Determination of Parenthood - Alexandra Hrušáková Abstract In my thesis "Determination of Parenthood", I focused on the largest area of family law. Everyone's life is influenced by his family the whole life. And there are many consequences connected to the relation between a child and his parents. My topic responds lively to the changes brought by current scientific and technical progress and dynamic development and metamorphoses in our society. I tried to describe it in a complex way, but in order to put accent on the most important segments of this problem. From the times of ancient Rome there exists the principle "mater semper certa est, pater incertus", which means that the identity of the mother is always certain, but the father isn't. However there exist some situations in which the principle could not be so clear. These situations created objective of this thesis. This thesis is divided into ten chapters. Fine scale genetic structure and extra-pair parentage in the socially monogamous Upland Sandpiper

Sandercock / Samantha Wisely / In birds, the offspring of females in socially monogamous species can be sired not only by their social partner (within-pair mating) but also by other males (extra-pair mating), resulting in broods of mixed paternity. Several hypotheses have been proposed which attempt to explain the adaptive significance of this behavior, including the genetic diversity hypothesis, the good genes hypothesis, the genetic compatibility hypothesis and the fertility insurance hypothesis. I report results of a 5 year population study of the Upland Sandpiper (Bartramia longicauda) at Konza Prairie Biological Station in northeast Kansas. My objective was to determine the genetic mating system of this socially monogamous shorebird, and determine which of the genetic hypotheses best explains the patterns of extra-pair paternity (EPP) in the population. As part of the analysis, I optimized laboratory protocols for genetic sexing of our monomorphic study species. Potential errors in molecular sexing have been previously described but usually result in females being misidentified as males. Here, I report evidence that events in PCR reactions can lead to the opposite error, with males misidentified as females. I recommend the use of multiple primer sets and large samples of known-sex birds for validation when designing protocols for molecular sex analysis. I genotyped birds and tested for the existence of EPP in 58 family groups of Upland Sandpipers. I found 15% of chicks and 30% of broods were the result of extra-pair paternity in this population, which is high in comparison to other socially monogamous shorebirds. Only 2% of chicks and 2% of broods were attended by females unrelated to the young. I tested ecological covariates known to influence EPP in other birds including relatedness of mated pairs, morphology of the within-pair male, and nest initiation date, as well as variables which signify genetic benefits, including morphology of the offspring and offspring heterozygosity, but found no significant relationships. None of the prevailing genetic hypotheses can fully explain the high rates of EPP in this population of Upland Sandpipers. However, the discovery of fine-scale genetic structure in female birds, but not in males, suggests female natal philopatry or male-biased dispersal. This sex-specific genetic structure could be a mechanism of inbreeding avoidance, thereby eliminating the need for females to choose mates based on relatedness. This study provides the first estimates of EPP for the socially monogamous Upland Sandpiper, and provides evidence that the inbreeding avoidance mechanism of engaging in extra-pair copulations does not seem to be as important in Upland Sandpipers as in other socially monogamous shorebirds. Future research should include the identification of extra-pair males and the determination of offspring fitness after departure from the nest.

Insights into the mating systems of green turtle populations from molecular parentage analyses

Gaining a good understanding of marine turtle mating systems is fundamental for their effective conservation, yet there are distinct gaps in our knowledge of their breeding ecology and life history, owing largely to the difficulty in observing these highly mobile animals at sea. Whilst multiple mating by females, or polyandry, has been documented in all marine turtle species, the fitness consequences of this behaviour have not been fully investigated. Furthermore, male mating patterns, operational sex ratios and the number of males contributing to breeding populations are poorly understood, impeding accurate assessments of population viability. In this thesis, I use molecular-based parentage analysis to study, in detail, the genetic mating system of two green turtle (Chelonia mydas) populations. In the focal population in northern Cyprus, I show that, despite exhibiting a strongly female-biased hatchling sex ratio and contrary to our expectations, there are at least 1.3 breeding males to every nesting female. I go on to assess the breeding frequency of male turtles in the population and determine that males do not breed annually at this site, demonstrating that the observed relatively equal sex ratio of breeders is not the result of a few males mating every year, but that the number of breeding males in the population is greater than expected. I show that 24% of nesting females in the population produce clutches with multiple paternity, but do not detect any fitness benefits to polyandrous females, and discuss the potential role of sexual conflict in influencing female mating decisions. Finally, I reveal a high frequency of multiple paternity in green turtle clutches on Ascension Island, one of the largest green turtle rookeries in the world, and discuss possible causes of variation in the level of polyandry among marine turtle populations. The results presented here shed new light on aspects of marine turtle mating systems that are challenging to study, and illustrate the value of molecular data, not only in describing mating patterns, but in elucidating aspects of life history and behaviour that would otherwise be very difficult to ascertain.

