Wactenamakanicic e opikihakaniwitc : comment se manifeste le « droit » coutumier en matière de circulation des enfants chez les Atikamekw Nehirowisiwok de Manawan ?

L ’ « adoption coutumière » est reconnue officiellement au Québec depuis le 16 juin 2018. En effet, l’article 543.1 du Code civil précise que l’autorité compétente - une institution créée par l’État et désignée par la communauté ou la nation - doit s’assurer que la « coutume » en matière d’adoption est en harmonie avec le principe de l’intérêt de l’enfant, du respect de ses droits et du consentement des personnes concernées. Cette reconnaissance statutaire semble paradoxale, d’un côté elle insiste sur des modalités procédurales harmonisées, puis de l’autre, elle laisse le soin aux communautés de définir leur pratique d’« adoption coutumière » en vue de préserver le droit « coutumier » substantif. Nous aborderons ces exigences législatives dans la perspective du pluralisme juridique et de l’interdisciplinarité. Grâce à l’anthropologie juridique qui offre les outils nécessaires à une démarche empirique, j’ai réalisé des entretiens semi-dirigés en atikamekw nehiromowin. La transcription et l’analyse approfondie des données m’ont ensuite permis de conceptualiser wactenamakanicic e opikihakaniwitc, le système juridique coutumier engagé vers l’autonomisation de l’enfant. Pour décrire wactenamakanicic e opikihakaniwitc, j'ai dû prendre position comme atikamekw nehiriwiskwew nehapiskak itekera pour tenir compte de kaskeritamowina - les savoirs nehirowisiw - et de conceptualiser avec la cartographie développée par la Chaire de recherche du Canada sur la diversité juridique et les peuples autochtones. Cette description contient les 5 éléments fondamentaux que l’on retrouve dans tout système juridique soit : les valeurs, les principes, les règles, les acteurs et les processus. Par respect des Atikamekw Nehirowisiwok de Manawan, je décris ces 5 éléments par l’entremise de Kokominook-Kimocominook ; ka motewkaniok ; ka nanakatcitakaniok ; ka waskapitcik et ka nosnetakaniok.

Head in the Clouds : A quantitative study on cloud adoption in a industrial setting

The purpose of this study is to investigate which factors that influence cloud adoption and contribute to existing research about cloud computing. Ten hypotheses were derived from the Technological, Organizational, and Environmental (TOE) framework combined with the Diffusion of Innovation (DOI) framework. Data was collected using a questionnaire and 91 individuals working in several industries and different countries participated in the study. The research model was tested using a quantitative approach using partial least squares structural equation modeling (PLS-SEM). The main factors that were identified as drivers for adoption of cloud computing are: digital strategy, competitive pressure, trading partner support, standardization, firm size and network and collaboration. These findings have important implications and great value to the research field, companies and cloud providers as they could formulate better strategies for a successful cloud adoption. The study also provides a new approach in research about cloud adoption where the type of enterprise system migrated to the cloud is taken into consideration. Findings in this study points towards system specific requirements influencing the adoption rate.

