El habla de la comunidad paisa de Medellín en Montreal

Dans cette étude nous faisons une description de l'état actuel de l'espagnol parlé par la communauté paisa de Medellin (Colombie) à Montréal, dont le dialecte ou variation de langue est aussi connu comme paisa. Pour mener cette recherche à bien un travail de champ a été réalisé au moyen d’un questionnaire écrit et d’entrevues orales mi-dirigées. Les données obtenues nous permettent d’établir des premières comparaisons entre le parler des paisas de Montréal et celui des habitants de Medellin, et d’identifier quelques-uns des principaux changements linguistiques chez cette communauté parlante, spécialement les interférences du français au moment de parler en espagnol, et certains facteurs qui en favorisent, de même que certains changements au niveau socioculturel, les attitudes linguistiques des paisas vers leur variété, vers l’espagnol, en général, et aussi vers le français des québécois de la Région Métropolitaine de Montréal, en particulier. Finalement, il est aussi possible de connaître quelques-unes des différences et similitudes par rapport à la situation linguistique actuelle à la ville de Medellin. Bien que la communauté étudiée représente un bas pourcentage des hispanophones de la ville, la recherche peut contribuer à l’avancement des connaissances de l’espagnol à Montréal, puisque ses résultats, ajoutés à ceux d’autres études, permettront de mieux connaître sa réalité linguistique. / In this study we describe the current state of the Spanish spoken by the Paisa community from Medellin (Colombia) in Montreal, whose dialect or language variant is also known as Paisa. To carry out this research, we conducted fieldwork with a questionnaire and semi-structured oral interviews. The data collected allowed us to establish the first set of comparisons between Paisa spoken in Montreal and that of Medellin and to identify some of the main linguistic changes in this community of speakers, especially interferences from French in spoken Spanish, factors that favour them, as well as changes at a socio-cultural level: Paisa’s linguistic attitudes towards their variation, towards Spanish in general and towards the French of Quebecois in Montreal’s Metropolitan Area. Finally, it is also possible to identify some of the differences and similarities in regards to the current linguistic situation in Medellin. Although the studied community represents a low percentage of Spanish speakers in the city, this research contributes knowledge about the Spanish spoken in Montreal, since its results combined with those from other studies will facilitate a better understanding of the linguistic reality facing this language. / En este estudio se describe el estado actual del español hablado por la comunidad paisa de Medellín (Colombia) en Montreal, cuyo dialecto o variación de lengua se conoce igualmente como paisa. Para llevar a cabo la investigación se ha realizado un trabajo de campo a través de un cuestionario y de unas entrevistas orales semidirigidas. Los datos obtenidos nos permiten establecer unas primeras comparaciones entre el habla de los paisas de Montreal y el habla de los habitantes de Medellín, e identificar algunos de los principales cambios lingüísticos en esta comunidad hablante, especialmente las interferencias del francés al momento de hablar español, y ciertos factores que los propician, así como algunos cambios a nivel sociocultural, las actitudes lingüísticas de los paisas hacia su variedad, hacia el español, en general, y hacia el francés de los quebequenses de la Región Metropolitana de Montreal, en particular. Finalmente, también es posible conocer varias de las diferencias y semejanzas con respecto a la situación lingüística actual en la ciudad de Medellín. Si bien la comunidad objeto de estudio representa un porcentaje bajo de los hispanohablantes de la ciudad, la investigación puede contribuir al avance del conocimiento del español en Montreal, ya que los resultados, en conjunción con los de otros estudios, permitirán conocer mejor su realidad lingüística.

