As medidas de ação afirmativa nas relações de trabalho: por um sistema de metas / Employment relations affirmative action: goals and timetables.

A garantia da igualdade implica a proibição da discriminação. Algumas normas internacionais criaram exceções à proibição de discriminar com o objetivo de permitir a adoção de medidas especiais ou positivas de caráter transitório para acelerar o desenvolvimento e a representação de grupos e categorias que, por motivos discriminatórios, se encontrem em posição de desvantagem diante dos demais. Cabe ao Estado eleger os grupos beneficiários e as medidas de ação afirmativa adequadas para atingir o fim almejado. A constitucionalidade das medidas de ação afirmativa depende da análise em concreto de cada tipo quanto à compatibilidade com os demais direitos e garantias fundamentais por se tratar de medida de exceção quanto à proibição de discriminar. As políticas públicas que incluam medidas de ação afirmativa devem se pautar pelos princípios da razoabilidade e da proporcionalidade, para que a busca da igualdade material não implique o paradoxo de criar novas desigualdades. A política de reserva de vagas por meio de cotas não é o tipo de ação afirmativa mais adequada ao Brasil. As cotas raciais são incompatíveis com a realidade brasileira, carecendo de proporcionalidade na medida em que não se prestam ao fim colimado no tocante ao combate à discriminação e ao preconceito. A formulação de uma política participativa com incentivos à representatividade de grupos sub-representados por meio de metas e cronogramas sem qualquer viés racial tende a atingir melhores resultados sem que o Estado institucionalize a racialização por meio da discriminação reversa. / The equality safeguard implies a ban on discrimination. Some international standards have created exceptions to the ban on discrimination to enable the adoption of special or positive measures, transient in nature, and speed up the development and representation of groups and segments that, because of discrimination, would be at a disadvantage before others. It falls to the government to choose the beneficiaries as well as the appropriate affirmativeaction measures to achieve the desired outcome. The constitutionality of affirmative-action measures depends on a concrete analysis of the compatibility of each type with the other fundamental rights and safeguards since this is an exception to the ban on discrimination. Any policies that include affirmative-action measures must follow the principles of reasonableness and proportionality so that the search for material equality does not entail an inequality-creating paradox. The racial-quota policy is not the appropriate type of affirmative action for Brazil. Racial quotas are incompatible with the Brazilian reality and lack proportionality as they fail to counter discrimination and bigotry. Devising a participatory policy that encourages the representation of underrepresented groups through goals and timetables without any racial bias tends to achieve better results and the government does not have to institutionalize racialization through reverse discrimination.

Railway operation analysis : Evaluation of quality, infrastructure and timetable on single and double-track lines with analytical models and simulation

This thesis shows the advantages of simple models for analysis of railway operation. It presents two tools for infrastructure and timetable planning. It shows how the infrastructure can be analysed through fictive line designs, how the timetable can be treated as a variable and how delays can be used as performance measures. The thesis also gives examples of analyses of complex traffic situations through simulation experiments. Infrastructure configuration, timetable design and delays play important roles in the competitiveness of railway transportation. This is especially true on single-track lines where the run times and other timetable related parameters are severely restricted by crossings (train meetings). The first half of this thesis focuses on the crossing time, i.e. the time loss that occurs in crossing situations. A simplified analytical model, SAMFOST, has been developed to calculate the crossing time as a function of infrastructure configuration, vehicle properties, timetable and delays for two crossing trains. Three measures of timetable flexibility are proposed and they can be used to evaluate how infrastructure configuration, vehicle properties, punctuality etc affect possibilities to alter the timetable. Double-track lines operated with mixed traffic show properties similar to those of single-tracks. In this case overtakings imply scheduled delays as well as risk of delay propagation. Two different methods are applied for analysis of double-tracks: a combinatorial, mathematical model (TVEM) and simulation experiments. TVEM, Timetable Variant Evaluation Model, is a generic model that systematically generates and evaluates timetable variants. This method is especially useful for mixed traffic operation where the impact of the timetable is considerable. TVEM may also be used for evaluation of different infrastructure designs. Analyses performed in TVEM show that the impact on capacity from the infrastructure increases with speed differences and frequency of service for the passenger trains, whereas the impact of the timetable is strongest when the speed differences are low and/or the frequency of passenger services is low. Simulation experiments were performed to take delays and perturbations into account. A simulation model was set up in the micro simulation tool RailSys and calibrated against real operational data. The calibrated model was used for multi-factor analysis through experiments where infrastructure, timetable and perturbation factors were varied according to an experimental design and evaluated through response surface methods. The additional delay was used as response variable. Timetable factors, such as frequency of high-speed services and freight train speed, turned out to be of great importance for the additional delay, whereas some of the perturbation factors, i.e. entry delays, only showed a minor impact. The objective of the thesis is to examine and appraise the accounting and taxation aspects of financial leasing in a particular trading company until valid rules of law within the territory of the Czech Republic. All the information gained was elaborated mainly by the combination of text and open excerption methods. Also methods of synthesis and deduction were used. The text of the thesis is joined by charts, model examples and a diagram which illustrates specialization of the leasing within the Czech Republic. Financial leasing is considered as a very flexible instrument for funding of the long term company requisites. Financial leasing is usually translated as a lease which is followed by surrender of a hired object when the period of lease is over. For a leaseholder financial leasing represents a long term commitment, usually a fixed one. The practical section of the thesis is focused on investigation of accounting and taxation aspects and their impact on a business unit. The cost development of financial leasing, bank credit and cash buying is compared among others.

