Local government's role in the pursuit of the transformative constitutional mandate of social justice in South Africa / Oliver Njuo Fuo

South Africa's transition to constitutional democracy marked the end of a system of government that perpetuated injustice on the basis of race. The previous system of government, underpinned by the principle of parliamentary supremacy, did not only exclude the majority of the population from public governance processes, it also economically exploited the majority of the population. As such, it laid the foundation for widespread poverty and inequalities in access to basic services. The Constitution of the Republic of South Africa, 1996 (the Constitution), is committed to correcting these past injustices and aims to establish a society based on social justice. This constitutional vision finds expression in the notion of transformative constitutionalism. Klare introduced the notion of transformative constitutionalism over a decade ago. For purpose of this thesis, the notion represents the socio-economic and political vision of post-apartheid South Africa to eradicate extreme poverty and inequalities in access to basic services as well as establish a democratic system of government that is inclusive, caring, participatory, representative and accountable. It captures the constitutional commitment to establish and maintain a society based on social justice by inter alia, eradicating poverty and inequalities in access to social services. The realisation of the socio-economic rights entrenched in the Bill of Rights of the Constitution (by all organs of state) is one of the ways in which to contribute towards meeting this transformative constitutional mandate, and by extension, striving towards the attainment of social justice. Although transformative constitutionalism and the achievement of a socially just society remain an ideal, the Constitution as the supreme law in the country, obligates the state, constitutive of public and private entities, to work towards its realisation, to the fullest extent possible. As part of post-apartheid institutional transformation, the Constitution established three spheres of government – national, provincial and local - which are distinct, interrelated and interdependent. All three spheres are obliged to operate in accordance with the principles of co-operative government and intergovernmental relations and are co-responsible for realising a number of constitutional objectives. Since 1996, the Constitution obliges local government (municipalities) to play an expanded "developmental" role. This has marked a move away from local government being regarded as merely a service delivery arm of government. xii The extended function of local government that came about with the constitutional dispensation finds expression in the notion of "developmental local government". This study is based on the premise that developmental local government must and can, together with the authorities in the other two spheres, contribute to transformative constitutionalism and social justice. Primarily, this study questions the extent to which the legal and policy framework on local government in South Africa enable local government (municipalities) to contribute towards realising the constitutional socio-economic rights underpinning the mandate of transformative constitutionalism. This study presents a review of relevant literature in order to establish links between the theoretical concepts underpinning this thesis. It examines the legal and policy framework on "developmental" local government in South Africa and analyses the central legal framework for the realisation of socio-economic rights at the local government level. In addition, the study explores the relevance and potential of local government indigent policies and Integrated Development Plans (IDPs) - as legally prescribed governance instruments - in contributing towards a more just society by examining their underlying legal and policy framework. It further distils from the theories and perspectives of social justice, benchmarks to guide local government towards achieving the transformative constitutional mandate aimed at social justice. Implementation Of A Democratic Decentralized Welfare Scheme : An Institutional Perspective

Decentralization leads to functional and financial devolution of authority, induces more transparency in the system and puts emphasis on local needs. It creates platforms to voice and institutionalize the interests of various groups, and comes nearer to the public by making all tiers of government accountable directly to the people. However, several complexities govern this effort in India. First, implementation involves several official agencies, creating administrative gaps, lack of coordination and fiscal complexities. Second, Indian society is largely agrarian and rural marked by divisions of religion, caste and economic class. Third, the socially vulnerable and poor are often trapped in interlocking economic transactions with affluent landlords making it difficult for them to go for collective change. This research critically evaluates these dynamics taking the case example of the Mahatma Gandhi Rural Employment Guarantee Scheme (MGREGS). We followed a threefold methodology in order to understand the policy dynamics, namely, stakeholders’ interviews, primary survey data analysis and secondary data analysis. Case studies were useful in understanding policy implementation dynamics through field observations. The multi-level regression results reflected co-existence of agriculture and MGREGS dynamics, with their own rules and objectives, apparently contradictory, but leading to social and economic equilibrium. Searching explanations for these contradictory results led us to two larger understandings: 1) Actors are seen to take rational decisions based on local socio-politico-economic understandings of the world. 2) These decisions are, however, at multiple levels and at multiple action spaces. Institutional rational choice perspective proposed by Ostrom (1999) corroborated these findings. Latent variable path analysis results indicated the dynamics of civil society and administrative bureaucracy as a negotiated equilibrium that has the potential to transform governance. The process of institutional evolution was through endogenous institutional change process as proposed by Grief and Laitin (2004). Furthermore, the effect of socio-structural factors on institutional structures was observed. The results indicated two major understandings: 1) the formation and effectiveness of institutional structures were dependent on social capital and in turn on social structures and networks 2) the influence of formal institutional structures on local governance and social dynamics affect the governance network formation (Hertting, 2001). Scenario-wise regression analyses results revealed that the effort to improve social capital of the groups through governance procedures need to be mediated through ‘local’ social structures. Agent based model results indicated the following: 1) regulatory dynamics need not necessarily follow the trend of socio-economic dynamics. Instead, they were in line with advocacy dynamics (Sabatier, 1988), which in turn depend on the social structures and networks. 2) regulatory strategies were endogenous institutional rational choices, given the existing socio-economic structures and networks of the society. Hence, Institutional theories were observed to be instrumental in understanding the policy implementation dynamics in democratic decentralization setup.