La justice transitionnelle est l’instrument juridique qu’a permis á la Colombie comme État, de sortir d’un long période de conflit armé et d’instaurer la paix dans son territoire. Cet outil utilisé par le gouvernement colombien et qui développe mécanismes juridiques et politiques appliqués dans ses processus de paix, doit être analysé sous différents angles. La première partie fait une étude des fondements théoriques des droits qui composent la justice transitionnelle comme la vérité, la justice et la réparation selon les instruments internationaux et la jurisprudence constitutionnelle colombienne et internationale. Dans cette partie les mécanismes qui rendent ces droits effectifs sont également analysés. L’étude de la deuxième partie propose un regard sur les deux étapes de la mise en œuvre du modèle colombien de justice transitionnelle. Ces étapes ont été appliquées par différents gouvernements du pays et dans de circonstances différentes. Cette analyse part tout d’abord, sur le développement de la nommé Loi de Justice et Paix de l’année 2005, ses caractéristiques et difficultés dans le processus avec les paramilitaires, pour ensuite se consacrer à la seconde étape du modèle qui á été mise en place pour donner suite à l’accord de paix signé entre le gouvernement colombien et la guérilla des FARC en 2016. / The transitional justice is the legal system that allowed Colombia as a State to overcome a long period of armed conflict and to find peace. This system, used by the Colombian government to develop political and legal mechanisms applied to peace processes, must be analyzed from different angles. The first section studies the theoretical foundations of the rights that compose transitional justice, such as the truth, the justice and the reparation, according to international instruments and both the Colombian and international constitutional rulings. In this section the mechanisms that make effective the rights are analyzed equally. The study of the second section is a look at the two stages of the Colombian transitional justice model implementation. These stages were applied by different governments of the country and with different circumstances. This analysis is, on the one hand the development of the so-called Justice and Peace Law of 2005, its characteristics and difficulties within the process with the paramilitaries. On the other hand, the second stage of the model was consecrated to enable the development of the peace agreement signed by the Colombian government and the FARC guerrilla in 2016.

El Sur como espacio identitario en Torres García, Borges y Solanas

L’étude conceptualise la symbolique du Sud en tant qu’espace identitaire construit par une idéologie politique et une esthétique. Les cartes géographiques inversées (1936, 1943) de Joaquín Torres García (Uruguay) sont une prise de position politique qui affirme le pouvoir d’énonciation des artistes latino-américains de façon indépendante aux centres culturels européens. Sa théorie, l’« Universalisme Constructif », propose un nouvel art pour l’Amérique latine, combinant l’éthique artistique précolombienne et l’abstraction moderniste. Dans la nouvelle « Le Sud » (1953) et l’essai « L’écrivain argentin et la tradition » (1951), Jorge Luis Borges (Argentine) redéfinit la littérature latino américaine, marginalisée et périphérique, en tant que littérature qui a droit à toute la culture occidentale. Il rejette une culture qui ne serait que nationaliste. Le diptyque de Fernando Solanas (Argentine) formé des films Sud (1985) et Tangos, l’exil de Gardel (1988) est étudié à partir de son manifeste « Vers un Tiers- Cinéma » (1969), coécrit avec Octavio Getino. Dans le diptyque, le Sud est un espace de dénonciation des censures de la dictature et de l’impérialisme, mais aussi un espace de rénovation culturelle et identitaire. Dans son cinéma, Solanas utilise un produit culturel régional, le tango, comme outil de dénonciation politique. Tout au long de l’étude, on utilise des notions de Michel Foucault, (hétérotopie) et de Walter Mignolo (le centre amovible) pour approfondir le sens de l’espace Sud. / This study conceptualizes the symbolism of the South as an identity space built by a political ideology and a local aesthetics. The Uruguay artist Joaquín Torres García’s inverted maps (1936, 1943) are a political stand that asserts the enunciative power of Latin American artists who create independently of the European cultural centers. His theory of “Constructive Universalism" proposes a new art for Latin America, for the South, and originating in the South, by combining pre-Colombian artistic ethics and modernist abstraction. In the short story "The South" (1953) and the essay "The Argentine writer and the tradition" (1951), the Argentine writer Jorge Luis Borges redefines South American literature, marginalized and peripheral, as a literature that is entitled to all aspects of the Western culture. By doing so, he rejects a culture that would only be nationalist. We analyze Argentine filmmaker Fernando Solanas’ cinematic diptych, which includes the films South (1985) and Tangos, the Exile of Gardel (1988) in dialogue with the manifesto "Towards a Thrid Cinema" (1969), co-written with Octavio Getino. The South is seen as a space for the denunciation of the censorships imposed by the dictatorship and imperialism, but also as a space for the renovation of culture and identity. In the two movies, Solanas uses a regional cultural product, the tango, as tool of political denunciation. Throughout the study, we use Michel Foucault's notion of “heterotopia” and Walter Mignolo’s concept of the “moveable center” to explore South’s multiple meanings. / Esta memoria conceptualiza la simbólica del Sur como un espacio identitario construido por una ideología política y una estética. Los mapas geográficos inversos de (1936, 1943) de Joaquín Torres García (Uruguay) son una postura política que afirma el poder de enunciación de los artistas latinoamericanos de modo independiente con respecto a los centros culturales europeos. Su teoría, el Universalismo Constructivo, propone un nuevo arte para América Latina que combina la ética artística precolombina y la abstracción modernista. En el cuento “El Sur” (1953), y el ensayo “El escritor argentino y la tradición” (1951), Jorge Luis Borges (Argentina) vuelve a definir la literatura latinoamericana, marginada y periférica, como una literatura que tiene derecho a toda la cultura occidental. Rechaza una cultura que sólo sería nacionalista. Estudiamos el díptico de Fernando Solanas (Argentina), constituido por las películas Sur (1985) y Tangos, el exilio de Gardel (1988) a partir del manifiesto “Hacia un Tercer Cine” (1969), co-escrito con Octavio Getino. En el díptico, el Sur es un espacio de denuncia de las censuras de la dictadura y del imperialismo, pero también un espacio de renovación cultural e identitaria. En su cine, Solanas utiliza un producto cultural regional, el tango, como instrumento de denuncia política. A lo largo del estudio, utilizamos nociones de Michel Foucault, (heterotopía) y de Walter Mignolo (movilidad del centro) para ahondar en el significado del espacio Sur.

