COMPARISON BETWEEN CLIENTS IN FORENSIC-PSYCHIATRIC TREATMENT AND PRISON IN SWEDEN 1995-2018

Abstract Purpose: The study aims to establish a summary of the main characteristics of gender, age, types of crimes and previous criminal records of the offenders sentenced to forensic-psychiatric care in the time period 1995 to 2018 in Sweden and to compare them with offenders sentenced to imprisonment for the same types of crime types in the same time period in Sweden as well as to link different types of crimes to mental illness. Furthermore, the study attempts to find correlations between the group sentenced to forensic-psychiatric care and different types of crimes. Method: Using official statistical data from BRÅ, serious crimes, age, gender and criminal records for all individuals sentenced to forensic-psychiatric care during 1995 to 2018 are described together. This group was compared to all individuals which were convicted to prison in the same period. Furthermore, correlations between types of crimes and the group of individuals sentenced to forensic-psychiatric care were examined in order to find any statistical difference between the two groups. Result: A few differences between the groups were found. The individuals in the forensic-psychiatric care group did not differentiate much in age, and also had similar criminal records, unlike the prison- group. Additionally, a meaningfully higher amount of women was prevalent in the forensic psychiatric care-group compared to the prison-group. A small correlation between individuals sentenced to forensic psychiatric treatment and arson were confirmed as well as stronger correlations with offenders sentenced to FPT and crimes of theft, vehicle theft, arson and homicide were found. Conclusion: These findings provide data for future research as well as potential support for courts to identify more suitable treatment for offenders with a mental illness. Additionally, the findings in this paper presents the health care system and social services with opportunities to analyse and prevent trajectories into more serious offending in particular regards to individuals who are young and/or have a mental disorder.

De anhörigas perspektiv av ett frihetsberövande är i stor utsträckning av forskning förbisedd trots den ökande kriminaliteten i samhället. Syftet med studien är således att undersöka hur en individ påverkas av att vara anhörig till en frihetsberövad genom att granska den anhörigas livssituation. Livssituationen inbegriper sysselsättning, ekonomi, bemötande från andra samt relationer. Studien grundar sig i en kvalitativ metodansats med ett målstyrt urval bestående av nio mödrar, systrar och kvinnliga partners till de frihetsberövade. Det empiriska materialet har analyserats utifrån ett hermeneutiskt perspektiv. Studiens resultat belyser den påverkan som ett frihetsberövade har på anhörigas livssituation. Flertalet anhöriga vittnade om förändrade relationer inom familjen, till den frihetsberövade eller till sina vänner. Gällande ekonomi förklarade ett antal frihetsberövade att deras ekonomi hade förbättrats medan andra såg sin ekonomi som försämrad. Några personer förklarade att frihetsberövandet hade fört med sig nya utgifter. Studiens slutsats är således att ett frihetsberövade påverkar relationer, dock varierar omfattningen. Påverkan på vänskapsrelationer är liten eller obefintlig medan familjerelationer kan drabbas av konflikter och splittringar. Samtidigt kan både familjerelationerna och relationen till den frihetsberövade förbättras. Besök samt brev- och telefonkontakt är väsentligt för att upprätthålla kontakten med den frihetsberövade. Anhörigas ekonomiska beror ofta på ändrade livsförhållanden, påverkan på sysselsättning eller nya utgifter. Eventuella fördomar mot anhöriga till frihetsberövade kommer från media och sociala medier, inte från vänner eller familj. / Relatives to incarcerated individuals are an overlooked group in the research despite today's increasing number of crimes in society. This study aims to investigate how a person is affected by being a relative to an incarcerated individual by reviewing the relative's life situation. The life situation embraces employment, finance, treatment from others, and relationships. This study establishes a qualitative approach with a goal-directed selection consisting of nine mothers, sisters, and female partners to the prisoners. The empirical material has been analyzed through a hermeneutic perspective. The results of the study highlight the impact that deprivation of liberty has on the life situation of relatives. Several relatives reported changes in relationships within the family, with the individual deprived of their liberty, or with their friends. Regarding the economy, some individuals deprived of their liberty explained that their economic situation had improved while others saw theirs as deteriorating. Some individuals explained that deprivation of liberty had brought new expenses.   The conclusion of the study is therefore that deprivation of liberty affects relationships, though the extent varies. The impact on friendships is minimal or non-existent, while family relationships may suffer from conflicts and divisions. At the same time, both family relationships and the relationship with the individual deprived of their liberty can improve. Visits, as well as letters and phone contact, are essential to maintain contact with the individual deprived of their liberty. The financial situation of relatives often depends on changed life circumstances, impact on employment, or new expenses. Any prejudices against relatives of those deprived of their liberty come from the media and social media, not from friends or family.

