Intégration scolaire des élèves handicapés par une déficience intellectuelle et droit à l'égalité

Est-ce que la décision de ne pas intégrer un élève handicapé sur le plan intellectuel dans une classe régulière est un acte discriminatoire au sens où elle viole les droits à l'égalité garantis par l'article 10 de la Charte québécoise et par l'article 15 de la Charte canadienne? L'hypothèse formulée en réponse à cette question est: oui, cette décision est discriminatoire parce qu'elle est fondée sur un motif illicite, à savoir le handicap. Une fois établi le cadre conceptuel de cette recherche en précisant le sens des concepts de discrimination, de handicap et d'intégration, l'étude de quelques décisions de la Cour d'appel du Québec révèle que, pour cette Cour, la norme d'égalité n'est pas la classe régulière, ce qui met en sourdine la conception de l'intégration comme droit objectif garantissant l'égalité. Ensuite, l'analyse de l'arrêt Eaton de la Cour d'appel de l'Ontario montre comment cette décision a suscité l'enthousiasme de ceux qui croyaient avoir trouvé dans le droit à l'égalité garanti par l'article 15 de la Charte canadienne un appui ferme pour l'intégration. Toutefois, la position de la Cour suprême dans l'arrêt Eaton a refroidi cet enthousiasme en rejetant toute présomption en faveur de l'intégration, lui préférant le critère du meilleur intérêt de l'enfant comme garant du droit à l'égalité pour les élèves intellectuellement handicapés. Ainsi, pour la Cour, le fait de ne pas intégrer ces élèves ne constitue pas en soi une forme de discrimination. / Does the decision not to integrate an intellectually disabled student in a regular c1ass constitute a discriminatory action in the sense that it violates equality rights guaranteed by section 10 of the Quebec Charter and by section 15 of the Canadian Charter ? The hypothesis formulated as an answer to that question is : yes, that decision is discriminatory because it is based on a forbidden ground, namely disability. The conceptual framework of this research is established by defining the concepts of discrimination, disability and integration. Then, the study of sorne Quebec Court of Appeal's decisions shows that in this Court's view the equality standard is not the regular c1ass, a position that underscores the conception of integration as an objective right ensuring equality. Next, the analysis of the Ontario Court of Appeal's decision in Eaton shows how that decision has aroused the enthusiasm of those who thought that they had found a firm support for integration in the equality rights guaranteed by section 15 of the Canadian Charter. However, the Supreme Court's ruling in Eaton has dampened that enthusiasm by rejecting any presumption in favor of integration, and rather adopting the child's best interest criterion as ensuring equality rights for intellectually disabled students. The purpose of this study is to conduct a historical survey of two swedish tour operators and how they arrange a charter destination for different target groups. The purpose is also to review the material from a gender perspective, starting in the 1950s up until today. The study has been based on a qualitative research approach where text and image analysis was applied as the primary method, which was also supplemented by two interviews. The empirical material has mainly been taken from archives and consisted of travel catalogs issued by swedish tour operators Ving and Fritidsresor. Previous research related to the research field as well as theoretical references on visual communication, gender studies, target groups and semiotics have been used as aid to review and analyze the empirical material. The results show that there were different gestures of men and women and what has historically been considered masculine and feminine. The target groups were initially couples but eventually extended to young people and families with children. / Denna studie har som syfte att göra en historisk undersökning om två svenska researrangörer och hur de framställt en charterdestination gentemot olika målgrupper samt granska materialet ur ett genusperspektiv från 1950-talet och fram till nu. Undersökningen har utgått ifrån en kvalitativ ansats där text- och bildanalys tillämpats som den primära metoden vilket även kompletterats med två intervjuer. Det empiriska materialet har framförallt hämtats från arkiv och bestått av resekataloger. Tidigare forskning relaterat till ämnet samt teoretiska utgångspunkter om visuell kommunikation, genus, målgrupper och semiotik har använts som hjälpmedel för att granska och analysera det empiriska materialet. Resultatet visar på att det funnits olika gestaltningar av män och kvinnor och vad som anses som manligt och kvinnligt historiskt sett. Målgruppen var till en början framförallt par men utökades så småningom även till ungdomar och barnfamiljer.

