We offer a criteria for selecting relevant proposed amendments to the Constitution in the Brazilian case and evaluate which topics of public policy were constitutionalized, which are more present in the Proposed Amendments and Constitutional Amendments in the country, and if those distribuitions relate to each other. In particular, the objective of this Thesis is to evaluate the different patterns of constitutionalization and amendment of different issues of public policy. The research covers the submission and aproval period from 1988-2010 for the Proposals in the Brazilian Chamber of Deputies. / Esta Tese investiga os temas de políticas públicas constitucionalizados e qual tem sido seu padrão de emendamento no Brasil pós-1988. Desenvolvemos uma proposta de seleção de Propostas de Emendas à Constituição (PECs) a partir do caso brasileiro, e avaliamos quais temas foram constitucionalizados, quais estão mais presentes nas Propostas e nas Emendas Constitucionais no país, e se estas distribuições têm relação entre si. Em particular, o objetivo desta tese é avaliar os diferentes padrões de constitucionalização e emendamento de diferentes temas de políticas públicas. A pesquisa cobre o período de submissão e aprovação de Propostas e Emendas de 1988 a 2010, para as PECs que tramitaram na Câmara dos Deputados.

Marinha do Brasil / O texto constitucional brasileiro de 1988 sofreu diversas alterações em matéria tributária e financeira. Praticamente todas as emendas constitucionais tiveram sua constitucionalidade questionada em razão de alegadas violações aos limites materiais do poder de reforma constitucional. O presente trabalho procura delinear alguns parâmetros para a construção de contornos mais precisos dos limites do poder de reforma constitucional em matéria tributária e financeira. A delimitação de tais parâmetros de reforma, além de contribuir para o exercício da jurisdição constitucional na análise da constitucionalidade das emendas constitucionais, permite que sejam mais bem delineadas quais as decisões fundamentais que a Constituição adotou na seara financeira e tributária, relacionadas ao federalismo, aos direitos fundamentais e à separação de poderes. / This study aims to analyze the constitutional amendments and to examine the limitations to which they are submitted in tax and public finance law. Constitutional changes are necessary as means of preservation and conservation of the Constitution. Constitutional norms are not to be considered perfect but are yet in a constant state of mutual interaction with reality. The obtained results with the research enables us to evaluate the limitations that are imposed to constitutional amendments, the binding orders of the Constitutional Court, the prohibition of abolition of perpetual clauses, as the prohibition retreating to fundamental rights, federalism and separation of powers.

O presente trabalho examina a amplitude do fenômeno do Processo Judicial Eletrônico e as perspectivas de resposta à sociedade com relação à razoável duração do processo e sua celeridade pela utilização dos meios eletrônicos. Com este objetivo, analisa as possibilidades de acesso à justiça e os desafios do desenvolvimento de um novo método que permita aperfeiçoar a participação dos sujeitos processuais para que os escopos jurisdicionais sejam plenamente atingidos. Neste sentido, observa as reconfigurações que as opções políticas realizadas a partir do início deste século engendram, tanto nos princípios processuais em face às garantias constitucionais, quanto na jurisdição e suas interdependências com outros aspectos do direito processual civil. Subsidiariamente, contextualiza o desenvolvimento da atuação estatal no ciberespaço, as estratégias formuladas e a inserção do Poder Judiciário nesta seara. Ao concluir, verificar-se-á que o Processo Judicial Eletrônico é um método em construção que, já dentro do caráter atual de forma autorizada pela Lei nº 11.419/06, quando complementada pela legislação e regulamentação correlata, possibilita maior transparência e participação, tendente a prover efetividade à prestação jurisdicional na sociedade pós-moderna. / This paper investigates the extent of the digital process phenomenon and the perspectives of its impact on the society concerning the examination of the case in a reasonable period of time and its celerity upon the employment of electronic means. In view of this, this study aims to analyze the possibilities of access to justice and the challenges imposed by the development of a new method which enables the improvement in the participation of all related parties in the judicial proceedings so as to fully accomplish the scope of the jurisdictional function. As follows, it examines the reconfiguration engendered by the political options which have been taking place since the beginning of this century both in the procedural principles in light of constitutional guarantees and in the jurisdiction and on its correlation with other aspects of civil procedure. Alternatively, this dissertation contextualizes the progression of the governmental interaction on the cyberspace, the conceived strategies and the insertion of the Judiciary in this field. In conclusion, it will be possible to establish that the digital process is still under development, but even under its current status, as authorized by Law 11,419/06 and complemented by other corresponding regulations, is nonetheless able to ensure more transparency and a higher level of participation, tending to provide effectiveness to the jurisdictional function in the postmodern society.

