Esta dissertação trata dos processos de socialização primária e secundária das adolescentes autoras de ato infracional que cumprem medida sócio-educativa de internação na Fase – Fundação de Atendimento Sócio-Educativo do Estado do Rio Grande do Sul, em Porto Alegre. O objetivo deste trabalho é, através da socialização primária, elaborar o perfil dessas jovens e, a partir da socialização secundária, compreender as condições em que elas vivem na instituição e como vivenciam a medida sócio-educativa de internação. Para tal, a análise desses processos considera quatro dimensões principais: a individual, a familiar, a coletiva e a educacional/profissional. A problematização deste trabalho se insere na perspectiva da sociologia da conflitualidade, que centra a sua análise nos mecanismos de controle social exercidos pelo Estado. De modo a articular distintas áreas do conhecimento, lança-se mão também das contribuições teóricas da sociologia jurídica e da criminologia através da perspectiva do labeling approach, que mostra como esse controle social acaba “selecionando” alguns indivíduos em detrimento de outros. Desta forma, busca-se elaborar o perfil das adolescentes, com intuito de verificar quem são as jovens “selecionadas” pelos mecanismos de controle social e como são construídos seus processos de socialização primária. Em relação à internação, procura-se compreender como as jovens vivenciam a privação de liberdade, como constroem as relações no cotidiano institucional, quais estratégias elas lançam mão nesse universo. O estudo possibilitou verificar que o controle social não atua somente na “seleção” das condutas para ingresso no sistema, mas ele persiste durante a internação das jovens, através de práticas que configuram um tipo de atendimento específico destinado somente às meninas, que procura “adequá-las” a determinados padrões socialmente aceitos. O trabalho também problematiza o ECA, pois, ainda que represente uma conquista em relação aos direitos das crianças e adolescentes, muitas das suas garantias são utilizadas como recurso para aumentar o controle sobre as internas. / This paper deals with the primary and secondary socialization process of female juvenile transgressors who are sentenced to a social-educational measure of detention at Fase (Fondation of Social and Educative Service of do Rio Grande do Sul, in Porto Alegre. The goal of this study is, through primary socialization, to establish the profile of those girls and, trough secondary socialization, to understand the conditions which they live in that institution as well as how they experiment the social-educational measure of detention. For this, the analyze of those processes considers four main dimensions: the individual, familiar, collective and educational/professional ones. The problematization of this research is in the sociology of conflictuosity perspective that focus on the analyze of social control mechanisms used by State. In order to articulate different fields of knowledge, it is also used theorical contributions from Law sociology and criminology through labeling approach point of view which demonstrates how that social control ends up “selecting” some individuals to the detriment of others. Through this, the profile of those girls is elaborate in order to check who are the girls selected by social control mechanisms and how they primary socialization processes are built. In relation to detention, the aim is to understand how those girls live without their liberty, how they build relationships inside the institutional routine, what strategies they use in that universe. The study has allowed to verify that social control does not only act in the “selection” of behaviors that can make part of this system, but it remains during the detention of the girls through practices that characterize a kind of specific care designated only to the girls and that try to “fit them” to new socially accepted patterns. The study also reflects about ECA (Statute of the Child and the Adolescent), once, even if it still represents a success in relation to child and adolescent rights, many of the guarantees are used as a tool to increase control over the interns.

Suid-Afrika is een van die lande met die hoogste gevangenis bevolking in die wêreld. Een van die grootste probleme wat tot die situasie bydra, is die aantal oortreders wat nie in staat is om borg te betaal nie. ʼn Ander probleem is die aantal verhoorafwagtendes wat in aanhouding is. Die Suid-Afrikaanse Witskrif van die Departement van Korrektiewe Dienste, is vasberade om die rehabilitering van die oortreder te bevorder. Die fokus van die studie wentel om die rehabilitasie van die oortreder en die vraag of hierdie doelwit binne die korrektiewe stelsel haalbaar is. Heelwat klem word op die noodsaaklikheid van alternatiewe vonnisse geplaas asook rehabilitasie as strafoogmerk tydens vonnisoplegging. The role of correctional supervision in curbing overpopulation in prisonsVisser, Johannes Gresse 10 1900 (has links)
The aim of this dissertation is to place the phenomenon of the overpopulation of South African prisons in perspective and to rectify the current situation in search of possible solutions. Since 1981, when this phenomenon reached unmanageable proportions, government has made numerous amnesties. This was only a short-term alleviation of the problem due to the high levels of recidivism.
Correctional supervision as a sentence option was advocated by both the Lansdowne and Viljoen Commissions, enacted during 1986 and finally implemented during 1991. Initial expectations soon became blurred by factors such as insufficient development programmes and specialised personnel, enormous caseloads and the exclusion of supervision cases from development programmes.