Planning for an Ageing Population

The majority of local areas in the UK are faced with an ageing population. Popular retirement destinations in coastal and more rural areas are particularly affected. The thesis aims to find out how local areas strategically tackle these demographic shifts. The British government has issued strategic guidance for local areas, but as yet little is known about how actual responses look. The literature has largely focused on good practice compilations. Consequently, the thesis attempts to analyse in depth local areas’ experiences in planning for an ageing population. The main research question is: How do local actors in the UK plan for population ageing? A grounded theory approach has been chosen to develop theoretical concepts from empirical data. Local governance and collective learning are used as sensitising concepts, i.e. wider theoretical perspectives. Due to the state of research and the aim to gather detailed knowledge regarding the planning for an ageing population in local areas, a qualitative research design has been chosen. More precisely, it is a multiple case study design, covering the three heterogeneous cases North Tyneside, Poole and Wealden. Empirical data has been assembled from qualitative interviews with local experts and documents such as local strategies or minutes of meetings. The results are threefold. Firstly, local governance arrangements are analysed. This covers the identification of involved actors, their action orientations and interactions. As approaches in planning for an ageing population differ across organisations, a typology of individual actors is developed. Moreover, it is observed that and analysed how traditional hierarchical steering by public bodies is complemented by more network-like forms of governance, for example multi-organisational older people’s partnerships. Secondly, local learning processes in planning for an ageing population are reconstructed. Four phases are differentiated: setting the agenda for the topic of ageing and older people followed by building up knowledge on the subject and collective learning in a narrower sense and, finally, strategy-making. Interrelations between governance arrangements and collective learning are analysed, particularly with respect to different forms of learning in different types of older people’s partnerships. Finally, central challenges and perspectives arising from the analysis of governance arrangements and learning processes are discussed. On the one hand, these pertain to the cross-cutting nature of ageing, on the other hand they are due to the ambivalent influence from national government on local areas. Ageing affects various spheres of local steering activity. Among the main implications for local areas in the UK are the continuous search for responsibility and the struggle to broaden the agenda beyond health and care. This has led to experimenting with governance structures, intensifying involvement of older people and developing inter-agency older people strategies and others as catalysts for further development. The strong influence from central government on local steering advances local reactions to ageing but provokes superficial and unsustainable answers at the same time. Overall, the thesis provides in-depth empirical knowledge on local planning for an ageing population. The theoretical lenses local governance and collective learning have been used to generalise from the practical experiences in the three case study areas. The thesis concludes with recommendations for practitioners locally and at the national level. These refer inter alia to local governance arrangements which come up to the issue’s cross-cuttingness and to national guidance and regulation which could facilitate their introduction or Küstengebiete und ländliche Räume sind besonders betroffen, da sie als Altersruhesitz bevorzugt werden. Ziel der Dissertation ist es, den strategischen Umgang der Gemeinden mit diesen demographischen Veränderungen zu beleuchten. Die britische Nationalregierung gibt den Gemeinden strategische Leitlinien vor, allerdings ist wenig darüber bekannt, wie die lokalen Ansätze tatsächlich aussehen. Bisher wurden vor allem Good Practice Sammlungen zum Thema veröffentlicht. Vor diesem Hintergrund beschäftigt sich die Dissertation detailliert mit der Stadtentwicklung für eine alternde Bevölkerung in solchen Gemeinden, die in