Relações sociais qualificadoras e o setor de turismo em Gramado : modo de vida e de trabalho

A questão sobre a qual se debruça este estudo é a qualificação e suas relações com as esferas do trabalho e do não-trabalho, sendo as relações sociais que conformam os modos de vida e de trabalho o ângulo realçado para investigar e compreender o processo de construção da qualificação no setor de turismo. O local onde o estudo foi realizado é o município de Gramado, localizado na Encosta da Serra do Estado do Rio Grande do Sul. A investigação prioriza dois ramos de atividades - alojamento e alimentação, enquanto o seu foco de estudo recai sob os seguintes casos-estilizados: 1) um “hotel”, 2) um “restaurante” e 3) um “resort”. O objetivo da pesquisa é investigar o processo de construção da qualificação no setor de turismo, buscando enfatizar as relações sociais contidas nas esferas da formação, do consumo e do tempo livre para a conformação da qualificação a partir destes ramos de atividade. A idéia central que orienta esta pesquisa é de que as formas de gestão do trabalho apresentam tendências distintas em quanto à organização do trabalho, como expressões do aprofundamento e da extensão que subentende o desenvolvimento da relação salarial, demonstrando não haver uma maneira ‘ideal’ para organizar o trabalho, mas modalidades diferenciadas de interação entre oferta e demanda de trabalho, correspondentes ao estado das relações sociais numa empresa, setor e/ou sociedade. Como desdobramento desta hipótese, considera-se que as mudanças na qualificação estão condicionadas por um processo de incorporação de formas de trabalho e de relações sociais de tipo não capitalista, ainda que essencialmente ligadas à construção da chamada relação salarial. A metodologia utilizada baseia-se na realização de entrevistas semi-estruturas (21 entrevistados) e na observação. Na direção proposta pela tradição que representa o trabalho de Alaluf e Enguita, portanto, o estudo analisa a qualificação desde uma perspectiva histórico-sociológica, levando em consideração o processo de transformação das relações sociais que acompanhou a evolução dos trabalhos e de um conjunto de aspectos que caracterizam o modo de vida dos que trabalham no setor de turismo em Gramado. / This dissertation focuses on qualification and its relation to the working and non-working spheres, being the social relations, that conform livelihood and work, the lenses through which the process of qualification for tourism is investigated. This research took place in the city of Gramado, in the State of Rio Grande do Sul. The investigation gives priority to two kinds of working activities: lodging and feeding, while the case studies are: 1) a “hotel”, 2) a “restaurant”, 3) a “resort”. The main objective of this research is to investigate the construction of qualification in the field of tourism, emphasizing the social relations that are contained in the process of education, consumption and the use of free time to conform qualification in each kind of activity. The central idea is that work management present different tendencies in relation to work organization that demonstrates that there is no ideal way of organizing work, but different ways of interaction between what is offered and what is demanded which, at the end, correspond to states of social relations in enterprises, sections or societies. As a result from this hypothesis, we consider that the changes in qualification are conditioned by a process of incorporation of work forms and social relations from a noncapitalist type, even though these are attached to the construction of the so called salary relation. The applied methodology is based on semi-standardized interviews (21 informants) and in observation. In the same direction proposed by Alaluf and Enguita, this study analyses qualification from a historical-sociological perspective, taking into consideration the process of transformation of social relations that take part on the evolution of works and the aspects that characterize the livelihood of those who work with tourism in Gramado – including its formative dimension.

