O programa Prêmio Capes de Tese : avaliação dos resultados pós-premiação

As premiações e honrarias a cientistas fazem parte da dinâmica de funcionamento da atividade científica desde o século XVII. O sistema de recompensas da ciência reforça essa prática baseada na motivação dos cientistas em busca de reconhecimento. No entanto, a lógica desse sistema a partir da estratificação dos cientistas e suas contribuições faz com que haja uma distribuição desigual dos créditos aos pesquisadores, favorecendo os pesquisadores com maior reconhecimento. Os estudos bibliométricos revelam tendências e normas de atuação desse sistema a cientistas ganhadores de grandes prêmios internacionais como Prêmio Nobel e Medalha Fields. Diante desse arcabouço teórico, cabe analisar de que maneira o sistema de recompensas afeta jovens cientistas no início da carreira e quais as consequências destes para a carreira científica e profissional. O estudo tem como objeto os doutores premiados, em âmbito nacional, com o Prêmio Capes de Tese, outorgado pela agência de fomento Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) que desde 2006, premia anualmente as melhores teses de doutorado em 48 áreas de conhecimento, com bolsas de pós-doutorado em instituições de excelência no país e no exterior. A partir dos resultados foi possível verificar que o tema da tese premiada permanece atual, e que mesmo os contemplados que não utilizaram as bolsas de pós-doutorado se beneficiaram dos efeitos do reconhecimento do prêmio na comunidade científica. / The scientific awards and honors are part of the operating dynamics of scientific activity since the seventeenth century. The reward system of science reinforces this based on the motivation of scientists in search of recognition. However, the logic of this system from the stratification of scientists and their contributions means that there is an unequal distribution of credit for researchers, encouraging researchers with greater recognition. Bibliometric studies reveal trends and models of performance winners of major international awards such as the Nobel Prize and Fields Medal. Given this theoretical framework, we analyze how the reward system affects young scientists in their careers and their consequences for the scientific and professional career. The object of this study is the winning doctors, nationwide, with the Capes Thesis Award, awarded by the Brazilian Federal Agency for Support and Evaluation of Graduate Education (CAPES) that since 2006, offer annually awards to the best doctoral thesis in 48 areas of knowledge, with post-doctorate scholarships in institutions of excellence in the country and abroad. From the results we observed that the subject of the award-winning thesis remains current, and even contemplated that didn’t use the post-doctorate scholarships were benefited from the effects of the recognition of the award in the scientific community.

Through this paper, the authors comment on the application of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, approved in New York on June 10, 1958, through the review of the most relevant case-law of the main jurisdictions in arbitration in Latin America. The following article provides a review of the different ground for refusal of recognition that a party can use to oppose the recognition of an award, revealing the criteria used by the courts to enforce or deny recognition of a foreign award. / A través de este artículo, los autores comentan la aplicación de la Convención sobre el Reconocimiento y la Ejecución de Sentencias Arbitrales Extranjeras, aprobada en Nueva York el 10 de junio de 1958, a través de la revisión de la jurisprudencia más relevante de las principales jurisdicciones en materia arbitral de América Latina. El siguiente artículo aporta una revisión de las diferentes causales que puede utilizar una parte para oponerse al reconocimiento de un laudo evidenciándose los criterios que emplean las cortes para amparar o denegar el reconocimiento de un laudo extranjero.