The name of my thesis is Alternatives of unconditional sentence of imprisonment. Because of a very wide range of alternative of unconditional sentence of imprisonment, I concentrated on suspended sentence, community service, house arrest and fine. I tried to present proposals base on studying laws, judicial decisions, czech and foreign literature. My compulsory work also examines legal regulations in the other countries in order to confrontation with Czech legal regulation and contains de lege ferenda reflections. The Austrian legal regulations of alternatives to imprisonment have been chosen for the purpose of this work, because their systems are close to the system of Czech criminal law. The thesis is divided into six chapters and some of them are divided into subchapters for better clarity. The first chapter is concerned with the concept of punishing. It is subdivided into two other parts. The first one deals with term of the punishment and the second one describes the purpose of the punishment. Denna studie utforskar återanpassningsprocessen och upplevelsen av stämpling bland före detta fängelsedömda individer i Sverige, med fokus på hur dessa erfarenheter påverkar deras återinträde i samhället. Genom kvalitativ analys av intervjuer från podcasten ”Utanför Murarna”, som innehåller intervjuer med före detta fängelsedömda, visar studien hur stämplingsteorin tar sig uttryck i deras vardagsliv. Studien belyser svårigheterna med att hitta boende och arbete som före detta fängelsedömd, samtidigt som den tar upp den dubbla stämpling som är relaterad till diagnoser som adhd och utmaningar som fängelsedömda mammor möter. Metodologiskt bygger studien på kvalitativ innehållsanalys av transkriberade podcastintervjuer, där fokus ligger på återanpassningsstrategier och påverkan av samhällelig stämpling. Resultaten pekar på strategier som ärlighet och undvikande, samt betydelsen av stöd från familj, vänner och rehabiliteringsprogram. Studien understryker behovet av en mer inkluderande och förstående samhällssyn gentemot före detta fängelsedömda för att understödja en effektiv återanpassning. Slutsatserna betonar vikten av att riktade stödinsatser och individanpassade program tillämpas för att adressera de specifika behov och utmaningar som före detta fängelsedömda individer möter. / This study explores the reintegration challenges that former prison inmates in Sweden face, especially caused by societal labeling through the lens of labeling theory. Using qualitative analysis, this study explores podcast interviews with former prison inmates, revealing their perceptions and experiences of reintegration. Previous research highlights the difficulties of finding housing and employment as an ex-convict, while addressing the double stigmatization as a consequence of labeling for diagnoses such as adhd and challenges faced by formerly incarcerated mothers. Accordingly, the findings of this study highlight the complexities of societal reentry, where former prison inmates struggle with societal labeling, employment, and housing issues. Strategies used by former prison inmates, such as honesty, avoidance, and earning their place in society, are examined. Additionally, the positive influence of support systems like family, housing assistance, and rehabilitation programs is highlighted. The study contributes to understanding the reintegration process, suggesting implications for policy development and interventions in criminal justice and social services. The findings also indicate areas for further research, particularly around societal labeling and effective reintegration practices.

