Advokát a klient - vzájemná práva a povinnosti / The lawyer and the client - mutual rights and obligations

The aim of this thesis is to specify certain legal relationship arising between attorney and his client. This legal relationship characterises, to certain extent, role of attorney in the legal system of the Czech Republic and that is why it deserves attention. The main legal source for this thesis is Act No. 85/1996 Coll., on the Legal Profession, as subsequently amended. This act is interpreted in following chapters in coherence with other acts, subordinate legislation and professional rules. After brief introduction into the issue I focus on particular causes of the formation of attorney-client legal relationship. The origin itself is determining for specification of mutual rights of both subjects. Besides talking about the formation, I will also mention the rejection and termination of the legal relationship. The next chapter deals with the ethics in advocacy, which we should keep in mind while interpreting particular rights and obligations. Ethics is characteristic sign of attorney's profession. Chapters 5 and 6 are the actual core of this thesis, when interpreting individual rights, that constitute the actual attorney-client legal relationship. Defence lawyer in the criminal proceedings Abstract The defending lawyer is an important institution in criminal law. With this institution a basic principal can be guaranteed, the right of defense. This master's degree thesis is about the defending lawyer in criminal trials in the Czech Republic and Switzerland, its similarities and differences. It consists of an introduction, a body consisting of 7 chapters and a conclusion. The first chapter deals with the historical development of this institution on Czech territory from the 18th century until the present time. It especially emphasizes the effect of historical events on modifications and on the practical observance of written law. The next chapter defines the term defending lawyer under Czech law and explains how someone can become a defending lawyer. It specifies how a defending lawyer should conduct the defense case and explains the differences between elected and nominated lawyers. The following chapters analyse the rights and obligations of lawyers and methods of legal defense. Furthermore, they try to examine the importance and necessity of a defending lawyer in a criminal trial. On the other hand, they show the limitations of defense lawyers and their tactics. Chaucer’s Man of Law’s Tale has been largely ignored in comparison to the rest of The Canterbury Tales due to the rhetorical embellishment in the tale. However, examining the tale in the cultural context of its narrator, as well as in the context of the textual and oral rhetorical strategies of the fourteenth century, reveals that the Man of Law creates an argument out of his fictional tale that ties the developing fourteenth century common law system to divine justice, thereby justifying his profession to his audience

L'avocat d'intérêt public en Chine : un nouveau type de "cause lawyer"? / The public interest lawyer in China : A new type of “cause lawyer”?

Cette thèse porte sur le rôle des avocats d’intérêt public dans les procès que les paysans intentent pour défendre leur droit au logement en Chine. Concernant les avocats d’intérêt public en Chine, deux figures sont valorisées dans cette thèse : l’avocat gouvernemental travaillant comme médiateur et l’avocat libéral travaillant comme acteur social. Le premier type d’avocat se compose de deux sous-groupes : les avocats recrutés comme fonctionnaires par le gouvernement local et les avocats libéraux sollicités provisoirement par le gouvernement local dans certaines affaires. Le deuxième type est également divisé en deux groupes : les avocats militants dans les grands cabinets et les avocats des petits cabinets. Dans sa dimension historique (chapitre 1), Cette profession s’inscrit dans la culture confucianiste de l’Empire - même si elle subit aussi l’influence de l’implantation juridique occidentale depuis la fin du XIXe siècle. Le concept occidental d’avocat a été introduit par le régime chinois de la dynastie de Qing de façon « top-down », et ce concept s’est superposé à la tradition du « Songshi ». Ces deux courants composent le fond sur lequel s’est construite la profession d’avocat chinois en se concentrant d’abord dans la région maritime du sud-ouest, surtout dans les grandes villes comme Shanghai et Canton. Dans les régions continentales, l’image de l’avocat reste encore fortement influencée par la tradition du « Songshi ». A partir de l’instauration de la République populaire de Chine, la profession d’avocat a obtenu du régime sa reconnaissance, mais elle a hérité de la tradition locale du « Songshi », et elle a fait partie des gestionnaires du régime (les fonctionnaires), au lieu d’être une profession libérale. Cette recherche met aussi en évidence la spécificité de l’institution judiciaire chinoise (chapitre 2): l’encastrement du système politique dans le système judiciaire conduit à une symbiose ; le passage par le politique est l’unique moyen de résoudre les problèmes ; les questions judiciaires et les problèmes sociaux sont politisés. Au niveau macro, l’organisation des grands corps de l’État est complexe et chaque corps défend son propre intérêt, bien davantage que l’intérêt général. Au niveau micro, tous les acteurs de l’action publique ont envie de devenir acteurs de l’action politique. Les avocats gouvernementaux sont un exemple, mais les avocats libéraux veulent aussi pénétrer dans l’administration de l’État par les activités extérieures de l’institution et du monde judiciaires. Les « cause lawyers » ont des prédispositions politiques (à gauche et à droite), et ils se confrontent au défi de défendre l’intérêt de leurs clients en même temps que de réaliser leur objectif politique. Dans le chapitre 3 et le chapitre 4, il nous montre les logiques d’activité dans différents groupes d’avocat, surtout dans l’affaire de démolition et d’expropriation. L’analyse de l’activité des avocats gouvernementaux qui travaille comme médiateur montre que ceux-ci utilisent la légitimité de la domination de l’État pour faire croire aux paysans que la destruction de leurs logements est une action politique légale. Leur rôle est plutôt celui d’un médiateur ou d’un conseil judiciaire que celui d’un avocat. La recherche porte sur les avocats libéraux s’engageant dans l’action publique comme acteurs. À cause du caractère politique de leurs interventions devant le tribunal, ces avocats perdent souvent leurs procès. Ils organisent des mobilisations à l’extérieur du tribunal comme des actions de ‘lobbying’, en espérant lancer un scandale sur les forums internet de sorte à faire pression sur les groupes d’intérêt. En utilisant internet, ils cherchent à transformer un procès en cause. / My study is about the role of Chinese public interest lawyers in the case of housing demolition of peasants. I want to know if there is a legal profession in China who has some similarity of cause lawyers in America. If there is, considering the reality of Chinese society, what are the same point and the difference between this professional group and the cause lawyers in the liberal democracy? These questions are relatives to the complex relation among the law, the politic, and the social change in chine. To answer these questions, I try to analyse the role of the lawyer in this relation from three dimensions. Firstly, it is necessary to describe the Chinese legal system in which the lawyer shows their characteristics, specially the relation between the law and the politic in China(Chapter 1 and chapter 2). Secondly, on the basis of interviews with the lawyers, observing the activity and the strategy of the lawyer inside and outside of their professional domain, I seek to make a conclusion of the specificity of the Chinese public interest lawyers (chapter 3); Thirdly, I will try to make a comparison with the cause lawyers according to these characteristics of Chinese public interest lawyers(chapter 4). This comparison can answer the question in the beginning of my study and give a good window into the role of Chinese public interest lawyer.

