Buscar-se-á compreender este fenômeno através do estudo da técnica, tudo com base nas obras do pensador Jacques Ellul, que trilhou sobre as mais diversas áreas do conhecimento no século passado, com extremo brilhantismo, podendo, além disso, ser considerado um visionário. Mostrar-se-ão os problemas que o avanço tecnológico vem trazendo, os quais complicam o ser humano em sua vida particular, criando neuroses, fruto da adaptação deste ao mundo moderno. Para tanto e de forma mais analítica estudar-se-ão as características da técnica moderna, as quais permitem entender como se dá o desenvolvimento da técnica. Buscar-se-á compreender também o que vem a ser a informação, a principal técnica da atualidade, e as diferentes concepções sobre a sociedade contemporânea. Além disso, analisar-se-á a influência da imagem na sociedade técnica e sua predominância em relação à palavra. Necessária também se mostrou a análise do que vem a ser o comércio eletrônico, o novo modelo de realizações negociais, que se apresenta em franco crescimento. Assim, o estabelecimento virtual surge dentro deste contexto, não permitindo a criação de obstáculos, se encontrando atualmente em todo o mundo, sem enxergar as diferenças culturais e as menosprezando, trazendo uma uniformidade ao mundo, tanto pela forma de comercializar, como pelos produtos que expõe. One of the objectives, is to understand this phenomenon thought the study of the technique, all based on the publications of the philosopher Jacques Ellul, who disserted about the various parts of knowledge in the last century with extreme brilliance,making him a true visionary. The problems brought by technological advances will be shown, these can complicated one's private life, generating neurosis, a product of its adaptation to the modern world. To do so in an analytical form, the characteristics of the modern technique will be studied, permitting tounderstand the development of the technique. The meaning of information, the principal technique used in the actuality, and its different conceptions in contemporaneous society will be explained, and also, the influence of image in the technical society and its predominance in relation with words will be analyzed. The analyses of what is electronic marketing, a new model of business transactions that is in fast growth should also be done. O serviço social e os direitos dos adolescentes : análise das medidas socioeducativas de meio aberto em Fortaleza-CE e Aracaju-SESousa, Iara Barbosa de 14 March 2014 (has links)
The study is going to be presented in this paper intends to analyze the guarantee of the rights of teenagers who pay their penalties through social and educational measures in open spaces, from the point of view of the Social Service. The work of a social worker with these teenagers is full of possibilities and limits. The grounding of this paper rewinds the beginning of this career and of the professional assignment connected to childhood and youth, having as focus the conflict to guarantee social rights of transgressor teenagers. This is a qualitative research, which uses as main technique interviews with social workers who follow teenagers that are under social and educational measures through Assisted Freedom and Community Service. To data collect, it was written an interview guide, which was applied to eight social workers that are involved in treatment centers of social and educational measures in open spaces, in the cities of Fortaleza-CE and Aracaju-SE. The research in Fortaleza-CE happened on April of 2013, and on November of 2013 in Aracaju-SE. After the interviews, the data collected was analyzed through a selection of speeches that are relevant to this study, articulated with some thoughts of writers who dedicated to researches in this subject. The results of this study emphasize that these professionals act in order to pursue the guarantee of teenagers rights, despite the difficulties to access these services. Another information found is about the actions and techniques used in this job, such as individual treatment, collective treatment, home visits, another politics, among others. It was found also some aspects that make these actions harder to execute, like discrimination to teenagers, little investment in childhood and youth, lack of capacity of the professionals who work with them, among others which point out the weakness to guarantee what is fixed by law. Therefore, it is considered that this research revealed limits and possibilities about the garantees of rights of teenagers who pay penalties through social and educational measures in open spaces, as well as the necessity to enlarge and improve the treatment to these young people. It is recommended studies about the politics directly related to treatment of these teenagers that are under social and educational measures, in order to provide to the hard job with subjects so discriminated by great part of society. / O estudo a ser apresentado tem como objeto a análise da garantia dos direitos de adolescentes que cumprem medida socioeducativa em meio aberto, a partir do Serviço Social. O exercício profissional do assistente social junto a esses adolescentes é permeado de possibilidades e limites. A fundamentação teórica resgata o início da profissão e do exercício profissional vinculado à infância e juventude, tendo como foco a luta pela garantia dos direitos sociais dos adolescentes que cometeram ato infracional. Trata-se de uma pesquisa qualitativa, que utiliza como técnica principal a entrevista com assistentes sociais que atuam no acompanhamento aos adolescentes em cumprimento das medidas socioeducativas Liberdade Assistida LA e Prestação de Serviço à Comunidade PSC. Para a coleta de dados, foi previamente elaborado um roteiro de entrevista, sendo