The theme is reflected in the work with regard to its historical legal developments, including the reflection of the current Czech legislation. Mentioned is also legislation in terms of international law. It often represents the direction of Czech legislation. The main idea of the domestic legislation parenthood child's interest and the protection of basic human rights. The child is seen as a specific body of legal rules with all its peculiarities and increased need for legal protection with regard to their position in society. Reproductive Medicine currently represents one of the fastest growing medical fields. The birth of Louise Joy Brown as the first baby conceived in vitro fertilization or in vitro, is considered being the historic milestone in development of the treatement methods in assised reproducion. Ethical discussions regarding the admissibility of these methods have developed as a result of technological advance of the infertility treatment. Adequate response of applicable law was required on the currant state of medicine which resulted in the need to regulate legally this field whether it's about establishing of assumption of fatherhood with regard to determination of fatherhood of a child conceived through artificial insemination, as well as determination of the basic conditions for the access to assisted reproductive techniques. Originally, the legislation of artificial insemination was defined only in the implementing regulation of the Ministry of Health, as the reproductive technologies were entirely new area. Active fatherhood as a part of family policy in EU Abstract The main objective of this thesis is to explore the conditions that determine the active involvement of men in the care of children in European Union member states and to analyze the impact of active fatherhood on the economic activity of women and fertility. A part of this study is a typology of family leaves with regard to the possibilities of fulfilling nature of active fatherhood, analysis of legislative conditions connected to paternity and parental leave as well as analysis of the Eurobarometer 59.1 survey dealing with the attitudes of men to use parental leave and the circumstances of these attitudes. The relationships between the main factors that influence the decision making of men about their participation in the care of the youngest children are analyzed and there is also tested the effect of this decision. In conclusion, the study outlines the development of conditions of childcare by men and summarizes proposals of legislative changes in conjunction of the studied issue in the Czech Republic.

The purpose of this thesis is to examine the legislation of parental leave in the Czech Republic and in Sweden in particular with respect to the possibilities of work-life balance, to evaluate an actual use of the system, its impacts on the individual labour markets and gender equality, to subsequently compare these two models and to propose amendments of legislation. The topic was chosen due to its significant impact on a vast amount of people and due to its currency with respect to a progressive change of perception of single parent's roles. The thesis is divided into five chapters following the main aim of the thesis, a comparison of several legislations. The first Chapter shortly describes the main terminology which has been used within the thesis and which is the main subject matter of the paper. In the first chapter there is a theoretical discussion about concepts of old age and aging, taking into account the notion of culture and how this culture indicates a large heterogeneity on issues related to old age and aging. Some examples of elders who exert or wish to exercise paternity and maternity through artificial insemination or adoption are highlighted. The second chapter focuses on adoption, its history and evolution in Brazil, reaching the current legislation defining cases for adoption. Taking into account that the legislation that guides and defines the case for adoption is the Child and Adolescent Statute (ECA), this statute does not define a maximum age for applicants interested in adoption. In the third chapter, the issue of old age and adoption appear united and there is an analysis of how the assessments of elders interested in adoption are conducted. This dissertation interprets how social workers of the Forums in the ABCD region - Santo André, São Bernardo, São Caetano do Sul and Diadema - who mediate the assessment processes for the qualification of elderly adopters, interpret the paternity and maternity of children and adolescents in the old age / Este trabalho discute a possibilidade de adoção de crianças e adolescentes por pessoas idosas. No primeiro capítulo, faz-se uma discussão teórica sobre conceitos de velhice e envelhecimento, focalizando a heterogeneidade no que se refere a essas questões, pelo viés da noção de cultura. São destacados alguns idosos que desejam ou que já exercem a paternidade e maternidade, nesta fase da vida, de filhos advindos de inseminação artificial ou pelo processo de adoção. O segundo capítulo aborda o histórico e a evolução da adoção no Brasil, chegando até a atual legislação que define e norteia os procedimentos que devem ser considerados quando se trata de adotar crianças ou adolescentes.
