Novacijos institutas nėra naujas teisinis reiškinys, jo užuomazgos siejamos su romėnų teise. Vis dėlto šis institutas nepasižymi dideliu populiarumu ir nėra plačiai taikomas. Tyriamajame darbe bandoma atskleisti novacijos nepopuliarumo priežastis per išsamią jos sampratos, taikymo sąlygų, atskyrimo nuo kitų teisės institutų, teisinių pasekmių prievoliniam teisiniam santykiui ir prievolės šalių teisinei padėčiai analizę. Vertinant teisės mokslininkų pozicijas, nuomones, teismų praktikos išaiškinimus ne tik Lietuvos, bet ir užsienio valstybių mastu, darbe gilinamasi į novacijos sampratos, taikymo sąlygų, kvalifikuojančių požymių ypatumus. Tyrimo eigoje keliami diskusiniai klausimai dėl novacijos atskyrimo nuo cesijos ir skolos perkėlimo institutų, atskleidžiama probleminė sąsaja su taikos sutartimi, teismo novacija, skolos pripažinimu, prievolės modifikavimu, sutarties pakeitimu. Inter novas personas (prievolės šalies pasikeitimo) kaip novacijos elemento svarba, būtinybė ir problematika nuodugniai nagrinėjama užsienio valstybių ir istoriniame kontekste. Daug dėmesio skiriama išsamiam novacijos taikymo sąlygų tyrimui, bandoma tiksliai apibrėžti jų turinį ir apimtį. Kadangi Lietuvos teismai dažnai novaciją vertina aiškaus šalių ketinimo (animus novandi) išraiškos kontekste, darbe akcentuojama šios sąlygos analizės svarba. Research work attempts to reveal the reason for the unpopularity of novations by analyzing its concept, conditions of the application, separation from other legal institutions, legal consequences to obligatory relationship and to legal position of parties. By assessing positions and opinions of legal scholars and case law interpretations (not only on the scale of Lithuania but also foreign country wide), the research work analyze the peculiarities of the concept of novation, conditions of the application, qualificatory features. The debating questions of separating novation from debt cession and transfer institutes is raised and problematic interface with settlement agreement, court novation, debt recognition, modification of the obligation and contract amendment is revealed in the course of study. The importance, necessity and problem of inter novas personas (the change of party) as the element of novation is thoroughly examined in the context of foreign countries and history. Diplominio darbo tema- ,,Metamorfozės“. Šiuolaikiniame pasaulyje viskas sparčiai keičiasi, kinta, tobulėja, transformuojasi, galiausiai sunyksta, pasimiršta, senus vėl keičia nauja. Viskas sukasi užburtu ratu. Darbo tikslas- savo darbe spalvomis, šviesa, šešėliu perteikti savo jausmus, patirtas emocijas, pajausti piešinio ritmą. Civilinės teisinės apyvartos dalyviai neretai savo teises ir pareigas realizuoja, taikydami asmenų pasikeitimo prievolėje institutą, tačiau netinkamas minėtą institutą reglamentuojančių teisės normų aiškinimas gali tapti kliūtimi įgyvendinant ir vykdant asmenų teises bei pareigas. Todėl darbe keliama problema: kaip turi būti aiškinami kai kurie asmenų pasikeitimo prievolėje aspektai ir kokių reikalavimų turi būti laikomasi, siekiant tinkamai realizuoti kreditoriaus ir skolininko pasikeitimo sutartinėje prievolėje institutus. [to full text] / The participants of civil legal turnover often use the institute of a change of persons to implement their rights and obligations. However, inaccurate interpretation of legal norms regulating this institute may hamper the realization of the rights and obligations. Therefore, the problem arises - how some aspects of a change of persons in an obligation should be interpreted and what particular requirements should be followed in pursuance of appropriate realization of institutes of a change of creditor or debtor in a contractual obligation. In order to solve the problem pointed out this work reveals the concept of a change of persons in a contractual obligation, analyses peculiarities of regulation of the assignment of claims, factoring, subrogation and delegation of debts upon Roman law, law of some of the foreign countries and the future European Civil Code, as well as distinguishes the assignment of claims and delegation of debts from similar institutes. Darbo tikslas – išnagrinėti dabartinę Lietuvos pašto veiklą ir susieti jos kitimo tendencijas su tradicinio pašto, kaip komunikacijos rūšies, ateities galimybėmis. Darbo uždaviniai: aptarti esminius Lietuvos pašto raidos etapus, įvertinti veiklos efektyvumo kitimą (orientaciniai etapai - darbas iki ir po tapimo akcine bendrove) ir paslaugų perspektyvas; remiantis pastarųjų metų pasiekimais, išanalizuoti bendrovės pasirengimą rinkos liberalizacijai ir nubrėžti būsimo darbo konkurencinėmis sąlygomis gaires; remiantis ryšių reguliavimo institucijos apklausomis bei savarankiško kiekybinio tyrimo pagalba ištirti vartotojų nuomonę ir lūkesčius, susijusius su bendrove ir pašto paslaugomis; identifikuoti pašto sektoriaus kaitos priežastis ir pamodeliuoti galimas pasekmes bei ateities tendencijas. PLC Lithuania Post was selected as a representational model of the provider of ordinary post services in a developing state, which is highly influenced by the spread of electronic communications, in which active information society is forming and the requirements of customers for various communications services are increasing. While being state enterprise up to 2006 Lithuania Post underwent certain political control, which is inherent to the companies subsidized from state budget, which adjusted dynamics of the enterprise. However after the change of its legal status from 2006 Lithuania Post became public limited company, the shares of