O recente desenvolvimento de uma teoria crítica dos sistemas, de Gunther Teubner a Andreas Fischer-Lescano, abriu novos horizontes teóricos para aqueles que se propõe a estudar a sociedade e o sistema jurídico. A construção de uma teoria crítica sob condições sistêmicas possibilitou o uso conjunto de temas e conceitos teóricos provenientes da teoria crítica da primeira geração da Escola de Frankfurt (crítica imanente, antagonismos sociais, reificação, dialética do esclarecimento) e da teoria dos sistemas (paradoxo, sistema, sociedade mundial). Partindo disso, o sistema jurídico foi analisado nas dimensões da justiça (como fórmula contingente e transcendente) e de sua crítica imanente como atitude transcendente, especialmente em face de sua tendência em se autorreproduzir como ordem social reificada que gera injustiça pelos excessos de justiça. Para alcançar essas conclusões, este trabalho se propôs a analisar o cenário da sociedade moderna no qual nasce a teoria crítica dos sistemas (Parte 1), lançando bases para os aspectos estruturais e semânticos sobre os quais ela se apoia. Seguidamente, foram estabelecidos os pressupostos teóricos básicos da teoria crítica da Escola de Frankfurt e da teoria dos sistemas de Luhmann (Parte 2) com o fim específico de colher os elementos essenciais à construção de uma teoria crítica dos sistemas voltada para o estudo do sistema jurídico. Logrado esse ponto, focou-se a análise do sistema jurídico e de sua evolução até alcançar sua atual condição na forma de um direito global na sociedade fragmentada (Parte 3). A partir disso a justiça autossubversiva e a crítica imanente do direito foram abordadas em seus aspectos essenciais e possibilitadores de uma autotranscendência sistêmica, capaz de tornar o direito mais responsivo com relação ao seu ambiente, limitando a irracionalidade racional inerente a uma ordem social reificada. A presente dissertação propõe dar mais um passo no sentido do desenvolvimento de uma teoria crítica dos sistemas aplicada ao direito, diagnosticando os dilemas contemporâneos e ao mesmo tempo, apontando os desafios existentes numa sociedade mundial paradoxalmente marcada pela possibilidade de hipertrofia sistêmica das ordens sociais reificadas e pelos processos de constitucionalização que buscam limitar essas ordens. / The recent development of critical systems theory, from Gunther Teubner to Andreas Fischer-Lescano, opened new horizons for the theorists who propose to study the society and the legal system. The construction of a critical theory under systemic conditions allows the joint use of theoretical concepts and themes from the first generation of the Frankfurt School (immanent critique, social antagonisms, reification, Dialectic of Enlightenment) and systems theory (paradox, systems, global society). Starting from this, the legal system was analyzed in the dimensions of justice (as contingent and transcendent formula) and its immanent critique as transcendent attitude, especially against the tendency to self-reproduce as reified social order, which produces injustices because excess of the justice. To reach these conclusions, this study aims to analyze the condition of modern society in which the critical systems theory arises (Part 1), laying the foundation for structural and semantic aspects on which it stands. Subsequently was established the basic theoretical premises of critical theory of the Frankfurt School and the systems theory of Niklas Luhmann (Part 2) with the specific purpose of collecting the essential elements to build a critical systems theory facing the study of the legal system. Reached this point, focused on the analysis of the legal system and its evolution to reach its current status of a global law in a fragmented society (Part 3). Like this the self-subversive justice and the immanent critique of the law have focused on key aspects that enable a systemic self-transcendence, able to make the law more responsive regarding to its environment by limiting its rational irrationality, which implies a reified social order. This thesis proposes give a step further towards the development of a critical theory applied to the law systems, diagnosing contemporary dilemmas and at the same time, pointing out the challenges of a global society paradoxically marked by the possibility of systemic hypertrophy stemmed from reified social orders and the constitutionalization processes that seek to limit such orders.

Dynamic real-time scene voxelization and an application for large scale scenes / Dynamisk voxelisering av stora 3D-miljöer

This report describes a basic implementation of scene voxelization within the Frostbite engine created by EA Frostbite. The algorithm supports dynamic scenes by voxelizing in real-time using the Graphical Programming Unit. The voxel grid is stored inside a buffer with a binary representation using clip mapping and multiple levels of detail. An ambient occlusion algorithm is implemented to show the benefits of the structure. Results from running the application within the engine is presented, both with figures showing the resulting image and timings for diifferent parts of the algorithm. Several future improvements to make the algorithm more competitive is presented as well.

