Relationship Between Private and Public Law: Past and Present Abstract This dissertation addresses the dualism of private and public law from Roman times to the present. It focuses on developments in the content of these concepts in a historical context. The dissertation examines primary sources from Roman law and highlights the significant difference between the distinction between private and public law in Roman law and later misinterpretations of the same. Particular attention is paid to the approach legal science takes to private and public law through the various phases of reception of Roman law, noting the political circumstances that led to the use of the dual concepts of ius publicum and ius privatum from Roman law as well as the change in content of those concepts. The dissertation compares the main differences between modern society and the earlier social system, especially with reference to the socio-legal structure of relationships. It describes the modern ideological sources of values on which modern society is based and traces the ways these values are reflected in modern legal systems. American Unwritten Constitutionalism

This dissertation explores contemporary American unwritten constitutionalism in three areas of public law: constitutional theory, election law, and administrative law. Drawing on methods familiar to political theory—analytic political philosophy and intellectual history—it offers a way of analyzing constitutional phenomena beyond legal reasoning tethered to text. The first essay uses social philosophy to build a theory of constitutional norms that explains their salient features and functions. The second essay builds a framework for understanding the concept of representation in the law of democracy. It uses political theory to reveal the latent normative questions animating election law doctrine. The third and final essay recovers the lost and contested origins of presidential administration during the Reagan administration. It shows how the combined efforts of executive branch lawyers, judges, and academics decisively brought the administrative state under presidential control and laid the foundations for the emergence of a plebiscitary president. Together these essays provide proof of concept for the dissertation’s central methodological claim: the need to move beyond text and legal reasoning in understanding American constitutionalism.

Exploring the tensions in Public Law Child Care Proceedings: an analysis of the legislative boundaries of decision-making within pre-proceedings protocols and the role of advocacy in promoting justice for families.

This PhD by published work consists of: • 1 single authored monograph; • 1 single authored paper in a refereed journal; • 4 main authored articles in refereed journals; • 3 joint authored articles in refereed journals; • 1 joint authored paper in a non refereed journal; and • 3 joint authored published reports. It covers the period 2009-2014 This thesis and the papers submitted demonstrate my significant contribution to a body of knowledge that provides a rich and unique insight to the development of changes in legislation and protocols in child protection practice. Particular expertise is threefold: the impact on the practice of all professionals involved with vulnerable families and children; the impact on the assessment of risk and working with families and children; and the impact on the ‘timetable for the child’. The publications reflect an examination of pre-proceedings protocols over a 5-year period. Throughout, the work demonstrates a theoretical and practical commitment to fairness and justice for families. The rationale that underpins this thesis is the need to explore the impact of procedural changes to the lives of children and their families. The rhetoric of improving pre-proceedings work in an attempt to divert cases away from court, and to ensure decisions that are made for children are both rigorous and timely, is at odds from the reality of practice on the ground. The recent hegemonic concern with the timetable for the child (Holt and Kelly, 2014) reinforces a change agenda that was ushered in ahead of the Children and Families Act that became law on 22nd April 2014. The President of the Family Division, Sir James Munby, has stated that 26 weeks completion time when cases progress to court is ‘a deadline not a target’, reinforcing the message that only a ‘comparatively small number of exceptional cases’ will fall outside it (Munby, 2013:4). This leaves little time for the court to intervene when cases have not been properly progressed at the pre-proceedings stage. The evidence from detailed observations of practice at all levels within pre-proceedings protocols affords an opportunity to send a clear message to legislators, policy makers and practitioners. Front-loading and diverting more cases into pre-proceedings protocols is quite simply a strategic measure to reduce the financial burden away from the courts and to place this elsewhere. Local authorities have child protection systems that are properly designed to support children who are in need of protection, and where it has been decided by professionals from a range of agencies working with families that the risk cannot be managed without the need to seek the involvement of the court, there should be no further delay. My concern is that in many instances children are already left holding the risk for too long. The question must be raised as to why, when a range of professionals working with the child and their family make the decision that an application to court should be made, a system that purports to hold children and families at the heart builds in further delay.

This public law study aims to analyze abstract norm review in Sweden and Azerbaijan, conducted byspecific entities – the Swedish Council on Legislation (Lagrådet) and the Constitutional Court ofAzerbaijan, respectively. The primary focus is to examine and compare the approaches of Lagrådet andthe Azerbaijani Constitutional Court in abstract norm control.In this essay, a comparison is made between abstract norm review in Sweden and Azerbaijan, revealingsimilarities in purpose but significant differences in the powers and the binding nature of decisions.Historically, Sweden has undergone a longer constitutional development, while Azerbaijan hasundergone changes following its independence from the Soviet Union, which is noticeable throughvarious historical and political contexts shaping their norm review processes.In practice, Lagrådet in Sweden plays an advisory role during the legislative process. Although itsadvice carries significant weight, the final decision to follow or deviate from these recommendationslies with the government. Meanwhile, the Constitutional Court in Azerbaijan possesses direct legallybinding authority over its decisions, which affect all organs and individuals in the country.The difference in independence and legitimacy between these institutions is reflected in their impact onlegislation. Despite its active role, Lagrådet is subordinate to the government's decisions. Meanwhile,the Constitutional Court in Azerbaijan has a more independent and tangible influence on legislation.