6 ABSTRACT IN ENGLISH The International Adoption has been introduced to the Czech law in a greater extent, in 2000, when the Czech Republic acceded to the Hague Convention on Protection of Children and Co-operation in Respect of intercountry Adoptions (1993). The Czech Republic currently provides a relatively large number of children each year for intercountry adoption to another contracting state. Nonetheless, no complex scientific publication on intercountry adoption does not exist in the Czech Republic so far, as most of the authors of expert's articles, textbooks or commentaries continue to perceive the intercountry adoption only as a marginal complement to adoption on national basis. International adoption pursues the same objective as adoption on national, namely, to find suitable new parents for the child, always in accordance with the child's best interests. However, international adoption is much more complex, as cooperation between several administrative authorities in the Czech Republic is not sufficient to effectively protect the rights and interests of the adopted child, but it is necessary to ensure mutual cooperation between administrative authorities in two sovereign states. Il s’agit de mieux comprendre l’expérience des utilisateurs avec les technologies de quantification de soi, telles que les bracelets connectés, et de questionner la contribution réelle de ces technologies au bien-être et à la santé des individus. Le premier essai présente une revue de la littérature systématique sur la quantification de soi et un agenda de recherche pour les chercheurs en management. Le deuxième essai est une étude qualitative qui révèle les relations de pouvoir qu’entretiennent les utilisateurs avec la technologie. Le troisième essai s’intéresse aux mécanismes sous-jacents qui guident la décision de l’utilisateur afin d’identifier les facteurs d’adoption d’une technologie de quantification de soi. / This thesis by articles explores the adoption of technologies and practices of quantified-self with a critical stance. The aim is to have a better understanding of users' experiences with self-quantization technologies, such as connected bracelets, and to question the real contribution of these technologies to the well-being and health of individuals. The first essay presents a systematic literature review on quantified-self and a research agenda for business researchers. The second essay is a qualitative study that reveals the power relationships that users have with technology. Thesis submitted in fulfilment of the requirements for the degree of Doctor of Philosophy in Social Work , Faculty of Humanities, University of Witwatersrand, Johannesburg, 2017 / In South Africa, there are thousands of children who cannot be raised by their parents or relatives and consequently unrelated, legal adoption is usually considered to be in their best interests. South Africa has ratified international agreements, which emphasise that adoptable children have a right to grow up in their country of origin and intercountry adoption should be considered ‘a last resort’. The Children’s Act (No. 38 of 2005) legally entrenches several innovations to facilitate adoptable children being raised in South Africa. Accredited adoption agencies have made ongoing efforts to make adoption more accessible to South Africans, but the number of South Africans legally adopting unrelated children adoption is small and continues to decline. To help address this pressing child welfare problem, the main aim of this research was to develop a grounded theory explaining what factors affect the decision-making processes of urban black South Africans regarding legally adopting unrelated child. This population group was focused on because they presented as a promising pool of prospective adopters. It was reasoned that to facilitate domestic adoption, policy makers and practitioners need to gain a clearer understanding of what factors dissuade black South Africans from legally adopting unrelated children. A qualitative inquiry was conducted using the Corbin and Strauss approach to the grounded theory method. Personal interviews were conducted with 39 purposively selected black participants that were divided into five cohorts, namely i) adopters ii) adoption applicants in the process of being assessed as prospective adopters iii) adoption applicants who did not to enter the assessment process iv) social workers specialising in the field of adoption and v) South African citizens who have some knowledge of legal adoption practice. The grounded theory emerging was ‘Tensions surrounding adoption policy and practice and perceptions and experiences of adoption.’ Essentially this grounded theory is based on five categories: Meanings of Kinship; Information and Support; Cultural and Material Mobility; Parenthood, Gender and Identity and Perceptions of Parenting and Childhood. It is recommended that adoption policy and practice be shaped to reflect a balanced child-centred and adult-centred approach. Furthermore, recruitment strategies should be based on findings at a grassroots level. When Transracial Adoption Goes in Another Direction

This study aims to understand the experience of a non-White family trying to adopt a transracial child. ‘Transracial adoption’ is defined as a family adopting a child from a different race than theirs. My overarching focus is on how society comes to understand transracial adoption as a one-way transfer of minority children into White families, however, when the roles are reversed there is a lack of acceptance for minority families adopting transracially – specifically, when the adoptive child is White. The purpose of my study is to share my mine and mother’s life experience of fostering, social workers, child welfare and adoption so that minorities who are looking to adopt transracially may use mine and/or my mother’s life experience to help guide their adoption process if they feel they are being discriminated against. This study will also explore motivations, values, ethics and possible biases regarding transracial adoptions. Highlighting the contradictions that exist in transracial adoption practices I will use my own research as a platform for awareness of how social work practice can influence the lives of minorities who would like to adopt transracially, and for the need at both a macro and micro to create clearer transracial adoption policies for minority and White families. / Thesis / Master of Social Welfare (MSW)