Partes e terceiros na arbitragem / Parties and third parties in arbitration

A tese discute o problema dos terceiros na arbitragem. Ela distingue os planos substantivo (contratual) e processual (jurisdicional) da arbitragem e, portanto, o status de parte e terceiro com relação, respectivamente, à convenção de arbitragem e ao processo arbitral. Depois de desenvolver as premissas teóricas na Parte 1, a Parte 2 expõe as teorias contratuais e societárias por meio das quais um não-signatário pode ficar vinculado à convenção de arbitragem, com destaque para a extensão a todos os acionistas da companhia da cláusula compromissória estatutária, bem como para a aplicação do princípio da boa-fé objetiva (teoria dos atos próprios, estoppel) para impedir com que determinados signatários burlem a convenção de arbitragem ao incluir terceiros no polo passivo da demanda ou, ainda, para impor a arbitragem a não-signatários que derivaram um benefício do contrato inter alios. Na Parte III, a atenção volta-se para o processo e a sentença arbitral. Expõe-se uma teoria dos efeitos da sentença, buscando-se explicar a sua potencial eficácia ultra partes com base: a) na necessidade de realizar o direito da contraparte à tutela jurisdicional (adquirente do direito litigioso, sucessores post rem judicatam); e b) na identificação de nexos de prejudicialidade-dependência permanente entre as relações jurídicas no plano do direito material (terceiro titular de situação dependente). Refutam-se, em passo seguinte, teorias que preconizam o valor absoluto da sentença. Oferece-se, como núcleo da tese, uma reconstrução dogmática das modalidades de intervenção de terceiro, buscando adaptá-las à arbitragem para alcançar, em cada situação, um justo equilíbrio entre as expectativas contratuais das partes originárias e a natureza privada da arbitragem, de um lado, e os efeitos da sentença perante terceiros, de outro. Conclui-se que, em alguns casos, legitima-se o terceiro a intervir voluntariamente, mesmo contra ou independentemente da vontade das partes, se ele estiver sujeito aos efeitos da sentença. Em hipótese excepcionalíssimas, ademais, a parte pode sujeitar um terceiro aos efeitos de intervenção, provocando a sua assistência no processo arbitral. / The thesis addresses the problems of third parties in arbitration. It distinguishes the substantive (contractual) and procedural dimensions of arbitration and, hence, the status of parties and third parties in connection with, respectively, the arbitration agreement and the arbitral proceedings. After spelling out theoretical premises in Part 1, Part 2 covers the contractual and corporate theories by which a non-signatory may be bound by the arbitration agreement, highlighting the extension to all shareholders of the agreement in the corporate bylaws, as well as the application of the equitable doctrine of estoppel to bar certain signatories from avoiding the arbitration agreement by including third parties as defendants or even to impose arbitration onto non-signatories who derived a benefit from the contract inter alios. In Part III, my attention turns to the proceedings and the arbitral award. I set out a doctrine of the effects of judgments, seeking to explain their potential effects on third parties based: a) on the prevailing need to preserve the counterpartys right to a binding declaration on its asserted claims (acquirers, successors post rem judicatam); b) the identification of substantive ties between legal relationships that make the third parties rights permanently dependent on the situation between the parties. I then refute theories ascribing absolute value to the award vis-à-vis third parties. As the core of the thesis, I offer a doctrinal reconstruction of third party interventions, seeking to adapt them to arbitration in order to achieve, in each situation, a fair balance between the contractual expectations of the original parties and the private nature of arbitration, in one hand, and the effects of the award on third parties, on the other. I conclude that a third party should be allowed to intervene, albeit against the will of the parties, if it is subject to the concrete effects of the arbitral award. In exceptional situations, moreover, a party may vouch in a third party, who will then be bound by the determinations of factual and legal issues made in the award.

Conselho Nacional de Desenvolvimento Científico e Tecnológico / This research aims to identify and characterize the main evolution of Management Organizations according to the Gaucho Program of Quality and Productivity, Level II - Towards Excellence, developing an examination of the main learning practices used in recognized organizations which have the Quality Award RS. This issue has an extreme importance to the award granting, which assures a good performance and maintain the survival of the business. As regards the research method, this study can be characterized as descriptive, predominantly qualitatively. Its approach was based on a study case, whose unit of analysis was considered from the universe of winner companies of the Trophy Gold Award Quality of RS. As a basis of research, the theme organizational learning in literature and its applying on Criteria for Excellence in the National Quality Awards were discussed together with the Gaucho program of Quality and Productivity. The implementation of this study has been performed through the adoption of a conceptual model for verification of organizational learning developed by Guaragna (2004). In consequence, the Report of Management was analyzed and the coordinators of the Management System of two companies, recognized by submitting processes cross outlined in a structure, were interviewed. This approach allows the occurrence of practices of organizational learning that are on course in the follow organizations: Centro Tecnológico de Mecatrônica SENAI and Medianeira Transportes Ltda. Based on the study, it is supposed that the learning can be understood as a process with specific characteristics, in which leaders have a key function in its achievement, occurring by meetings of critical analysis, preparation or revision of the Strategic Planning and benchmarking with companies in the same segment. Finally, it is suggested that further researches should be developed in order to verify the effectiveness of the practice of organizational learning and the competitive gap created to the organizations by the Quality Award RS in its different modalities. / A presente pesquisa tem como objetivo principal identificar e caracterizar a evolução da Gestão de Organizações de acordo com o Programa Gaúcho da Qualidade e Produtividade, Nível II - Rumo a Excelência, por meio do exame das principais práticas de aprendizagem utilizadas nas organizações reconhecidas com Prêmio Qualidade RS, visto ser esse tema fundamental à concessão da referida premiação, à sobrevivência e ao desempenho empresarial. Quanto ao método de pesquisa, este estudo pode ser caracterizado como descritivo, predominantemente qualitativo, a sua abordagem baseou-se em um estudo de caso, cuja unidade de análise considerada foi extraída do universo de empresas ganhadoras do Troféu Ouro do Prêmio Qualidade RS. Como forma de pesquisa, buscou-se identificar o tema aprendizado organizacional na literatura e sua abordagem nos Critérios de Excelência do Prêmio Nacional da Qualidade, concomitantemente ao Programa Gaúcho da Qualidade e Produtividade. A execução deste estudo deu-se por meio da adoção de um modelo conceitual para verificação do aprendizado organizacional desenvolvido por Guaragna (2004) e, mediante análise do Relatório de Gestão e entrevista com os coordenadores do Sistema de Gestão de duas empresas reconhecidas por apresentarem processos delineados e uma estrutura interfuncional, que possibilita a ocorrência de práticas de aprendizagem organizacional que estejam em decurso nas organizações: Centro Tecnológico de Mecatrônica SENAI e Medianeira Transportes Ltda. Com base no estudo, sugere-se que o aprendizado possa ser entendido como um processo com características específicas, nos quais as lideranças têm papel fundamental na sua implementação, ocorrendo por meio de reuniões de análise crítica, elaboração ou revisão do Planejamento Estratégico e, benchmarking com empresas do mesmo segmento. Por fim, sugere-se que pesquisas futuras sejam realizadas com o intuito de verificar a eficácia das práticas de aprendizagem organizacional, bem como o diferencial competitivo gerado às organizações, pelo Prêmio Qualidade RS nas suas diferentes modalidades.