Andreas Hofer : the modernization and Europeanization of the Tyrolean national myth

Depuis le début de la crise des réfugiés en Europe en 2014, nous observons une montée du nationalisme au sein de l’Union européenne. L’apparition de groupes nationalistes et anti-migrants nous montre cette tendance, puisque même en Allemagne, l’Alternativ für Deutschland, un parti d’extrême droite s’est implanté dans l’espace politique. L’Union européenne fait présentement face à une crise d’identité, selon Thierry Chopin de la fondation Robert Schuman et Gérard Bouchard, de l’institut Jacques-Delors. Selon eux, l’Union devrait puiser dans les différents mythes nationaux ayant déjà une forte résonnance au sein des différents pays-membres plutôt que d’en inventer de nouveaux. Le mythe d’Andreas Hofer est un bon exemple de ce phénomène. Le héros de la rébellion de 1809 contre l’occupation bavaroise au Tyrol jouit d’une forte popularité au Tyrol et au Tyrol du Sud, en Italie. Son nom se retrouve sur des enseignes d’auberge, sur des panneaux de rue, et de multiples statues peuplent le paysage tyrolien. Depuis 1984, le mythe de ce héros est entré dans une phase de changement : il est désormais possible de remettre en question la trame du mythe et des événements y étant liés, bref, de douter. À l’aide d’articles de journaux concernant le mythe et ses diverses manifestations (événements culturels, expositions dans divers musées, célébrations, débats politiques, etc.), nous tracerons l’évolution du mythe d’Andreas Hofer depuis l’entrée de l’Autriche au sein de l’Union européenne. Nous observons l’évolution du mythe en trois phases : celle de la modernisation, de la consolidation lors des célébrations du 200ième anniversaire de la rébellion de 1809, et, finalement, celle de l’européanisation. Nous démontrerons ainsi que, contrairement à ce que pensaient plusieurs chercheurs sur le sujet, le mythe est encore très présent aujourd’hui. / Since the European refugee and migrant crisis began in January 2015, nationalism has grown in popularity again across Europe. The number of nationalist parties and anti- migrant movements have increased to a point where there is once again a far-right movement, the Alternativ für Deutschland, in Germany; something thought impossible until recently. The EU itself is facing an identity crisis, as identified by Thierry Chopin of the Robert-Schuman Foundation and Gérard Bouchard of the Jacques-Delors Institute. Both scholars have argued that, instead of creating new national myths to bolster its political support, the EU should exploit existing ones, and indicated that they might already be doing so. Still, the extant literature does not explain how this mythological reframing influences local, mediated discourses and policies. Therefore, the Euroregion of Tyrol- South-Tyrol-Trentino’s Andreas Hofer mythology and its impacts are still strong candidates for study. Indeed, Hofer, who was called the “rebel of the Alps” during the Napoleonic wars, has always enjoyed high popularity in both Tyrol and South-Tyrol in Italy, where his name is on street signs, hotels, and the many statues dedicated to him. Since 1984, Hofer mythology shifted in ways that challenged its traditional narratives. This shift was accomplished, in part, by newspaper articles covering the myth and its various manifestations (e.g., museums, cultural events, and other celebrations). Therefore, the current study traces the myth’s evolution back to Austria’s entry into the EU in 1995 to demonstrate that this folk-hero mythology underwent three stages of development: 1) Modernization, where the myth took on new forms to fit its current local contexts; 2) consolidation, where this new Hofer-imagery coalesced during the rebellion’s 200th-year celebrations in 2009, and, finally; 3) Europeanization. We conclude that, in this final stage, contrary to popular scholarly belief, Hofer and his mythology are still very salient topics and political tools in, not only the Euroregion, but now, also across the whole of Europe.

Earthquakes in complex fault settings: Examples from the Oregon Cascades, Eastern California Shear Zone, and San Andreas fault