This study endeavours to analyse the current application of correctional supervision to determine the stumbling blocks and to create a foundation for new perspectives and possible solutions. / Penology / M.A. (Penology)

Afrikaans text / The purpose of this study was to retrospectively analyze a group
of observation cases referred to a psychiatric institution through the criminal justice system by
means of certain measuring instruments in order to determine on which grounds some of the cases
were classified as criminals and others as state patients.
The sample for the purposes of this investigation consisted of one hundred and forty-two cases
referred to the Weskoppies hospital for psychiatric observation during 1988 to 1994. The measuring
instruments were the South African Wechsler intelligence scale, the Rorschach projective
technique and an information schedule which was used for the purpose of gathering biographical
information and personal details of each particular case. The data collected through these
instruments was statistically analyzed utilising frequencies and crosstabulations,
chi-square tests, t-tests, correspondence
analyses, factor analyses and regression analyses.
The findings of this investigation revealed that crimes concerning personal relations and property
crimes were more committed by criminals than state patients while crimes concerning communal life
were encountered more amongst state patients than criminals.
Non-person-directed crimes of violence were encountered proportionally more amongst state patients
who had a history of substance abuse than in criminals with a similar history. State patients who
had a history of substance abuse were proportionally more prosecuted on account of
person-directed-crimes of violence than criminals with a similar history.
The predictive measuring instrument developed by means of
regression analysis indicated as important predictors three
subtests of the South African Wechsler intelligence scale namely general information, digit-symbol
substitution and picture arrangement as well as the variable "previous psychiatric treatment".
The following recommendations were also made:
The current endeavour to adapt the South African Wechsler intelligence scale for all population
groups needs to be maintained and this adaptation should also be pursued in each country where the
scale is used or was used in the past.
It is advisable to draw up certain profiles of specific offenders by means of the Rorschach
projective technique while the testing procedure should preferably be undertaken by the same
researcher.
Provision should be made that the accused be declared as state patients only on account of serious
and violent crimes while the courts should have the right in appropriate cases to charge the
accused with detention in accordance with chapter three of the
Mental Health Act.
The testimony of criminologists and psychologists should be added to the testimony of psychiatrists
especially in cases of accountability or diminished accountability.
The proposed predictive model may be further refined and adapted through the use of a larger,
nation-wide sample resulting in the inclusion of a greater number of observation cases and
variables.
Due to the accelerating rate of revision associated with The DSM IV manual and the fact that its
validity is questioned, ethically responsible psychiatrists, psychologists and criminologists are
obligated to identify practices and procedures which threaten to misinform the legal system. / Die doel van hierdie studie was om aan die hand van bepaalde meetinstrumente retrospektief 'n groep
observasiegevalle wat deur die regstelsel na 'n psigiatriese inrigting verwys is, te ontleed, sodat
daar vasgestel kon word op watter gronde sekere van die gevalle as misdadigers en ander as
staatspasiente geklassifiseer is.
Die steekproef vir die doeleindes van hierdie ondersoek het bestaan uit honderd twee-en-veertig
gevalle wat vanaf 1988 tot
1994 na Weskoppieshospitaal vir psigiatriese waarneming verwys is. Die meetinstrumente wat gebruik
is, was die Suid-Afrikaanse Wechsler-intelligensieskaal, die Rorschach-projeksietegniek en
'n inligtingskedule wat biografiese inligting en persoonlike
besonderhede van elke besondere geval ingewin het. Die gegewens wat uit hierdie meetinstrumente
versamel is, is statisties
verwerk met behulp van frekwensies en kruistabellerings, chi
kwadraattoetse, t-toetse, korrespondensie-analises, faktoranalises en regressie-ontledings.
Die bevindinge van die ondersoek het aan die lig gebring dat persoonverhoudings- en
eiendomsmisdrywe meer deur misdadigers as staatspasiente gepleeg word, terwyl gemeenskapslewe
misdrywe meer by staatspasiente as misdadigers voorgekom het.
Nie-persoonsgerigte geweldsmisdrywe het verhoudingsgewys meer onder staatspasiente met 'n
geskiedenis van substansmisbruik as by misdadigers met 'n soortgelyke geskiedenis voorgekom.
Staatspasiente met 'n geskiedenis van substansmisbruik is ook verhoudingsgewys meer as misdadigers
met 'n soortgelyke geskiedenis weens persoonsgerigte geweldsmisdrywe aangekla.
Die voorspellingsmeetinstrument wat met behulp van die regressie
ontledings ontwikkel is, het drie subtoetse van die Suid Afrikaanse Wechsler-intelligensieskaal
naamlik algemene inligting, syfersimboolvervanging en prentrangskikking asook
die veranderlike "vorige psigiatriese behandeling" as die
belangrikste voorspellers uitgewys.
