Is It Worth It? Evaluating an Open Educational Resources Awards ProgramSergiadis, Ashley, Smith, Philip 01 January 2022 (has links)
Awards or grant programs are a common way for higher education institutions to incentivize the use of Open Educational Resources (OER) and other affordable course materials. This study evaluates the results of a two-year pilot OER awards program at East Tennessee State University. To assess the awards program, we used data from student savings and program costs, grades, drop-fail-withdrawal (DFW) rates, and survey results compiled within the COUP framework (Cost, Outcomes, Usage, and Perception). The initial monetary return on investment was moderately positive, while the grades and DFW rates remained steady. The faculty and students rated the open and affordable materials as well as the OER awards program favorably but expressed some issues with using and implementing open and affordable resources. Based on these results, we determined that the awards program was worth the costs and efforts but needed improvements specifically to address the faculty’s feedback around the lack of time to implement OER and the absence of OER for their courses.

Kreativitet är en av de viktigaste komponenterna i effektiv marknadsföring. Årligen anordnas hundratals branschtävlingar runt om i världen där de mest kreativa kommunikationsinsatserna belönas med priser. Dessa tävlingar har stort inflytande i branschen, men kritiseras även för att premiera nyskapande över andra faktorer trots att forskning visat att effektiv, kreativ reklam innehåller tre dimensioner: nyskapande, meningsfullhet och anknytning.Syftet med denna uppsats är att undersöka om denna kritik är applicerbar även på svenska kommunikationstävlingar, genom att studera i vilken utsträckning vinnare av kreativitetstävlingen Guldägget innehåller de olika kreativitetsdimensionerna.En kvantitativ enkätundersökning genomfördes där respondenter ur två olika grupper, yrkesverksamma respektive icke-yrkesverksamma inom kommunikationsbranschen, fick ta ställning till nio olika Guldägget-vinnande annonskampanjer. Resultatet baseras på de 198 inskickade enkätsvaren och indikerar att alla kreativitetsdimensionerna finns representerade, men att nivån av anknytning är lägre än övriga två. Tänkbara orsaker är att anknytning är mer subjektivt, att respondenterna inte ingick i annonsernas ursprungliga målgrupp samt att annonsernas ålder påverkat anknytningen negativt.Icke-yrkesverksamma tenderade att skatta meningsfullhet och anknytning lägre än yrkesverksamma inom branschen. Detta kan bero på yrkesverksamma är mer vana vid att analysera reklam, men begränsningar i urvalet gör att inga generella slutsatser kan dras. / Creativity is an essential component in advertising, and there are hundreds of advertising awards that honour the most creative concepts. These creativity awards are influential in the industry, but have received criticism for favouring novelty over other factors. Meanwhile, research shows that advertising creativity has three dimensions: novelty, meaningfulness and connectedness. This thesis investigates if Swedish creativity awards are guilty of the same misrepresentation, by studying which creativity dimensions can be found among winners of the Guldägget award.Respondents from two separate groups – workers in the advertising industry versus outside of the industry – participated in a quantitative survey, where their attitudes towards nine Guldägget-winning advertisements were measured. The results are based off 198 questionnaires and indicate that all dimensions are present. However, connectedness was rated lower than the rest. Possible reasons include connectedness being inherently more subjective, the respondents not being part of the original target group as well as the advertisements’ age having a negative impact.People from outside the advertising industry rated meaningfulness and connectedness lower than those in the industry. A possible reason is that industry people are more accustomed to analysing advertisements; however, shortcomings in the sample prevent general conclusions to be drawn.

The successful secondary marketing teacher: case studies of teaching award recipients in marketing educationRuff, Nancy Schoettinger January 1989 (has links)
The purpose of this study was to develop a profile of the successful secondary marketing teacher based upon perceptions of teaching award recipients in marketing education. A naturalistic inquiry paradigm using the case study approach was the research design selected for the study. Semistructured, open-ended interviews were conducted with 11 teachers who were recipients of the annually presented, state-level teaching award in marketing education in the states of North Carolina and Virginia.
Data collected from the interviews were analyzed according to tenets associated with the constant comparative method. The perceptions of the participants were organized and coded into the following five core categories established by the research questions: (a) teacher preparation, (b) personal motivations and abilities, (c) students, (d) professional roles and practices, and (e) teaching environment. Conceptual categories which emerged within each core category formed the framework for a perceptual profile of the successful secondary marketing teacher presented in the case report.
Based on the findings from this study, it can be concluded that the successful secondary marketing teacher: (a) approaches the job with enthusiasm and strives to accomplish more than the minimum job requirements; (b) receives satisfaction from watching students experience success and develop positive self-concepts; (c) is professionally committed and involved; (d) is a very caring, student-centered teacher; (e) is most effective when allowed the freedom to work with minimum supervision; (f) performs teaching and other program duties in a somewhat structured, methodical manner; (g) realizes the success of the marketing education program is dependent on his or her ability to maintain good interpersonal relationships; and (h) receives thorough preparation in both technical content and pedagogy.
It is recommended that secondary marketing teachers attempt to improve their performance in teaching, coordination, and other areas of the job through the emulation of the profile produced from this study. Additional recommendations are presented for education policymakers, teacher educators, and future research. / Ed. D.