The High Performing Charter School Operator's Guide To Replication With Fidelity

The purpose of this study was to create a manual for organizations seeking to expand from one high-performing charter school into a network of charters, while serving high-poverty populations. A well-documented critical need exists to expand quality educational options for high-poverty students. Despite legislation and investments, prior reform efforts have failed to significantly improve the academic outcomes of historically underserved Black, Brown, Latino, and low-income students. Charters schools are an important option for families seeking to expand the educational options for students whose parental incomes assign them to chronically failing schools. Despite disproportionately enrolling high-poverty students, some high-performing charter schools are excelling with this population. The research methodology included semi-structured 1-hour interviews, site visits, and artifact review from CMO leaders, funders, and consultants of high-performing charter schools The interviews were then transcribed and coded, and seven recurring themes emerged. Data analysis involved comparing these emergent themes with previous research. Data analysis found that the high-performing charter schools serving high populations credit culture, systems, and human capital as the three main components of successful expansion. Although the order differed, every participant cited these three factors as critical to replication with integrity. Interviews, site observations, and artifacts in the current study identified the following recurring themes: 1. Culture Is Everything 2. The Model: This Is How We Do Things 3. Codification for Replication 4. Inspect What You Expect 5. Develop Human Capital 6. Operations Are the Drivers of Network Success 7. Accountability, Autonomy, Equity The findings in the current study show a demonstrated need for replication with the participants highlighting the challenges, lessons learned, and crucial advice to future operators. The final product is a guidebook that provides charter school leaders, charter management leaders, and other stakeholders with concise information on instructional practices, school culture, curriculum, finances, and other factors that impact charter school expansion. This manual is based on the premise that high-performing charter schools offer increased opportunities for academic success and, thus, life success for economically disadvantaged students.

A COMPARATIVE ANALYSIS OF TWO EXPANDING URBAN CHARTER SCHOOL ORGANIZATIONS

Charter school expansion is on the forefront of educational reform. There is currently little research on what issues charter school organizations face when they expand, how specific organizational structures are implemented during a charter school expansion process, and which structures provide a favorable outcome of the expansion. The overall goal of this study was an in-depth analysis of two expanding charter schools. This qualitative two-site case study examined several select issues that charter schools face during expansion, with the goal of identifying differences in approach, and evaluating outcomes of the expansion in the light of these differences. Two urban charter school organizations within the same city were chosen for this case study. The following are the four specific research questions addressed: 1) What issues did the selected charter school organizations face when they were expanding? 2) What type of organizational system did the charter schools have and how did that system facilitate their expansion? 3) How was information communicated during the Charter School Organizations' expansion? 4) How did the selected charter school organizations handle heightened turbulence during the expansion period? The primary sources were: 1) data obtained through interviews with three school administrators within each organization; and, 2) data collected via questionnaires in order to determine administrator's approaches to decision making, strategic plans, and communication flow within each organization. The data were analyzed and the research reflects an in-depth analysis of the varying level of turbulence experienced by each charter school organization including factors and decisions that impacted each organization's expansion process. The findings indicate that there are a variety of internal factors and external obstacles that charter school organizations must consider and ultimately overcome before and during a charter school organizational expansion. The results of these findings suggest that each organization experienced varying levels of turbulence when expanding due to a multitude of factors including relationships with stakeholders, community support, school performance, as well as the availability of resources including students, facilities, finances, and staff. Ironically, the levels of turbulence experienced by each charter school organization were quite different given the variety of factors that impacted each charter school organization's expansion. Additionally, there were only a few areas in which each charter school organization experienced similar levels of turbulence to one another. These findings indicate that while at times each charter school organization may have faced different levels of turbulence, given a variety of internal and external factors, it did not appear that these varying levels of turbulence prevented either charter school organization from expanding. Furthermore, the degree of turbulence experienced by different individuals within iv each charter school organization, based upon their positionality, was influenced by a multitude of factors that are both controllable and uncontrollable. These factors that impact the level of turbulence experienced by each organization include the organizational structure, stakeholder involvement, and the flow of communication. The benefit of this study is to better understand the variety of factors both internal and external that influence and contribute to a charter school expansion and to better understand the varying degrees of turbulence experienced by all stakeholders involved in a charter school while the organization is expanding. The results of this study provide insight regarding varying factors charter school organizations should consider when expanding and how decisions are made and communicated to all stakeholders while simultaneously considering the impact these decisions have on all individuals. / Educational Leadership

