Magister Commercii - MCom / This thesis provides an in-depth explorative case study of the relationship between electoral management and civil rights, using the 2013 Tlokwe By-Elections in South Africa as a case study. The central question in this thesis was: what are the implications of the Tlokwe Ruling on South Africa’s electoral democracy? This topic is extremely important to the field of democracy and elections, as electoral processes become ever more essential in allowing citizens to access free and fair elections. Without the ability to access free and fair elections, the power of citizens to hold leaders accountable is diminished. The study used the framework provided by Diamond and Morlino on the quality of democracy because it contains useful normative values of a democracy and assisted in providing a lens by which to view and analyse elections in a democratic regime.

Stakeholders' perceptions on the management of the 2011 electoral processes in the Democratic Republic of Congo

This study investigated the perceptions of election stakeholders with regard to the management of the 2011 electoral processes in the Democratic Republic of Congo (DRC). The involvement of civil society organizations, electoral experts and academia, including party agents as domestic observers and stakeholders in Congolese electoral processes, is crucial as they help electoral and participatory democracy to take root in the DRC. This study was underpinned by political trust, political support and neopatrimonial theories. Furthermore, a mixed methods research design was used in order to understand the perceptions of stakeholders on the management of the 2011 electoral processes in the DRC. The findings of the study showed that stakeholders‟ perceptions on the management of the 2011 electoral processes in the DRC were driven by both internal and external factors pertaining to the Independent National Electoral Commission (INEC) that have the potential to affect the electoral processes as well as the level of trust in the INEC and other institutions involved in the electoral processes. / Political Sciences / M.A. (Politics)

Disertacijos tyrimo objektas yra juridinių asmenų valdymo organų narių civilinės atsakomybės teisinis reguliavimas bei praktinis taikymas ir aiškinimas. Kadangi Lietuvos teisinei sistemai būdinga juridinių asmenų rūšių įvairovė, darbo apimtis nulėmė poreikį atsiriboti nuo skirtingoms juridinių asmenų rūšims būdingų specifinių valdymo organų narių teisinio statuso bei civilinės atsakomybės problemos aspektų ir koncentruotis tik į bendriausius jų bruožus. Tyrimo tikslai sąlygojo, kad didesnis dėmesys skiriamas juridiniams asmenims, užsiimantiems ūkine-komercine veikla, kadangi būtent šie teisės subjektai dažniausiai susiduria su juridinio asmens valdymo organų narių civilinės atsakomybės problema. Visgi šiame darbe aptariami atsakomybės principai mutatis mutandis turėtų būti taikomi ir kita veikla užsiimančių juridinių asmenų valdymo organų nariams. Šiame darbe sistemiškai ir išsamiai išanalizuota juridinio asmens valdymo organų narių civilinės atsakomybės prigimtis, šios atsakomybės kilimo bei įgyvendinimo ypatumai, atskleistos aktualiausios šio instituto aiškinimo bei taikymo problemos ir, remiantis užsienio šalių patirtimi bei naujausiomis pasaulinėmis tendencijomis, pateikti teisiškai pagrįsti pasiūlymai ir rekomendacijos šioms problemoms efektyviai spręsti bei esamam teisiniam reguliavimui tobulinti. / The object of the dissertation is the legal regulation, practical application and interpretation of the civil liability of the members of management bodies of the legal entities. Whereas Lithuanian legal system is characterised by the variety of types of legal persons, the scope of the research determined the necessity to disassociate from the specific aspects of the problems of legal status and civil liability of the members of management bodies in respect of different types of legal persons and to concentrate only on common characteristics. The aims of the research determined that greater attention is paid to the legal entities engaged in economic-commercial activities, because they mostly face with the problems of civil liability of the members of management bodies. However, the principles discussed in this research should apply mutatis mutandis to the members of the management bodies of legal persons engaged in other activities. The thesis systematically and comprehensively analyses the nature of civil liability of the legal entity’s management body members, features of rise and realization of this liability, as well as reveals the most relevant interpretation and application problems of this legal institute and, on the basis of foreign experience and the latest global trends, provides legally-based suggestions and recommendations to effectively solve these problems and improve existing legal regulations.