Thesis (LLD (Public Law))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: The unique and intimate relationship that exists between a medical practitioner and his/her client is possibly one of the most important relationships that can come into being between any two people. This relationship is characterised and influenced by the qualities and attributes specific to the nature and historical development of medical care, as well as medical science in general. The doctor-patient relationship is also influenced by the social dynamics of a particular community, environmental factors, technological advances and the general social and commercial evolution of the human race. With regard to medical care and health service delivery, the doctor-patient relationship is furthermore vital to the quality of the care provided, as well as to the outcomes and relative success of the specific medical intervention or treatment. One of the distinct characteristics of the doctor-patient relationship is the power imbalance inherent in this relationship. The medical practitioner has expert knowledge and skill, while the patient finds himself or herself in an unusually dependent and vulnerable position. It is because of this important role that the doctor-patient relationship still plays in health service delivery today; the susceptibility of the relationship to a variety of influences, and the characteristic power imbalances inherent in this relationship, that a study of the doctor-patient relationship in South African medical- and health law is necessary. The characteristic power imbalances will be considered from a legal perspective in this dissertation. This study provides a comprehensive source of the doctor-patient relationship from a legal perspective. Where relevant, references are made to theories and principles from other disciplines, including sociology, economy and medical ethnomethodology. The prevalence and consequences of power imbalances in the doctor-patient relationship are identified and discussed with the aim of bringing these to the attention of both the legal fraternity, and medical practitioners. Specific problem areas are identified and solutions are offered, including the following: • The adverse consequences of power imbalances inherent in the doctor-patient relationship on the medical decision-making process are considered from various perspectives. With regard to these adverse consequences, the doctrine of informed consent is analysed and evaluated in great detail. • The influence of paternalistic notions in health service delivery; the business model of health service delivery and the effects of managed care and consumer-directed health care on the doctor-patient relationship and health service delivery in general are also analysed from a legal perspective, and specifically with regard to the power imbalances inherent in this relationship. • The role of autonomy, self-determination and dignity, as well as the principles of beneficence in medical practice, are reconsidered in an attempt to provide a solution for redressing the power imbalances inherent in the doctor-patient relationship. • The fiduciary nature of the doctor-patient relationship and the special role of trust in the relationship are emphasised throughout the dissertation as the focal point of departure in the doctor-patient relationship and the main constituent in any legal endeavor to redress the power imbalances inherent in it. / AFRIKAANS OPSOMMING: Die unieke en intieme verhouding wat bestaan tussen ‘n mediese praktisyn en ‘n pasiënt is wêreldwyd waarskynlik een van die belangrikste verhoudings wat tussen twee persone tot stand kan kom. Hierdie verhouding word gekenmerk en beïnvloed deur kwaliteite en eienskappe eie aan die besonderse aard en historiese ontwikkeling van gesondheidsorg, sowel as die mediese wetenskap in die algemeen. Die dokter-pasiënt verhouding word verder beïnvloed deur die sosiale dinamika van ‘n bepaalde gemeenskap, omgewingsfaktore, tegnologiese vooruitgang en die algemene sosiale en kommersiële ontwikkeling van die mensdom. Op die terrein van gesondheidsorg en mediese dienslewering is die dokter-pasiënt verhouding voorts ook sentraal tot die kwaliteit van die mediese sorg wat verskaf word, sowel as die uitkomste en relatiewe sukses van die spesifieke mediese behandeling. Hierdie kenmerkende magswanbalans sal vanuit ‘n regsperspektief verder in hierdie proefskrif ondersoek word. Hierdie studie bied ‘n omvattende bron van die dokter-pasiënt verhouding benader vanuit ‘n regsperspektief, terwyl verwysings na teorieë en beginsels van ander dissiplines soos die sosiologie, ekonomie en mediese etnometodologie ook waar nodig ingesluit word. Spesifieke aandag word in dié verband gegee aan die invloede van hierdie benaderings en perspektiewe op die magswanbalans inherent aan die dokter-pasiënt verhouding. • Die besondere rol van autonomie, selfbeskikking en menswaardigheid, asook die beginsels van weldadigheid in gesondheidsorg, word heroorweeg in ‘n poging om ‘n meer gelyke distribusie van mag in die dokter-pasiënt verhouding te verseker. • Die fidusiêre aard van die dokter-pasiënt verhouding en die besondere rol wat vertroue in hierdie verhouding speel, word in hierdie proefskrif beklemtoon en word voorts as die basis van die dokter-pasiënt verhouding beskou. An evaluation of the transformation of public service delivery through the development of administrative justice in South Africa