The impact of extrinsic rewards on employee motivation and organisational effectiveness : a case study of ZFC Limited in Zimbabwe

Submitted in fulfillment of the requirements for the Degree of Masters in Management Sciences Specialising in Human Resources Management, Durban University of Technology, Durban, South Africa, 2017. / This research project was aimed to investigate the impact of extrinsic rewards on employee motivation and organisational effectiveness at ZFC Limited in Zimbabwe. In the globalised environment, it is of important to ensure a motivated workforce because employees are the only asset that appreciates in value over time, thereby directly contributing to organisational outcomes. Employee motivation has been a major problem in manufacturing companies in Zimbabwe, due mainly to poor salaries and pecuniary benefits such as transport allowances and bonuses. The main objectives of the study were to determine employee perceptions of extrinsic rewards, ascertain the relationship between extrinsic rewards and employee motivation and determine the effect of extrinsic rewards on organisational effectiveness. The study adopted a quantitative paradigm, which entailed a structured questionnaire being distributed to respondents. The structured questionnaire comprised Section A and Section B. The sample size was 140, which was derived from a target population of 280 employees through the systematic sampling technique. The researcher used the personal method in distributing and collecting questionnaires to sample respondents and 98 completed questionnaires were returned. This equated to a high response rate of 70%. Furthermore, the data collected was analysed using the Statistical Package for Social Sciences (SPSS) Version 24.0 for Windows. Upon completion, the entire dissertation was checked for plagiarism through the TURNITIN program. The study found that salaries, bonuses and transport allowances were amongst the top extrinsic rewards at ZFC Limited in Zimbabwe. Good financial rewards are vital in influencing the behaviour of employees, as well as in enhancing organisational outcomes. The researcher recommended that ZFC Limited should consider reviewing the reward system, offering competitive financial rewards and timeously rewarding employees. The research project concluded with directions for future research on the role of extrinsic rewards on employee behaviour. / M

(Information Science) / Although the influence of literature cannot be determined exactly, it is generally accepted that it can influence attitudes and values and therefore play an important role in the socializing process of the adolescent. One of the most important processes the adolescent undergoes is the development of his/her sex role through socialization, within the context of the family and society at large. In addition the traditional role of women through the ages has undergone such substantial changes that women play an increasingly important part in society. The modern woman can attain self-realization and self-expression through marriage, motherhood and a career. The problem addressed in this research, is whether the portrayal of women in available youth literature is a realistic reflection of society at a particular point. The ideal is that the attitudes that are projected are not biased toward either of the sexes and that boys as well as girls may develop to their full potential within the prescribed boundaries of their sex roles. Because of the feminist interest, much research has been done since the sixties and seventies regarding sexism in children's and youth literature. Virtually throughout, the findings of these investigations showed that the female characters are portrayed as passive stereotypes. The portrayal of women in literature awarded with the Scheepers Prize for Afrikaans youth literature is investigated in this research.

Esta dissertação se propõe, em um primeiro momento, analisar o campo literário brasileiro a partir do prêmio literário Portugal Telecom. Por meio do estudo do prêmio, identificam-se alguns elementos que expandem a compreensão do campo, como a posição dos agentes culturais, quais sejam, escritores, editores, curadores, críticos e administradores culturais. Parte-se do pressuposto que o campo é um lugar de disputas, e que cada um desses agentes atua de forma a adquirir ou manter a posição de prestígio. Além disso, os romances premiados no Portugal Telecom fornecem pistas que permitem delinear as tendências narrativas da literatura brasileira do séc. XXI. A hipótese é a de que o prêmio ajuda a consolar um prestígio já adquirido por seus agentes, funcionando duplamente como instrumento de legitimação e confirmação do prestígio / This dissertation proposes, in a first moment, to analyze the Brazilian literary field from the literary award Portugal Telecom. Through the study of the award, we identify some elements that expand an understanding of the field, such as a position of cultural agents, which are writers, editors, curators, critics and cultural administrators. It starts from the assumption that the field is a place of disputes, and that each of the current agents in order to acquire or maintain a prestigious position. In addition, the non - Portugal Telecom award - winning novels, which are more complex than the narrative tendencies of Brazilian literature of the 20th century XXI. The aim of the diploma thesis is to find out and evaluate the influences affecting the price of building land in the city of Brno. The theoretical part of the thesis defines the concepts of laws relating to building land. Selected land is located in the city of Brno, which also analyzes the market of building plots. In addition, the aspects that influence the price of the building land in the valuation according to the price regulation are summarized. The analytical part is focused on the land to which the price data was published in the cadastre of real estate, which are then confronted with the valuation decree. In the end, the informations obtained are evaluated.
