-1- Abstract Counsel in the Criminal Proceedings: The objective of our Diploma Thesis is to analyze the currently valid law governing the counsel's position in the criminal proceedings, to evaluate its sufficiency or insufficiency and to provide views and proposals in the sense of 'de lege lata' and 'de lege ferenda', focusing more in detail upon some partial aspects which are closely related to the counsel's position during the criminal proceedings. Good quality law system relating to the counsel's position in the criminal proceedings, his/her process rights and obligations is an assumption for meeting the criminal proceedings purpose and is reflected in the possibility to provide to the accused efficient legal counselling and thus meet the accused person's right of defence and fair trial (process) which is guaranteed by the Constitution. The counsel as an actor operating in the criminal proceedings plays a significant role in enforcing the rights and justified interests of the accused. The counsellor masters the legal argumentation, strategy and tactics of the defence, is able to better formulate ideas, to draw ideas from the experience gained in former law suits, whilst for the accused person his/her position is entirely new and unknown, many time it is the first experience in life. Britská pěchota a proměny evropského válečnictví na přelomu 18. a 19. století / British Infantry and Transformations of European Warfare at the Turn of the 18th and 19th Century

(in English): The author's main focus was on development and causes of military art changes which British infantry has undergone, especially in the years 1775 - 1815. In author's work, given the magnitude and the topic specificity, the only focus was primarily on the study of official documents, which were used for British infantry training and to form a tactical doctrine. Work is divided into five chapters, which consist of an introductory part to the topic issue and analyse warfare factors in the 16th and 17th century that survived throughout the 18th and early 19th century. The second chapter was devoted into two main streams, including tactical ways of thinking related to the 18th century, which Great Britain army faced and socialised with. The second part of the chapter deals with causes and ways of how the first infantry introduces its training with a prescription of all-army presence. The third chapter, as the most comprehensive part of my thesis, analyses the main training document that the British infantry used since 1792. This was meant to be a turning point to the introductory of similar legislation in the Great Britain. Analyzing anti-terrorist tactical effectiveness of picket boats for force protection of Navy ships using X3D graphics and agent-based simulation

Approved for public release, distribution unlimited / S) technologies to demonstrate a prototypical planning tool that can be used by today's deployed warfighter. All research and work is conducted in a web-based, 'user-centric' fashion utilizing a combination of user-driven and agentbased control of entities for simulation iterations, along with various open source technologies which include Extensible 3D Graphics (X3D), Scalable Vector Graphics (SVG), and Extensible Markup Language (XML). Conventions are demonstrated for the integration of the many academic disciplines utilized during this research to achieve automatic generation of tactically significant scenarios. In order to give the end-user the greatest insight towards potential drawbacks in the tactical planning against surface-borne terrorist threats, various 2D and 3D media provide both real-time and non-real time scenario playback. The result of this work is a fully integrated, prototypical, Java-based application that demonstrates how various Open-Source, web-based technologies can be applied in order to provide the tactical operator with tools to aid in Force Protection planning. Scenarios can be auto generated, viewed, analyzed, and manipulated by end users with little to no computer experience necessary beyond requirements for operation of a desktop personal computer (PC) in the Information Technology for the 21st Century (IT-21) environment at sea. South Asian Immigrants' Perceptions of Abuse in Marital Conflicts: When are Male Abusive Tactics an Acceptable Method of Managing Conflicts?

Thesis advisor: Karen Kayser / Abstract As there is an increasing awareness of the occurrence of domestic violence among South Asian immigrants, a need for cultural-sensitive interventions and community education are necessary to break the silence of victims. In order for us to begin the process of breaking the silence, there is need for a paradigm shift that can more accurately capture the experience of South Asian immigrant victims. This paradigm shift requires us to move away from blaming culture for the violence but to look at socialization, acculturation processes and mutuality in relationships as factors that may lead to increased acceptance of abusive tactics in marital conflicts. Using a sample of predominately first generation South Asian immigrants (N= 50), in the United States, the present study investigates the perception of acceptance of a husband's use of abusive conflict tactics to manage marital conflicts. Approximately half of the sample completed online surveys measuring South Asian immigrants' perception of acceptance of marital conflicts and the rest completed a paper survey. Through various statistical analyses such as regression, one-sample t-tests and chi-square, South Asian immigrants demonstrated higher levels of acceptance when it was perceived that the wife violated a social norm and when they perceived the wife as less educated. In addition, South Asian male immigrants who perceived that their own wives were not meeting their needs were more likely to rate the abusive tactics of the husband in the Abusive Conflict Tactics Perception Scale (ACPTS) as acceptable. The findings have implications for domestic violence advocates who are seeking to educate the community on domestic violence by challenging the misperceptions that abuse in marital relations is a direct result of cultural norms rather than socialization that can transcend culture. / Thesis (PhD) — Boston College, 2009. / Submitted to: Boston College. Srovnaní ročních tréninkových plánů florbalových týmů v české a slovenské extralize mužů / Comparison of the annual training plans of floorball top leagues teams in the Czech and Slovak Republic