aplicado a 8 assistentes sociais em exercício profissional nos núcleos de atendimento de medidas socioeducativas em meio aberto, em Fortaleza-CE e Aracaju-SE. Ressalta-se que a pesquisa de campo em Fortaleza foi realizada no mês de abril de 2013 e, em novembro de 2013, foram realizadas as entrevistas em Aracaju-SE. Posteriormente, foi feita a análise dos dados coletados nesses espaços, por meio de seleção das falas relevantes a esse estudo, bem como da articulação com o pensamento de autores que se dedicaram a pesquisas acerca dessa temática. Os resultados do estudo enfatizaram que existem ações desenvolvidas por esses profissionais, no que diz respeito à busca pela garantia dos direitos dos adolescentes, apesar dos impasses existentes com relação ao acesso a tais serviços. Outro dado refere-se às ações e técnicas utilizadas no exercício profissional, como atendimentos individuais, atendimentos grupais, visitas domiciliares, articulação com outras políticas, dentre outras. Constata-se, também, alguns aspectos que dificultam essas ações, tais como a discriminação com os adolescentes, o pouco investimento na área da infância e juventude, a falta de capacitação dos profissionais, evidenciando a fragilidade em garantir o que está previsto no ECA e SINASE. Considera-se, portanto, que esta pesquisa revelou limites e possibilidades a respeito da garantia dos direitos de adolescentes em cumprimento de medida socioeducativa em meio aberto, além da necessidade em ampliar e melhorar o atendimento a esses jovens. Recomenda-se a realização de estudos sobre as políticas que estão diretamente relacionadas ao acompanhamento de adolescentes que cumprem medidas socioeducativas, a fim de subsidiar a árdua atividade a ser realizada com sujeitos que são discriminados pela grande parte da sociedade.

Constitutional damages for the infringement of a social assistance right in South Africa are monetary damages in the form of interest a just and equitable remedy for breach of a social assistance rightBatchelor, Bronwyn Le Ann January 2011 (has links)
This dissertation will explore the revolutionary progression in the provision of monetary damages and the availability thereof due to the change in South Africa’s legal system from Parliamentary sovereignty to Constitutional supremacy after the enactment of the final Constitution in 19961. The Constitution of South Africa brought with it the concepts of justification and accountability as the Bill of Rights enshrines fundamental rights and the remedies for the infringement of same. The available remedies for the infringement of a fundamental right flow from two sources, being either from the development of the common law remedies in line with the Bill of Rights or alternatively from Section 38 of the Constitution, which provides for a remedy which provides ‘appropriate’ relief. The question that will be raised in this dissertation is, ‘does appropriate relief include an award of delictual damages?’ or a question related thereto ‘is an award of monetary damages an appropriate remedy?’ The motivation for this dissertation arises from the plethora of case law, especially in the Eastern Cape, that has come to the fore in the last sixteen years, highlighting the injustice of cancellations of social assistance grants and the non-payment of such in South Africa’s social security system, as well as the precedent that was set by our Constitutional Court and Supreme Court in remedying that injustice. The central case to this dissertation is that of Kate v Member of Executive Council for Department of Welfare, Eastern Cape 2005 1 SA 141 SECLD; Member of Executive Council, Department of Welfare, Eastern Cape v Kate 2006 (4) SA 478 (SCA), which is generally regarded as having paved the way for the granting of monetary damages for the infringement of an individual’s constitutional right as same require legal protection. Firstly the past approach to damages will be explored in relation to South Africa’s common law, being the Roman-Dutch law. The common law Aquilian action is the focal point of this dissertation in relation to the common law in that the granting of damages for the infringement of an individual’s social assistance right (being a specific constitutional right framed within the 1996 Constitution) results in pure patrimonial loss which in our common law system was remedied by the actio legis Aquilae. In delict, an award of damages is the primary remedy, aimed at affording compensation in respect of the legal right or interest infringed. After the common law system of damages has been explored, this dissertation will then examine the changes that have developed therefrom, and largely shaped by the current state of disorganization in the National Department of Welfare coupled with the all encompassing power of the final Constitution. The final Constitution provides the power, in section 38 of the 1996 Constitution, for the court to award a monetary remedy for the breach of a constitutional right. The question, however, is “does the award of monetary damages not merely throw money at the problem, whereas the purpose of a constitutional remedy is to vindicate guaranteed rights and prevent or deter future violations?” The battle for domination between the common law approach and the constitutional approach to damages is witnessed as the two systems eventually amalgamate to form an essentially new remedy, unique to South Africa. South Africa’s new system is aligned with the Constitution as the Constitution is the supreme law of the land and underpins the awarding of all damages and, especially, the awarding of constitutional damages. For the sake of completeness, alternatives to monetary damages will also be canvassed in this dissertation. It is hoped that the reader will, in the end, realize that the final Constitution is the supreme law of the land and as such dictates the manner and form in which damages are provided. If such provision is not in alignment with the Constitution, it will be declared invalid. The flexibility of our common law is put to the test, yet it is found to be adaptable to the ever-developing boni mores of society exemplified in the embracing constitutional principles and the production of this new remedy. The courts develop the common law under section 39(2) of the Constitution in order to keep the common law in step with the evolution of our society and the ever changing nature of bonos mores. / National Research Foundation