A presente pesquisa investigou a utilização da análise musical e de uma gravação na construção interpretativa do pasillo andino-colombiano “Sincopando” para flauta solo por três flautistas brasileiros. A obra, composta por Léon Cardona originalmente para trío típico colombiano - constituído por bandola, tiple e guitarra - foi adaptada para flauta solo pelo flautista e compositor colombiano Ignacio Ramos. Os participantes da pesquisa foram três flautistas brasileiros de diferentes formações e atuações com nenhuma prática interpretativa em música tradicional colombiana. Cada flautista recebeu a partitura da obra para flauta solo e, após sessões de estudo individuais, realizaram uma gravação sem interferência ou referência externa seguido de uma entrevista semiestruturada. Em seguida cada flautista recebeu uma referência distinta (uma análise musical; uma gravação e uma análise e gravação da obra) para auxiliar o processo interpretativo individual. Posteriormente uma nova gravação e entrevista foram realizadas com o intuito de averiguar como estas referências poderiam ter influenciado ou modificado a interpretação dos flautistas. Os registros sonoros do semi-experimento foram enviados a três avaliadores externos - professores de flauta transversal com ampla experiência - para determinar possíveis diferenças entre o registro sonoro anterior e posterior à utilização da referência. Como conclusão a pesquisa observou resultados positivos na utilização de referências na construção interpretativa da peça bem como a possível influência do perfil artístico e do background de cada flautista no resultado final. / This research aims to investigate the use of musical analysis and recording in the interpretative construction of the Colombian pasillo “Sincopando” by three Brazilian flutists. This work was composed by Leon Cardona for the traditional Colombian trio – constituted by bandola, tiple and guitar – and adapted to solo flute by the Colombian composer and flutist Ignacio Ramos. The participants in this research were three Brazilian flutists with different professional backgrounds and without any background on traditional Colombian music. The flutists studied the piece on his own and recorded it without any reference or information about it. Afterwards, they participated in a semistructured interview. Each player then received different information about the musical piece (a musical analysis, a recording and an analysis and recording) in order to support the interpretation. The players recorded it again and participated in a second interview. The aim was to know how the information given could have influenced their interpretation. The recordings were delivered to three external professors to evaluate the differences between the recordings. The conclusions point out positive results on the use of external references through the interpretative construction of the piece, as well as possible influences of the profile and artistic background of the flutists in the final result. / En el presente trabajo se investigó el uso de análisis musical y de una grabación de audio en la construcción interpretativa del pasillo andino colombiano “Sincopando” para flauta sola por tres flautistas brasileños. La obra fue compuesta originalmente para trio típico colombiano – conformado por bandola, tiple y guitarra - por León Cardona y adaptada para flauta sola por el flautista y compositor colombiano Ignacio Ramos. Los participantes fueron tres flautistas brasileños de formación y perfil artístico diferentes sin ninguna práctica previa de música tradicional colombiana. Cada flautista recibió la partitura de la obra e después de estudio individual sin ningún tipo de interferencia o referencia cada uno realizó una grabación de la obra, seguido de una entrevista semiestructurada. Discutimos como este corpo e subjetividade feminina negra homossexual se reconfigura para a construção subjetiva de seu lar, considerando-se a experiência da desterritorialização e da migração, e o poema como a força reterritorializadora que alça as noções de pertencimento e conexão à sua própria criação poética como principal catalizadora de suas vivências. Percorremos toda sua obra em certa cronologia temática, iniciada com Continente Mohíno (1996) até El rostro del pan (2014), cujo principal objetivo é compreender a relação estabelecida entre sua escrita poética e o imaginário da diáspora contemporânea e fluxos migratórios, no que diz respeito aos territórios e a construção subjetiva do lar. A versatilidade e criatividade de sua poesia é flagrante por seu próprio curso de vida de movimento e desarraigo, que confluem para uma literatura capaz de abrigar suas vivências para além dos reducionismos históricos e sociais do lugar da mulher negra homossexual na literatura e na sociedade. / This dissertation approaches the poetic work of Colombian poet Marta Quiñónez, who currently lives in Medelin, which has been published to date, consisting of the following volumes: Noctívago (1998), Acantilado (1999), Abecedário de Eximición (2000), Eva (2001), Kartalá (2002), La Trinidad (2005), Arcanos (2007), No. Libro de haripalas (2010), Dame tu canto ciudad (2012), Conversaciones en Comala (2012), Paréntesis (2013), El rostro del pan (2014) and Continente Mohíno (2016), originally published in 1996. The work focuses on four main axes: diaspora, migration, territory and home, in dialogue with the themes of love, affectivity, territorialization/deterritorialization in urban centers, and the house, bypassing gender and racial discussions in the division of geographic and social spaces. We discuss how this homosexual black female body and subjectivity reconfigures itself for the subjective construction of its home, considering the experience of deterritorialization and migration, taking the poem as the reterritorializing force that elevates the notions of belonging and connection to its own poetic creation as main catalyst of her experiences. We go through all her work in a certain thematic chronology, beginning with Continente Mohíno (1996) until El rostro del pan (2014), whose main objective is to understand the relation established between her poetic writing and the contemporary diaspora imaginary and migratory flows, concerning territories and the subjective construction of home. The versatility and creativity of her poetry is blatant for her own life course of movement and uprooting, which converge to a literature capable of sheltering her experiences beyond the historical and social reductions of the homosexual black woman's place in literature and society.