Title: Comparison of annual training plans of floorball teams in the Czech and Slovak top league of men Objectives: This diploma thesis deals with the comparison of annual training plans in the top league of men in the Czech Republic and the Slovak Republic and on this basis compares the achieved scores in the 2017/2018 season in the highest league. Methods: The quantitative research was about the detection and comparison of a training capacity in the Czech and Slovak top league. To conclude the research aim a questionnaire with open-ended questions was used. The research was implemented in Czech and Slovak top league teams. The questionnaire was completed by 20 Czech and Slovak coaches. Results: Based on the comparison of the annual training plans teams in the Czech top league have 40 % more training lessons than in Slovakia. Teams which weekly dedicate one hour or more to the power play skills are more successful according to statistics in the Czech top league. This hypothesis has not been confirmed in the Slovak League. Hypotheses dealing with technique training and video analysis have also not been confirmed. The American Police Paramilitary Unit: An Analysis of SWAT as an Aggressive Policing Strategy

This research study examines the American paramilitary units know as Special Weapons and Tactics. Throughout this thesis, the fundamental and foundational research on police paramilitary units is presented and discussed. Additionally, this paper focuses on trends of militarization in American policing. Mainly, these trends are identified by the tremendous rise and normalization of American paramilitary police units since the internal societal wars of the 1970s. In this study, research is presented on Special Weapons and Tactics team deployments in the state of Maryland. Four years of data are analyzed focusing on proactive search warrant crime deployments from 2010 through 2013. Several independent variables including, violent crime rates, property crime rates, vice type crime rates and the number of sworn law enforcement officers are examined. Le but de cette thèse est d’analyser l’emploi des blindés dans globalité et jusqu’aux plus petits échelons (pelotons, équipages) c’est-à-dire à hauteur d’hommes (slogan devenu à la mode depuis). En effet beaucoup d’écrits et d’études précédents restent souvent au niveau tactique voire stratégique. Il s’agit également d’étudier les éventuelles différences entre la théorie doctrinale et son application sur le terrain, voir si l’emploi des blindés variait en fonction des acteurs et si oui pourquoi. Cette étude se veut globale, elle prend en compte, les hommes (donc leur formation, leur origine, leur passé), la doctrine et le matériel car l’emploi au combat est la réunion de tous ces facteurs. Les recherches montrent que les trois GU blindées françaises n’étaient pas employées de la même façon, la raison principale résidant dans les conceptions d’emploi des chefs. Les unités blindées françaises étaient composées d’hommes au passé et au parcours différents. Des Gaullistes historiques au jeune engagé d’aout 1944 en passant par les rappelés de l’armée d’Afrique. Tous se retrouvèrent dans les tourelles avec un même but libérer le pays. Elles-mêmes avaient des origines diverses. Certaines n’avaient cessé de combattre, d’autres étaient restées en Afrique du nord ou en Afrique occidentale jusqu’au débarquement allié de novembre 1942. Mais toutes montrèrent un haut niveau de maîtrise tactique et de professionnalisme Leur équipement et leur organisation étaient homogènes car d’origine américain. Leur concept d’emploi était celui dicté par les FM qu’elles adaptèrent à leur main pour combattre à la Française et parfois marquer leur différence par rapport aux alliés. Une fois engagées, elles tinrent toute leur place aux côtés des unités alliés, prouvant leur valeur et marquant ainsi la renaissance de l’armée française. Cette unicité d’organisation, de doctrine et d’équipement masque cependant des différences dans l’emploi. Elles furent tributaires des grandes unités auxquelles elles étaient rattachées et de leur chef. L’emploi des unités blindées dépendait en grande partie des hommes. Des chefs d’abord dont tous n’avaient pas les mêmes conceptions d’emploi des unités blindées ce qui se traduisit par des frustrations et des conflits en particulier entre les généraux Leclerc et de Lattre. Mais également des équipages qui firent preuve d’un état d’esprit remarquable mais particulier et de beaucoup d’abnégation. / The aim of this thesis is to analyze the use of armored vehicles globally and up to the smallest levels (platoons, crews), that is to say at the level of men (slogan that has become fashionable ever since). Indeed, many previous writings and studies often remain at the tactical or strategic level. It is also a question of studying the possible differences between the doctrinal theory and its application in the field, to see if the use of armored vehicles varied according to the actors and if so why. This study is intended to be comprehensive, it takes into account, men (thus their training, their origin, their past), doctrine and equipment because employment in combat is the meeting of all these factors. Research shows that the three French armored GUs were not employed in the same way, the main reason residing in the chiefs' conceptions of employment. French armored units were made up of men with different backgrounds and backgrounds. From the historical Gaullists to the young worker of August 1944, passing by the recalled African army. All found themselves in the turrets with the same goal to liberate the country. They themselves had various origins. Some had continued to fight, others had remained in North Africa or West Africa until the Allied landings of November 1942. But all showed a high level of tactical mastery and professionalism. Their equipment and organization were homogeneous because of American origin. Their concept of employment was that dictated by the FM that they adapted to their hand to fight the French and sometimes mark their difference compared to the allies. Once engaged, they held their place alongside the allied units, proving their value and thus marking the rebirth of the French army. This uniqueness of organization, doctrine and equipment, however, masks differences in employment. They were tributaries of the great units to which they were attached and of their leader. The use of armored units depended largely on men. Chiefs first, all of whom did not have the same conceptions of the use of armored units, which resulted in frustrations and conflicts in particular between Generals Leclerc and de Lattre. But also crews who showed a remarkable state of mind but particular and a lot of self-sacrifice.

