An evaluation of the South African National Credit Act and the implications for credit users

Thesis (MBA (Business Management))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: The National Credit Act came into being on the 1st of June 2007 and besides its other objectives was intended to make credit more accessible to all South Africans, to stop unreasonable practices by lenders and to protect consumers against reckless lending. This research study investigates the credit environment for the period since the implementation of the Act up to the fourth quarter of 2009 to determine whether South African credit users are indeed better off or whether we are heading for a credit crisis. A literature review was conducted to investigate the extension of credit to households during the period under review and to investigate consumers’ ability and willingness to repay their debt. Due to the global and local financial crisis that happened during this period and the losses and wealth destruction that ensued, the research was extended to consider the influence of the macroeconomic situation on the debtors’ ability to honour their debt commitments. To determine whether South African households are heading for a credit crisis the researcher reviewed literature relating to the financial vulnerability of households, the application of their monthly disposable income, the main reasons for entering into credit agreements, and lastly the extent of over indebtedness. The findings indicate that credit has indeed become more accessible to all South Africans as the number of credit active consumers continued to increase from quarter to quarter. With regards to the cost of credit and the minimum qualifying criteria, credit also became more accessible as individuals earning as little as R1 500 per month became eligible for credit and store cards that used to be exclusive to higher income earners. During the period under review the standing of credit active consumers continued to deteriorate with only 54% of credit active users classified as current at the end of the period, almost 10% lower than before the implementation of the act. It was also found that macroeconomic influences from around the world had a real influence on the ability of credit active consumers to honour their financial commitments. Increased interest rates, inflation, higher transport and energy costs, unemployment and many other factors influenced the income available for and the ability to repay debt over the period under review. Lastly it was found that households are increasingly vulnerable to any changes in their income, expenses, savings or debt position. It is increasing to such an extent that more than 50% of all credit active consumers surveyed during a previous study admitted to borrowing in order to re-pay debt and that a relatively large percentage of users are committed to debt repayments for more than 100% of their monthly income. These findings support the opinion that a credit crisis is on the loom in the South African credit industry. Due to the relatively short period covered by the research stretches and the multitude of income groups and credit agreements included, more research is needed to make specific recommendations to improve the position of credit active consumers. The challenges facing the industry are further complicated by the need credit and other needs of the lower income earners, the required price-for-risk-policies of credit providers and the low levels of financial education amongst users. All three these themes require more research. / AFRIKAANSE OPSOMMING: Die Nasionale Kredietwet wat op 1 Junie 2007 in werking getree het het onder meer ten doel gehad om krediet meer toeganklik te maak vir alle Suid Afrikaners, om onbillike praktyke deur krediegewers stop te sit en om gebruikers te beskerm teen roekelose kredietverlening. Hierdie navorsing verken die kredietomgewing vir die tydperk sedert inwerkingtreding van die wet tot en met vierde kwartaal van 2009 ten einde vas te stel of Suid Afrikaanse gebruikers inderdaad beter daaraan toe is, en of ons afstuur op n krediet krisis. ‘n Literatuurstudie is onderneem om die toestaan van die verskillende tipes huishoudelike krediet tydens hierdie termyn te ondersoek, sowel as die gebruikers daarvan se gewilligheid en vermoë om hul maandelikse skuldverpligtinge na te kom. Vanwee die ernstige finansiële krisis wat tydens hierdie periode in die wêreld en in Suid Afrika grootskaalse verliese en welvaartsvernietiging tot gevolg gehad het, is die literatuurstudie uitgebrei om ook oorweging te gee aan die invloed van hierdie gebeure op skuldenaars se vermoë om hul skuldverpligtinge te diens. Ten einde vas te stel of Suid Afrikaanse huishoudings afstuur op ‘n kredietkrisis het die navorser literatuur bestudeer rakende die finansiële kwesbaarheid al dan nie van huishoudings, die aanwending van hul beskikbare inkomste, die redes vir huishoudings om geld te leen en laastens die omvang van gebruikers wat meer veskuldig is as wat hulle kan bekostig. Die bevindinge dui daarop dat krediet weliswaar meer toeganklik is vir alle Suid Afrikaners aangesien die aantal krediet gebruikers gedurende die tydperk van kwartaal tot kwartaal gegroei het. Wat betref die koste daarvan en die minimum vereistes daarvoor het krediet ook meer toeganklik geword, en kwalifiseer individue wat so min as R1 500 per maand verdien nou vir kreditkaarte en winkel krediet wat voorheen net beskore was vir die hoër inkomste groepe. Tydens hierdie periode het die status van kredietgebruikers verder verswak en het die persentasie kredietgebruikers wat op datum is met hul verpligtinge so laag as 54% gedaal; bykans 10% minder as voor die inwerkingtreding van die wet. Daar is verder bevind dat makro ekonomiese toestande in die res van die wêreld en Suid Afrika ‘n daadwerklike invloed het op die vermoë van kredietgebruikers om hul skuldverpligtinge na te kom. Stygende rentekoerse, inflasie, duurder vervoer en energiekoste, werkloosheid en vele ander faktore het die kontant beskikbaar vir en die vermoë om skuld te delg baie nadelig geraak oor heirdie tydperk. Laastens is bevind dat huishoudings toenemend kwesbaar is vir enige veranderinge in hul inkomste, uitgawe, spaar of skuld verpligtinge. Soveel-so dat meer as 50% van alle gebruikers van krediet erken dat hulle by tye geld geleen het om ander skuld te betaal, en dat ‘n beduidelnde persentasie gebruikers tot meer as 100% van hul besteebare inkomste verbind is vir maandelikse terugbetalings. Bogenoemde bevindinge ondersteun die opinie dat daar n dreigende krisis in die Suid Afrikaanse kredietomgewing is. Aangesien hierdie navorsing beperk is tot ‘n relatiewe kort termyn en dit ‘n groot spektum van inkomstegroepe en kredietooreenkomste dek, is verdere navorsing nodig om spesifieke aanbevelings te maak ten einde Suid Afrikaanse kredietgebruikers in ‘n beter posisie te plaas. Die uitdagings in die industrie word verder gekompliseer deur die krediet en ander behoeftes van laer inkomstegroepe, die noodsaaklikheid vir uitleners om hul produkte te prys vir die inherente risikos wat daaraan gebonde is en die lae vlak van finansiële opleiding onder gebruikers. Al drie hierdie temas benodig verdere navorsing.

