Governança pública de royalties: federalismo fiscal e futuras gerações. / Royalties public governance: fiscal federalism and future generations.

Esta dissertação tem por objetivo analisar criticamente a governança das receitas públicas de recursos naturais não renováveis no Brasil. Considerando a característica essencial de finitude dos recursos naturais explorados, que importa também em negar às gerações pósteras o acesso aos bens minerais e petrolíferos, impõe-se reconhecer nos diversos aspectos dessa governança a necessidade de tratar essa receita de forma singular. Para compreender quais são estas especificidades, foram eleitos dois eixos de análise: o primeiro, com a revisão da literatura sobre a maldição dos recursos naturais, a doença holandesa, e fenômenos (especialmente econômicos) relacionados à exploração mineral; e o segundo, com consulta à doutrina de diversos ramos (no Direito e fora dele) sobre a noção de justiça, solidariedade ou equidade entre gerações, bem como com a busca de especificação do conteúdo desta perspectiva, que se aplica a diversas áreas do Direito, inclusive e especialmente ao Direito Financeiro. Com essas bases, elegem-se aspectos da governança brasileira de royalties a serem analisados: o federalismo fiscal dessas receitas públicas patrimoniais; a forma de tratamento financeiro-orçamentário dos royalties, especialmente sua classificação consoante a Lei nº 4.320/1964; a utilização de Fundos para gestão dessas receitas (o Fundo Social); a relação entre a arrecadação de royalties e a arrecadação tributária, especialmente nos entes subnacionais beneficiados em grande monta com essas receitas patrimoniais; os modos de direcionamento e coação que a lei impõe ao gestor no gasto dos royalties; a transparência fiscal brasileira; e, de forma ampla, as recentes alterações (efetivadas e propostas) nas leis que regem as explorações de minérios e de petróleo no país. Conclui-se que, apesar de o ordenamento jurídico brasileiro ter avançado significativamente em alguns desses aspectos recentemente (especialmente com a criação do Fundo Social no âmbito da União, e no que diz respeito à transparência fiscal relacionada à atividade exploratória), ele não está, sob as perspectivas de análise escolhidas, adequadamente aparelhado para a governança das receitas públicas de recursos naturais não renováveis. / This dissertation aims to critically analyze the Brazilian governance of public revenues from nonrenewable natural resources. Considering that finiteness is an essential characteristic of natural resources that are exploited, which implies in denying future generations the access to mineral and oil assets, one must acknowledge, in various aspects of governance, the necessity to treat these revenues singularly. To understand what these specificities are, two axes of analysis were elected: the first envolves revisiting the curse of natural resources, the Dutch disease, and phenomena (especially those of economic nature) related to the mineral exploitation; and the second involves consulting doctrine of different areas of study (in and out of Law) about notions of justice, solidarity or equity between generations, as well as searching for specification of this content, which applies to various areas of Law, including and especially Public Finance Law. Building on these foundations, some aspects of Brazilian governance of royalties were elected to be analyzed: fiscal federalism applied to these public revenues; the financial-budgetary treatment of royalties, especially its classification under Law nº 4.320/1964; the utilization of Funds to manage these revenues (the Social Fund); the relationship between the collection of royalties and the collection of taxes, especially in subnational governmental entities largely benefited by these revenues; the ways the law directs and coerces the expenditure of royalties; Brazilian fiscal transparency; and, broadly, the recent modifications (finished and proposed) in the laws that conduct the exploitation of minerals and oil in the country. It is concluded that, although the Brazilian legal system has advanced significantly in some aspects as of late (especially the creation of the Social Fund by the central government, and in respects to fiscal transparency related to the exploratory activities), it is not, under the elected perspectives of analysis, adequately prepared to regulate the governance of public revenues originating from exploration of nonrenewable natural resources.

