Miljöns betydelse för barn i behov av särskilt stöd. : En studie om pedagogers syn på miljön i förskolan / The significance of the preschool environment for children with special needs. : A study about educators observation of this aspect

Syfte med detta arbete är att få en ökad kunskap om hur pedagoger planerar sin lärmiljö så att den är anpassad för barn i behov av särskilt stöd. Jag vill också med arbetet få en bild av hur mycket miljön överhuvudtaget påverkar ett barns lärande i förskolan. Syftet har besvarats genom intervjuer med fyra pedagoger på två olika förskolor. Resultat visar att pedagogerna har ett noggrant tänk bakom miljön som byggs upp inför varje nytt läsår på förskolan. Är det en avdelning som har barn som är i behov av särskilt stöd ska detta självklart tas på allvar. De förskolor som jag har varit på använder sig bland annat av bilder som stöd för att se till att alla barn kan på något sätt bli förstådda genom att använda sig av bilder i kommunikation med andra. Pedagogerna trycker på att man alltid ska se till det enskilda barnets behov för att skapa det bästa för just det barnet. När man jobbat en stund så man skapat det bästa för de enskilda barnen kan man sedan jobba med barngruppen i helhet för att skapa den bästa miljön för just denna barngrupp. / The purpose of this work is to gain more knowledge about how educators plan their environment to be adapted for children with special needs. I also want to get a picture of how much the environment affects a child's learning. This purpose is answered through interviews with a total of four teachers at two different preschools. Through these interviews have I come up with a result where the educators have a great idea of the environment that is being built for every new year at the preschool with every new group of children. If it is a department that has children with special needs, this should of course be taken seriously. The preschools I have been at are, among other things, using pictures to ensure that all children can be understood in some way. All four educators I have been talking to are taking this very seriously and they all said that they have to look to every single child needs to create the best environment for the whole group.

The legal position of unmarried fathers in the adoption process after Fraser v Children's Court, Pretoria North, and others 1997 (2) SA 261 (CC) : towards a constitutionally-sound adoption statute

The subject-matter of this thesis is the rule, previously contained in section 18(4)(d) of the Child Care Act 74 of 1983, in terms of which a mother could surrender her child born out of wedlock for adoption without the consent of its father. This section was struck down as unconstitutional by the Constitutional Court in Fraser v Children's Court, Pretoria North and others 1997 (2) SA 261 (CC), on the grounds that it violated an unmarried father’s constitutional rights to equality and non-discrimination. In the light of this judgment, this thesis seeks to articulate the constitutional parameters within which section 18(4)(d) must be amended. The requirements of Fraser are identified and discussed. Regard is also had to other constitutional rights upon which Fraser might have been decided; in particular, an unmarried father’s right to procedural fairness, and his child’s right to family or parental care. Case law from the United States, Canada, Ireland and the European Court of Human Rights is also discussed. The end product of this examination is an exposition of the various constitutional rights which vest in the father of a child born out of wedlock. A separate exposition is given of the distinct rights which vest in all children in the adoption process. The latter set of rights is drawn both from the Constitution of the Republic of South Africa Act 96 of 1996, and the United Nations Convention on the Rights of the Child. The thesis then proceeds to examine the Adoption Matters Amendment Act 56 of 1998, which was enacted in response to Fraser. The consent and notice provisions of adoption statutes in the United States, Canada, Australia, Ireland and England are also examined, and compared to the provisions of the Adoption Matters Amendment Act. The object, here, is two-fold: first, to consider the practical value of this Act; and second, to consider whether it satisfies the constitutional requirements identified earlier in this thesis. The thesis concludes with suggestions for the improvement of this Act.

A phenomenological exploration of adoptive parents' motivation for and experience of transracial adoption in South Africa

Prior to the democratic elections of 1994, South Africa was daunted by legislation flooded with racial segregation. Adoption across racial lines is, because of South Africa’s racially segregated past, a relatively recent phenomenon in this country. The number of legal adoptions has increased dramatically, especially after its legalization in 1991. Parents may adopt across racial lines for an array of different reasons, from not being able to conceive a baby, to wanting to give a child the best opportunity in life. This study explored the experiences of white parents who have adopted black children, paying particular attention to how they deal with issues of “racial” identity. In-depth interviews were used to generate qualitative data pertaining to the parental perceptions of their motivation for, and experiences of adopting a child transracially in South Africa. The study aimed to explore their motivation for adopting and experiences, as well as issues relating to “racial” identity. Recommendations have been made to assist parents who are interested in adopting transracially. The report presents findings relating to the unique characteristics of the participants who have adopted transracially. These include adopters’ motivation and thought processes before taking the relevant steps to adopt transracially; the support that they have received from others in their decision to adopt transracially; communication patterns; their relevant concerns regarding the future of their adopted child; and issues pertaining to race, culture, heritage, prejudices and stereotypes. The findings suggest that parents were pragmatic, without regrets, in their views about adopting across racial lines. The parents’ motivations for adopting across racial lines were very similar to various perspectives, but were all due to the fact that they were unable to have biological children. Parents were aware of the child’s identity and cultural issues, which may be more perceptible in the future. Their perceptions, views and opinions, and the future concerns of their children were not unrealistic. Due to the children’s young age a follow-up study of these children should be considered.

