A teoria sistêmica autopoiética e a juridicização temporal: o recurso externo da linguagem visual ao tempo útil do direito processual

E, nesta esteira, se aproveita esse novo método para o presente estudo. Do exame sobre a conceituação sobre o tempo, em suas mais distintas versões, pode-se chegar a uma ideia de tempo útil a ser explorada no âmbito jurídico. A problemática existente entre o tempo e o processo judicial, principalmente quando este deve se realizar sem os extremos ditados pela rapidez, tampouco pela morosidade, é tema atual e mundial. Por essa razão, a ideia de um tempo justo, como aquele vinculado a uma temporalidade processual útil, ganha espaço no cenário jurídico. Ademais, um processo judicial temporâneo, já que proveitoso por sua eficácia, resta próprio da consagração dos valores básicos dos direitos do homem. Ocorre que um mundo de expressiva quantidade de informações, as quais não se comprometem com a qualidade de conteúdo, resulta por provocar o sistema jurídico. A existência de uma nova sociedade, caracterizada pela rápida temporalidade, por certo reflete no Direito. E, assim, as irritações originadas pela sociedade, em razão de seu tempo social de velocidade extrema, restam processadas pelo Direito e permitem os aparecimentos de outras lógicas como fundamento da decisão. Dessa forma, o trabalho analisa a diferenciação consubstanciada no Direito Processual, destacando que se trata de um próprio direito e que promove operações recursivas, sempre através de seus elementos constitutivos e suas estruturas, em obediência ao esquema binário legal/ilegal. Mas, como o mundo atual reclama por uma temporalidade justa aos processos judiciais, se busca um recurso fora do Direito, a fim de auxiliar em sua funcionalidade perfeita. Assim, provoca-se a possibilidade de o Direito aproveitar o recurso externo da linguagem da imagem como uma benéfica razão, a fim de aperfeiçoar a temporalidade do processo. Veja-se que essa espécie de comunicação permite uma maior quantidade de cognição, a qual resta produzida em menor tempo. Nessa linha, o estudo segue no sentido de que a linguagem da imagem é uma forma de racionalizar a temporalidade processual, pois se trata de uma comunicação conveniente como alternativa para o justo tempo processual. Por certo não se pretende substituir integralmente a linguagem da palavra pela linguagem da imagem na processualística, porém estabelecer a possibilidade de um aproveitamento maior desta espécie de comunicação, já que o visual pode se adaptar à técnica e a outras condições exigidas no processo judicial. / Through Luhman’s system and autopoietic theory one observes the existence of another pattern of observation of law. And this way,we use this new method in the present study. From examining the concept about time in its several distinct versions, one can get to an idea of useful time to be explored in the legal field of action. The existing problem between time and legal proceedings, especially when this must happen without extremes dictated neither by speed nor by slowness, is a topic present all over the world. Therefore,the idea of a fair time as that one related to a useful processual temporality grows in the legal scenario. Moreover, a temporal legal proceeding, advantageous for its efficacy i s proper for the consecration of the basic values of men’s rights. It occurs that an expressive amount of information which does not promise quality of content ends up provoking the legal system. The existence of a new society characterized by fast temporality reflects in Law, for sure. So, the exasperation originated by society because of its social time of extreme speed are processed by Law and allows the appearance of other logics as basis for decision. This way, this paper analyses the consubstantiated differentiation in Processual Law, underlining that it is a proper right and it promotes judicial appeals always through its constitutive elements and its structures, obeying the binary scheme legal-illegal. But, as the present world claims for a temporality fair to law suits, one seeks resources out of the law in order to help its perfect functioning.This way one provokes the possibility for law to take advantage of the external resource of the language of image as a beneficial ratio in order to improve the temporality of proceedings. Notice that this kind of communication allows a bigger quantity of cognition, which is produced in shorter time. The study continues in this line, in the sense that the language of image is a way to rationalize the processual temporality, for it is convenient communication as an alternative for fair processual time. Certainly, one does not intend to totally substitute language by image in processualistic, but to establish the possibility of a bigger use of this kind of communication since the image can adapt to technique and to other conditions asked for in legal proceedings.