台灣中央統籌分配稅款對財政努力影響之研究 / A Research of the Influence of Distribution Regulations for Centrally-Allotted Tax revenues on Regional Efforts in Taiwan

近年來地方財政困難已成眾所關注焦點,當前地方財政困難原因,主要在於實質收入無法配合支出成長,致財政收支差短擴增;且難以稅課收入劃分調整全面解決地方財政問題;在整體財政收入不足,中央財政同屬困難,對地方財政支援受限狀況下,要解決財政困難問題,鼓勵地方財政努力是相當重要的關鍵。 目前有關財政努力的文獻,大多著重於財政努力指標之估測及衡量,而有關分配稅款的文獻則大多著重於分配比例、公式之設計,至於分配稅款對財政努力的影響,目前尚無實證研究論述。本研究以台北市、高雄市及台灣21縣市為研究對象,追蹤資料年度為2001年至2005年;搭配最小平方估計式模型(Ordinary Least Squares, OLS)的估計,探討分配稅款現制對地方「財政努力」的影響。實證結果,分配稅款、財政能力及補助協助收入與財政努力呈顯著負向影響,自有財源則與財政努力呈顯著正向影響;在區域之虛擬變數方面,北區、中區及南區相較於東區而言,與財政努力呈顯著正向影響,至時間之虛擬變數實證結果顯示,2001年、2003年、2004年及2005年相較於2002年而言,與財政努力呈顯著負向影響。 / The origin of the fiscal difficulties of local governments in Taiwan in recent years lies mainly in the fact that revenue has been unable to match the growth of expenditure. It is not possible to adjust the proportion of tax revenue and the central government can only provide limited aid as it is in the same fiscal position as that of the local governments. The key measure in solving the problem is to encourage local governments to tackle their financial problems themselves. Most of the studies of fiscal efforts in this area focus either on the measurement and evaluation of indexes which indicate the extent of the efforts which have been made or how to design a formula to calculate the allotment in the distribution of centrally-allotted tax revenues. Up to this point, there has been no research on the influence of regulations governing the distribution of centrally-allotted tax revenues on fiscal efforts in Taiwan. This research uses data collected for the years from 2001 to 2005 and applies the OLS (Ordinary Least Squares) statistical model to explore how the current allocation system influences the fiscal effort of local governments. The results show that there is a negative relationship between the use of centrally-allotted tax revenues, the fiscal ability of the local government, and the general subsidies provided by the central government in comparison with the fiscal efforts of local governments and a positive relationship between revenue derived from local governments in comparison with such efforts. Also, the use of the dummy variable of regions shows a significantly positive relationship for the northern, central, and southern regions when compared with the eastern region and the use of the dummy variable of time shows a significantly negative relationship for the years 2001, 2003, 2004, and 2005 when compared with the year 2002.

This thesis examines the impact of the real exchange rate on the amount of revenues from a system of tolled and time tolled roads in the Czech Republic in the years 1999-2014. This effect is investigated on monthly data using regression analysis on two systems of tolled roads separately, system of tolled roads and system of time-tolled roads. Based on available dataset was shown a statistically significant negative effect of the real exchange rate on toll revenues in the system of tolled roads. In the case of time-tolled roads system was demonstrated negative effect of real exchange rate on time-toll revenues, but this effect is questionable, since the influence has been demonstrated only in a model with limited explanatory power.

This thesis deals with the public financing of the road transport issue, particularly in the Czech Republic. The quantitative analysis of the revenues from the road transport and capital and maintenance costs on road transport in the Czech Republic in 2001 - 2007 is the fundamental part of this thesis. The vehicle excise tax, fuel tax, road tolls, parking policy revenues and other specific charges belong to the public revenues from the road transport. The output of the thesis is the assessment whether the public revenues from the road transport at least cover the capital and maintenance costs on the road infrastructure and the road transport is therefore a source of the revenues to public sources, or whether, on the contrary, the road transport represents the drain for the public sources and thus also for the tax payers. The evaluation of this situation while including the externalities of road transport is also part of this thesis.

This diploma thesis is focused on analysis of factors affecting tax revenues in the Czech Republic. The theoretical part is dedicated to dividing taxes according to the type, discusses their functions and their principles, as well. After that the summary of previous investigations of factors with potencial effects to tax revenues is presented. The practical part begins with comparation of tax quota and its structure between the Czech Republic and selected European Union member countries. The main part is represented by the correlation and regression analysis of selected factors. As the result of this analysis the evaluation of their real effect is done.