sich zwar mit der Bevölkerungsalterung beschäftigen, aber nicht als Good Practice klassifiziert werden können. Die Hauptforschungsfrage ist: Wie planen lokale Akteure für eine alternde Bevölkerung? Die Arbeit folgt einem Grounded Theory Ansatz, der darauf zielt, theoretische Konzepte aus den empirischen Daten zu entwickeln. Lokale Governance und kollektives Lernen dienen als sensibilisierende Konzepte, d.h. weitergefasste theoretische Perspektiven. Aufgrund des Forschungsstandes und des Ziels, detailliertes Wissen über die Stadtentwicklung für eine alternde Bevölkerung zu gewinnen, folgt die Arbeit einem qualitativen Forschungsdesign. In den drei heterogenen Fallstudiengemeinden North Tyneside, Poole und Wealden wurden insbesondere qualitative Interviews mit lokalen Experten durchgeführt und Dokumente wie Strategiepapiere und Sitzungsprotokolle ausgewertet. Die Ergebnisse umfassen drei Themenbereiche. Zunächst werden lokale Governanceformen analysiert, was die Identifikation der beteiligten Akteure, ihre Handlungsorientierungen und Interaktionen umfasst. Da Ansätze zum Umgang mit der alternden Bevölkerung sich stark zwischen individuellen Akteuren unterscheiden, wurde auf dieser Basis eine Akteurstypologie erstellt. Darüber hinaus wird analysiert wie traditionale Steuerungsansätze staatlicher Akteure durch netzwerkartige Governanceformen ergänzt werden. Bedeutendstes Beispiel sind Arbeitsgruppen, in denen Akteure verschiedener Organisationen und Sektoren zusammenkommen, um Ansätze zum Umgang mit Senioren und der Bevölkerungsalterung zu entwickeln. Anschließend werden lokale Lernprozesse in der Planung für eine alternde Bevölkerung rekonstruiert. Dabei werden vier Phasen unterschieden: Agenda-Setting, Wissensaufbau, kollektives Lernen im engeren Sinne und Strategieerstellung. Es werden die Wechselwirkungen zwischen Governanceformen und kollektivem Lernen analysiert, insbesondere bezüglich der Lernformen in verschiedenen Typen von Arbeitsgruppen. Schließlich werden Herausforderungen und Perspektiven der Stadtentwicklung für eine alternde Bevölkerung diskutiert, die aus der Analyse von Governanceformen und Lernprozessen hervorgehen. Einerseits beziehen diese sich auf den Querschnittcharakter des Themas Alterung, andererseits auf den ambivalenten Einfluss der Nationalregierung. Die Alterung betrifft verschiedenste Bereiche lokaler Steuerung. Dies führt zu einer anhaltenden Suche nach lokalen Verantwortungsträgern und zu Schwierigkeiten, die Agenda über Gesundheit und Pflege Älterer hinaus zu erweitern. Darüber hinaus hat der Querschnittcharakter ein Experimentieren mit Governanceformen angeregt, sowie die Schaffung von mehr Partizipationsmöglichkeiten für ältere Bürger und die Erstellung ressortübergreifender lokaler Alterungsstrategien. Die starken Eingriffe der Nationalregierung in lokale Steuerungstätigkeiten befördern einerseits die Auseinandersetzung mit der Alterung, andererseits führen sie auch zu oberflächlichen und wenig nachhaltigen Reaktionen. Insgesamt bietet die Dissertation detailliertes empirisches Wissen zur Stadtentwicklung für eine alternde Bevölkerung. Die theoretischen Perspektiven lokale Governance und kollektives Lernen wurden genutzt um generalisierbare Ergebnisse aus den Erfahrungen in den drei Fallstudiengemeinden zu gewinnen. Abschließend werden Handlungsempfehlungen für Praktiker auf der lokalen und nationalen Ebene abgeleitet.:Figures and A Framework for Community-based Governance in Grasslands and Savannahs of South America

Die folgenden Arbeiten folgen einem vergleichenden Ansatz zweier ausgewählter Gebiete Südamerikas, um die Komplexität der Governance-Prozesse zu strukturieren. Sie konzentriert sich auf das kolumbianische Llanos- und das paraguayische Pantanal-Gebiet und korreliert die räumliche Beziehung der von natürlichen Ressourcen abhängigen Gemeinden mit sozioökonomischen und ökologischen Veränderungen, Macht und hierarchischer Struktur auf allen Ebenen, politischer Dynamik und Programmen zur Einbindung von Stakeholdern. Die Hypothese hinter dieser Arbeit ist, dass die Verwendung einer geklärten, nicht-normativen Governance-Perspektive in der sozio-ökonomischen und politischen Forschung zu einem besseren Verständnis sozio-ökonomischer und politischer Prozesse beitragen kann, einschließlich formaler und informeller Prozesse, die in größere und kleinere soziale Systeme eingebettet sind, sowie sowohl vertikale als