Enforcement of Annulled Arbitral Awards : A Study on the Enforcement of Annulled Foreign Arbitral Awards under the 1958 New York Convention from a Swedish PerspectivePersson Thurén, Martin January 2018 (has links)
Different interpretations of the New York Convention’s Article V(1)(e) have caused inconsistencies regarding how courts deal with applications for enforcement of annulled foreign arbitral awards. Court cases from various Contracting States display that the courts have adopted different approaches to this matter. With the rising number of challenges of awards, the issue has become increasingly important. The author examines international case law to analyze the issue of enforcement of annulled arbitral awards with the purpose of suggesting a possible Swedish approach. A number of aspects support the view that national courts have discretion when deciding whether to enforce a foreign arbitral award notwithstanding that has been annulled in the country of origin. Both the New York Convention and the Swedish Arbitration Act leaves narrow room for the court to exercise this discretion. The author suggests that enforcement of an annulled foreign arbitral award should be possible in Sweden under certain exceptional circumstances. If the competent authority in the country where the award was made annuls the award for reasons totally unacceptable from a Swedish point of view, the option to enforce the foreign arbitral award in Sweden should still be available. This approach is in line with the wording and purpose of both the New York Convention and the Swedish Arbitration Act. The suggested Swedish approach would not cause any serious uncertainty for the parties to the arbitration, but would create a necessary safety-valve for the courts to avoid having to refuse enforcement of a foreign arbitral award when it has been set aside for obscure reasons or by a corrupt court. As is evident from international case law, the interpretation and application of Article V(1)(e) of the New York Convention varies depending on what country enforcement is sought. To avoid contributing to further inconsistencies, it is necessary for Swedish authorities and practitioners to consider the issues addressed in the study.

1 The purpose of this thesis is to discuss the main aspects of the Czech legal regulation of the arbitration proceeding under the view of the particular Western European national and international legal orders. By doing so, the author strives for critical review of the arbitration proceeding as per the Czech legal order under the worldwide perspectives and with the prism of modern Western European and world legal theory of the arbitration proceeding. The intention of such research is to determine if the contemporary Czech legal regulation of the arbitration proceeding is in conformity with the modern theory and practice of the arbitration proceeding. This thesis also aims to answer a question whether the Czech courts shall have the right to review the application of law by the arbitrators. The author is seeking to answer this question by comparing the the Czech, or rather Continental system of law with the law of England and Wales.

Arbitration is central to the settlement of transnational commercial disputes. This
dissertation discusses arbitration as an alternative method of dispute settlement as
opposed to litigation. The work surveys the difficulties relating to international
commercial arbitration and the enforcement of awards, and efforts made to overcome
them.
The research is divided into four chapters. The first chapter introduces the reader to the
work. It gives a general background to international commercial arbitration and briefly
explains what the dissertation is all about. Chapter two is definitional. It examines some
of the definitions of international commercial arbitration and contains the author's
thoughts on this issue. The author is of the view that the traditional definitions do not
properly address the concept. It is concluded that the question whether an arbitration is
international should largely depend on whether international norms are used to resolve
the dispute rather than by reference to geographical considerations. This chapter also
weighs the advantages and disadvantages of arbitration as against litigation. Chapter three
deals with recognition and enforcement of awards. This is considered crucial since at the
end of the day, parties to arbitration would want to enforce their awards in a court of law,
in the event of non-compliance. Since the award might be made in a foreign country,
enforcement may be problematic. The chapter examines efforts made in intemational and
domestic law to overcome such problems and achieve enforceable awards. A selection of
multi-lateral, regional and domestic laws is examined. This chapter also discusses
problems of enforcing awards against states and steps taken to overcome them. The final
chapter deals with general conclusion and suggestions. It is suggested that efforts should
be made to harmonise international commercial arbitration. This can be achieved both in