Esta pesquisa trata da aplicação de meta-heurísticas baseadas em busca em vizinhança variável em problemas de operação de transportes. Desta forma, buscou-se encontrar problemas complexos durante a operação de sistemas de transportes, nas grandes cidades, que possam ser resolvidos com a aplicação de meta-heurística baseada em busca em vizinhança variável. Este trabalho aborda dois diferentes problemas de planejamento e operação de transportes. O primeiro problema abordado neste trabalho é o Problema de Programação da Tabela de Horários, de Veículos e de Tripulantes de Ônibus, no qual as viagens que comporão a tabela de horários, os veículos que executarão as viagens e as tripulações que operarão os veículos são alocadas simultaneamente e de maneira integrada. O segundo problema a ser abordado é o problema de distribuição física, o qual envolve o agrupamento e a alocação de entregas a uma frota de veículos visando minimizar o frete total. Uma abordagem para a modelagem matemática deste problema é modelar como um problema de bin-packing, com bins de tamanho variável unidimensional (do inglês Variable Sized Bin-Packing Problem - VSBPP), ou seja, uma generalização do tradicional problema de bin-packing no qual bins (veículos) de diferentes capacidades e custos estão disponíveis para a alocação de um conjunto de objetos (cargas), de modo que o custo total dos bins (veículos) utilizados seja mínimo. A outra abordagem proposta para o problema de distribuição física é modelar o problema como um problema de bin-packing, com bins de tamanho variável bidimensional (do inglês Bidimensional Variable Sized Bin-Packing Problem BiD-VSBPP). Assim sendo, trata-se de uma expansão do problema de bin-packing com bins de tamanho variável unidimensional (VSBPP), no qual bins (veículos) de diferentes capacidades (capacidade volumétrica e capacidade de carga) e custos estão disponíveis para a alocação de um conjunto de objetos (cargas), os quais possuem as dimensões peso e volume, de modo que o custo total dos bins (veículos) utilizados seja mínimo. Durante a realização deste trabalho, foi desenvolvido um programa computacional em C++, o qual implementa a meta-heurística Busca em Vizinhança Variável (VNS) e duas meta-heurísticas baseadas em VNS. São apresentados resultados de experimentos computacionais com dados reais e dados benchmarking. Os resultados obtidos comprovam a eficácia das meta-heurísticas propostas. / This work approaches variable neighborhood search meta-heuristic applicate on transport operation problems. This way, we sought find complex transport operation problems in large cities that can be solved with the variable neighborhood search meta-heuristic application. This work approaches two different transport planning and operation problems. The first problem approached in this paper is the Bus Timetable Vehicle Crew Scheduling Problem, in which timetabling, bus and crew schedules are simultaneously determined in an integrated approach. The second problem to be approached is the physical distribution problem which comprises grouping and assigning deliveries to a heterogeneous fleet of vehicles aiming to minimize the total freight cost. The problem can be mathematical modeled as one-dimensional Variable Sized Bin-Packing Problem (VSBPP), a generalization of the traditional bin-packing problem, in which bins (vehicles) with different sizes and costs are available for the assignment of the objects (deliveries) such that the total cost of the used bins (vehicles) is minimized. Another proposed approach to the problem of physical distribution is model as two dimensional Variable Sized Bin-Packing Problem (BiD-VSBPP). Therefore, it is an expansion of the bin-packing problem with bins variable-length-dimensional (VSBPP), in which bins (vehicle) of different capacity (capacity and load carrying capacity) and costs are available for allocation a set of objects (loads), which have the dimensions weight and volume, so that minimized the total cost of bins (vehicle). In this work, was developed a C++ software implemented, which was implemented a meta-heuristic Variable Neighborhood Search (VNS) and two others meta-heuristics based on VNS. Computational results for real-world problems and benchmarking problems are presented, showing the effectiveness of these proposed meta-heuristics.