auch horizontale sozio-ökonomische und politische Arrangements. Über die Entwicklung eines spezifischen Rahmens für die CBG hinaus werden zwei praktische und methodische Instrumente generiert. Das Community-Based Governance Manual (CBGM), einschließlich einer Fallstudie über das kolumbianische Llanos, und die Guidelines to Strengthen CBGG in the Paraguayan Pantanal (CBGG) versuchen, die politische, wirtschaftliche und soziale Analyse von Gemeindeakteuren sowie Szenarien zur Bewältigung der sie betreffenden sozio-ökologischen und sozio-ökonomischen Probleme zu fördern. Der CBGM und der CBGG können als konkrete und greifbare Auswirkungen auf Feldebene sowie als gültige Prognosen für die erwartete zukünftige Entwicklung von lokalen und ökologischen Governance-Modellen angesehen werden. / The following work develops the Community-Based Governance (CBG), a bottom-up organizational model, ought to increase the participation of local groups in the planning, research, development, management, and formulation of policies and strategies for the wider community. It follows a comparative approach of two selected areas of South America in order to structure the complexity of governance processes: the Colombian Llanos and the Paraguayan Pantanal, correlating the spatial relation of natural resource-dependent communities with socio-economic and environmental changes, along with power and hierarchical structure at all scales, political dynamics, and stakeholder engagement schemes. The hypothesis behind this work is that using a clarified, non-normative governance perspective in socio-economic and policy research can contribute to an improved understanding of socio-economic and political processes, including formal and informal ones, those embedded in larger and smaller social systems, as well as both vertical and horizontal socio-economic and political arrangements. Beyond the development of a specific framework for CBG, two practical and methodological tools are generated. The Community-Based Governance Manual (CBGM), including a case study of the Colombian Llanos, and the Guidelines to Strengthen CBG in the Paraguayan Pantanal (CBGG) seek to promote the political, economic, and social analysis of community actors as well as scenarios addressing the socio-environmental and socio-economic problems that affect them. CBGM and CBGG may be regarded as concrete and tangible impacts on the field, as well as valid outlooks on expected future development of local and environmental governance models.

1999年地方制度法施行以來,地方極力爭取自主權,中央與地方自治團體間衍生多次衝突,爭議之層面涵括地方財政權、立法權及人事權等地方自治核心領域。針對中央地方衝突,司法院大法官作出多號解釋,惟並未定紛止爭,突顯出建立中央地方衝突解決機制之必要性。 本論文選擇五個衝突個案,分別是財政衝突的統籌分配稅款及地方積欠健保政府補助款;立法衝突之行動電話基地台自治條例牴觸案及台北市里長延選案;人事權衝突之縣市警察局長任免案。先以府際關係理論進行鉅觀分析,分析其府際關係網絡圖,突顯其網絡利害關係人,如何進行聯合或對抗。次以賽局理分論析中央地方之賽局策略選擇過程,進而賽局及報酬模擬分析。 期望透過各類型中央地方府際衝突個案研究,提出解決下列問題。一、釐清中央地方府際衝突之影響因素?二、究竟何為中央地方權限爭議解決機制?三、台灣府際衝突之關係網絡圖像為何?四、府際衝突賽局中之博奕過程模式為何? 本研究提出四項結論。一、法律與制度變遷與府際衝突交互運作影響;二、政黨對立為府際係衝突最關鍵影響因素;三、建立多元之協調解決機制,為解決府際衝突之有效措施。四、提出全觀型府際賽局理論,以詮釋我國府際關係衝突現象。 本研究並提出五項建議,有助於未來我國府際關係正向發展,一、釐清府際衝突深層網絡關係結構,二、擴大跨域合作府際關係,三、追求中央與地方府際之最適效益,四、邁向多層次之地方治理,五、體認「地方自治為憲法制度性保障」之真諦。 / Since the Local Government Act enacted in 1999, local governments strive for local autonomy; therefore some supervisory conflicts aroused between central and local government. Those conflicts related to law autonomous enactment, finance autonomous rights and personnel rights. Despite Judicial Interpretation No.550 and 553 had review above conflicts, disputes still remained unsolved, which proclaimed the importance of constructing the reconciliatory mechanism of conflicts. This study tries to analyze five conflict cases including tax redistribution fund, premium of National Health Insurance, cellular phone base management local act, the prolonged election of Taipei li-chairman and incumbency of police bureau chief. Four conclusions are drawn as below, first, legal and system change will affect the IGR conflicts mutually. Second, parties antagonism is a crucial factor for IGR conflicts. Third, multi reconciliatory mechanism of conflicts would be efficient, a holistic game theory could interpret those conflicts. The last chapter proposes recommendations such as to clarify the IGR networks structure, broaden the cross-boundary cooperation, pursuit the optimal payoffs, work towards a multi-level governance and comprehend the core meaning of “local autonomy as a system assurance”.