Gritos en el Desierto: Denuncia y Resistencia en las Obras de las Escritoras Wayuu Estercilia Simanca Pushaina y Vicenta Marí­a Siosi Pino

The way we read and interpret literature is frequently influenced by factors that operate beyond the scope of the average reader's awareness. In this thesis, selected works by two Wayuu writers, Estercilia Simanca Pushaina and Vicenta Maria Siosi Pino, are analyzed and interpreted in an attempt to unveil some of these behind-the-scenes agents and issues, as well as explore how the stories' classification in the children's literature genre reveals a deep-rooted colonial tendency to infantilize indigenous individuals in contemporary Colombia. Despite the fact that the two authors, both mestizo women who self-identify with the Wayuu indigenous group of northern Colombia, prefer to write short stories that highlight the child and adolescent experience, the implicit themes and the complexity of their texts reject the "children's story" label that has been imposed on their literature. Furthermore, this thesis discusses how the two authors utilize the colonial trope of the Indian-as-child to their advantage by capsizing the imagery, thus rejecting the original power of the symbol and claiming it as their own. The first section of this investigation provides certain contextual specifics related to the cultural and social environment of the Wayuu indigenous group, particularly regarding that experienced by women. The second chapter includes an explanation of the impact a book's genre and its "paratext" may have on the reception and interpretation of these texts, and additionally proposes that the colonial practice of infantilizing indigenous people appears in both the assignment of genre as well as in several extratextual elements surrounding the stories. Chapter three offers an in-depth analysis of five selected pieces of the Wayuu authors' writing and explores how the texts may be read on multiple levels. This close reading reveals several examples of overt criticism towards the hegemonic society as well as displays instances of a more subtle rebellion; both explicit and implicit messages effectively expose and protest the current conditions of abuse, oppression and injustice that continue to anguish the Wayuu people.