Tendo como embasamento teórico os estudos discursivos do Círculo de Bakhtin, buscamos identificar como os valores ideológicos relativos às questões que envolvem os direitos da criança no país se materializam nessas peças. Buscamos também responder a outras questões, tais como: Qual o destinatário previsto pelas peças? Considerando a natureza verbo-visual do corpus, como o momento da infância é representado? Quais discursos podem ser identificados nas peças publicitárias e de quais esferas de atividade se originam? Com esse intuito, trabalhamos com alguns conceitos bakhtinianos que nos possibilitam realizar as análises, na medida em que amadurecemos nosso entendimento teórico dos estudos do Círculo. Os conceitos de enunciado concreto, esfera de atividade, autor, gêneros do discurso e destinatário são fundamentais para o desenvolvimento desta pesquisa. Com as análises, identificamos a presença de um duplo destinatário previsto, tanto infantil quanto adulto, fenômeno discursivo que demanda estudos posteriores. Identificamos, também, indícios de uma mudança gradual do gênero discursivo em questão – o da publicidade de utilidade pública – com possível evidenciação crescente de discursos não-verbais em detrimento de discursos verbais. Encontramos, também, uma representação idealizada da infância, como momento de formação, carinho e proteção. Investigamos, ainda, de que forma a dupla autoria dos enunciados, por Maurício de Sousa e o UNICEF, mobilizam discursos de outras esferas (política, pedagógica, científica) de maneira conjunta, em favor de um projeto de dizer unificado. Trata-se de uma pesquisa qualitativa, na qual nos propomos à análise de oito peças pertencentes ao corpus, e interpretativa, reconhecendo a importância do rigor científico sem o apagamento do papel subjetivo do pesquisador. / This research aims to analyze dialogically a set of advertisements signed by the United Nations Children's Fund (UNICEF) along with Maurício de Sousa, an acclaimed Brazilian cartoonist know for having created the Monica’s Gang. In these advertisements, the characters from Monica’s Gang approach the subject of children’s rights, a very socially relevant theme in Brazil. The selected theoretical basis of the research comprehends the discourse studies by The Bakhtin Circle, as it is our goal to identify how the ideological values pertaining to children’s rights in the country are materialized in this campaign. It is also our goal to answer other questions, such as: what is the recipient of the advertisements? Considering the verbal-visual nature of the corpus, how is childhood represented? Which discourses can be identified in the advertisements and which realm of human activity are the originally from? Having set those goals, we work with a few Bakhtinian concepts which enable us to do the analysis as we further develop our own theoretical understanding of the studies by the Circle. The concepts of concrete utterance, sphere of activity, author, genres of speech and recipient are fundamental for the development of this research. The analysis shows the presence of a double recipient, both adults and children, which demands further investigation. Evidence of a gradual change in the studied discourse genre were also found, indicating a growing preference for non-verbal discourse in detriment of verbal ones. The moment of childhood is found to be represented in an idealized manner, as a time of formation, care and protection. We have also investigated in what way the two authors, Maurício de Sousa and UNICEF, mobilize discourses from other realms of activity (political, pedagogical, scientific) towards a unified dialogic project. In terms of methodology, we work with the proposal of Brazilian scholars regarding discourse dialogic analysis, especially pertaining to the analysis of verbal-visual utterances. It is a qualitive research, in which we propose to analyze eight advertisements from the set, and also an interpretative work, where we recognize the importance of scientific rigor without the erasure of the subjective role of the researcher. / FAPESP: 2016/02639-7

Ochrana práv dětí v České republice / Protecting children's rights in the Czech Republic

This thesis was initially concerning protecting children's rights. Due to wide variety of this topic, it was neccesary to focuss the thesis more specificly. I decided to explore the field of work with childen from desintegrating families, where there is also a difficult parental conflict. Content is divided into two integrated parts. In the first one, there was build the theoretical bases using variety of sources and authors in three different chapters. First chapter concerned desintegrating of families, its psychological, legal and sociologic contexts and effects. Second chapter reflected the history of defending rights of children and there were also analysed both czech and international documents on protection of children's rights. I also analysed the term "best child's interest" and its impact on practising the law. In the third chapter I described different approaches in work with desintegrating families, including nameless current approach practised in the Czech Republic, the Cohem praxis and others, less known approaches. In the second part, the practical segment of my work was presented. The project of research included interviews with seven professionals. Judges, family councelors and social workes have taken part in the research of changes, which would be beneficial for nowaday's approach...

Violence against children is a common phenomenon that is spread all over the world and always existed through the centuries. The present work will define the different forms of violences that children are victims of, present the causes which lead to these types of adult behaviors and the consequences on the child. The situation of two countries of our interest will be compared: France and Sweden. One will go through their history in term of infant violence, the laws which contributed to develop the rights of children and the actual situation in both nations. A personal investigation will be included in the work to have direct answers from both a French public and a Swedish one. This will allow us to have an idea about the actual way of thinking in both countries. The problems that France as well as Sweden face to fight for better children care will be mentioned, such as the difficulties people or different institutions have to alert the specialized organisations on a case of child mistreatment. The aim of this work is to compare France and Sweden and see if the hypothesis that violence is still largely spread in France and almost disappeared in Sweden is true. By analysing all the points mentioned earlier, one will eventually confirm that both countries are in totally different places concerning child violence, Sweden being the first nation to forbid any form of violence on children and France being the last one on date. One will notice that French people need to change many different points of their system as well as their way of thinking, while Swedish people need to continue their efforts to fight for this topic.