Para este estudo, tomou-se como ponto de partida o referencial do materialismo histórico dialético e como aspecto metodológico a perspectiva crítico-dialética. Como estratégia de pesquisa foi utilizada o estudo de caso. O caso investigado foi o processo de produção e os programas de qualificação profissional de uma fábrica de papel do município de Três Lagoas ¿ MS. Os procedimentos de pesquisa adotados foram: a observação do processo de fabricação do papel e entrevistas semi-estruturadas com os gerentes de produção e de recursos humanos e com alguns trabalhadores (as). Depois das referidas análises verificou-se que para todos os trabalhadores da fábrica, sejam os da produção ou os da gerência, são necessárias algumas competências. A habilidade responsabilidade foi uma das mais mencionadas pelos trabalhadores da fábrica de papel quando indagados sobre quais as principais competências necessárias para desempenhar bem sua função. Quanto mais o trabalhador sobe de função, mais a responsabilidade e a pressão aumentam. Constatou-se que os trabalhadores (as) que saíam da sua função para receber treinamentos para uma futura promoção eram aqueles que tinham bons resultados nas avaliações realizadas pelos gestores. A maior exigência de qualificação foi evidenciada na fábrica. Praticamente 100% dos trabalhadores da produção possuem curso técnico na área em que atuam. Um aspecto importantíssimo é que em sua grande maioria as mulheres não estão desempenhando a mesma função que os homens. Na produção, elas estão presentes na área de acabamento, onde o trabalho é totalmente sem conteúdo e nos laboratórios químicos e físicos, onde o trabalho demanda certo cuidado, por conta da manipulação de vidrarias. Também foi observada a presença praticamente massiva de homens ocupando os cargos de liderança. Os representantes sindicais da fábrica investigada são trabalhadores que estão a favor do capital e não do trabalho, visto que, os representantes são designados pela própria gerência da fábrica. Desse modo, concluímos que o "modelo de competência", ferramenta utilizada pela fábrica investigada para qualificar e avaliar seus trabalhadores faz parte de um tipo de gestão empresarial designada por Vincent de Gaulejac como gestão gerencialista. Esse novo modelo de gestão está vinculado ao processo de reestruturação do mundo do trabalho e foi observado primeiramente nas multinacionais / Abstract: This paper aims to analyze the "competency model" adopted by a paper mill in Três Lagoas - MS as a tool for professional training for their employees and also analyze the production process of the same factory, based on technological advances in the new organization of work and new production techniques employed in developed in the 1970s and in Brazil from the 1990s to study this country, we took as starting point the framework of dialectical and historical materialism as an aspect methodological perspective the critical-dialectical. As a research strategy, the case study was used. The case was investigated the production process and professional qualification programs of a paper mill in the municipality of Três Lagoas - MS. The research procedures were adopted: the observation of the paper manufacturing and semi-structured interviews with production managers and human resources and some workers (the) interview process. After these analyzes it was found that for all factory workers, are the production or management, some skills are required. Responsibility ability was one of the most mentioned by the workers of the paper mill when asked about what the core competencies needed to perform its function well. The more the work function rises more responsibility and pressure increase. It was found that the workers (as) that came from his function to receive training for a future promotion were those who had good results in the assessments by managers. The biggest qualification requirement was evidenced in the factory. Virtually 100% of production workers have technical course in the area in which they operate. An important aspect is that mostly women are not performing the same function than men. In production, they are present in the finishing area where the work is totally content and chemical and physical laboratories, where labor demand some caution, due to the manipulation of glassware. Practically massive presence of men occupying leadership positions was also observed. Union representatives are investigated factory workers who are in favor of capital and not of labor, since the representatives are appointed by own factory management. Thus, we conclude that the "competency model", a tool used by the factory investigated to qualify and evaluate your employees is one of a kind business management designated by Vincent Gaulejac as managerialist management. Investigating the articulation of National Qualifications Framework level 4 engineering vocational and academic qualifications with higher education qualifications