Este estudo pretende narrar a história das Filhas da Imaculada Conceição, com ênfase nas táticas utilizadas por elas para formar uma congregação religiosa no sertão de Vígolo (SC), em 1890, a fim de atender idosas doentes, meninas e órfãs. Começa a análise estudando os contextos familiares, religiosos, socioculturais e históricos da fundadora da congregação, Amabile Lucia Visintainer, a qual emigrou da Itália com sua família em 1875. Acompanha o crescimento, a expansão e os processos de institucionalização de sua organização que são consolidados em 1909, no bojo da intervenção romanizada e ultramontana de bispos paulistas e do jesuíta diretor espiritual da congregação. Utiliza como fontes: crônicas das próprias irmãs que viveram a experiência, crônicas de outras irmãs que coletaram e reescreveram sua história, biografias, cartas, entrevistas e outros documentos institucionais que possibilitam investigar o cotidiano dessa antiga comunidade de mulheres que se transformou na quarta congregação a ser fundada no Brasil. Para reler os temas apreendidos das fontes, inspiram-nos as propostas teóricas de Michel de Certeau, as quais subsidiam a reflexão sobre as táticas utilizadas pelas irmãs para inventar sua realidade em Vígolo, Nova Trento e São Paulo. As conclusões apontam, entre outras questões, a relevância para a História da Educação de uma pesquisa voltada para a análise da trajetória e do cotidiano de freiras, possibilitando compreender melhor as razões e os contextos que levam uma congregação feminina a desenvolver um trabalho com meninas e órfãs, o que explica também o sentido da educação que receberam e que ministraram. / This study aims to tell the history of the Daughters of the Immaculate Conception with emphasis on the tactics used by them to initiate a religious congregation in the wilderness of Vigolo (SC) in 1890, in order to care for elderly sick people, girls and orphans. Beginning the analysis by studying the family, religious, socio-cultural and historical backgrounds of the founder of the congregation, Amabile Lucia Visintainer, who emigrated from Italy with his family in 1875. This work follows the growth expansion and institutionalization processes of her organization that is consolidated in 1909, in the course of the intervention of ultramontane and Romanized bishops from Sao Paulo and the Jesuit spiritual director of the congregation. The source of this study are the chronicles of their own sisters who lived through the experience, chronic of other sisters who collected and rewrote their history, biographies, letters, interviews and other institutional documents that enable to investigate the everyday life of this ancient community of women who became the fourth congregation be founded in Brazil. To reread the topics picked up from the sources, we had as inspiration the theoretical proposals of Michel de Certeau, which are the base to reflect on the strategy used by the sisters to invent their reality in Vigolo, Nova Trento and Sao Paulo. The conclusions indicate, among other things, the relevance for the History of Education a survey that aims at analyzing the history and the daily life of nuns, enabling better understand on the reasons and contexts that make a female congregation to develop a working with girls and orphans, which also explains the meaning of education they have received and given.

