Breaking New Ground: The First Generation of Women to Work as Professional Authors in English Canada (1880-1920)QUIRK, LINDA ELIZABETH 15 October 2011 (has links)
In the later decades of the nineteenth century and the early decades of the twentieth, large numbers of Canadian women were stepping out of the shadows of private life and into the public world of work and political action. Among them, both a cause and an effect of these sweeping social changes, was the first generation of Canadian women to work as professional authors. Although these women were not unified by ideology, genre, or date of birth, they are studied here as a generation defined by their time and place in history, by their material circumstances, and by their collective accomplishment. Chapters which focus on E. Pauline Johnson (Tekahionwake), the Eaton sisters (Sui Sin Far and Onoto Watanna), Joanna E. Wood, and Sara Jeannette Duncan explore some of the many commonalities and interrelationships among the members of this generation as a whole. This project combines archival research with analytical bibliography in order to clarify and extend our knowledge of Johnson’s and Duncan’s professional lives and publishing histories, and to recover some of Wood’s “lost” stories. This research offers a preliminary sketch of the long tradition of the platform performance (both Native and non-Native) with which Johnson and others engaged. It explores the uniquely innovative ethnographic writings of Johnson, Duncan, and the Eaton sisters, among others, and it explores thematic concerns which relate directly to the experiences of working women. Sectional ownership has introduced several new concepts of property that differ
significantly from prevailing as well as common-law concepts of property. The
right of extension with regards to sectional titles is one such concept. The right
entails a subtraction from the dominium of sectional owners and is widely
regarded as a limited real right. It is submitted that the right cannot be
categorised into any common-law category. The right is a statutory limited real
right sui generis that has its own characteristics with regards to the way it is
established, transferred, alienated, burdened or lapses. The right should also be
recognised as constitutional property. The study concludes with an investigation
into selected aspects relating to the right as an estate asset and points to
problems relating to the valuation of the right for purposes of estate, capital gains

東漢末年,一種名為「塔」的宗教建築物,隨著佛教的傳入而與之同時進入中國,成為崇敬禮拜的信仰中心。在佛教於中國的傳播過程中,塔的定位隨著宗教空間需求的擴大、以及中國固有王權空間觀念的影響而不斷的調適演變,逐漸的喪失了原本禮佛與信仰的中心地位,而轉變成為寺廟中缺乏實質用途的裝飾象徵性建築物。隋唐時期,先有隋文帝於仁壽年間大規模的造塔活動,使佛塔的建築與信仰普及全國,後有唐代重視休閒娛樂活動的社會風氣,並進而與科舉文化相結合,使得高聳的佛塔也同時成為得以享受登臨與題名之樂的風景名勝,具有更為世俗化的形象。
此外,多部講述造塔功德的佛經於唐代加以翻譯,使得唐代佛教徒以塔為墓風氣盛行,而民間功德塔的興造也非常興盛。在塔的概念與形象轉變方面,「以塔鎮地」概念的出現;佛塔高聳筆直、層層累疊的建築外型,也被用來指稱外觀或概念近似的建築物。最後,塔所突現出的垂直向度,也容易引申出人們各種關於崇敬、焦慮、與好奇的情緒:既是膜拜禮敬、溝通凡聖、得以消滅罪障的神聖空間,卻也是異常高聳、攀登不易的危險場所,甚至還是異人藏寶、夜叉棲居的奇特領域,而成為形象多元並具備豐富色彩的文學空間。甚至,具體而微的掌中小塔,也因為佛塔靈驗奇特的形象,而被延伸發展成為具有保護功能的隔離所。這些複雜神奇之各種異想的出現,也預示出塔在隋唐之後所即將呈現出之更為璀燦豐富的文化面貌。 / As a unique architecture of Buddhism, the Buddhist pagoda immigrated into China in the Han dynasty. Pagodas were built widespreadly as the religion center in the following centuries. However, after emerging with the traditional Chinese architecture concept, the main hall replaced the pagoda becoming the center of Buddhist temple gradually. In the Sui and Tang dynasties, various forms of the pagoda were presented because of the popular acceptance of Buddhism in the society and of the newly translated Buddhist Scriptures. In the form of tall pagodas of large temples in the capital to the small ones as memorials of eminent monks, the pagodas presented various images and were completely transformed from foreign architecture to the Chinese building. In the peace period, activities around the pagodas were recorded in documents and literatures forming a unique landscape in the Tang culture. Combination of the images of tall obvious building and holy religious space, lots of implications, other than solely Buddhist architecture, appeared in the literatures. Arising from the sensation to the architecture space and from the miraculous legends and tales, diversified and colorful imaginations have enriched the culture of Sui and Tang dynasties. Based on the literatures, historical documents, Buddhist Scriptures, architecture researches, and archaeological excavation, the details of different presentations and implications of the pagoda were demonstrated and concluded.

