A partir da análise do quadro histórico e teórico dos projetos de integração em matéria de infraestrutura, bem como da análise da política externa brasileira para a integração da infraestrutura física sul-americana, a presente dissertação verifica o panorama dos principais projetos de infraestrutura sul-americanos, a agenda e execução das obras realizadas e as principais fontes de financiamento. À luz da análise do desenvolvimento histórico e dos projetos implementados, conclui-se que conciliar a integração da infraestrutura, suas obras e o desenvolvimento econômico com a preservação do meio-ambiente, a sustentabilidade e a busca de justiça social, consistem nos principais desafios que se colocam para o COSIPLAN atualmente. / The integration of regional physical infrastructure is one of the most important issues in the multilateral agenda of South American countries, since the advent, in 2000, of the Initiative for the Integration of the Regional Infrastructure in South America (IIRSA), later incorporated as a technical forum of the South American Council on Infrastructure and Planning (COSIPLAN), an organ of UNASUR. From the analysis of the historical and theoretical framework of integration projects in infrastructure, as well as the analysis of the Brazilian foreign policy for the integration of South American physical infrastructure, this dissertation verify the overview of the main projects of infrastructure in South America, the agenda and the execution of the infrastructure works and the main sources of funding. In the light of the historical analysis and of the implemented projects, it concludes that reconcile the integration of infrastructure, its infrastructure works and economic development with the preservation of the environment, sustainability and the search for social justice, consists the main challenges that arise for COSIPLAN currently.

Ao propor uma dissertação a respeito da teoria jurídica da integração no MERCOSUL, buscamos investigar aquelas características jurídicas próprias do bloco que não permitem que ele seja caracterizado como mais um instrumento de cooperação econômica clássica entre os Estados, nem como um organismo comunitário. Apesar de utilizarmos a teoria jurídica da integração econômica para esclarecer os critérios de investigação, será na análise da estrutura orgânica e da estrutura normativa do MERCOSUL que buscaremos investigar a natureza peculiar do direito mercosulino. Acreditamos que a caracterização de um bloco sob uma das nomenclaturas propostas pela teoria da integração regional seja produto, em realidade, da natureza de seu direito derivado. De fato, serão os diversos elementos que concorrem para a caracterização deste direito que são tantas vezes apresentados como evidência de que um bloco regional seja cooperativo ou comunitário, numa metonímia que toma a parte pelo todo. Ao contrário, a dissertação de mestrado que apresentamos expõe os resultados iniciais de nossa investigação sobre a totalidade dos elementos que concorrem para indicar a natureza de direito da integração do processo mercosulino. Não pretendemos investigar a natureza do bloco por mero argumento classificatório. Acreditamos que a identificação do caráter do processo de integração regional facilite a análise criteriosa a respeito do cumprimento das funções que lhe foram confiadas, permita projetar eventuais correções de rumo para retornar ao caminho pretendido e indique para onde caminha o processo de integração do MERCOSUL. / By proposing a masters thesis on the legal theory of regional integration, we intend to investigate those specific legal characteristics that do not allow it to be characterized as just another classic economic cooperation instrument between States, nor as a community organism. Despite using the legal theory of economic integration to clarify the investigation criteria, it will be in the analysis of the organic and the normative structure of MERCOSUR that we aim to investigate the peculiar nature of its law. We believe that the characterization of a block under one of the nomenclatures proposed by the regional integration theory is, in reality, a product of its derived law. Indeed, the diverse elements that concur to a characterization of this law that are the ones so may times presented as evidence that a regional block is a cooperative or a community one, defining a whole mechanism by a single piece of it. On the contrary, the masters thesis now presented exposes the initial results of our investigation about the totality of elements that concur to indicate the nature of law of the integration process in MERCOSUL. We do not intend to investigate the nature of the block just for classificatory sake. Rather, we believe identifying the unique character of MERCOSURs integration process might contribute not only to a strict analysis of the blocks performance on the functions it was once assigned but also to foresee possible corrections on its direction in order to drive the block back to its path and to indicate where the integration process is actually driving us all.

