A Study Of Public Employee Labor Law In The United States

This study examined the legal issues of public employee labor relations in the United States. Included in this study is a review of relevant case law as it pertains to collective bargaining in the public sector. In addition to reviewing the case law, this study researched the statutory language of each state for public sector collective bargaining. The study includes a review, analysis, and summary of the state and federal laws for public sector collective bargaining. The collective bargaining process in the United States is designed to resolve disputes between two parties, the employer and the employee. The resolution of these disputes often depends on the relative bargaining power of each party. The private sector has a collective bargaining process that has been well established since the passage of the National Labor Relations Act in 1935 and the Labor-Management Relations Act of 1947. The federal laws that have been implemented in the last fifty years, to include the Civil Rights Act of 1964, the Equal Employment Opportunity Act of 1972, the American with Disabilities Act of 1990, among others, cover the scope of almost all of the private sector collective bargaining (Oberer, 1994). The public sector contains 50 different state laws and several federal laws defining the scope of collective bargaining for public employees. The bargaining process in the public sector takes place in the context of the political arena. This political influence, which is unique in each state and at each level of government, provides additional steps to the bargaining process that further differentiate public sector bargaining from private (Valletta, 1985). This study provides conclusions on certain aspects of public sector collective bargaining that lead to dispute resolution and contract negotiation to include fact-finding procedures, mediation, arbitration, and strike policies, in the current state of the law. Recommendations are made to public officials, policy makers, and other stakeholders for the future of public employee labor relations in the United States.

This work deals with problems of the termination of labor relation in the Czech Republic, as well as Slovak Republic. I approached this topic by comparing the currently valid regulations as stated in the Labor Codes of the Czech and Slovak republics. I consider thorough knowledge of this issue to be of great practical importance. I am convinced that labour is one of the most important attributes determining systemic functioning of the whole society. From the presentation of the labour as a basic means of production of any state system we can deduce a great amount of interesting information. The work is and always has been a prerequisite to our survival and is thus the foundation of any state system. My thesis is divided into six separate chapters, each of which deals with labor law from a different perspective. The first chapter deals with the subject, purpose and content of labor law. The second chapter describes the history of the labor law and is divided into two parts before and after 1989. Therefore it also describes the situation in Czechoslovakia, where identical laws were applied in all legal sectors. In this thesis, we present the outcomes of a research conducted on children's domestic labor in Haiti. In addition to being engaged in housekeeping work -- which has a negative impact on access to basic education -- children in domesticity are generally victims of harmful disciplinary measures as well. Consequently, our main objective is to expose the actual norms and practices regarding the education and the physical treatment of young domestic workers. / Based on legal pluralism, the approach undertaken during this research combines both theoretical and empirical research, and focuses on law and norms existing at multiple levels. / First, we present the information gathered from our theoretical approach. After exploring the notion of "Haitian child domestic servant", sketching social profiles of actors engaged in the practice of domesticity, and identifying the most significant contingent factors, we underline the principal national and international norms guaranteeing children the right to education as well as to physical integrity. / Second, we explore the local norms related to the education and to physical treatment of young domestic servants through the results of empirical research carried out in Haiti in the form of observation and interviews with relevant actors. / We conclude by identifying the framework of norms that govern the behaviour of families that host domestic children. Understanding that framework allows jurists and other actors to identify and implement the actions more likely to improve the quality of life of child domestic workers.

It treats from a decision that generated a lot of criticism as, many workers felt impaired with the new point of Supreme Court. In the begining, will be analysing the concept of presciption in labor law, the influence in interpretation of norms and the definition of protector principle. Then, it will be study the concept of legal nature of FGTS. It will be observed the prescription of the FGTS in the law 8.036/90, the prescription of labor credits in the CF/88(Federal Constitution of Brazil) and the possibility of conflits among constitutional norm about prompt prescription and the principle most favourable norm. The study will be carried out through empirical, bibliographic, qualitative, exploratory, descriptive and documentary research. The methodology to be adopted will be critical analysis of legal discourse through which the decision pronounced by the STF is investigated in an attempt to understand the change of a jurisprudential understanding consolidated for years. Finaly, we hope to identify the consequences of the aplicability from the new prescriptional promt could bring to the legal effectiveness about the worker´s rights. / O trabalho tem como objetivo analisar a decisão do Supremo Tribunal Federal que julgou inconstitucional a norma que prevê a prescrição trintenária para a cobrança judicial dos depósitos não efetuados do FGTS. Trata-se de uma decisão que gerou críticas já que muitos trabalhadores se sentiram prejudicados com o novo posicionamento da Suprema Corte. De início, serão analisados os conceitos de prescrição no direito do trabalho, a influência na interpretação das normas e a definição do princípio protetor. Em seguida, serão estudados o conceito e a natureza jurídica do FGTS. Será observada a prescrição do FGTS na lei 8.036/90, a prescrição dos créditos trabalhistas na CF/88 e o possível conflito existente entre a norma constitucional sobre o prazo prescricional e o princípio da norma mais favorável. O estudo será realizado por meio de pesquisas empírica, bibliográfica, qualitativa, exploratória, descritiva e documental. A metodologia a ser adotada será a Análise Crítica do Discurso Jurídico por meio da qual se investiga a decisão proferida pelo STF na tentativa de entender a mudança de um entendimento jurisprudencial consolidado há anos. Como resultado, espera-se identificar as consequências que a aplicabilidade do novo prazo prescricional possa vir a trazer tanto à eficácia da justiça, quanto aos direitos dos trabalhadores.

Stuck in legal limbo: a case study of migrants accessing the law in Johannesburg

This study looks at the experiences of migrants accessing notions of justice at the Wits Law Clinic, the pro-bono public interest law clinic of the University of the Witwatersrand, Johannesburg, South Africa. This study explores the way migrants engage with public interest law in the light of an overwhelming adversarial and threatening experience of the law. The law in the form of state law and its powers embodied in law enforcers and petty bureaucrats is mainly used against them and confines them to a ‘state of bare life’. One could therefore expect that this compels migrants to keep their heads down and avoid any form of formalization, and instead reverting to a total reliance on informal survival strategies. This study however shows that migrants retain a strong faith in the law and draw a huge sense of hope from the services they receive from the Wits Law Clinic – even though the only action that is sometimes taking place is the endless writing of letters. But it appears that the reduction of the law to absolutely mundane bureaucratic activity still holds enough symbolic power of giving migrants a sense of moving closer towards the promise of justice, which the law also holds, even though it might be over and over deferred.