Paskolų teikimas yra viena pagrindinių kredito unijų veiklos krypčių, o pagrindinė ir svarbiausia rizika su kuria jos susiduria yra būtent kredito rizika, todėl būtina ją detaliai analizuoti ir turėti patikimą šių aktyvų valdymo mechanizmą. Taip pat valdant, šią riziką, būtina atsižvelgti į socialinį kredito unijų aspektą. Darbo objektas – kredito rizikos valdymas. Darbo tikslas - išnagrinėti kredito unijų, kaip specifinių finansinių institucijų, veiklos ir kredito rizikos valdymo ypatumus. Pirmoje darbo dalyje nagrinėjami kredito unijų kredito rizikos valdymo ypatumai: analizuojama kooperatyvinių finansinių institucijų kreditavimo specifika bei kredito rizikos ypatybės būdingos kredito unijoms. Taip pat apžvelgiami kredito rizikos vertinimo principai ir pateikiami kredito rizikos valdymo metodai bei jų veikimo ypatybės. Antroje darbo dalyje analizuojama ir apibendrinama kredito rizikos valdymo kredito unijose praktika ir empiriniai tyrimai, apibūdinamos Lietuvos kredito unijų sektoriaus veiklos sąlygos ir formuojama kredito rizikos valdymo Lietuvos kredito unijose tyrimo metodika. As well as the management, this risk is necessary to consider the social aspect of the credit union. The work item - credit risk management. The aim - to examine the operational and credit risk management features of credit union as a specific financial institutions. The first part of the study looked at the credit union theoretical credit risk management features: characterized by cooperative financial institutions lending and credit risk perception of the concept of inherent credit unions. It also reviews the credit risk assessment principles and provides credit risk management techniques and performance characteristics. Secound segment of the paper characterizes situation in Lithuanian credit unions sector and describes researches based on credit risk management in credit unions practice. There also is given research method of credit risk management in Lithuanian credit unions. The work led to the following main conclusions. Credit union is a lending institution which distinguished higher degree of confidence and a wider access to financial services. La fraude et la dématérialisation du crédit documentaire