The surface expression of upper crustal deformation varies widely based on geologic settings. Normal faults within an intra-arc basin, strike-slip faulting within a wide shear zone, and creeping fault behavior all manifest differently and require a variety of techniques for analysis. In this dissertation I studied three different actively deforming regions across a variety of geologic settings. First, I explored the drivers of extension within the La Pine graben in the Oregon Cascades. I mapped >20 new Quaternary faults and conducted paleoseismic trenching, where I found evidence for a mid-late Holocene earthquake on the Twin Lakes maar fault. I suggest that tectonics and not volcanism is responsible for the most recent deformation in the region based on fault geometries and earthquake timings, although more research is needed to tease out finer temporal and genetic relationships between tectonics and volcanism regionally. Second, I investigated the rupture pattern and earthquake history of the Calico fault system in the Eastern California Shear Zone. We mapped ~18 km of continuous rupture, with a mean offset of 2.3 m based on 39 field measurements. We also found evidence for two earthquakes, 0.5 - 1.7 ka and 5.5 - 6.6 ka through paleoseismic trenching. We develop a number of different multifault rupture scenarios using our rupture mapping and rupture scaling relationships to conduct Coulomb stress change modeling for the most recent earthquake on the Calico fault system. We find that the most recent event places regions adjacent to the fault in a stress shadow and may have both delayed the historic Landers and Hector Mine ruptures and prevented triggering of the Calico fault system during those events. Last, I studied the spatial distribution of the southern transition zone of the creeping section of the San Andreas fault at Parkfield, CA to determine if it shifted in response to the M6 2004 Parkfield earthquake. I used an Iterative Closest Point algorithm to find the displacement between two lidar datasets acquired 13 years apart. I compared creep rates measured before the 2004 earthquake to creep rates calculated from my lidar displacement results and found that there is not a discernible change in the overall pattern or distribution of creep as a response to the 2004 earthquake. Peaks within the lidar displacement results indicate complexity in the geometry of fault locking. / Doctor of Philosophy / Fault behavior varies widely across different regions, depending on the type of fault and local geology. In this dissertation I examine three regions with different mechanisms controlling deformation within them. First, I study the relationship between volcanic and tectonic induced faulting in the La Pine graben in the Oregon Cascades. While volcanoes and tectonics can both produce faults within a region, the surface expression of those faults changes depending on the underlying driver. I map > 20 new faults in the La Pine graben. I also conduct paleoseismic trenching on one of the newly identified faults, the Twin Lakes maar fault, and find that its most recent rupture occurred < 7.6 ka. I conclude that tectonism is the dominant driver of faulting within the La Pine graben based on the fault geometries and timing between identified regional earthquakes and volcanism. Second, I explore recent rupture on the Calico fault system in the Eastern California Shear Zone, which is a wide region across eastern California where deformation is distributed among many faults. Faulting in this region is complex, with some earthquakes occurring on multiple connected faults. I conducted a paleoseismic survey to determine the timing of the most recent earthquake(s) on the Calico fault system. This trenching effort found evidence for 1-2 earthquakes, the most recent occurring 0.5 – 1.7 ka. I use the rupture mapping and earthquake timing to develop a number of various rupture scenarios. I use these scenarios as inputs for computer modeling to explore the regional stress changes from these events and find that they reduce the overall stress in the area, elongating the amount of time between regional earthquakes. Last, I examine how creeping fault behavior on the San Andreas fault near Parkfield, CA changes as a response to an earthquake. Creeping behavior is where the two sides of a fault are continuously moving past one another. I examine the spatial distribution of where the San Andreas fault transitions from creeping to locked behavior by differencing two high-resolution lidar topographic datasets taken after the M6 2004 Parkfield earthquake. I compare my displacement results to pre-2004 datasets and conclude that the transition zone did not appreciably change as a result of the earthquake.

Transkription und Exegese der „KriegsOrdnung/zu Wasser vnd Landt-1594“: Exemplarische Untersuchung einer Kriegsordnung aus dem 16. Jahrhundert

