Juridical prism: modernity's transmutation of the religious, as refracted through secularist law

Modern, Western, secularist legal systems are, in actuality, religious legal systems. The religious bedrock underlying secularist legal systems is the same as the transmuted, and therefore immanentist, faith and creed that underlies the essential mindset and spirit of modernity. Secularist legal systems may be conceived of as semeiotic prisms that refract modernity's relocation, within the phenomenal world, of the transcendence and divine presence of Ultimate Reality. As prisms that bring to light secularist law's customarily unrecognized and unacknowledged, immanentist religious foundation, secularist legal systems express modernity's faith. Further, secularist law acts to validate, enforce, and propagate modernity's religious orthodoxy. Among modernist polities, the United States functions as a bellwether in the modern, Western, civilizational drive to globally proselytize, through the bringing to bear of state power, modernity's worldly religious tradition. Secularist law's unspoken, religious import is powerfully intimated by two interdependent signs that are interwoven within the semeiotic texts comprised by secularist legal systems. Each of these signs embodies one in a pair of reciprocally reinforcing ideas that are avatars of the secularist juridical mind. First is secularist law's idea that all existents - corporeal and non-corporeal; biological and non-biological; human and non-human - are subject to one or another property holder's personal, proprietary claim. Second is the idea that humans, who are in their ontological essence proprietors, have a rightful, transactional power over all existents (inasmuch as all things that exist can be conceived of as property). As these two ideas presuppose that all existing things are reducible to a tangible, proprietary form that is subject to human ownership, ordering, and exchange, they elevate to a presumed level of metaphysical absoluteness both the human proprietary claim and transactional power over existing things, and the things, themselves. The inquiry construes the underlying, religious significance of the two ideas - that is, it reads these two signs - as they occur within the following, ontologically all-encompassing, areas of secularist law: environmental jurisprudence; intellectual property law; and legal doctrine governing the ownership and alienation of human, biological property.

The Experiences of People Who Use Injection Drugs with Accessing Hepatitis C Testing and Diagnosis in Western Countries: A Scoping Review

The purpose of this thesis is to scope the literature to understand how people who use injection drug (PWIDs) experience access to hepatitis C (HCV) testing and diagnosis. The design was a scoping review methodology, guided by Arksey and O’Malley, JBI, and PRISMA-ScR guidelines. A search was conducted through seven electronic databases using a peer-reviewed search strategy. Five studies were yielded through two-level screenings. The extracted data were synthesized using conventional data analysis and reported using tables and narrative summaries. Four categories were found: Awareness and Knowledge, Stigma, Healthcare Service, and Psychological Responses. The studies were conducted in Australia, UK, and US published between 2014 to 2018. A total of 19 participant characteristics were extracted to contextualize their experiences. The World Health Organization’s definition of accessibility should be defined through the guidance of the constructed truths of the individuals in the current context. The lack of demographic data and connection to client quotes further exacerbates the inequities among the population through overlooking their intragroup identities.

The impact of the negative perception of Islam in the Western media and culture from 9/11 to the Arab Spring

Indiana University-Purdue University Indianapolis (IUPUI) / While the Arab spring succeeded in ousting the long-term dictator led governments from power in many Arab countries, leading the way to a new democratic process to develop in the Arab world, it did not end the old suspicions between Arab Muslims and the West. This research investigates the beginning of the relations between the Arab Muslims and the West as they have developed over time, and then focuses its analysis on perceptions from both sides beginning with 9/11 through the events known as the Arab spring. The framework for analysis is a communication perspective, as embodied in the Coordinated Management of Meaning (CMM). According to CMM, communication can be understood as forms of interactions that both constitute and frame reality. The study posits the analysis that the current Arab Muslim-West divide, is often a conversation that is consistent with what CMM labels as the ethnocentric pattern. This analysis will suggest a new pathway, one that follows the CMM cosmopolitan form, as a more fruitful pattern for the future of Arab Muslim-West relations. This research emphasizes the factors fueling this ethnocentric pattern, in addition to ways of bringing the Islamic world and the West to understand each other with a more cosmopolitan approach, which, among other things, accepts mutual differences while fostering agreements. To reach this core, the study will apply a direct communicative engagement between the Islamic world and the West to foster trusted relations, between the two.