Cette recherche étudie les enjeux symboliques et organisationnels de la communication managériale, envisagée comme un phénomène « composite ». En mobilisant une heuristique de l’interstice, elle interroge les rapports de pouvoir mis en jeu autour de l’unification et de l’orientation du sens dans ce projet d’encadrement de la parole des managers. Il s’agit, grâce à une approche compréhensive dans une perspective critique, d’analyser les enjeux traversant les médiations de cette méthode, des discours d’escorte aux pratiques en situations des acteurs. Cette mise en tension a permis de montrer que la rhétorique qui a pu contribuer à la fortune de cette méthode est également ce qui peut expliquer certaines des « manières de faire », voire des difficultés pragmatiques qu’elle pose aux acteurs en organisations. Ainsi, l’idéologie aconflictuelle qui travaille la communication managériale se trouve actualisée en situations par les pratiques autour de la communication portée par les managers. Ce faisant, se pose la question des conditions de représentations et d’expressions du dissensus dans des organisations tendues vers un idéal de consensualité marginalisant l’écart. / This research focuses on the symbolic and organizational stakes of managerial communication as a “composite” phenomenon. By using a heuristic of the interstice, it questions the power dynamics surrounding unification and meaning orientation in a project meant to give a frame to managers’ words. Through a comprehensive approach and in a critical perspective, we will analyze what is at stake in the mediations of this method, from appendant speech to actual practices of the participants. Applying this voluntary tension allowed us to demonstrate that the same rhetoric which contributed to the fortune of this method can also explain the way some things are done, or even the pragmatic difficulties encountered by the participants in organizations. Thus, the un-contentious ideology behind managerial communication is updated in practice by customs surrounding communication as carried out by the managers. This raises the question of how the “dissensus” is represented and expressed in organizations reaching for an ideal of “consensuality” that marginalizes difference.

Proactive interpersonal influence tactics: leadership precedent in teams

Influence is the "ability to get others to do something they might not otherwise do" (Mowday, 1978, p. 146), and a literature has developed over the past three decades around proactive interpersonal influence tactics. Given (1) the importance of influence to all in society, (2) the significant gaps that exist in the literature on proactive influence tactics, (3) the empirical and theoretical acknowledgement of the pivotal role that contextual forces (i.e., precedent and history) can exert on organizational phenomena, and (4) the prevailing workforce and workplace trends that have highlighted the need to study this topic, the purpose of this dissertation is to examine how precedent impacts leaders, subordinates, and the proactive influence tactics that are employed across performance episodes and leadership successions in teams. In the leadership literature, complexity leadership theory (Uhl-Bien, Marion, & McKelvey, 2007) has identified the importance of contextual forces (i.e., history) on leadership processes. Similarly, in the teams literature, Ilgen, Hollenbeck, Johnson, & Jundt (2005) have outlined the IMOI framework of teams, which accounts for the non-linearity by which teams' inputs, processes/mediators, and outcomes can influence other future team stages across performance episodes. However, although both the leadership and teams literatures have recognized the importance of contextual forces, the difficulty in studying such factors has left these nascent theoretical perspectives under-explored, particularly in the literature on proactive influence tactics. Thus, this study represents an important undertaking because studying influence in teams without accounting for contextual forces limits our understanding of within-team phenomena. In particular, it is important to consider past precedent within an entity when trying to predict future individual-level behavior, influence processes, and outcomes within that entity. In proposing to demonstrate the impact of contextual forces on individuals and teams, I explore how a leader's use of influence tactics during an initial performance episode within a team impacts a subsequent leader's use of influence tactics during a subsequent performance episode within the team. Further, I explore boundary conditions for that relationship (e.g., prior team performance and team member individual differences). In addition, I study how the relationship between a leader's influence tactic use and subordinates' commitment to do what is asked of them is moderated by factors that stem from previous performance episodes within the respective team (e.g., prior role composition and subordinate perceptions of the current leader's effectiveness relative to the effectiveness of his or her predecessor). In order to study the dynamics of proactive influence in light of team precedent, I study project teams characterized by leadership successions that take place over time during a series of performance episodes. The series of hypotheses I have generated is tested in a multi-level moderated mediation research model using Mplus.