O estudo é baseado na perspectiva teórica do Neo-funcionalismo, o que levou a separar a análises dos partidos em dois níveis: um interno e outro externo. No nível interno estudamos, primeiramente, os graus de institucionalidade dos países eleitos (Argentina, Brasil e Uruguai) e, posteriormente, realiza-se um levantamento acerca da porcentagem de aprovação das decisões emanadas do Mercosul e interiorizadas por cada Parlamento Nacional. No nível externo foram pesquisados os partidos políticos no âmbito do Parlamento do Mercosul, centrando a análise, especificamente, na composição político partidária e territorial dos parlamentares e, num segundo momento, foram estudados os debates e aprovações feitas nas sessões. A principal conclusão do trabalho permite afirmar que as características próprias dos sistemas partidários dos países do Mercosul, não estariam gerando condições propícias para um desempenho adequado dos partidos políticos para com o mesmo / Abstract: This dissertation investigates the action of political parties within the Mercosur, aiming to demonstrate how the particular characteristics of each political party may interfere in their capacity to influence the regional process. The study is based on the theoretical perspective of Neo-functionalism, which led to divide the analysis of the political parties in two levels: internal and external. At the internal level we first analyzed the level of institutionalization of the studied countries (Argentina, Brazil, and Uruguay) and, subsequently, we conducted an analysis of the percentage of the decisions made by the Mercosur and adopted by the Congress of each country. At the external level, first we studied the political parties within the Mercosur Parliament, focusing the analysis in the political party and territorial composition of the representatives, and secondly, the debates and acts passed during the Sessions. Investissement direct et sous-traitance internationale dans les pays du Sud : le cas de la Tunisie. / Direct Investment and international outsourcing in the South : the case of Tunisia.

Depuis le début des années 1980, l'ouverture de l'économie mondiale a conduit à une évolution rapide des flux d'IDE essentiellement vers les pays en voie de développement. Cette croissance est le résultat du changement structurel de l'activité économique vers la spécialisation verticale internationale. Ainsi, elle a fait émerger un nouveau principe d'analyse pour arbitrer entre l'IDE et la sous-traitance internationale.Notre travail s'intéresse au cas de la Tunisie et examine l'évolution des IDE entrants, essentiellement après la signature de l'accord de partenariat avec l'Union Européenne en 1995. Cet accord représente le point fort du processus d'ouverture de l'économie Tunisienne censé consolider les déterminants économiques traditionnels. Notre analyse empirique des flux entrants entre 1992 et 2008 pour l'ensemble des 58 pays originaires des investissements étrangers en Tunisie, montre que ces investissements se sont concentrés principalement dans le secteur énergétique et dans la branche des textiles et habillement. La principale motivation des investisseurs étrangers demeure la recherche d'une main d'œuvre bon marché, dans une logique de division internationale du travail. En outre, mis à part quelques opérations de privatisation générant des flux importants et concentrés dans la télécommunication et la cimenterie, le processus de libéralisation de l'activité économique n'a pas eu les effets escomptés sur les flux entrants d'IDE. / Since the early eighties, the liberalization of the world economy has led to a rapid evolution of the FDI flows essentially to the developing countries. This growth is the result of a structural change of the economic activity towards an international vertical specialization. Consequently, a new principle of analysis has emerged to arbitrate between the FDI and the international outsourcing.Our work is interested in the case of Tunisia and examines the evolution of the FDI inflows after the signing of the partnership agreement with the EU in 1995. This agreement represents a landmark in the liberalization process of the Tunisian economy meant to strengthen the traditional economic determinants.Our empirical study of the inflows between 1992 and 2008 for the 58 countries originating in the foreign investment in Tunisia shows that these investments have concentrated mainly on the sector of energy and on the textile and clothing industry. The main motivation of the foreign investors remains the search for cheap labour in a logical international division of labour. Furthermore, apart from some privatization operations generating important flows and concentrated in telecommunications and cement, the process of liberalization of the economic activity didn't have the expected effects on the incoming FDI flows.

Facilitating intra-regional trade through the movement of people in the Southern African development community (SADC).