Essays on asymmetric fiscal and monetary policy

Cassou / This dissertation consists of three essays on modeling the behavior of both fiscal and monetary policy by allowing for asymmetry in preferences of the policy authorities. Whether the responses of fiscal or monetary policy to the business cycle conditions are symmetric or asymmetric is still an unresolved question. The idea behind asymmetric behavior is that policy makers take stronger action during times of distress than during ordinary times. The following chapters investigate this question empirically using data for the United States and show that policy makers do behave asymmetrically. Chapter 1 investigates whether the asymmetric monetary policy preferences for the output gap as shown in Surico (2007) disappeared during the post-Volcker period spanning 1982:04- 2003:02. The results show Surico’s conclusion to be fragile as moving the starting period for the estimation a few quarters forward shows strong asymmetric policy behavior. Chapter 2 investigates U.S. fiscal policy sustainability and cyclicality in empirical structures that allow fiscal policy responses to exhibit asymmetric behavior. Two quarterly intervals of data are investigated, both of which begin in 1955. The short sample was chosen for comparison to Bohn (1998), while the full sample uses all available data. The results for a short sample that ends in the second quarter of 1995 show some differences from the results for the full sample that includes the financial crisis and the Great Recession. For the full sample, U.S. fiscal policy is asymmetrical in regard to both sustainability and cyclicality. Regarding fiscal policy sustainability, the best fitting models show evidence of fiscal policy sustainability for the short sample. However, the fiscal sustainability question does become less clear for the full sample. Regarding fiscal policy cyclicality, we find during times of distress, policy is strongly countercyclical, but during good times the results are mixed. Chapter 3 investigates the source of asymmetry in reaction of U.S. fiscal policy to business cycle conditions, as shown in chapter 2. By decomposing the fiscal policy variable into the tax revenues and the expenditures, we show that both series exhibit asymmetry in a way which is analogous to the results found in chapter 2.

Abstract  Background and problem discussion: Revenues has been an important financial measure in financial reports. During the last decades the revenue accounting has been problematic and some remarkable incidents have occurred. The 1 January 2018 entered the new revenue recognition standard IFRS 15. Transition into IFRS 15 has been expected to have varying results for the companies.  Purpose: The purpose with this study was to review how IFRS 15 affected profitability ratios for companies listed on the Stockholm exchange. The study also intended to discuss how the relationship between companies and investors was affected by a new revenue standard within IFRS.  Method: This study has been based on a quantitative approach when the empirical data was collected. The data were collected mainly from the selected companies annual reports for the fiscal year 2017. To measure the effect of adaption to IFRS 15 for the companies, the key ratios were chosen for gross margin and operating margin.  Result: In this study 18 of a total of 225 companies got a percentage effect on the selected key ratios. Where 16 of these companies got an effect on gross margin and 16 on operating margin. The hypotheses that was created and tested in the study did not show any statistic significant difference on the key ratios. / Sammanfattning  Bakgrund och problemdiskussion: Intäkter har alltid varit en viktig post i företags årsredovisning. Under de senaste decennierna har redovisningen av intäkter varit problematisk och en del uppseendeväckande händelser har skett. Den 1 januari 2018 trädde den nya intäktsredovisningsstandarden IFRS 15 i kraft. Övergången till IFRS 15 har förväntats få varierande utfall för företagen.  Syfte: Syftet med studien var att granska hur IFRS 15 påverkade lönsamhetsnyckeltalen i företag noterade på Stockholmsbörsen samt vad som kännetecknade de med påverkan. Studien ämnade även att diskutera hur relationen mellan företag och investerare påverkats av en ny redovisningsstandard inom IFRS.  Metod: Denna studie har utgått från ett kvantitativt tillvägagångssätt när den empiriska data samlats in. Data samlades främst in från de utvalda företagens årsredovisningar för räkenskapsåret 2017. För att kunna mäta den kvantifierbara påverkan av anpassning till IFRS 15 för företagen så valdes lönsamhetsnyckeltalen bruttomarginal och rörelsemarginal ut.  Resultat: Av totalt 225 studerade företag fick 18 stycken en procentuell påverkan på de utvalda nyckeltalen. Där 16 av dessa företag fick en påverkan på bruttomarginal och 16 stycken på rörelsemarginal. De hypoteser som utformades och testades i studien visade ingen statistiskt signifikant skillnad på nyckeltalen.