La thèse constitue une étude théorique et pratique, où nous avons utilisé l’approche multidisciplinaire du concept de mentalité; nous avons recouru aux disciplines comme histoire, sciences politiques, sociales et économiques, psychologie et management interculturel. / This thesis is a tool allowing to establish, develop, and improve the cooperation between Russian and western partners, as well as help the western representatives of both sectors (private companies and international organizations) develop their activities in Russia. Its main goal is to show the role of national mentality (in our case, Russian mentality) in the development of such relations. This thesis is a theoretic and practical study for which we used multidisciplinary approach to the concept of mentality; we drew upon disciplines like history,social, political, and economic sciences, and intercultural management.

L’objectif de ce travail de recherche est de démontrer qu’il existe de bonnes pratiques économiques et commerciales à adopter pour tout acteur souhaitant évoluer dans une relation entre la République populaire de Chine et les pays méditerranéens occidentaux. Afin de répondre aux attentes des parties-prenantes et de favoriser ainsi le développement économique territorial grâce au modèle proposé, ce travail de recherche met en avant, dans un premier temps, une analyse précise des échanges commerciaux et de la coopération économique entre la République populaire de Chine et les pays méditerranéens occidentaux désormais intégrés dans un contexte globalisé et mondialisé. Après cette étape d’observation, nous avons souhaité modéliser les processus liés au développement économique territorial à travers une grille de lecture issue de l’intégration transrégionale et centrée sur les relations entre la Chine et les pays méditerranéens occidentaux. C’est pourquoi notre question de recherche va tenter de démontrer quel est le modèle de développement économique territorial qui doit être mis en place entre la République populaire de Chine et les pays méditerranéens occidentaux dans une optique de posture de prospérité mutuelle « gagnante-gagnante »? Pour répondre à cette dernière, nous avons établi un modèle d’intégration transrégionale inspiré par la philosophie chinoise Yi Jing qui a pour avantage de prendre en compte tout autant le schéma de pensée occidental que la philosophie orientale dans ses approches. Cela permet de favoriser le développement économique territorial réciproque. / The objective of this research is to prove that good economical and commercial practices exist and that they can be adopted by any actor who aims to develop a relationship between the Popular Republic of China and the occidental mediterranean countries. In order to answer to the expectations of the stakeholders and thus to facilitate the economical and territorial development with the aid of the proposed model, this research work highlights, in a first step, a precise analysis of the commercial exchanges and the economical cooperation between the Popular Republic of China and the western mediterranean countries that are now integrated in a worldwide global context. After the observation step, we have wished to modelize the processes that are linked to the territorial economical development. We used a reading method which comes from the transregional integration and which is focused on the relations between China and the occidental mediterranean countries. This is the reason why our research question will try to prove which territorial and economical development model must be implemented between the Popular Republic of China and the occidental mediterranean countries in a vision of win-win mutual prosperity. In order to answer to this question, we have established a transregional integration model which is inspired by the Chinese philosophy Yi Jing. This philosophy has the advantage to take into account the western thinking scheme as well as the oriental philosophy. This allows the facilitation of the reciprocal territorial and economical development.