Changing Mindsets: A Case Study of a Community of Practice between Charter and Traditional Public School Leaders in the School Leaders Network

The purpose of this study was to examine the essential elements of a community of practice intended to increase communication and collaboration between traditional public and charter school leaders. Members of the Los Angeles Cohort of the School Leaders Network participated in this study. This case study triangulated observation, interview, and document review data to identify the factors that were most beneficial to this particular community of practice. Drawing on the research of communities of practice, constructivism, and leadership theory, these factors were articulated into five domains with the hope that, with further research, this framework could influence the creation of additional communities of practice between traditional public and charter school leaders. This framework, including indicators and action steps to aid in creating a community of practice, identified five key factors: knowledge, relationships, authenticity, constructivism, and leadership. The convergence of these five domains pointed to two key take-aways: Communities of practice must create a risk-free environment in which sharing can occur so that participants can use storytelling as a vehicle for the exchange of ideas. Essential in creating this environment is the influence of a skilled facilitator who can drive these conversations. Ultimately, in sharing stories and building community, these communities of practice are meant to further the cause of a socially just education for all students regardless of the type of schools they attend.

Analysis of Special Education Compliance and Special Education Funding in Four Texas Open-Enrollment Charter Schools.

The purpose of this study was to conduct an in-depth examination of special education services in open-enrollment charter schools in north Texas and to examine relationships between special education compliance and funding. Six questions guided the research: How have the charter schools designed special education services, and do these services meet individual needs of students with disabilities? Have federal education and disability laws affected charter schools' admissions, operations, or student performance ratings? What were the levels of special education funding and compliance with federal and state regulations? Is there a relationship between special education funding and special education compliance with rules and regulations? Studies at the national and state levels have frequently been conducted in the form of surveys, and provide only preliminary information about the status of special education in charter schools. There is a paucity of case specific information about the management and delivery of special education services in open-enrollment charter schools. A within-case study research design was used for this investigation utilizing qualitative methods of structured open-ended interviews, observations at the schools, and document analysis. Administrators at four open-enrollment charter schools were interviewed to gather data for this multi-case study. The data supported the hypotheses related to special education services in open-enrollment charter schools. The schools in this study provided special education services with an inclusion model for the first two years. In their first years of operation, charter schools face challenges of small budgets, few if any special education students, and difficulty finding special education teachers and other staff. In the third year and beyond, the schools were able to add special education services and staff and were more stable in terms of budget and operations. For the time period analyzed, special education costs exceeded special education funding. Compliance with special education regulations was relatively high as services were provided to students with mild disabilities with a high commitment to individualized instruction.

Uppsatsens syfte är att undersöka huruvida språket skiljer sig åt i resmålsbeskrivningar riktade till två olika målgrupper hos en reklambyrå – erfarna livsnjutare och en bredare allmänhet. Metoden som används i undersökningen är en kombination av stilistisk analys och systemisk-funktionell grammatisk analys. Den stilistiska analysen undersöker huvudsakligen syntax och ordklasser medan den systemisk-funktionella analysen behandlar texternas interpersonella metafunktioner, alltså relationen avsändare och mottagare emellan. Resultaten visar att resmålskategorierna skiljer sig åt mycket lite. Det finns alltså inte många stabila målgruppsegenskaper. De som förekommer inom premiumtexterna är mindre krånglig syntax och färre explicita uppmaningar. Inom chartertexterna förekommer mer krånglig syntax och påtagligt fler explicita uppmaningar. Inom kategorierna skiljer sig texterna åt mer än vad de gör kategorierna emellan. Slutsatsen av det hela är att syntax och explicita uppmaningar är viktiga för målgruppsanpassningen och att resebyråns skribenter utöver detta inte verkar ha haft någon egentlig definierad mall när de författat resmålsbeskrivningarna.