An Analysis of the Perception of the Degree of Compliance of Selected Texas Public High Schools with Title IX of the Education Amendments of 1972

In recent years, few laws have had greater impact on public education than Title IX of the Education Amendments of 1972. As a result of this legislation, participation levels of female athletes have risen dramatically. Conducted in the Texas Education Agency's Region XI, this study sought to ascertain the perceptions of high school principals, the lead coaches of male athletes, and the lead coaches of female athletes with regard to their schools' compliance with the components of Title IX. The study centered on the results of a survey instrument that included twenty Likert-scale questions as well as several demographic questions. The research questions sought to determine: (1) respondents' overall perception of compliance; (2) any differences in perceptions of compliance based upon the role of the individual; (3) any differences in perceptions based upon the percentage of students qualifying for free and reduced lunch; (4) any differences based upon the state classification of the schools; (5) any differences based upon the gender of respondents; (6) whether complaints filed via OCR result in a perception of increased compliance; and (7) the program component areas in which respondents view their schools to be most compliant. Descriptive and causal-comparative methods were used to analyze the data. The results revealed that school leaders in north central Texas public high schools perceived a high degree of compliance of their schools with the requirements of Title IX regardless of their role. A descriptive analysis of the responses based upon respondent role yielded slight differences between coaches of males and females. An ANOVA of responses considering the variables of free and reduced lunch as well as state classification did not yield a statistical significance in terms of perceptions of compliance. Although the mean scores of female respondents were slightly lower than males, the research did not yield statistically significant differences based upon gender. The study was inconclusive in terms of whether districts that have experienced formal Title IX complaints are more compliant with Title IX. Finally, the study indicated that school leaders should focus more attention on the areas of coaching assignment and compensation as well as publicity as they seek to comply with Title IX.

The Effects of Positive Behavioral Supports in Schools since the Implementation of the Individuals with Disabilities Education Act of 1997 based on 2001 SLIIDEA Data

Congress in 1997 recognized that there were some issues and concerns that had emerged surrounding the Individuals with Disabilities Education Act (IDEA) and sought to address these issues and concerns by mandating a national evaluation on the implementation and progress toward improving outcomes for students with disabilities. The Study of the State and Local Implementation of the Individuals with Disabilities Education Act was designed to address how the amendments of IDEA were being implemented by states, school districts, and schools. This mixed methods study examined the first year of data collected from the six-year Study of the State and Local Implementation of IDEA (SLIIDEA) and analyzing 20 case studies that used interviews of special education personnel and principals, conducted at the local school level. Data from the national survey were examined in light of findings from the case studies. The case studies brought out the varying opinions on implementation success at the local level. Further case studies for each year of the study would be helpful in determining the level of implementation locally and the significant insights of local school personnel on whether these initiatives have worked.

Health Care Institutions and the Taft-Hartley Act: An Assessment of the Impact of the 1974 Amendments

The problem with which this research is concerned is that of determining the impact of the 1974 Amendments (Public Law No. 93-3 60) to the Taft Hartley Act. These amendments provided new coverage to over two million health care workers. The purpose of this study is to determine the impact of this law on labor relations in the health care industry. In retrospect, the first years following the amendments have been eventful; National Labor Relations Board cases, court decisions, increased organizing activities. Boards of Inquiry recommendations, and professional associations union functions are the most significant developments. Future research will be able to present a longitudinal analyses of these activities and investigate other important areas of health care labor relations such as nursing homes and clinics.

Effect of Individualized Curricular Accommodations, Incorporating Student Interest and the Impact on the Motivation and Occurrence/ Nonoccurrence of Disruptive Behavior Displayed By Students with Emotional/behavioral Disorders.

As a result of the reauthorization of the Individuals with Disabilities Education Act of 1997, schools must now consider positive behavioral interventions and strategies to address problem behavior of students with Emotional/Behavioral Disorders (E/BD). Given the poor behavioral, academic, and social outcomes for these students, there is a compelling need to identify effective, proactive interventions. Current literature has well established the ineffectiveness of traditional, punitive, and consequence-laden strategies to deal with behaviors. Research has shown the manipulation of antecedent stimuli, in the form of curricular adaptations, can provide a positive, proactive means of managing behavior. Specifically, curriculum modifications, based on student interest, are proposed as a positive, proactive strategy used to manipulate antecedent stimuli to improve the behavior of students with E/BD. The purpose of this study was to investigate the manipulation of antecedent stimuli through the implementation of individualized, curricular adaptations, based on student interest, to reduce the problem behavior of students exhibiting disruptive behaviors. A second purpose was to explore the effect of those adaptations on the behavior motivation of students with E/BD. In this study, curriculum modifications based on student interest were used to reduce disruptive behavior, increase desirable behavior, and effect change in the motivation for problem behavior among four elementary school boys with E/BD. Use of an ABAB reversal design, including interval data collection, and the use of a behavior rating scale and a motivation assessment scale were used to establish baseline data and determine effectiveness of the intervention. Results indicate that each student demonstrated a reduction in disruptive behavior, an increase in desirable behavior, and changes in motivation for behavior.

First, it develops the historical evaluation of the Constitutionalism and the death pension in the Brazilians Constitutions. Then, it gives emphasis to the Constitution of 1988 and the right of the integrality of the death pension left by the civil servant, regarding jurisprudence. It deals, afterwards, with the public welfare reforms that turned into the Amendments 20/98 and 41/03, with approach towards the tribute problem and the situations inflicted by the summit wage. At the end, it outlines the relation lead by the principle of Juridical Security and the public death pension / O objeto deste estudo compreende uma investigação, sob a ótica do Direito Constitucional, no regime próprio do funcionalismo público visto pelo prisma da pensão previdenciária por ele deixada.