trade disputes between the member of Mercosur. The hypothesis is that this system has not
played its role, despite the changes brought about by the Protocol of Olivos, because since its
entry into force in 2004, a few times it was requested by Member of Mercosur, showing
thereby that the system of dispute settlement block has to be improved towards the creation of
a Court of Justice. The method chosen for investigation was the case study. To this end, we
selected nine awards given by the Arbitral Tribunal. The essay points out that a supranational
court is a tool to enable the further integration of the variety of subjects covered by the
structure of your organization by changing its internal evolution and its contribution to the
formation of a genuine Community law. / Este trabalho tem como objetivo principal verificar se o Sistema de Solução de Controvérsias
do Mercosul tem resolvido com funcionalidade os contenciosos comerciais entre os Estados-
Membros. A hipótese é que esse sistema não tem desempenhado seu papel, apesar das
mudanças trazidas pelo Protocolo de Olivos, uma vez que desde sua entrada em vigor, em
2004, poucas vezes o mesmo foi solicitado pelos Estados que integram o Mercosul. O que,
por sua vez, demonstra que o sistema de solução de controvérsias do Bloco tem de ser
aperfeiçoado rumo à criação de um Tribunal de Justiça. O método escolhido para investigação
foi o estudo de caso. Para tanto, foram selecionados nove laudos proferidos pelo Tribunal
Arbitral. A dissertação destaca que um tribunal supranacional é um dos instrumentos capazes
de possibilitar o aprofundamento da integração pela variedade dos temas tratados, pela
estrutura de Entidade, por sua constante evolução interna, e por sua contribuição à formação
de um autêntico Direito Comunitário.

O presente trabalho versa sobre a sentença parcial no processo arbitral. Seu tema inicial é a demonstração da existência de um processo arbitral, de natureza jurisdicional, no curso do qual o julgamento do mérito pode ser fracionado em diferentes momentos, por meio da prolação de mais de uma sentença, sendo aquela proferida no ínterim --- e não pondo fim a toda a lide --- denominada sentença arbitral parcial. Conceituamos esse tipo de sentença como o ato pelo qual o árbitro define parcialmente a causa, com ou sem julgamento do mérito. A partir desse conceito, são analisadas diversas categorias de decisão, tais como as sentenças finais, decisões referentes à definição da jurisdição do árbitro, decisões interlocutórias, e decisões de caráter provisório. Também são analisados os requisitos de admissibilidade das sentenças parciais, bem como as situações em que a cisão do julgamento do mérito é ou não é recomendável, tendo em vista critérios de efetividade do processo e de eficiência, em termos de tempo e recursos. Com base nesses critérios, são analisadas algumas hipóteses típicas de sentenças parciais. Trata-se, ademais, da problemática envolvendo a execução e a invalidação das sentenças arbitrais parciais, com vistas às possíveis consequências da anulação de sentenças parciais e dos eventuais efeitos que a invalidação de sentenças finais pode provocar nas sentenças parciais --- e vice versa --- e em procedimentos arbitrais que estiverem em curso. Por fim, o trabalho versa a respeito das especificidades da homologação no Brasil das sentenças arbitrais parciais estrangeiras. / This paper addresses the partial award in the arbitration procedure. Its starting point consists of the existence of an arbitration procedure of jurisdictional nature, during which the judgment of the merits can be divided in different moments, by way of the rendering of more than one award, being the one rendered in the middle of the procedure --- and not concluding the entire conflict --- called partial arbitral awards. Such type of award can be defined as the act by which the arbitrator decides the dispute partially, with or without resolving the merits. Based on such concept, various categories of decisions will be examined such as final awards, awards on the arbitral jurisdiction, interlocutory awards and interim awards. Additionally, the legal requirements for partial awards to be rendered will be examined, as well as the situations in which the parceling of the judgment of the merits is or is not recommended aiming at the effectiveness of the procedure and efficiency in terms of time and resources. Based on such criteria, this paper will analyze the most common cases in which partial awards are rendered. Moreover, this paper deals with the problems involving the enforcement and the setting aside of partial arbitral awards aiming at analyzing the possible consequences of the nullification of partial awards and also the possible effects over partial awards that the voidance of final awards --- and vice versa --- may cause. Finally, the paper deals with the particulars of the recognition in Brazil of foreign partial arbitral awards.