Le cinéma de l'Argentine, le Chili et la Colombie entre 1990 et 2005 a dû faire face à divers changements liés aux modèles politique, économique et culturel. En particulier, les lois relatives à la production du cinéma ont changées dans les années ci-dessous, ce qui a permet de configurer un cinéma hétérogène par rapport aux thèmes et moyens de raconter. Dans cette thèse, nous nous proposons d’étudier un phénomène particulier situé temporellement dans un moment de transition et envisagé à travers un corpus clairement sélectionné. Le dit phénomène se présente à travers la relation que le cinéma entretient avec la réalité, relation qui, à cette époque, se caractérise par une grande ambigüité. Il s’agit principalement d’un élargissement des frontières de classifications des productions en vertu de sa relation avec la réalité qui, traditionnellement fut séparée en deux grands groupes définis comme fiction et non fiction. Pour cette raison, nous avons développés un cadre théorique autour du réalisme comme une catégorie d'analyse du corpus. Aussi, nous avons fait une analyse basée sur les approches des Études Culturelles d'Amérique Latine, l’Analyse Critique du Discours et l'Analyse de Cinéma. Notre travail a été de systématiser et de mettre en relation les processus qui ont permis la consolidation du cinéma contemporain d'Amérique Latine. Également, nous avons confirmés le besoin de contextualiser et de nourrir l'analyse de film avec la connaissance de l'histoire sociale, politique et économique comme une condition pour 'interpréter et analyser le récit de l'Amérique Latine. / Argentine, Chilean and Colombian Cinema of the period between1990-2005 had to face several changes related to political, economic and cultural models. In particular, laws related to film production changed over the years, allowing the configuration of a heterogeneous cinematography regarding its topics and ways of narrating. The main problem of this research is studying the relationship between cinema and reality and how the strategies of construction of fiction and nonfiction narratives are put into tension during the period above mentioned. For this reason, we developed a theoretical framework around the realism as a category to get an approach to the corpus. Additionally, we carried out an analysis of our corpus based on the Latin American Cultural Studies, Critical Discourse Analysis and Film Analysis approaches. We systematized and correlated the processes that have allowed contemporary Latin American films to consolidate as a reference. In this project, we have been able to confirm the need to contextualize and nourish film analysis using knowledge of the social, political and economic history as a condition to interpret and study Latin American Narratives.

Le droit applicable au contrat en droit international privé colombien. Etude comparée, critique et prospective / The law applicable to the contract in colombian private international law. Comparative, critical and prospective study

Le droit international privé colombien demeure tributaire d’une approche publiciste qui repose sur les principes de territorialité et de souveraineté. Ces principes, pourtant délaissés depuis le début du XXe siècle en droit international privé comparé, constituent encore aujourd’hui le fondement des règles de conflit en matière contractuelle qui forment le droit positif. Bien que la jurisprudence colombienne ait aussi utilisé des méthodes qui s’apparentent à d’autres proposées plus récemment aux États-Unis et en France, le système colombien n’offre pas de solutions satisfaisantes aux problèmes que posent les situations internationales, y compris en matière contractuelle. Le droit international privé colombien doit donc être repensé. À cet égard, il est possible, sur le fondement des textes en vigueur, de justifier tant la transformation de l’approche que l’adoption de nouvelles solutions. En matière de contrats, il est possible d’identifier au sein de l’ordre juridique colombien une tendance favorable à la consécration de la liberté de choix de la loi applicable en tant que solution de principe. En effet, cette solution est conforme au principe constitutionnel d’internationalisation et compatible avec le rôle reconnu à l’initiative privé en droit colombien. Largement répandue en droit international privé comparé, la liberté de choix a les faveurs des institutions internationales et, en 2015, la Conférence de La Haye a publié des principes sur le choix de la loi applicable aux contrats commerciaux internationaux. Cet instrument non contraignant peut servir d’inspiration pour l’élaboration d’une réglementation du choix de loi en droit colombien. / Colombian private international law remains in thrall to a public-law inspired approach resting on the principles of territoriality and sovereignty. These principles, which have been abandoned since the beginning of the twentieth century in comparative private international law, still form the basis of the choice-of-law rules for contractual matters found in positive law. Even though the courts have also used methods that are similar to others put forward more recently in the United States and France, the Colombian system does not offer satisfactory solutions to the issues raised by international situations, particularly in contractual matters. Colombian private international law therefore needs to be rethought. In this respect, it is possible, on the basis of existing texts in Colombian law, to justify both the transformation of the approach and the adoption of new solutions. As far as contracts are concerned, a favorable trend towards the consecration of the freedom of choice of the applicable law as a solution of principle can actually be identified within the Colombian legal order. Indeed, this solution aligns with the constitutional principle of internationalization and is compatible with the role recognized to private initiative in Colombian law. Choice of law, which is widely used in comparative international private law, is also favored by international institutions. In 2015, The Hague Conference thus published its Principles on the choice of law applicable to international commercial contracts. This non-binding instrument can provide inspiration for the development of a choice of law regime in Colombian law.