Análise do risco financeiro da produção de tomate de mesa em Caçador (SC) e Mogi Guaçu (SP) / Analysis of financial risk of fresh market tomato production in Caçador (SC) and Mogi Guaçu (SP)

O trabalho tem por objetivo principal mensurar o risco financeiro da produção de tomate de mesa em duas importantes regiões produtoras do Brasil - Caçador (SC) e Mogi Guaçu (SP), representando a safra de verão e inverno respectivamente. Como objetivos específicos têm-se: descrever as propriedades tomaticultoras \"típicas\" de cada região e mensurar seu custo de implantação; compor o fluxo de caixa da produção para analisar a viabilidade econômica de cada propriedade \"típica\" e mensurar o risco econômico do negócio. Assim, fez-se uma análise determinista das variáveis que compõem o fluxo de caixa de cada região, entre 2006 e 2012, e dos indicadores de viabilidade econômica - Valor Presente Líquido (VPL) e Taxa Interna de Retorno (TIR). A descrição das propriedades \"típicas\" e o levantado do investimento inicial para a produção foi realizado por meio da metodologia do Painel. Para mensuração do risco financeiro realizou-se uma análise probabilística, com o cálculo do quantil negativo da distribuição de probabilidade das receitas líquidas operacionais (RLO) simuladas por Monte Carlo. O risco econômico do negócio em cada uma das propriedades típicas foi calculado pela probabilidade do VPL ser negativo. Por meio do Painel, constataram-se três modelos distintos de produção de tomate de mesa nas regiões pesquisadas. Em Caçador foi diagnosticado propriedades de pequena escala de produção (1,25 ha), cujo investimento foi de R$ 91.700,3 ha-1, e de grande escala (27,27ha), com investimento de R$ 52.354,5 ha-1. Em Mogi Guaçu a propriedade \"típica\" foi de média escala (15 ha) e o investimento totalizou R$ 42.789,2 ha-1. Comparando o fluxo de caixa das duas regiões entre 2006 e 2012, a soma das RLO\'s foi positiva, mas houve meses consecutivos de receita negativa. Este cenário pode levar o produtor ao endividamento e inviabilizar seu negócio no longo prazo. Quanto aos indicadores de viabilidade econômica (VPL e TIR), todas as propriedades típicas se mostraram viáveis entre 2006 e 2012. Porém, o risco financeiro de ambas as regiões foi elevado, 37,23% para Caçador e 32% para Mogi Guaçu. Já o risco econômico do negócio foi menor, 16,8% e 10,3% para pequena e grande escala de Caçador, respectivamente, e praticamente nulo para a média escala de Mogi Guaçu. Apesar de parecer vantajoso do ponto de vista econômico, o elevado risco financeiro mostra a importância de o tomaticultor fazer uma reserva financeira em meses de bons preços para cobrir os fluxos de caixa negativo e, assim, conseguir se manter na atividade no longo prazo. / The main objective of this study is to calculate the financial risk of fresh market tomato production in two important brazilian production regions - Caçador (SC) and Mogi Guaçu (SP), which represents the summer and winter harvest, respectively. The especific goals are: to characterize the \"tipical\" tomato farms in each region and to obtain their implantation cost; to compose the cash flow to analyze the economic viability of each \"tipical\" farm and to calculate the economical risk of the business. Therefore, it was carried a deterministic analysis of the cash flow variables and the economic viabiliy indicators - Net Present Value (NPV) and Internal Rate of Return (IRR) - in each region between 2006 until 2012. The \"tipical\" farm characterization and the measurement of the implantation cost was carried using the Painel methodology. The financial risk was calculated using a probabilistic analyzis, through the negative quantile of net revenues probability distribution using Monte Carlo simulation. The economic risk of business in each \"tipical\" farm was calculated using the probability of negative NPV. Through the Painel methodology it was distingueshed three tipical farms at the evaluated regions. At Caçador it was found small scale properties (1,25 ha), which the investment was R$ 91.700,3 ha-1, and large scale (27,27ha), with investment of R$ 52.354,5 ha-1. At Mogi Guaçu the tipical farm is a median scale property (15 ha) with an investment of R$ 42.789,2 ha-1. Regarding the cash flow analyses, the average of net revenues is positive, but there was consecutive negative net revenues for month. This cenarium can lead the producer to debt which might threaten the busines at long term. Regarding economic viability indicators, all tipical farms were viable during 2006 until 2012. But the financial risk was high in both regions, 37,23% at Caçador and 32% at Mogi Guaçu. The economic risk of busines was lower, 16,8% and 10,3% for the Caçador small and large scale property, respectively, and close to zero at the Mogi Guaçu median scale property. Despite the good economical results, the high financial risk reveles the importance of saving revenue during good prices periods to cover negative cash flow months and so continue busines at long term.