Thesis (LLM (Public Law))--University of Stellenbosch, 2007. / In order to test whether South African public service fulfills democratic aims and objectives, this study establishes the limits to and extent of the Promotion of Administrative Justice Act 3 of 2000 (the PAJA) in promoting the right to administrative justice as a human right (the RAJAH) and thereby transforming public service delivery. To achieve above aim the background to the entrenched right to administrative justice is analysed through a study of principles underlying administrative justice. Both South African common law and Constitutional systems are analysed against the principles underlying administrative justice. Batho Pele principles contained in the White Paper on the Transformation of the Public Service (WPTPS) are also analysed to find out how the South African Public Administration interprets its constitutional duties and to establish the relevance of these principles to administrative justice principles ensconced in the PAJA. The PAJA is then analysed in order to measure the extent to which it affirms the transformation principles ensconced in the Constitution and coinciding with Batho Pele principles. As the public service is a reflection of democracy in action, the public expects it to be professional, representative and proficient. If it does not fulfil these expectations, this may be interpreted as a fundamental failure of democracy. South African democracy in particular is development oriented because it is based on the Constitution that entrenches among others the right to administrative justice. The right to administrative justice as a development tool urges the public sector to recognise and apply constitutionally recognised procedures and processes in every delivery so that the social status of citizens may be enhanced. Such steps, if effectively followed, signify that the public sector has transformed from bad governance practices of the pre constitutional era where there was no requirement for the observance of individual rights in public service delivery. Failures to the adoption of good governance principles by the public sector show the opposite of the expected standards and signify that the public sector is not yet transformed. In the light of the problems caused by the lack of protection of human rights from abuse by the executive under the common law system of parliamentary supremacy, the constitutional era was expected to have changed the position of South African administrative law drastically through its adoption of the principles underlying administrative justice. To develop insight into the extent of the transformation towards administrative justice that is expected to have occurred in South Africa since the advent of constitutionalism the implementation of the PAJA is evaluated through an examination of a selection of cases that deals with public administration decisions in the area of social assistance as a context in which members of the public are most dependent on effective state administration. As the scope of the study limits the number of cases that can be examined, only the most informative cases on social assistance that relates to the KwaZulu-Natal and the Eastern Cape provinces are analysed. The research finds that public service is not yet transformed and identifies the causal factors. It recommends steps to be followed so that the expected culture from the public sector is attained.

Lateral and subjacent support

Thesis (LLM (Public Law))--University of Stellenbosch, 2009. / ENGLISH ABSTRACT: The first part of this thesis deals with the right of lateral and subjacent support and explains how it should be applied in South African law. The thesis illustrates how the neighbour law principles of lateral support were incorrectly extended to govern conflicts pertaining to subjacent support that arose in South African mining law. From 1911 right up to 2007, these two clearly distinguishable concepts were treated as synonymous principles in both academic writing and case law. The thesis plots the historical development of this extension of lateral support principles to subjacent support conflicts. In doing so, it examines the main source of South Africa’s law of support, namely English law. The thesis then shows how the Supreme Court of Appeal in Anglo Operations Ltd v Sandhurst Estates (Pty) Ltd 2007 (2) SA 363 (SCA) illustrated how the English law doctrine of subjacent support, with all its attendant ramifications, could not be useful in resolving disputes that arise between a land surface owner and a mineral rights holder in South African mining law. The second of half of the thesis investigates the constitutional implications of the Supreme Court of Appeal’s decision in Anglo Operations in light of the systemic changes introduced by the Minerals and Petroleum Resources Development Act 28 of 2002. In terms of this new Act, all the mineral and petroleum resources of South Africa are the common heritage of the people of South Africa, and the state is the custodian thereof. This means that landowners are no longer involved in the granting of mineral rights to subsequent holders. In light of the Anglo Operations decision, landowners in the new dispensation of mineral exploitation face the danger of losing the use and enjoyment of some/all their land. The thesis therefore examines the implications of the statutory provisions in South African legislation (new and old) that have/had an impact on the relationship between landowners and mineral right holders with regard to the question of subjacent support, as well as the implications of the Anglo Operations decision for cases where mineral rights have been granted under the statutory framework. / AFRIKAANSE OPSOMMING: Die eerste deel van die tesis handel oor die reg op sydelingse en oppervlakstut en hoe dit in die Suid-Afrikaanse reg toegepas behoort te word. Die tesis wys hoe die bureregbeginsels rakende sydelingse stut verkeerdelik uitgebrei is na konflikte rakende oppervlakstut wat in die Suid-Afrikaanse mynreg ontstaan het. Vanaf 1911 en tot in 2007 is hierdie twee duidelik verskillende konsepte in sowel akademiese geskrifte en in die regspraak as sinonieme behandel. Die tesis sit die historiese ontwikkeling van die uitbreiding van laterale stut-beginsels na oppervlakstut-konflikte uiteen. In die proses word die hoofbron van die Suid-Afrikaanse reg ten aansien van steun, naamlik die Engelse reg, ondersoek.