Die volgende aanbevelings word ook hiermee gemaak:
Daar moet volgehou word met die huidige poging om die Suid Afrikaanse Wechsler-intelligensieskaal
vir alle bevolkingsgroepe in Suid-Afrika aan te pas asook met die aanpassing van die meetskaal vir
elke land wat dit tans gebruik of in die verlede gebruik het.
Dit is raadsaam om met behulp van die Rorschach projektiewe tegniek bepaalde profiele ten opsigte
van spesifieke oortreders op te stel terwyl die toetsingsproses verkieslik deur dieselfde
ondersoeker waargeneem word.
Daar moet seker gemaak word dat beskuldigdes slegs in die geval van ernstige en gewelddadige
misdade tot staatspasiente verklaar word, terwyl die howe die bevoegdheid kry om in geskikte
gevalle te beveel dat beskuldigdes ingevolge Hoofstuk 3 van die Wet op Geestesgesondheid aangehou
moet word.
Die getuienis van kriminoloe en sielkundiges behoort bygevoeg te word by die van psigiaters en wel
in gevalle waar toerekeningsvatbaarheid of verminderde toerekeningsvatbaarheid ter sprake is.
Die voorgestelde voorspellingsmodel kan verder verfyn en aangepas word deurdat 'n groter, landwye
steekproef van alle observasiegevalle getrek word wat uiteraard 'n groter aantal veranderlikes
sal insluit.
Weens die versnellingstempo van hersiening met betrekking tot die
DSM-IV handleiding en die feit dat sy betroubaarheid bevraagteken word, word aanbeveel dat eties
verantwoordelike gedrag aan die kant van psigiaters, sielkundiges en kriminoloe gevolg word sodat

These studies have resulted in new standards, known as 3.5G, published by 3GPP group, for the evolution of the third generation of the cellular systems. In this Masters Thesis the performance of a 3G WCDMA system, with diverse base stations and thousand of users is developed with assists of the planning tool NPSW. Moreover the performance of the 3.5G techniques hybrid automatic retransmission and multi-user detection with interference cancellation, candidates for enhance the WCDMA uplink capacity, is verified by means of computational simulations in Matlab of the increase of the data communication capacity and the reduction of the delays in the retransmission of packages of information / A introdu??o de novos servi?os digitais nas redes celulares, em taxas de transmiss?o cada vez mais elevadas, tem impulsionado recentes pesquisas que v?m estudando maneiras de aumentar a capacidade de transmiss?o de dados e diminuir os atrasos nos enlaces direto e reverso de sistemas de terceira gera??o WCDMA. Human Rights in Times of Social Insecurity: Canadian Experience and Inter-American Perspectives / Derechos humanos en tiempos de inseguridad ciudadana: experiencia canadiense a la luz del derecho interamericanoProvost, René 10 April 2018 (has links)
Canada’s experience in the war against terrorism goes back to the seventies, and continues to develop nowadays, with the last direct terrorist activity in 2017. The Canadian Government reacted to these terrorist attacks by enacting a number of statutes that reflect a changing international paradigm in relation to the fight against terrorism. Fundamental rights and liberties such as the freedom of expression, the right to private life and to personal freedom have been curtailed by these legislative measures. The practical consequences of these measures are analyzed via a comparative examination of the Inter-American System of Human Rights. In general terms, the war against terrorism produces significant impacts over the human rights. / La experiencia de Canadá en la lucha contra el terrorismo se remonta a inicios de la década de los setenta y se desarrolla hasta la época actual (los acontecimientos más recientes han tenido lugar en el año 2017). Las medidas legislativas fueron la vía adoptada por parte de Canadá para contrarrestar los ataques y reflejar el cambio de paradigma político en la esfera internacional con relación al fenómeno del terrorismo. Derechos fundamentales como el derecho a la libre expresión, a la vida privada y a la libertad personal se encuentran particularmente afectados por estas medidas. Un análisis comparativo del sistema canadiense y el sistema interamericano permite identificar las consecuencias de estas medidas. En términos más amplios, la lucha contra el terrorismo genera impactos significativos sobre los derechos humanos en general.