Le temps dans la procédure pénale sénégalaise / Time in Senegalese criminal procedures

Le temps pénal, à la lumière de la pratique judiciaire sénégalaise révèle, à l'instar des législations progressistes, l'émergence d'un phénomène d'effritement de la loi procédurale face à un contentieux hétérogène complexifié par l'enchevêtrement d'éléments d'extranéité, des ramifications sous-régionales. Ces ingrédients, densément composites, ont fondamentalement désaxé la temporalité processuelle. Le dérèglement du temps pénal est la conséquence d'un pullulement de règles dérogatoires occasionnant un véritable millefeuille pénal. La pathologie de l'appareil judiciaire sénégalais est que la justice pénale s'enlise et reste peu lisible. Elle est empreinte d'inefficacité, de lenteurs endémiques. Cette étude est un réel prétexte, ayant permis d'indexer avec vigueur les lacunes saillantes d'une règle procédurale importée et fragmentée. À cet égard, il est nécessaire de cristalliser l'attention sur l'improductivité des réformes ponctuelles et contingentes, proposer une issue à ce labyrinthe procédural et poser le soubassement d'un humanisme pénal, fondé sur le consensualisme clé de voûte de la nouvelle figure du procès pénal. Ce processus de déjudiciarisation conforte la priorisation de la modulation du temps de la réponse pénale comme vecteur de qualité de la justice. L'édification d'une charpente d'une nouvelle politique criminelle passe par un modèle de droit processuel plus lisible, performant qui recentre l'idéal de justice pénale sur un mode de traitement de l'infraction plus cohérent en phase avec les exigences de droits de l'homme pour remplir les fonctions essentielles d'une justice juste et équitable. / Penal time, in the light of the Senegalese legal practice reveals, following the example of liberal legislations, the emergence of a phenomenon of flaking of the procedural law vis-a-vis a heterogeneous litigation made more complex by the tangle of extraneous elements, sub-regional ramifications. These ingredients that have basically offset procedural temporality, call undoubtedly for a differentia processing of the infringement. The deregulation of the penal time is the consequence of a proliferation of derogatory rules causing a true penal cream slice. The pathology of the Senegalese legal apparatus is that criminal justice is getting stuck and remains not very readable This study is a real pretext, having made it possible to stress with strength the salient gaps of an imported and split up procedural law. In this respect, it was of a burning need to focus the attention on the unproductiveness of the specific and contingent reforms, by suppressing the culture of slowness, proposing a solution to this procedural labyrinth and posing obviously the base of a penal humanism based on the consent, the keystone of the new face of the criminal trial. The construction of a frame for a new criminal policy passes by a model of more readable, efficient procedural law which focuses the ideal of criminal justice on a more coherent mode of management of the infringement in tune with the requirements of human rights to fulfill the essential functions of a fair and equitable justice law.

Les recours individuels directs devant la juridiction constitutionnelle : (Allemagne, Autriche, Belgique, Espagne) : contribution à une approche processuelle de contentieux constitutionnel / Direct constitutional complaints before the Constitutional Court : (Austria, Belgium, Germany, Spain) : a contribution to a processual approach to constitutional litigation

Les recours individuels directs devant la juridiction constitutionnelle sont marqués par une forte originalité. Leur originalité se caractérise tant par la possibilité qu’un individu puisse accéder sans intermédiaire au prétoire du juge constitutionnel, que par la diversité des actes contestables devant ce juge et par cet individu. Afin d’appréhender les diverses formes de recours individuel direct en Allemagne, Autriche, Belgique et Espagne, il convenait de mobiliser un instrument qui mette en évidence cette double spécificité d’études : le droit processuel. Celui-ci se définit en effet par l’ambition de traiter les divers contentieux de manière comparée, au-delà de leur nature particulière.Cette démarche comparative permet plus spécialement de relativiser le clivage droit privé/droit public : tandis que le droit processuel trouve habituellement son terrain d’élection dans le droit judiciaire privé, alors que le contentieux public est accaparé par la dimension du « procès fait à un acte », l’analyse des recours individuels directs permet d’appréhender pleinement le contentieux constitutionnel comme structure procédurale de protection des droits. Le droit processuel permet ainsi d’analyser les recours individuels directs comme forme entièrement développée de recours en protection des droit devant la juridiction constitutionnelle, forme qui n’existe pas en France : il permet une mise en perspective de notre culture juridique centrée sur la conformité juridique objective des actes. / Direct constitutional complaints before the Constitutional Court appear as a strongly original procedure. It is caracterized both by the possibility for an individual to have direct access to the Court and by the wide variety of the legal acts that can be challenged there. The analysis of the diverse forms of direct constitutional complaints in Austria, Belgium, Germany and Spain requires a conceptual framework that allows those two characteristics to stand out: processual law. Processual law can be defined by its ambition to consider various kinds of litigation in a comparative way beyond their specific nature. This comparative approach especially allows for a relativisation of the public law/private law distinction. In France, processual law is generally used in private litigation context, whereas public litigation is more focused on the “procès fait à un acte” dimension. By contrast, the analysis of direct constitutional complaints through processual law sheds a specific light on it as a procedural structure directed towards the protection of rights. In other words, direct constitutional complaints appear in this light as a fully developed form of procedure for the protection of rights, a form that does not exist in France. Our legal culture which is focused on the question of the objective legal conformity of acts is thus put into a new perspective.