Innovation adoption har etablerat sig i forskningslitteratur som den enskilda processen bestående av en serie olika etapper som man genomgår från att först höra om en produkt till att slutligen adoptera den (Rogers, 2003). Den gemensamma teorin i litteraturen för innovation adoption riktar sig till diffusionen av innovationen över tid och adoptionsprocessen som genomgår de olika s.k. “adopter groups”. Forskning belyser de osäkerheter som nya innovationer kan ha och utmaningarna med att adoptera sådana innovationer, samtidigt som man bortser från möjligheten att konceptualisera användandet av innovationen, och minska osäkerheten genom kommunikation av information som ingår i själva innovationen. Denna rapport kommer att lyfta denna klyfta i kunskap genom att bedöma inflytandet av adoptering av innovation genom att kommunicera värderingar.  Detta examensarbete baseras på litteraturstudier, kvalitativ och kvantitativ forskning samt generativa sessioner, som utgör ett komplementärt perspektiv och bidrar med kunskap och förståelse till varför, vad och hur människor adopterar innovationer samt dess konsekvenser för både företaget och dess kunder. Studien har identifierar flera kundsegment. Denna rapport visar också på möjligheterna med att minska på de upplevda osäkerheterna samtidigt som man kan öka inflytandet av adoptering av nya innovationer genom att kommunicera värderingar genom sammansättning av signaler som innehåller verbala och visuella s.k. “triggers”. Dessutom introducerar denna studie ett nytt sätt att påverka inflytandet av adoptionen av nya innovationer med avseende på tekniska tillämpningar och möjligheterna med att göra det på en mycket större skala, digitalt. / Innovation adoption has established itself in literature as the individual process which consists of series of stages one undergoes from first hearing about a product to finally adopting it (Rogers, 2003). The common theory in innovation adoption literature addresses the diffusion of innovation over time, and the adoption process it undergoes by various adopter groups. Research highlights the uncertainties novel innovations might possess and the challenges of adopting such innovations, disregarding the opportunity to conceptualize the usage of the innovation, and reduction of uncertainty through communication of information embodied in the innovation itself. This report will address this gap in knowledge by assessing the influence of innovation adoption through the communication of values. This thesis report is based on literature studies, qualitative and quantitative research and generative sessions, which serve as a complementary perspective and add knowledge and understanding about why, what and how people adopt innovations, and its implications for both the company and its customers. The study has revealed the identification of several customer segments. This report also shows the possibilities of reducing perceived uncertainties while enhancing the adoption of novel innovations by communicating values through the composition of signals containing verbal and visual triggers. Moreover, this study introduces a different way of influencing the adoption of novel innovations with regards to technological applications and the possibilities of doing so on a much larger scale, digitally.

Adoption and Implementation of Hospital IT Systems in Ambulatory Surgical Care

Purpose - The purpose of this study is to receive an understanding for how to enable higher rates of adoption implementation success of hospital IT (HIT) systems in ambulatory surgical care settings.   Method - The study is an explorative deductive multiple case-study, incorporating 15 ambulatory surgical centers situated in Sweden, Germany, and the United States. In total, 24 interviews were conducted with managers and users at the selected ASCs in three waves and analyzed through thematic analysis.   Findings - The study resulted in the identification of six barriers and eight enablers in the adoption- and implementation phase of HIT systems. In addition, an implementation framework was developed based on the findings from RQ1 and RQ2, with critical activities to execute to facilitate adoption- and implementation success of HIT systems in ASCs.   Theoretical contribution - This study adds to the literature by identifying new barriers and enablers in HIT adoption and implementation characterizing ambulatory surgical centers. Furthermore, the findings extend on previous literature by presenting an new all-encompassing implementation framework, showing the necessity to approach the implementation process as a whole process-improvement project for successful HIT adoption and implementation.  Managerial implications - This study emphasizes the important role managers in ambulatory surgical centers hold in facilitating successful HIT implementation and provides managers with a practical implementation framework to serve as a roadmap to guide them in achieving a successful implementation of HIT systems.   Limitations and future research - The study is limited to investigating adoption- and implementation of HIT systems (EHR, EMR, HIS) in the context of ambulatory surgical centers. Future studies can explore the identified barriers and enablers in more ambulatory surgical settings and extend upon the developed implementation framework.