Le crédit documentaire, qui est un instrument de règlement du prix de prestations commerciales entre un vendeur exportateur et un acheteur importateur, fait partie du domaine touché par l'évolution électronique. C'est la raison pour laquelle la Chambre de commerce international de Paris a adopté récemment le Guide sur le crédit documentaire informatisé (eRUU), supplément aux règles et usances uniformes (les RUU 500) appliqué aux crédits documentaires. Le crédit documentaire doit être basé sur une grande confiance et une énorme sécurité. Ainsi, la fraude nuit au principe de l'autonomie de la lettre de crédit et détruit le besoin de sécurité qu'elle engendre. Les divergences relatives à certains critères de la fraude et la délimitation des obligations de la banque dans la vérification des documents sur support papier sont assez complexes pour les commerçants internationaux et pour les banques. Et même si la dématérialisation des documents a tendance à diminuer la fraude en la matière, le crédit documentaire dématérialisé serait encore loin d'être réalisé sans difficultés, avec l'émergence directe des tiers dans l'opération. Son analyse exhaustive doit donc continuer sur le plan doctrinal. La délimitation du devoir de la banque dans la recherche de cette fraude électronique, et dans le paiement des documents électroniques deviendrait aussi discutable que celle dans le crédit documentaire traditionnel. Les banques devraient, entre autres, être sensibilisées sur la nécessité de prendre dans les meilleurs délais certaines dispositions, pour permettre à la clientèle des entreprises d'effectuer des présentations ou des réceptions électroniques des documents de la lettre de crédit en conformité avec le règlement eUCP. / The international trade does not cease developing with the evolution of information technology nowadays. The documentary credit, which is an instrument of payment of the price of commercial services between an exporting salesman and an importing purchaser, is part of the field touched by the electronic evolution. This is why the international Chamber of Commerce of Paris recently adopted the Guide on the computerized letter of credit (eRUU), supplement to the Uniform Customs and Practice for Documentary Credit (RUU 500). The letter of credit must be based on a great confidence and an enormous safety. Thus, the fraud harms the principle of the autonomy of the letter of credit and destroyes the need for safety which it generates. The divergences relative to certain criteria of the fraud and the delimitation of the obligations of the bank in the checking of the documents on paper medium are complex enough for the international tradesmen and the banks. And even if the dematerialization of the documents tends to decrease the fraud on the matter, the dematerialized credit on security would be still far from being carried out without difficulties, with the direct emergence of the thirds in the operation. Its exhaustive analysis must then continue on the doctrinal level. The delimitation of the duty of the bank in the search for this electronic fraud, and in the payment of the electronic documents would become as debatable as that in the traditional documentary credit. The banks would have to be somewhat sensitized on the need for making certain provisions as soon as possible, to allow companies' customers to carry out presentations or electronic receptions of the documents of the letter of credit in conformity with the eUCP.

Trade credit and the joint effects of supplier and customer financial characteristics

We examine how access to bank credit affects trade credit in the supplier-customer relationships of U.S. public firms. For identification, we use exogenous liquidity shocks to supplier firms in the form of staggered changes to interstate bank branching laws. Using a variety of tests, we show that supplier firms with greater access to banking liquidity offer more trade credit to their customers. We also show that when bank branching restrictions are relaxed in the supplier's state, the supplier-customer relationship is more likely to survive. (C) 2015 Elsevier Inc. All rights reserved.

The final part looks at the regulation and standardisation of the CDS market and trend in the changes to those regulations.

The theoretical part is the basis for the practical part within which the analysis of the credit risk management process in the lease company is performed, including the case study analysis.

Theoretical unit describes potential risks in the international and domestic trade and instruments by which these risks can be eliminated or reduced. The practical part is focus on the service of credit insurance as an effective tool to ensure against the risk. On the case study is calculated by using Net Present Value dependence on the size of discount rate, size of insured loss and date of insurance claim. In the final part of the thesis author take a think of what extent are credit insurance companies responsible for the deepening of economic recession.

This dissertation analyzes key features of credit derivatives market, basic risks of the products and trends the market has experienced for several years since its inception, discusses regulatory issues of the market with regard to the Basel II treatment and key reasons for investors using credit derivatives. Dissertation also examines whether and how credit derivatives affected current financial turmoil, analyzes credit derivatives losses of selected institutions on the financial markets and compares them with total losses of these institutions. The main result of the work is that there was no substantial effect of the credit derivatives market on the current financial crisis. Dissertation also examines whether there is any connection between U.S. banks credit derivatives trades and their capital adequacy ratio. According to the analysis, there is no evidence for credit derivatives to essentially affect capital adequacy ratio of U.S. banks. A potential explanation for the higher values of U.S. banks' capital adequacy ratio may be that there are sophisticated risk management strategies banks have been implicating for many years.

Pricing of Multi-Name Credit Derivatives Using Copulas

The goal of this project is to price multi-name credit derivatives using a copula approach. The properties and advantage copula functions have to other traditional methods are carefully evaluated. Monte Carlo simulations are studied and performed to obtain numerical results for copula functions with explicit and implicit forms. A model was developed to price a basic form of a first-to-default basket using different copula functions. The outcomes are analyzed and comparisons are carried out.