Genom art. 7 i databasdirektivet, 96/9/EG, introducerades det så kallade sui generis-skyddet för icke-originella databaser. Skyddet infördes i syfte att skapa incitament till investeringar i databaser genom att erbjuda ensamrätt för sådana databaser vilka på grund av sin icke-originella karaktär inte kunde skyddas av upphovsrätt. Enligt Direktivets art. 7 (1) ska medlemsstaterna tillerkänna databaser vilka är resultatet av väsentliga investeringar i anskaffning granskning och presentation visst skydd. Denna uppsats utreder vad rekvisitet "väsentlig investering" enligt art. 7 (1) Direktivet innebär. I uppsatsen utreds vilka sammanställningar som omfattas av Direktivets definition av databas, vem ensamrätten tillfaller, vilka investeringar som är hänförliga till anskaffning, granskning och presentation samt vilka investeringar som ska anses vara väsentliga.

What do we owe to our loved ones? What is the status of these requirements? How do we reconcile them with other requirements? Are we allowed to buy our child an expensive car when that money could save countless strangers overseas? What exactly does morality demand of us? / My thesis defends an account of partiality justified in terms of relationships. I develop the view that relationships are inextricably linked to wellbeing, and I defend the idea that morality must be concerned with our wellbeing. I try to make sense of this account of partiality with the idea that morality carries a requirement of impartiality. If wellbeing is an important part of morally right actions, and if acting in accordance with reasons of partiality (qua relationships) sometimes promotes wellbeing better than impartiality, then some reasons of partiality lead to morally right actions. Minimally, I argue that for why a strictly impartial (or, on the other extreme, a strictly partial) theory does not work. Both reasons (of partiality and impartiality) must be taken into account and carefully calibrated. More ambitiously, I argue for why partiality deserves its own place at the table in normative ethical theorizing. This is not to say that partiality always leads to right action, rather the suggestion is that there are some forms of partiality (found within relationships) which morality requires. / Thesis / Candidate in Philosophy / Some forms of partiality seem clearly wrong, like racial bias or nepotism; in such cases, it is better to consider our reasons to be impartial, which seem to lead to more fairness or equality. Still, there seem to be other forms of partiality which are clearly right, like the love and care a parent has for their child; in these cases, considering our reasons to be impartial seem like (to quote Bernard Williams), “one thought too many.” This thesis tries fit reasons of partiality and reasons of impartiality together, and argues for a view of (moral) partiality grounded in relationships.

Il s'agit notamment de la Convention de l'UPOV, qui s'inscrit dans une logique de protection par la voie sui generis avec la possibilité de délivrance de certificat d'obtention végétale aux sélectionneurs; de l'Accord ADPIC, qui, en plus de recommander un système sui generis efficace, ouvre l'option de protection par brevet ou en définitive par le cumul des deux systèmes; de la Convention sur la Diversité Biologique (CDB) et du Traité de la FAO portant sur les ressources phytogénétiques pour l'alimentation et l'agriculture, qui, favorables aux deux précédentes formes de protection, demandent que soient prises en compte des considérations relatives aux droits souverains des pays sur leurs ressources végétales, au partage des bénéfices, etc. Au plan régional, on distingue, entre autres, l'initiative de l'Afrique, visant à assurer la protection des plantes suivant une logique partagée entre l'alignement sur les normes internationales existantes (Accord de Bangui) ou l'institution d'une autre législation originale qui reflète les réalités et préoccupations du continent (Loi modèle). Il apparaît donc qu'il existe plusieurs instruments pour cerner la même réalité. This has been reflected, at the international level through the adoption of several measures to ensure a fairly comprehensive protection of rights arising. These measures include the Convention of the Union for the protection of Plant breeder' Rights, which is part of a logic of protection through sui generis with the possibility of issue plant breeders' rights to breeders; the Agreement on Intellectual Property Rights Related to Trade, which, in addition to recommending an effective sui generis system gives the option of protection by patent or by the combination of the two systems of law to protect plant varieties; the Convention on Biological Diversity (CBD) and the Treaty on Plant Genetic Resources for Food and Agriculture, which supported both previous forms of protection, ask to be taken into account considerations on sovereign rights of nations over their plant resources, benefit sharing, and so on. At the regional level, there are the initiative of the Africa which aimed to ensure the protection of plants following a certain vision shared between alignment on existing international standards or the institution of another original legislation which reflects the realities and concerns of the continent. It then appears that there are several tools to handle the same reality, which can be a source of difficulty. These are difficulties are conceptual, socio-economic, environmental and legal. T0 overcome these difficulties, it is important that certain conditions are met to harmonise points of view between different actors involved in the issue and ensure a consistent ownership of the instruments adopted.