This research sought to investigate the articulation of two NQF level 4 qualifications with higher education qualifications. For the purpose of this study, the two qualifications are the National Senior Certificate (NSC) and the National Certificate (Vocational) [NC (V)], respectively. The NSC is an academic qualification offered in schools while the NC (V) is a vocational qualification offered in Technical and Vocational Education and Training (TVET) colleges. The research question explored the manner in which higher education institutions enable the articulation of the NSC and the engineering NC (V) as NQF Level 4 qualifications. It examined how a University of Technology evaluated vocational and academic qualifications for enabling the said articulation. Furthermore, the research questions intended to establish if there were any measures put in place by higher education institutions to ensure equal opportunities of access for holders of vocational and academic engineering qualifications on NQF level 4, thereby enabling articulation. The TVET College was also part of the study for determining if there were any negotiations and collaborations with universities to facilitate and enable access for successful NC (V) students. The research approach followed in this study was qualitative. A case study research design was used. Purposive sampling and convenience sampling were used to identify the institutions and the participants. Interviews and document analysis constitute the data collection methods for this study. The findings of this study show that the policies of the University of Technology do make provision for the admission of students that hold both the NSC and NC (V) qualifications without discrimination. The study revealed that for potential students to be successfully admitted into this institution, they must comply with the requirements set by the institution in terms of the subjects required for entry into engineering programmes. Improving and Expanding the Capabilities of the Poly-Picosatellite Orbital Deployer

The Poly-Picosatellite Orbital Deployer (P-POD) has undergone a series of revisions over the years. The latest revision, described in this Master’s Thesis, incorporates new capabilities like EMI shielding, an inert gas purge system, and an electrical interface to the CubeSats after they are integrated into the P-POD. Additionally, some mass reduction modifications are made to the P-POD, while its overall strength is increased. The P-POD inert gas purge system successfully flew, on a previous revision P-POD. The P-POD components are analyzed to a set of dynamic loads for qualification, and successfully undergoes random vibration qualification testing. The P-POD encounters some problems in thermal vacuum cycling qualification and EMI testing, but there is evidence that the issues can be mitigated. A path forward is laid out to complete both sets of testing.

L'irruption de la catégorie d'oeuvre audiovisuelle en droit libanais / Emergence of the audiovisual work category in Lebanese law

L’examen des dispositions de la loi libanaise n.75 du 3 avril 1999 sur la propriété littéraire et artistique relatives aux oeuvres audiovisuelles nous permet de déterminer le cadre juridique relatif à ce type de création. Pour accéder à la protection par le droit d’auteur, l’oeuvre audiovisuelle doit bénéficier d’un certain degré d’originalité mais aussi elle doit répondre à la définition légale de l’oeuvre audiovisuelle consacrée à l’article 1 de la loi libanaise. Une fois les conditions d’accès à la protection déterminées, on peut étudier le régime juridique applicable à ce type de création. Les oeuvres audiovisuelles sont qualifiées par l’article 9 de la loi libanaise d’oeuvres collectives. Cette qualification nous permet de déterminer le régime juridique applicable. Ceci implique la détermination des différents "acteurs" de l’oeuvre audiovisuelle, leurs droits et les modes d’exploitation de ces droits. / The examination of the provisions of Lebanese law number 75 dated on April 3, 1999 concerning the literary and artistic property for audiovisual works allow us defining the legal framework for this type of creation. Therefore, to reach the copyright protection, any audiovisual work shall benefit from a certain degree of originality and shall also meet the legal definition of an audiovisual work stipulated in article one of the Lebanese law. Once the necessary conditions for an audiovisual work protection are defined, we can proceed with the study of legal regulations applicable to this kind of creation. Audiovisual works are qualified by article 9 of the Lebanese law on collective works. Based on the audiovisual work qualification, we can define the applicable legal regulations. This involves identifying the different “actors” of audiovisual work, their rights and ways of exploiting these rights.