Cette thèse de doctorat est consacrée à l’étude de l’un des tabous majeurs des sociétés humaines :la consommation par un individu de la chair ou de toute autre substance issue de ses semblables, autrement dit l’anthropophagie (ou cannibalisme). Selon une approche inédite, la problématique a été abordée dans toute la diversité de ses manifestations, au travers d’une documentation très variée, tant textuelle qu’iconographique, dans le cadre de l’Antiquité grecque et latine et au sein du Moyen Age occidental (latin surtout). L’objectif de la recherche était de mettre en évidence les pratiques, les discours et l’imaginaire d’un comportement alimentaire radicalement étranger aux normes culturelles des périodes et des lieux envisagés.<p>Le plan de la thèse est conçu comme un parcours débutant et s’achevant aux confins du monde (le cannibalisme de « l’Autre »), tandis que le cœur du travail est consacré au cannibalisme de « l’intérieur », celui des affamés et des marginaux surtout. Tout naturellement, l’attention se focalise d’abord sur Homère et la confrontation d’Ulysse avec le Cyclope, qui installe dans la tradition l’imaginaire du pasteur des confins du monde, grand amateur de chair humaine. Hérodote, quant à lui, construit l’image d’un monde connu dont les frontières sont occupées par des peuples qui apprécient bien souvent la chair humaine. Là encore, le pasteur nomade est synonyme de sauvagerie. Une telle tradition perdure chez les auteurs latins antiques et médiévaux, qui reprennent à leur compte les anciens anthropophages en les déplaçant parfois, en les multipliant éventuellement. Mappae mundi médiévales, récits de voyage et descriptions du monde maintiennent dans les siècles qui suivent les mangeurs de chair humaine aux marges du monde, là où Colomb s’attendra plus tard à les trouver.<p>Le rôle du cannibalisme en tant que marqueur d’altérité trouve un écho très fort dans la marginalisation de certains groupes ou individus au sein même des sociétés antiques ou médiévales. A notamment été développé le cas des accusations de cet ordre portées contre les premiers Chrétiens. Le danger représenté par le franchissement de la norme fait naître par inversion des pratiques ou des croyances qui visent à exploiter les potentialités curatives ou « magiques » de la consommation de substances humaines :en témoignent le controversé cannibalisme médical ainsi que le matériel offert par les pénitentiels médiévaux. Un bref chapitre s’attache à un autre genre de comportements en marge :des scènes de cannibalisme censées avoir constitué le point culminant d’épisodes de violence collective.<p>Une grande attention a été accordée au cannibalisme de survie, le recours à la chair humaine comme nourriture de substitution en période de famine. Le passage de l’incompréhension antique face à un comportement indigne de l’homme à l’assimilation par la pensée chrétienne de ce type de cannibalisme à un fléau divin a été largement traité. La longue tradition médiévale des récits, issus de Flavius Josèphe, relatant la consommation d’un enfant par sa mère au cours du siège de Jérusalem a permis de démontrer la force de la présence du thème du cannibalisme dans l’imaginaire médiéval en tant que sanction divine. Arab hip-hop and politics of identity : intellectuals, identity and inquilab

Indiana University-Purdue University Indianapolis (IUPUI) / Opposing the culture of différance created through American cultural media, this thesis argues, Arab hip-hop artists revive the politically conscious sub-genre of hip-hop with the purpose of normalising their Arab existence. Appropriating hip-hop for a cultural protest, Arab artists create for themselves a sub-genre of conscious hip-hop – Arab-conscious hip-hop and function as Gramsci’s organic intellectuals, involved in better representation of Arabs in the mainstream. Critiquing power dynamics, Arab hip-hop artists are counter-hegemonic in challenging popular identity constructions of Arabs and revealing to audiences biases in media production and opportunities for progress towards social justice. Their identity (re)constructions maintain difference while avoiding Otherness. The intersection of Arab-consciousness through hip-hop and politics of identity necessitates a needed cultural protest, which in the case of Arabs has been severely limited. This thesis progresses by reviewing literature on politics of identity, Arabs in American cultural media, Gramsci’s organic intellectuals and conscious hip-hop. Employing criticism, this thesis presents an argument for Arab hip-hop group, The Arab Summit, as organic intellectuals involved in mainstream representation of the Arab community.