Sociální začleňování osob propuštěných z výkonu trestu / Social Including of Convicted Offenders Left from Prison

The title of the thesis is Social Integration of People Released from the Prison. The theoretical part describes current situation concerning living conditions of the people sentenced to the prison, that are determined by legal standards in Czech Republic and by internal regulations of each jail house. These conditions form the personality of convicts and influence their social situation, relationships, and connections. The convicts need after the release to be helped with their integration into the society the most and also to be helped with handling their social situation to avoid recidivism. The aim of the diploma work is to describe problems of individuals released from the prison and the process of resocialization in detail. The thesis also provides the survey of possibilities for helping these people, thus service provided for people with inability to adapt to a society and types of facilities dealing with this target group. The practical part was conceived as the qualitative research in form of case studies using semi-structured interviews with the individuals released from the prison. I asked eight clients 28 questions in following categories: social situation of clients before the sentence, their life while imprisoned, their return to freedom and cooperation of the clients with institutions. There was also performed subsidiary quantitative research within the diploma work. I inquired social workers supervising released adults two questions, using e-mail correspondence. The questions were concerning the most frequent problems they had to deal with, after a client was released from the prison, and also services in Czech Republic{\crq}s system that workers missed in helping the target group. I outlined the comparison of the results coming out of my investigation with the current situation in related area, and also with other investigations at the end of my thesis. I recommend for improving the situation of the released individuals from prison to establish institutions with complete range of assistance, multi focused team, and the support in employing the people with criminal records as the high quality instrument of their social integration.

Post-penitentiary treatment and prevention of recidivism The subject of the submitted thesis is the issue of post-penitentiary treatment and prevention of recidivism and its definition within the Czech legal framework. The thesis is divided into four main chapters which are further divided into subchapters. The first chapter analyses the key concept of the subject of the thesis - that is criminal recidivism, its possible concepts and types. Additionally, this chapter describes the reflection of criminal recidivism in the current Czech legislation, particularly in relation to the determination of the type and severity of penalties of recidivistic offenders. This chapter also deals with the causes of recidivism as an essential prerequisite for the application of appropriate treatment and care within the scope of the penitentiary and post-penitentiary treatment. The second chapter deals with the possible ways of preventing recidivism and is further divided into four subchapters. The first two subchapter describe the system and the purpose of the penalties in the prevention of recidivism, the issue of imposing these penalties on recidivist offenders and the issue of an unconditional prison sentence and the related negative consequences with this type of penalty. La sanction des infractions délictuelles constitue le nœud gordien d’une politique pénale contemporaine largement désapprouvée. Privilégiée, la peine privative de liberté manifeste de multiples défaillances portant atteinte à sa crédibilité. Les peines d’emprisonnement inférieures ou égales à cinq ans exécutées principalement en maison d’arrêt sont les plus problématiques car nombreuses. Elles sont le plus souvent inadaptées à la délinquance contemporaine. Si des alternatives, déjà anciennes et d’autres plus récentes, existent, elles ne sont que peu prononcées alors même que leur utilité sociale en matière de réinsertion et de lutte contre la récidive ne paraît plus à prouver. La punition hors les murs de l’infraction délictuelle est une thématique politique et législative récurrente. Cependant, elle ne parvient pas à s’ancrer véritablement dans le paysage judiciaire français ; son enracinement étant notamment freiné par le défaut d’adhésion des magistrats en partie conditionné par des mécanismes procéduraux pourvoyeurs de peine privative de liberté. L’heure du changement de paradigme a pourtant sonné dès lors que la peine d’emprisonnement ne permet pas d’agir sur les causes de l’acte infractionnel et du passage à l’acte. Il est également temps de soulager une situation carcérale exsangue ne permettant plus à l’Administration pénitentiaire d’assurer convenablement ses missions de garde et de réinsertion. Albert Camus écrivait qu’une société se juge à l’état de ses prisons, la société française ne peut persister à épandre une telle incarnation de sa politique pénale. Aussi, au travers de mécanismes procéduraux perfectionnés, de l’influence d’exemples positifs du droit comparé, grâce au faire-valoir des ressources intrinsèques des services pénitentiaires d’insertion et de probation, à la rédaction nouvelle d’articles fondamentaux du Code pénal et au déploiement de moyens adéquats, la punition hors les murs des délits passibles de cinq ans d’emprisonnement devient accessible et tangible. / The penalty of the criminal breaches constitutes the Gordian knot of a widely disapproved contemporary penal policy. Privileged, the custodial sentence shows multiple failures striking a blow at its credibility. The lower prison sentences or five-year-old equals executed mainly in detention center are the most problematic because numerous. They are badly adapted for the contemporary crime. If alternatives, already older and others more recent, exist, they are only little pronounced even though their social utility regarding rehabilitation and regarding fight against the repeat offense does not any more appear to prove. The punishment outside the walls of the criminal breach is a recurring political and legislative theme. Nevertheless, it does not succeed in anchoring really in the French judicial landscape; its implanting being slowed down in particular by the defect of membership of the magistrates partially conditioned by procedural mechanisms suppliers of custodial sentence. The hour of the change of paradigm nevertheless rang since the prison sentence does not allow to act on the causes of the unlawful act and the acting out. It’s also necessary time to relieve a pale prison situation not allowing anymore the Prison Service to assure suitably its missions of guard and rehabilitation. Albert Camus wrote that a society judges itself in the state of its prisons, the French society cannot persist in spreading such an embodiment of its penal policy. So, through sophisticated procedural mechanisms, the influence of positive examples of the comparative law, thanks to the use of the intrinsic resources of the prison departments of insertion and probation, to the new writing of fundamental articles of the Penal code and to the deployment of adequate means, the punishment outside the walls of the offences punished for five years of detention becomes accessible and tangible.