Ce mémoire fait l’hypothèse que le sens qu’accordent les individus au fait d’être surqualifié est beaucoup plus large. Même s’il est raisonnable de croire que la majorité des diplômés espèrent pouvoir obtenir un emploi à la hauteur de leur diplôme, le fait de définir le sentiment de surqualification de façon substantialiste, en ne considérant que le niveau de diplôme obtenu par le travailleur et exigé par l’employeur, semble quelque peu réducteur. Le sentiment de surqualification naît d’un jugement social : il est empirique, contextualisé et dynamique. À la croisée des mesures objectives et subjectives, nous explorons ainsi les facteurs explicatifs du sentiment de surqualification chez les diplômés canadiens à partir d’une analyse statistique des déterminants de ce sentiment dans les premières années qui suivent l’obtention de leur diplôme d’études postsecondaires. Nous montrons d’abord que l’utilisation de compétences en emploi et le lien entre le diplôme obtenu et l’emploi expliquent bien plus le sentiment de surqualification que la suréducation objective. This analysis shows that the issue of overqualification has a broader interpretation than these authors have shown. One assumes that a graduate hopes to obtain a position commensurate with his level of education, but we also have to consider other factors that explain overqualification. The notion of overqualification comes from a social judgment: it is empirical, contextualized and dynamic. As there are objective and subjective measures, we explore the different factors that contribute to the perception of overqualification in Canadian postsecondary graduates. Statistical analysis is used to identify such factors in these individuals during their first years after graduation. Initially, we show that work skills and the link between the diploma earned and the employment obtained explains much more about the feeling of overqualification than solely the matter of overeducation. We also demonstrate that the impact of the extent a given skill is used on the feeling of overqualification varies substantially according to the graduate’s field of study and the nature of the particular skill utilized.

Le processus de qualification pénale : étude sur la transformation des faits en droit dans le traitement des contentieux de masse / The criminal qualification process : study about the transformation of facts into law in mass litigation

La qualification pénale est classiquement considérée comme une sous-catégorie de la qualification juridique et partage avec elle la même définition et les mêmes caractéristiques. Elle est effectivement conçue comme une opération intellectuelle et, par voie de conséquence, elle est pensée dans sa dimension individuelle. L’opération de qualification apparaît ainsi comme une traduction des faits en droit par la mise en œuvre du langage juridique. Le chercheur qui entend faire de la qualification pénale son objet d’étude est nécessairement confronté à des disciplines qui lui sont peu familières telles que la linguistique ou la psychologie cognitive. Pour contourner les difficultés inhérentes à ces disciplines, il est possible d’opérer un changement de paradigme dans l’approche de la qualification pénale. Elle peut être envisagée sous l’angle du processus. Cette notion permet de rendre à la qualification pénale sa dimension institutionnelle et de l’envisager comme le produit des micros-décisions prises par des acteurs en réseau. Leurs actions respectives constituent les différentes phases de ce processus complexe qui aboutit in fine à la dénomination pénale d’une situation. La présente recherche se propose de mettre en œuvre la notion de processus de qualification pénale dans les contentieux de masse, domaines propices à l’observation des pratiques de qualification. L’analyse de ces pratiques, observées à partir des travaux empiriques, a permis de vérifier l’hypothèse selon laquelle la qualification pénale se construit en réseau. Elle apparaît alors comme le produit de la rencontre des divers acteurs aux prises avec des objectifs et des contraintes institutionnelles. De l’évènement à l’exacte qualification, la dénomination pénale est le fruit d’un processus multifactoriel. / Criminal qualification is conventionally considered as a sub-category of the legal qualification and shares with it the same definition and the same characteristics. It is actually conceived as an intellectual operation and, as a consequence, thought out in its own dimension. This qualifying operation appears as a translation of the facts in law by the use of legal language. The researcher who intends using this qualification process as his purpose of study is necessarily confronted with subjects that are unfamiliar to him such as linguistics and cognitive psychology. To circumvent the difficulties inherent to these subjects, it is possible to make a paradigm shift to the approach of the criminal qualification. It can be forseen in the terms of the process. This concept allows to give the criminal qualification its institutional dimension and to consider it as the product of micro-decisions of actors in a network. Their respective actions form different stages of this complex process which ultimately leads to the criminal definition of a situation. This research proposes to implement the concept of process of criminal qualification in mass litigation, areas that are favorable to the observation of qualification practices. The analysis of these practices observed from empirical work has permitted to verify the hypothesis that criminal qualification is formed through networking. It therefore appears as the product of various actors/participants dealing with objectives and institutional constraints. From the concept to the exact qualification, criminal designation is the result of a multifactorial process.