Doctor Legum - LLD / Regional integration has been part of Africa’s overarching strategy for economic transformation. To further enhance sustainable development and economic growth, in the African continent intra-regional trade is equally as important as international trade. Therefore, African countries are faced with the daunting task of adopting comprehensive and well-structured measures to ensure the movement of goods and people across borders are seamless and unrestrictive. Free movement of persons in particular is one of the core tenets of regional integration, building towards a common market. To that effect, the African Union (AU) based on Agenda 2063 has agreed on a Continental Free Trade Area and a Protocol on Movement of Persons indicating a commitment of attaining a single market where goods, persons and services can move freely across national borders. With the Southern African Development Community (SADC) being a Regional Economic Community (REC) recognised under the AU, this thesis seeks to argue for deeper integration by ensuring the movement of persons in the SADC is regulated beyond the scope that is recognised internationally under the International laws influencing the movement of persons. Also, this thesis argues for amendment of certain provisions in the SADC Protocol on the Facilitation of the Movement of Persons to further facilitate intra-regional trade. The SADC operates to an extent as a Free Trade Area (FTA) where goods are traded duty free across borders and the intention is to go higher up the integration ladder to become a Common Market by 2015 and an Economic Union with a Single Currency by 2018. Targets which has not been met to date. Article 5(2) (d) and Article 23 of the SADC Trade Protocol realises the significance of policy development in promoting free movement of people and services within the SADC region. To facilitate the movement of people, the SADC drafted a Protocol on the Free Movement of People in 1995. This Protocol never materialised and it was subsequently replaced by a Protocol on Facilitation on Movement of People which is limited in scope and is not yet operational as ratification by two third majority of Member States has not occurred. In 2012, a Protocol on Trade in Services which also within a limited scope influences the movement of persons in the region was also concluded but is not yet ratified by Member States of the SADC. The absence of a single consistent and comprehensive framework makes people vulnerable to informal practices at the border. Thus, the issue of ensuring free movement of people between SADC Member States still remains debatable and unresolved.

Challenges and opportunities in developing a common legal and regulatory framework on energy in East African Community

However, in Africa, they are still many challenges in the energy sector with limited energy access for the population and a huge energy deficit. In this regard, many initiatives following the AU Agenda 2063 have been introduced with a regional approach focused to address energy deficit in Africa as a necessary key to reducing poverty and increasing economic growth of the Continent. East African Community, as a Regional Economic Community, faces energy challenges with a great impact on its economic development and prosperity. Indeed, the lack of energy is a major impediment for the development of the region as a whole and for the achievement of the regional integration aimed as a Community. Among many challenges faced by the energy sector in East African Community, the lack of a legal and regulatory framework on energy in the region is included and needs to be addressed in order to facilitate and improve trade and investment in the Community. This research work aims to review the legal and regulatory landscape on energy in EAC to assess the achievements, challenges, and opportunities of the energy sector to seek a foundation to develop a common legal and regulatory framework on energy in EAC promoting trade and investment through lessons learned from ECOWAS. "After their independence, African countries undertook to establish sub-regional organisations in order to join their efforts towards improving the living standard of their populations. Primarily vested with economic objectives, these sub-regional organisations, aware that economic development cannot be attained withouth peace, security and political stability, are more and more involved with political issues, especially since the 'democratic wind' of the early 1990s. It is therefore interesting to study how sub-regional integration as an external factor affects democracy domestically, that is to contemplate to what extent this sub-regional integration is contributing to the strengthening of democracy in Africa, and to research ways of enhancing this contribution. ... A pesquisa tem como objetivo primário compreender os desafios da integração de infraestrutura regional na América do Sul. Partindo do estudo das obras de interconectividade de infraestrutura sob a égide da Iniciativa de Integração de Infraestrutura Sul-Americana (IIRSA). Analisam-se as irregularidades na execução das obras, de forma a ressaltar seus impactos no esforço regional de integração. A hipótese central da pesquisa é a de que o processo de integração regional de infraestrutura depende da normatização supranacional que obrigue aos países a elevação dos parâmetros de qualidade de execução das obras de infraestrutura. A análise mobiliza o arcabouço teórico oferecido pela literatura de Bens Públicos Regionais, a Nova Geografia Econômica e a Abordagem Neo-Regionalista, levando a uma revisão do pensamento neo-funcionalista sobre a integração. A ferramenta metodológica utilizada para o teste de hipóteses é o process-tracing. / This research aims primarily at understanding the challenges regarding the regional infrastructure integration in South America. Studying the infraestructure interconnectivity Works of the Innitiative for the Integration of Infrastructure in South America (IIRSA), irregularities in public Works execution are analysed, aiming at stressing their impacts on the regional integration effort. This reaearch\'s central hypothesis is that the regional infrastructure integration process depends on supranational normatization which obliges countries to raise their quality standards on infrastructure public works. The analysis uses the theoretical framework offered by Regional Publi Goods theory, New Economic Geography and the New Regionalist Approach, leading to a revision of neo-functionalist thought on integration. The methodological tool used for hypothesis testing is process tracing.