Cette thèse s’intéresse à la protection de la vie privée informationnelle dans le contexte de la biosécurité. La biosécurité se définit comme le processus qui vise à prendre en charge, dans une optique de sécurité nationale, les menaces et dangers que représentent les épidémies de maladies infectieuses pour la santé des populations humaines et la sécurité de l’État. Notre projet remet en question l’idée selon laquelle la conduite des activités de surveillance de la santé publique implique nécessairement une diminution de la protection offerte aux renseignements personnels sur la santé. Nos recherches tendent à démontrer que la conciliation de la surveillance de la santé et la protection de la vie privée est non seulement possible, mais qu’elle est surtout nécessaire. Nous portons plus précisément notre attention sur le cas de la collecte et de l’utilisation de renseignements dépersonnalisés sur la santé par les systèmes de surveillance syndromique. Bien calibrée et soigneusement réglementée, cette forme novatrice et particulière de surveillance offrirait le double avantage de réduire les risques d’atteintes à la vie privée des individus et d’augmenter de manière considérable l’efficacité des capacités étatiques en matière de détection des épidémies. / This thesis focuses on the protection of privacy in the context of biosecurity. Biosecurity is concerned with the threats that epidemics of infectious diseases present to public health and national security. The main goal of my thesis is to challenge the idea that conducting meaningful public health surveillance necessarily implies that the scope of the legal protection given to personal health information has to be reduced. My research demonstrates that, given certain conditions, a public health surveillance conducted with carefully configured syndromic surveillance systems operating with de-identified health data would increase both the efficiency of surveillance in terms of its capacity to detect emerging epidemics and the level of informational privacy of the patients.

The administration of the disability grant by the South African Social Security Agency within Makhuduthamaga Local Municipality, Limpopo ProvinceSekele, Mantima Anna 03 1900 (has links)
Thesis (MPA.) -- University of Limpopo, 2017 / The disability grant administration and dispensation has always been a challenge to the Department of Social Development and cause for concern from recipients of the disability grant. The Government decided on establishing the South African Social Security Agency (SASSA) as an entity to specifically deal with the administration of social grants including the Disability Grant. A number of studies have been conducted around the management and administration of the disability grant. The purpose of this study was to assess the efficiency and effectiveness of the administration and management of the disability grant. It further shows that the South African government spends a substantial amount of money in dispensing this grant. It is therefore necessary to investigate through an empirical research if these funds reach their intended beneficiaries, namely, the disabled community.
This study employed the qualitative method which involved documents analysis, Questionnaire, interview and observation. Policy documents and reports from SASSA were analysed. Twenty applicants and twelve officials and three assessing doctors were interviewed.
The findings of the study reveal that, although the SASSA has an improved model in place to redress and to contribute towards the effectiveness of the administration, there are still certain policy areas that needs to be reviewed. These policy areas include, amongst others, the appeal process, turnaround time, access and processing of the grant. In view of the findings from this study, the major recommendation is that there is a need to review the current booking system to ensure that the applicants are not subjected to unnecessary transports costs, time and delays.
The SASSA needs to embark on vigorous and on-going community campaigns to educate the society on the operations of the SASSA and its jurisdiction within the Makhuduthamaga area.

in the South African social security law. The notion social security is concerned with
the protection of individuals during the happening of certain event such as
unemployment, maternity, disability, old age, sickness, and death. For the purpose of
this study, social insurance schemes which arise from the employment relationship
will be explored. It is submitted that domestic workers like any other employees
should also be afforded social security protection as envisaged in the Constitution of
the Republic of South Africa, 1996 (the Constitution). Therefore, domestic workers
must also be provided social security rights arising out of their employment. Thus,
the research process will involve thorough analysis of statutes, case law, textbooks
and scholarly articles dealing with the social security law protection afforded to
domestic workers, in particular the social insurance component of social security.