Well, the study of prisons and their (correct) functioning necessarily lead to the study of law to punish the state and own imprisonment. Now what legitimizes the state to segregate one of its members and interfere with their way of life, imposing the restriction of certain legal rights? What do you want the state to impose a prison sentence, in other words, to segregate an individual for a certain period of time, conscious of his return to the bosom of society? Well, this thesis is dedicated, in its first two chapters, answer these questions and establish what function pen in a democratic state. From there, it becomes possible to analyze the Brazilian prison system: if the prisons are intended to serve the sentence in prison, they must necessarily be structured to achieve the function of this same penalty. The Chapters 3 and 4 are intended, in this sense, to demonstrate the current reality of the prison system, if it lends itself to the fulfillment of the function that it is intrinsic and, if not, it is possible to design public policies aimed at achieve this very purpose. / Trata o presente trabalho acerca do sistema prisional brasileiro e, portanto, dos estabelecimentos destinados ao cumprimento da pena privativa de liberdade, sanção mais grave que pode ser imposta, no ordenamento jurídico brasileiro, a quem realiza uma conduta considerada intolerável pelo resto da comunidade. Pois bem, o estudo dos estabelecimentos penais e de seu (correto) funcionamento conduz necessariamente ao estudo do Direito de punir do Estado e da própria pena de prisão. Ora, o que legitima o Estado a segregar um de seus membros e interferir em seu modo de vida, impondo a restrição de certos bens jurídicos? O que pretende o Estado ao impor uma pena de prisão, ou seja, ao segregar um individuo por determinado período de tempo, consciente de seu retorno ao seio social? Bom, a presente dissertação se dedica, em seus dois primeiros capítulos, a responder essas questões e estabelecer qual a função da pena em um Estado Democrático de Direito. A partir daí, possível se torna a análise do sistema prisional brasileiro: se os estabelecimentos penais são destinados ao cumprimento da pena de prisão, eles devem necessariamente estar estruturados de forma a alcançar a função desta mesma pena. Os capítulos 3 e 4 se destinam, neste sentido, a demonstrar a atual realidade do sistema prisional brasileiro, se ele se presta ao cumprimento da função que lhe é intrínseca e, em caso negativo, se é possível a elaboração de políticas públicas que visem a alcançar essa finalidade essencial.

This thesis deals with the application of the fine arts with much focus on the development of personality on people serving prison sentences. The content of this thesis is divided into theoretical and practical chapters. First part defines some key terms of including the program of rehabilitation and pedagogical events that are used in this specific environment. The practical chapters are devoted to the realization of own longer-term didactic project named ?Kordelie? which is concerned with the positive thinking, values, and the development of competences at the target group of occupationally unclassified sentenced women in the custodial prison České Budějovice. Based on the application of these sets of activities and their consequent evaluation, I am obliged to observe the real possibility of fine art inclusion in didactic projects to individuals in correctional facility.