Les champs radiatifs dans le complexe d’accélérateurs du CERN sont caractérisés par des particules mixtes avec un large spectre d’énergie. Le système de surveillance des radiations, le RadMon, a été développé pour la mesure distribuée, et en temps réel, des radiations et ses effets sur l’électronique installée dans les tunnels et les zones expérimentales. Pendant la première phase d’opération du RADMON, un problème critique a été identifié sur les mémoires SRAM utilisées comme capteurs de fluence des hadrons de hautes énergies. Un large nombre de MCU (Multiple Cell Upsets), générés par des microlatchups, ont commencé à apparaître sur les RADMONs, affectant ainsi la précision de mesure de la fluence. Une étude de la cause de cet effet a été réalisée et une solution utilisant un algorithme de détection et de correction en ligne, embarqué sur un FPGA, a été évaluée et mise en place sur les RADMONs installés dans les zones du SPS, PSB, NA62, HiRadMat, ALICE et CHARM.Par ailleurs, dans le cadre du projet CELESTA, une étude de faisabilité a été réalisée pour valider l’adaptation du RadMon à une charge utile pour des applications CubeSat de dimension 1U. Le travail de recherche a été soutenu par le service de transfert de connaissance du CERN en collaboration avec l’Université de Montpellier, le Centre Spatial Universitaire.Les tests expérimentaux ont été effectués dans le nouveau moyen de test CHARM. CHARM offre la possibilité de reproduire les champs radiatifs mixtes présents dans les installations du CERN ainsi que les basses orbites terrestres (LEO).Un module autonome de charge utile pour Cubesat a été développé et équipé avec des capteurs permettant de mesurer dose ionisante ainsi que la fluence des hadrons de haute énergie. Par ailleurs une expérience permettant de détecter des latchups a été ajoutée au module. Les résultats des tests ont permis la définition d’une nouvelle procédure pour la qualification des nano satellites au niveau des radiations sur le système. Ce travail de thèse détaille l’approche suivie pour le choix et la caractérisation des composants utilisés sur la charge utile.La charge utile de CELESTA est le premier projet du CERN sur le sujet de la science des "small satellites". Il représente la première étape d’un intérêt croissant de l’utilisation du moyen de test CHARM pour des missions en environnement spatial. / Radiation fields in the CERN accelerator complex are characterized by mixed particles with broad energy ranges. A Radiation Monitoring System, called "RadMon", was developed for the distributed, on-line measurement of the complex radiation fields and their effect on the electronics installed in areas with a harsh radiation environment. The most recent version of the RadMon revealed a critical issue soon after deployment in the tunnel and the experimental areas. Multiple Cell Upsets (MCUs) arising from microlatchup events started showing up on the SRAM-based particle flux sensors equipped by the system, ultimately affecting the measurement and resulting in corrupted data and accuracy losses. A study of the generation of this effect was performed, and a solution using an on-line detection and correction algorithm embedded on an FPGA, was evaluated and implemented on the RadMon device.Furthermore, in the framework of the project CELESTA, a feasibility study was carried out to validate the adaptation of the RadMon to a 1U CubeSat payload. The research was supported by the CERN Knowledge Transfer as a collaboration between the University of Montpellier, the Centre Spatial Universitaire and CERN. Experimental tests were performed at the new CHARM facility, which allows the characterization of small components, as well as large systems, in a mixed-field representative of the Low Earth Orbit.A stand-alone payload module for 1U CubeSats was developed and equipped withsensors of ionizing dose and high energy hadron fluence. In addition a Latchup Experiment was added on the module as part of the scientific goals of the mission. Results of experimental tests led to the definition of a new procedure for the radiation qualification of small satellites at system level. Details of the characterization and the choice of components are presented together with the approach followed.The payload is the first small satellite module ever designed at CERN. It representsthe first step of an increasing interest towards radiation qualification at CHARM of electronics for low orbit space missions.