A discourse on Althusius : an investigation into Sui Generic constitutionalismMcCullock, Matthew R. J. January 2005 (has links)
This thesis aims at furthering our understanding of the constitutional structures and processes of sui generic associations such as the European Union. The thesis argues that the problematical constitutionalisation of the European Union has highlighted the limitations of the political thought that has served as the basis of political associationalism since the Treaty ofWestphalia (1648) and the publication of Thomas Hobbes' Leviathan (1651). These limitations have resulted in the European Union being described, for want of a better expression, as sui generis. The thesis advances the argument that in order to be in a position to understand constitutional relations in a 'non-statal' setting, what is needed is an alternative variant of political thought that is not based in or dependent on the societas canon that originates with Hobbes. One source of such political thought can be located in the work of Johannes Althusius (1557-1638) who, writing in the city of Emden in the Holy Roman Empire in the early 17th Century, described a constitutional structure of a political association that differs in significant features to the centralised state theories of the societas canon. The thesis also argues that the traditional concepts of constitutionalism and political association applied to sui generic constitutionalism are hampered by the inherent weaknesses of modem political and legal vocabulary. Despite being used ad infinitum in the constitutional discussions on the European Union, there is not a precise definition of either the term 'constitution' or treaty' in political or legal theory. Althusius' work avoids this weakness, due to the fact that the centralised state does not enjoy the same position it does in the societas canon, and so the need to classify 'intra' or 'inter' state relationships does not exist to the same degree. While taking the European Union as a workable model of a sui generic association, this thesis does not aim at solving the European Union's constitutional problems or offering a more suitable term to describe its nature. Rather, based on an analysis of Althusius' work, the thesis aims to offer an alternative understanding of the problems that result from the constitutionalisation of sui generic associations.

The Study of Xu Yin-Fan's 'Lu Sui Ji Yao¡¨THEORY of PoetryGuo, Suei-Ci 06 August 2012 (has links)
Fang Hui ¡§Ying Kui Lu Sui¡¨ is one of widely discussed literary productions among Tang and Song poems of eight lines collections, which could be viewed in ¡§Ying Kui Lu Sui Literary Criticism¡¨ edited by Li, Qing-Jia; among the most important criticisms are Ping Ban, Ping Hao, Zha Shen-Xing, Ji Yun, and Xu Ying Fang. Xu Ying Fang is one of the most important poets and poetry critics in Yun Na. ¡§Lu Sui Ji Yao¡¨ is edited in the purpose of teaching students during Xu¡¦s late years of being the chairman in Jing Zheng college.
This literary production has twelve chapters; the first six chapters are about the poems, which are worthy to be followed, and the later six ones are vice versa.
However, Xu passes away before finishing this work. The reason why Xu Ying Fang edits this production bases on the criticism of ¡§Ying Kui Lu Sui¡¨ (written by Fang Hui), and ¡§Ying Kui Lu Sui Kan Wu¡¨ (written by Ji Yun), yet the literary figure of ¡§Lu Sui Ji Yao¡¨ is different from that of Fang Hui. Comparing to the late Qing
dynasty, which is prevalent to the movement of Song poetry with Tong-Guang style, Xu Ying Fang¡¦s reflections toward Tang and Song poetry reversely present the most important feature of poetics in Qing Dynasty- neutrality. Xu partially accepts Fang Hui¡¦s proposition of ¡§one ancestor and three predecessors¡¨; and he further advances the idea of lists Li Shang-Yin, and Wang An Shi into the followers of Du Fu. Moreover, he even raises poetics status of Chen Yu Yi above Chen Shih Dao. Therefore, in ¡§Lu Sui Ji Yao¡¨, Du Fu is the most listed poet among Tang Dynasty poets, and Chen Yu Yi is the poet among Song Dynasty poets; the above arrangement is the most vivid poetic feature, which Xu Ying Fong breaks through Fang Hui¡¦s
previous propositions. The advantages and
weaknesses about poetry appeared among Xu Ying Fong¡¦s literary production are not judaged by times nor poets themselves. His literary criticism is deeply affected by neutral concept and textual research in Qing Dynasty poetics. As a result, ¡§Lu Sui Ji Yao¡¨has been accounted as an important status among the relative works of ¡§Ying Kui Lu Sui¡¨.