Kriegsordnungen erscheinen in einer Geschichtsperiode, in dem der Mensch sich als Krone der Schöpfung zu verstehen beginnt. Die „KriegsOrdnung zu Wasser und Landt“ von 1594 ist das älteste Buch im Bibliotheksbestand der Polizei Berlin. Der in Leder gebundene Originaldruck umfasst insgesamt 162 Seiten plus nicht nummerierte Vor- und Schlussreden. Zur Verfügbarmachung des Textes ist der bisher noch nicht erforschte Originaldruck transkribiert und digitalisiert worden und kann in der Polizeibibliothek Berlin, die der Polizeiakademie Berlin angegliedert ist, sowohl als digitale Ausgabe, aber auch als Printexemplar (Signatur: D III 1 06/119) ausgeliehen werden. Soweit es möglich war, entspricht die neuhochdeutsche Auslegung des Textzeugen den originalen Formulierungen. Ausgenommen von dieser Vorgehensweise sind die Besoldungstabellen sowie die im Anhang befindlichen Muster- und Registerrollen, die die alphabetische Verwaltung der eingeschriebenen Rekruten, die Bestallung bzw. die Höhe der Besoldung beinhalten. Dem Deckblatt der Kriegsordnung ist zu entnehmen, dass der Regiments- und Musterschreiber, Andreas Reutter von Speyer, die Kriegsordnung des Adam Junghans von der Olßnitz überarbeitete, Unnötiges entfernte, und durch neue Praktiken der Kriegsführung ersetzte. Er kürzte den Artikelbrief von ursprünglich 57 Artikeln auf 44 und bleibt in der weiteren Textformulierung als imaginärer Lehrer in der „Ich“- Form präsent. Das Buch kann folglich als Lehrbuch verstanden werden. Der Autor orientierte sich in seiner Darlegung an der Kriegsordnung aus dem Jahr 1589. Diese Kriegsordnung war für die Aufstellung eines königlichen Heeres verfasst worden und erscheint erneut im Jahr 1611; diesmal als Regelwerk für die Aufstellung eines kaiserlichen Heeres. Die Prioritäten der Textinhalte sind diesem Ziel untergeordnet und unterscheiden die drei Kriegsordnungen voneinander. Der Aufbau der Artikel in der Kriegsordnung von 1594 folgt, bewusst oder unbewusst, einem didaktischen Prinzip; nämlich: Lehrinhalte aus einem komplexen Text herauszulösen und auf ein Wesentliches zu minimieren, so dass der Inhalt für eine breite Masse verständlich wird. Im Falle der Kriegsordnung des Andreas Reutter von Speyer ist dieses Wissen offensichtlich für ein Fähnlein „[…] Theutchses Krigs volck […]“ als eine Art Lehrbuch geschrieben worden. Es enthält Erfahrungswissen, dass der Musterschreiber für eine junge Zielgruppe verfasste, wie im nicht nummerierten Vorwort zu lesen ist. „[…]Demnach dann diß Büchlein nicht den Alten geübten/son=der den jungen anhebenden Kriegsleuten zuuor angefangen/vnd jetzt Corigiert/vnd der gelegenheit nach gebessert/ vnd aber=mals in Druck verfertiget worden/[…].“ Ein Fähnlein hatte eine Personalstärke von 400, später 500 Mann. Außerdem enthält die Kriegsordnung von 1594, anders als die Ausgaben von 1589 und 1611, keinerlei Hinweise auf die „Policeyordnungen“ des 16. Jahrhunderts, was die These stützt, dass die Ausgabe des Andreas Reutter von Speyer der militärischen Ausbildung und Lehre diente und mit dieser Bestimmung verfasst worden ist. Den Zusammenhang mit den Ordnungsstrukturen des Gemeinwesens hielt der Autor offensichtlich für entbehrlich. Die zwischen den Zeilen der Musterrollen notierten Hinweise des Musterschreibers und der Inhalt, sowohl der Vorrede als auch der Schlussrede, in denen persönliche Einstellungen und Weltbilder sichtbar werden, lassen viel Raum für philosophische Betrachtungen und zwingen den Lesenden die Frage auf, wieviel Humanismus in einer Ordnung steckt, die dem Krieg gewidmet war. Der Text auf Seite 145: „Zu vnrechtmessigen Kriegen sol keiner sich ge=brauchen lassen.“, kann als Aufruf an nachfolgende Generationen verstanden werden. Ein Ruf aus dem 16. Jahrhundert, der durch die Transkription des Textzeugen bis ins 21. Jahrhundert dringt.

A Creative Tension: Anthropocentrism and the Human-Nonhuman Boundary in Christian Europe, 1400-1700

This dissertation seeks to understand the idea of a boundary between humans and non-human creatures in the early modern era. The idea of a boundary between people and non-people, while implicit among most sixteenth-century theologians, is still an important feature of early modern history. However, the boundary, while rhetorically very important and static, did not match with the reality of the boundary in theology and culture as fluid. Theologians argued at length that humanity, being made in the “image of God,” retained a fundamental difference from animals and other nonhuman creatures, in which that boundary could not be crossed. However, they also allowed for animals to possess positive traits and even moral and legal culpability. They also accepted creatures that challenged the boundary, whether monsters (including exotic creatures and misbirths) or humans who were not thought to possess all of the constituent characteristics of the “image of God,” such as those with mental or cognitive deficiencies. Thus, they struggled to reconcile the experiential reality of a fluid boundary with the theological conviction of an anthropocentric hierarchy of creation. This dissertation will address the inherent tension between these two views and assess the ways in which theological and cultural figures helped to resolve the tension. Using early modern commentaries on Genesis, we will first examine the rhetorical insistence on a firm boundary articulated by figures both mainstream and heterodox. Then, we will examine the popular perception of a fluid boundary, in which nonhuman creatures could be addressed and understood morally in bestiaries, saints’ lives, and trial records. Finally, we will examine how proto-scientific thinkers of the sixteenth century, like Conrad Gessner, Andreas Vesalius, Johann Weyer, and Ambroise Paré, actively challenged existing authorities and helped to resolve the tension to a state in which humans and nonhuman creatures were different, yet both existed within the broader sphere of nature. By the end of the sixteenth century, violations of the boundary between people and non-people come to be rejected more for their natural than theological implications.