Magistro baigiamajame darbe analizuoti universiteto valdymo pokyčiai po 2009 m. mokslo ir studijų reformos. Darbe iškelta universitetų valdymo struktūros kaitos problema, įvertinami valdymo subjektų funkcijų perskirstymo, sudėties formavimo, universitetų autonomijos bei atskaitomybės visuomenei aspektai. Lyginami Aukštojo mokslo (2000 m.) ir Mokslo ir studijų (2009 m.) įstatymai, siekiant nustatyti valdymo reformos pokyčius, apibrėžti jų privalumus ir trūkumus. Pirmoje darbo dalyje apžvelgiamas viešojo valdymo kontekstas, analizuojant viešojo valdymo paradigmą, išryškinami viešojo valdymo principai ir modernizavimo prielaidos Lietuvos aukštojo mokslo reformoms vykti. Aptariamas aukštojo mokslo institucijų valdymas, pristatoma aukštojo mokslo samprata, aukštojo mokslo institucijos vaidmuo, jos veiklos administravimas. In this work was raised a problem of change in structure of universities management, evaluated aspects of reformation of functions of management bodies, formation of structure, autonimy of universities and accountability to society. There is comparison of the Law of Higher education (2000) and the Law of Science and Studies (2009) in order to identify management changes and to discribe its advantages and disadvantages. In the first chapter is reviewed the content of public management by analysing paradigm of public management and there is highlighted principles of public management and assumptions for modernization in performing reforms of higher education area. There is reviewed the management of higher education organizations, is represented a conception of higher education, a role of higher education organization and administration of its activities. Guaranteeing the independence of election management bodies in Africa : a study of the electoral commissions of Kenya and South Africa

"Election management bodies (EMBs) have thus been established throughout the world with the responsibility of administering elctions. However, merely creating a body to administer elections does not create public conficence and integrity in the electoral process. The establishment and operation of such a body must meet the key requirements of credible election administration. One such requirement is the need for the EMB to be independent of any party. The independence of the EMB is said, by and large, to attract the confidence of all the stakeholders in the electoral process and create integrity in the process. ... However, as one scholar has observed, the lack of autonomy of EMBs from the government in some African countries is one of the major challenges to the credibility of the electoral process on the continent. It is important to note at this point that the independence of EMBs, though not in itself a guarantee of free and fair elections, determines to a large extent the overall legitimacy and acceptability of an elected government by the electorate. Flowing from this discourse is the need for the independence of EMBs in Africa, both in theory and practice, in order to enhance democracy on the continent. ... Kenya and South Africa have established EMBs to manage elections in accordance with the Universal Declaration on Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR) and the Organisation for African Unity/African Union (OAU/AU) Declaration of 2002. The Kenyan EMB has been in existence since 1991. Recently, the issue of its indpendence has become a central focus in a raging national debate on minimum constitutional reforms in Kenya. I chose the topic of my diploma thesis ?Role and Compass and Potential of Non-government Non-profit Organisations when Solving Crisis Situations and System of Co-operation between them and Bodies of Crisis Management? because I believe that non-profit organisations play a key role at providing help to people in distress. I pay high attention to the non-profit organisations which, within their compass, try to help people in distress. They attempt to mitigate the consequences of emergencies or crisis situations, which can affect any human being at any time. It was only when I started studying at the University of South Bohemia and when working for the police that I found out that the non-profit organisations which operate in the Czech Republic depend mainly on the grant policy, sponsorship and human approach of the people who are employed in these organisations or support them in whatever way. Having chosen the topic of my diploma thesis, I have tried to summarize and submit as much information for the readers of this paper to absorb as many data as possible on the non-profit organisations which work within the South-Bohemian region and are available when preparing and solving emergencies and crisis situations. I have made an attempt to describe their role, compass and employment at emergencies. The other objective of my thesis is to describe their communication within the Emergency Services and with the bodies of Crisis Management. The objective of my diploma thesis is to analyse the activities of non-government non-profit organisations when dealing with crisis situations and emergencies. Based on qualitative research, this goal was met. Nowadays, in the time of economic crises both in the Czech Republic and in the world, I must state that to secure funding, material and human resources, which would enable their workers to perform the activities given by their mission, represents for the non-profit organisations a superhuman task. The hypothesis that the system of co-operation of the bodies of Crisis Management and non-profit organisations is sufficient has been confirmed. The hypothesis that the activities of non-profit organisations when dealing with crisis situations and emergencies represent an important factor has been confirmed as well.

An assessment of the level of independence of electoral management bodies and their effects on democratisation in africa: the case of Ghana and the Democratic Republic of Congo

The basic problem in this study is to determine whether the electoral management body (EMB) in the Democratic Republic of Congo (DRC) is sufficiently independent and whether it complies with most of the criteria of an ideal independent EMB in order to conduct free and fair elections in the promotion of democracy in the DRC. However, an ideal type of an independent EMB is not easily realizable but Ghana’s electoral commission (EC) is widely regarded as a model of an independent EMB in Africa. Therefore, this study uses the EC as a workable ideal type of independent EMB that informs this study in assessing the Independent National Electoral Commission (CENI)’s level of independence. The study discovered that while the formal legal framework guarantee the independence of the CENI, it lacks practical independence due to certain factors which include the mode of appointment and composition of the body, the unstable security of tenure of its members, the negative influence of the judiciary, executive and the parliament over the functioning of the CENI, and the lack of adequate funding. The study argues that the composition of the CENI has to be depoliticized; its members should enjoy a strong security of tenure and the issue of political parties funding should be effective and handled by the CENI in order to enhance political competitiveness in the electoral process. An adequate funding should be timely realized so that the CENI carries out its work with autonomy.