For an exceptionally long time, domestic workers have been excluded from the
formal employment sector, which followed that they were automatically excluded
from social security protection. Despite section 9 of the Constitution, this espouses
non-discrimination and equal treatment of all the workers in South Africa. To this
end, there is no comprehensive social security system in South Africa that is capable
of providing adequate social protection to domestic workers. For example, most
domestic workers have no pension fund, and some are not registered with
Unemployment Insurance fund and Compensation for Injuries and Diseases
schemes.

U.S. Intelligence Reform A Bureaucratic Politics ApproachSchickler, Bonnie M. 01 January 2010 (has links)
This study investigates the current bureaucratic struggles that exist within the U.S. intelligence community as a result of the Intelligence Reform and Terrorism Prevention Act (IRTPA) of 2004. The first part of this research examines the history of intelligence reform in the United States beginning with the National Security Act of 1947. The second part provides an indepth discussion of the 2004 legislation as well as an examination of the main bureaucratic conflicts that have arisen between the Director of National Intelligence (DNI) and the rest of the U.S. intelligence community. This study used the bureaucratic politics model to explain the development of the current disagreements, the reasons behind the DNI‘s struggle for power, and the intelligence community‘s inability to adapt to the reform. This research determined that the current conflicts have occurred as a result of the unclear authorities issued to the DNI by IRTPA and have been further exacerbated by interest-driven intelligence agencies and a well-developed culture that has proven difficult to abandon. This research also provides insight into several alternative approaches that can be used to explain the current U.S. intelligence reform process. Additionally, recommendations were made for reducing the bureaucratic friction that currently exists within the intelligence community and to strengthen the overall authority of the Director of National Intelligence.

A legal comparison of a notarial bond in South African law and selected aspects of a pledge without possession in Belgian lawNtsoane, Lefa Sebolaisi 24 February 2017 (has links)
A real security right improves a creditor’s chances of recovering a debt owed to him by the debtor. In the case of an ordinary pledge, the pledgor delivers physical control of his movable property to his creditor to serve as security for the repayment of the principal debt. The increasing value and use of movable property as an object of security coupled with technological advancement have resulted in many countries calling for legal reform of real security rights over movable property. In South Africa this led to the introduction of the Security by Means of Movable Property Act 57 of 1993 which makes provision for a pledge without possession. The Act regulates only special notarial bonds and does not apply to general notarial bonds. The real security right vests in the bondholder upon registration of the bond, provided that the movable property encumbered is described in a notarial bond in a way that makes it readily recognisable. The Act has substituted delivery with registration in the Deeds Registry. Registration of the notarial bond in the Deeds Registry is questioned as to whether it complies with the publicity principle. This is because movable property can be shifted from one place to another without any knowledge on the part of the creditor due to the inaccessible and costly registration system. The third party then receives the property subject to the real security right of the creditor. The substitution of delivery with registration is the controversial feature in this study. Linked to the legal problems regarding compliance with the publicity principle, is the description and identification requirement as provided for under the Act, the exclusion of general notarial bonds from the application of the Act, and the question of whether it is appropriate to regard special notarial bonds as pledges without possession. This study questions whether the current land registry system should be used for the registration of notarial bonds and suggests that a new system designed specifically for the registration of real security rights over movables be considered. I compare the position in the Belgian legal system as regards developments in real security rights over movables to identify possible solutions and recommendations for the South African approach. / Private Law / LL. With the dawn of democracy, the South African social security system was in dire need
of change. The right of access to social security was for the first time entrenched as a
fundamental right in the 1995 Constitution. Since then, many changes have been effected
to the present formal social security system, but these were mostly ad hoc and lacked a
comprehensive approach. The past history of the country led to the exclusion of the
majority of the population from formal social security protection. The excluded and
marginalised had to rely on informal social security measures to provide social
protection. This resulted in a system of co-existence between formal and informal social
security. Although informal social security is increasingly recognised as part of the social
security landscape, the role and importance of informal social security have largely been
ignored in all reforms to improve the protective scope of the present social security
system. The thesis aims to change this. Informal social security has been denied a rightful
place in the South African social security landscape. The thesis recommends a model as
to how the divide between formal and informal social security can be bridged. This
model will, it is hoped, serve as a baseline for stimulating debate and generating new