What’s Mine is Mine, What’s Yours is Negotiable : A Study of Active Measures Within Russian Soft Power

Västerländska och ryska perspektivär oförenliga. Detsamma gäller för uppfattningenom mjuk makt. När möjliga framtida scenarion av rysk utrikes-och säkerhetspolitik analyserasär ettav det mest framträdande skapandet av nya och kreativa metoder för att försvaga motståndare utan att tillgripa militära medel. Aktiva åtgärder är en uppsättning av sådana instrument. Ur ett akademiskt perspektiv är det förbryllande att en av de främsta experterna på rysk mjuk makt, holländaren Marcel H. van Herpen, förbisåg aktiva åtgärder som metod för att främja rysk mjuk makt i sin teori som beskrivs i Putin’s Propaganda Machine. Studien har en teoritestande ansats och undersöker samma instanser av mjuk makt som Herpen i den tidigare nämnda boken men adderar ytterligare en dimension till forskningen, nämligen aktiva åtgärder. Dessa analyseras med stöd av ett modifierat metodologiskt ramverk av Jonas J. Driedger. Slutsatsen av denna studie är främst att Herpens teori är tekniskt korrekt men de facto saknar relevanta dimensioner. Således kan teorin enbart demonstrera fall av rysk mjuk makt, men inte förklara eller operationalisera. Genom att addera perspektivet aktiva åtgärder för att analysera fallen i källor, metoder och konsekvenser, stärks den vetenskapliga förståelsen för mjuka maktmedel i den ryska arsenalen. Studien resulterar även i utvecklingen av en metod för att upptäcka ryska mjuka maktmedel med hjälp av identifiering av aktiva åtgärder. Vidare påvisas även att flertalet mjuka maktförstärkande strategier används för att genomföra Kremls aktiva åtgärder samt ryska utrikespolitiska mål i allmänhet, vilket framgår av de kvalitativa fallstudier som presenteras. Slutligen ifrågasätter resultaten av studien och efterföljande analys den västerländska uppfattningen om mjuk makt som en global företeelse. / Западная и российская точки зрения несовместимы. То же самое относится и к понятию мягкой силы. При анализе возможных будущих сценариев внешней политики и политики безопасности России одним из наиболее примечательных является создание новых и креативных методов ослабления противников без применения военных средств. Активные меры представляют собой набор таких инструментов. С академической точки зрения вызывает недоумение тот факт, что один из ведущих экспертов по российской мягкой силе, голландец Марсель ван Херпен, упустил это из виду в своей теории, описанной вкниге «Путинская пропагандистская машина».  Настоящее, исследование основано на проверке теории и, таким образом, рассматривает те же примеры мягкой силы, что и Херпен в ранее упомянутой книге, но добавляет к исследованию  ещё одно параметр, а именно активные мероприятия. Они проанализированы при поддержке модифицированной методологической базы Джонаса Дж. Дредджера. Вывод исследования в основном состоит в том, что теория Херпена технически верна, но в теории фактически не хватает некоторых важных аспектов. Таким образом, теория может только продемонстрировать случаи российской мягкой силы, но не объяснить или операционализировать их. Другим результатом исследования является разработка метода выявления российских мягких средств силы посредством выявления активных мероприятий. Кроме этого, нами показано, что большинство стратегий усиления мягкой силы используется для реализации активных мероприятий Кремля, а также целей внешней политики России в целом, что видно из представленных в работе качественных тематических исследований. Результаты исследования и последующего анализа ставят под сомнение западное представление о мягкой силе как о глобальном явлении.

This dissertation critically evaluates the issue of the `silencing' of the subaltern woman in the 1988 version of Gayatri Spivak's essay `Can the Subaltern Speak?' The conclusions reached are then related to the novel The Purple Violet of Oshaantu by the Namibian woman writer Neshani Andreas. Chapter 1 deals with the essay `Can the Subaltern Speak?' and the `silenced' subaltern woman, examining both Spivak's theory on this issue as well as criticism of this theory by different postcolonial theorists. Chapter 2 presents aspects of both the creative and political practice of women, specifically the woman writer, in certain countries in Africa. Chapter 3 deals with the novel The Purple Violet of Oshaantu by Neshani Andreas and explores issues like the `silencing' of the subaltern women in the novel, opposition to patriarchal oppression and the engendering of agency by both the writer and the characters in the novel. / English Studies / M.
