks factors of Islamic radicalisation in France. It argues that Islamic radicalisation in France cannot solely be explained through one factor. This research argues that mental illnesses, deception, trauma and relative deprivation do not give a solid impetus for individuals to radicalize. Rather, radicalisation in France should be understood as an association of socio-economic, psychological, and political factors. Given the misuse of the term, the first chapter has been dedicated to its definition and to the differences between cognitive and behavioural radicalisation. Such differentiation is necessary for a thorough understanding of the topic. The second chapter gives a clear and concise overview of the different models and theories of radicalisation, contributing to a quick introduction to the different root causes and risk factors of radicalisation. The third chapter consists of a review and analysis of the available literature on the risk factors of radicalisation while the fourth and final chapter consists of an analysis of said factors in light of the French case, ultimately aiming to understand which root causes and risk factors are of high relevance in the case of France.