which still belong to the state, and got the impulse to improve the efficiency of its activity and to prepare for the full market opening of postal services. Magistro baigiamajame darbe yra nagrinėjami du asmenų pasikeitimo prievolėje būdai – reikalavimo perleidimas (cesija) ir subrogacija. Pateikiama reikalavimo perleidimo ir subrogacijos institutų istorinio atsiradimo Senovės Romoje apžvalga, analizuojamos reikalavimo perleidimo ir subrogacijos sąvokos bei šių institutų teisinė prigimtis Lietuvos bei užsienio civilinės teisės sistemose. Autorė detaliai nagrinėja reikalavimo perleidimo (cesijos) bei subrogacijos institutus, atskleidžia esmines šių institutų sampratos problemas bei prievolės šalių teisinės padėties reglamentavimo ypatumus. Darbe taip pat skiriama nemažai dėmesio santykio tarp reikalavimo perleidimo (cesijos) ir subrogacijos nustatymui. 2000 m. Lietuvos Respublikos civiliniame kodekse įtvirtintas subrogacijos teisinis reglamentavimas suponuoja išvadą, jog subrogacija yra atskira reikalavimo perleidimo rūšis. Darbe autorė suformuluoja kriterijus, kurie padeda atskirti reikalavimo perleidimo ir subrogacijos institutus ir laikyti juos dviem savarankiškais asmenų pasikeitimo prievolėje būdais. The author puts through the review of the historical development of the institutes of cession and subrogation since the times of Roman law, analyses the conceptions of assignment of claim and subrogation and legal nature of these institutes in the legal system of Lithuania and other foreign countries. The author thoroughly researches the institutes of assignment of claim (cession) and subrogation, points out the main problems arising in the field of conception of these institutes and approaches to the pecularities of the legal position of persons in an obligation. This Thesis at large scale approaches to detection of the relation between assignment of claim (cession) and subrogation. The legal regulation of subrogation, provided in the Civil code of the Republic of Lithuania, supposes the conclusion that subrogation is a particular kind of assignment of claim. In the doctoral dissertation, we consider problems of testing and estimating changed segment with unknown starting position and duration of epidemic state in the autoregressive first-order model. The proposed tests are based on partial sums of model residuals and model-parameter partial-estimator polygonal line processes. We derive asymptotic results for these processes in Holder spaces. The behavior of test statistics under the null hypothesis of no change and alternative is provided. Empirical power analysis has shown that tests are more powerful when absolute values of model parameter are quite large or autoregressive process changes from a stationary state to a nonstationary one. We prove the consistency of the least square changed-segment estimators and provide their convergence rates. / Disertacijoje nagrinėjamas pirmos eilės autoregresinio modelio pasikeitusio segmento testavimo ir vertinimo uždavinys. Aprašomo modelio epideminio pasikeitimo pradžia ir ilgis nėra žinomi. Pasiūlyti kriterijai pasikeitusio segmento testavimui, kurie pagrįsti modelio paklaidų įvertinių dalinių sumų ir modelio parametro dalinių įvertinių laužčių procesais. Šiems procesams gautos ribinės teoremos Hiolderio erdvėse. Nurodomas testų statistikų ribinis elgesys esant teisingai nulinei ir alternatyviajai hipotezėms. Iš empirinio kriterijų galios tyrimo rezultatų matyti, kad pasiūlytų testų galia didžiausia aptinkant pasikeitimus iš stacionarios būklės į nestacionarią arba esant artimoms vienetui modelio parametro reikšmėms. Taip pat įrodoma, kad mažiausių kvadratų metodu gauti pasikeitusio segmento pradžios ir ilgio įverčiai bei autoregresinio modelio su pasikeitusiu segmentu parametrų įverčiai yra suderintieji bei pateikiamas jų konvergavimo greitis.

Problems, emerging from requirements changes in software development and maintenance phases are analyzed in this thesis. Requirements for an architecture, which allow easier implementation of requirements changes, are discussed. There are analyzed world spread architectures, which ease the maintenance of the software. Also there is analyzed the three tier architecture implementation in the project “distributed basketball competition registration and analysis software”, analysis subsystem. The cons and pros of implemented architecture are discussed also.

We study some Hölderian functional central limit theorems for the polygonal partial sum processes built on a first order nearly nonstationary autoregressive process and its least squares residuals Innovations are i.i.d. centered and at least square-integrable innovations. Two types of models are considered. For the first type model we prove that the limiting process depends on Ornstein – Uhlenbeck one. In the second type model, the convergence to Brownian motion is established in Hölder space in terms of the rate of coefficient and the integrability of the residuals. We also investigate some epidemic change in the innovations of the first order nearly nonstationary autoregressive process . We build the alpha-Hölderian uniform increments statistics based on the observations and on the least squares residuals to detect the short epidemic change in the process under consideration. Under the assumptions for innovations we find the limit of the statistics under null hypothesis, some conditions of consistency and we perform a test power analysis. / Disertacijoje nagrinėjami dalinių sumų laužčių procesai sudaryti iš pirmos eilės beveik nestacionaraus proceso bei jo mažiausių kvadratų liekanų.