Understanding Refugee Stories: Lawyers, Interpreters, and Refugee Claims in Canada

The interpreter is overlooked when considering the refugee claim process in Canada, even though refugee lawyers most often work with interpreters to understand their clients. Through qualitative interviews with refugee lawyers, this thesis aims to better understand how interpreters affect the lawyer-client dynamic. Tension surrounding the appropriate role of the interpreter, the complexity of communicating through interpreters, and interpreters’ effects on lawyer-client relationships emerged as themes and are explored with reference to the existing interpretation studies literature. The author proposes that an updated lawyer-interpreter-client relationships framework is necessary to fully encompass the realities of these complex relationships, and offers suggestions for best practices to ensure lawyers, interpreters, and clients maintain productive relationships. / Graduate / 0398 / actontess@gmail.com

Objetivando fazer este diagnÃstico, toma-se como palco investigativo, a cidade de Fortaleza, CearÃ, diante da hipÃtese de que referida capital nÃo estimula o desenvolvimento da Advocacia Ambiental. Aiming to develop such diagnostic, it was considered the city of Fortaleza as the investigative scenery, having the hypothesis that is not identified in this city any support for the development of the environmental advocacy. Concerning its methodology, it was applied legal and documental reading and bibliographical notes; interviews and questionnaires; informal conversations; visits to Universities and Law Courses, to courts responsible for judging and prosecuting environmental issues and to Brazilian Advocates Order, sectional State of Cearà (OAB/CE); requesting of documentation; and treatment, analysis and interpretation of collected data, which originated three study cases (at UNIFOR, at UFC and at 1st and 2st prosecuting courts specialized in environment and urban planning) and superficial studies concerning more recent academic structures (Law Courses established since 2001). The results point in the direction of the confirmation of the initial hypothesis that is not identified in the city of Fortaleza any academic or professional structures specialized in environment the education and performance of lawyers in the environmental area. Nevertheless, it is not forgot sporadic enterprises, specially in academic area, that aim to approach the professional to its constitutional hole of protecting and defending the ecologically balanced environment for present and future generations. Finally, through this preliminary diagnostic, it is aimed to continue this research in a new perspective: offering suggestions of models of academic and jurisdictional structures in order to promote a more intense performance of lawyers as protagonists of sustained development.

A busca pelos ideais que norteiam a profissão deve ser retomada, sob pena do advogado subsistir sobre o império da técnica massificada e acrítica. Como o novo Parsifal, deve o advogado se entregar a tarefa de auto-conhecimento, entendimento do seu topos na realidade, assim como todos os elementos radicais de uma mitologia que guiam através do processo de individuação, reestabelecendo sua ligação com sentido e os significados, restaurando a imagem e a ética da profissão / In the contemporary scene, the lawyer lost his professional identity. He lives within a problem of a theoretical substrate. He is incapable of dealing with the complexity of the living world in the new millennium. The search for the ideals that guide the profession should be resumed, under the penalty of lawyer survives under the technique power and uncritical mass. As the new Parsifal, the lawyer must seek self-knowledge, understanding of his place in reality, like all radical elements of mythology that guide you through the process of individuation, reestablishing its connection with meaning and significance, restoring the image and ethics of the profession.