Association d'origine protestante, la Cimade naît en 1939 pour venir en aide aux Alsaciens-Lorrains repliés dans le sud-ouest de la France. Son action s'oriente vers l'accueil des réfugiés dans les lieux d'enfermement et de relégation. Son histoire permet d'aborder sous un angle particulier les années 1940, les camps d'internement français et la Shoah, la Libération, l'épuration, la reconstruction et les mutations du système pénitentiaire. La Cimade œuvre durant la Guerre d'Algérie auprès des populations algériennes dans les camps de regroupement et en métropole dans les centres d'accueil des familles harkies comme indochinoises et dans les bidonvilles où vivent les travailleurs post-coloniaux. Enfin,le gouvernement fait appel à la Cimade en 1984 pour intervenir dans les centres de rétention administrative auprès des étrangers reconduits à la frontière. Sa présence est exclusive jusqu'en 2007. L'histoire de cette association permet de saisir comment d'une assistance humanitaire, l'action bascule vers une "juridiciarisation" dès les années 1970. La continuité de sa présence livre une lecture originale de la gestion des étrangers en France. Interface entre "le dedans et le dehors", la Cimade est en tension permanente avec l'Etat. Association de terrain, pouvant sembler participer à la cogestion du système de l'enfermement, elle ne renonce pas à son militantisme ancré à gauche et dénonce ce qu'elle considère comme des cas d'injustices. Son action est représentative de l'ambiguïté de l'interventionnisme associatif. Ce travail de thèse met en lumière les repositionnements et la progressive sécularisation d'une association protestante qui traverse une partie du XXème siècle,"siècle des camps". / Originally a Protestant association,the Cimade was created in 1939 to help people from Alsace-Lorraine,who had taken refuge in the south-west of France.Its action was mainly based on welcoming refugees in confinement and banishment places.Its history helps to understand the 1940s,the French internment camps and the Shoah as well as the purge then post-war reconstruction and the penitentiary reform.During the Algerian war,the association worked both in grouping camps in Algeria and in France where the members of the FLN were assigned.During decolonisation,it gave assistance to harkies and Indochinese families in reception centres as well as to post-colonial workers in shanty towns.As soon as 1984,the government urged the Cimade to work with foreigners escorted to the border in administrative confinement centres.Its presence was exclusive until 2007.The history of this association helps to understand how humanitarian assistance became a cause lawering in the early 1970s.Its permanent presence in camps enables us to consider the specific approach to the governments policies concerning foreigners in France.Working as an interface between "the inside and the outside",the Cimade,throughout its history,was in constant tension with govenments.Although being an association in the field,seemingly involved in joint management of the confinement system,the Cimade didn’t give up its left-centered activism, denouncing what they considered as a justice denial. Its action is representative of the ambiguities of the associations interventionism.This research highlights the repositioning and the progressive secularization of the association throughout the 20th century,the century of camps.

Les stratégies d'adaptation des détenus et du personnel pénitentiaire: le cas de la prison centrale de la Kasapa / Adaptation's strategies of the inmates and the prison staff: the case of the central prison of Kasapa.N'Kulu Ngoy, Hugo 11 June 2015 (has links)
Pays en voie de développement, la République Démocratique du Congo est confrontée à des nombreux problèmes sociaux auxquels les pouvoirs publics tentent d’apporter des solutions sur base d’une échelle de priorités définies par des choix politiques. Parmi ces priorités sociales politiquement déterminées, la prison comme dernier maillon de la chaine pénale ne semble pas encore figurer en bonne place malgré des sporadiques déclarations d’intention généralement non suivies d’action concrète conséquente. Il est de la sorte évident de constater que les établissements pénitentiaires congolais en général et la prison centrale de la Kasapa en particulier se trouvent dans un état de dégradation depuis plusieurs décennies :délabrement des bâtiments carcéraux, mauvaises conditions matérielles de détention, mauvaises conditions de travail pour le personnel de garde en nombre manifestement insuffisant, etc. C’est dans ce contexte social particulier que nous avons essayé de saisir, par une approche qualitative inductive, comment l’unique prison de la ville de Lubumbashi arrive à s’adapter aux contraintes spécifiques de son environnement (interne et externe) pour remplir sa mission sécuritaire de garde (évitement des évasions et des troubles graves intramuros), et quelles sont les pratiques de survie et de débrouille que développent respectivement les détenus et le personnel de garde. La thèse s’articule autour de deux parties. La première pose le cadre méthodologique en explicitant les choix opérés ainsi que les questionnements réflexifs qui se sont imposés durant les phases d’immersion. La deuxième partie présente les différentes stratégies d’adaptation en lien avec différentes thématiques classiques telles que l’organisation sécuritaire et la gestion de la discipline, les conditions matérielles de détention, les visites et autres formes de contact avec le monde extérieur, le travail pénitentiaire, les activités socioéducatives et loisirs, etc. L’adaptation aux objectifs sécuritaires de la prison centrale de la Kasapa ainsi que les stratégies de survie et de débrouille se réalisent à travers les interactions sociales dans lesquelles sont impliquées les acteurs caractérisant par définition l’univers carcéral :les gardés et les gardiens. Les interactions sociales sécuritaires s’expriment notamment en termes de participation ou de collaboration de certains détenus à des tâches de surveillance de la population détenue. Ces détenus surveillants se dressant comme une sorte de troisième groupe social à cheval entre la population détenue et le personnel pénitentiaire. Les pratiques de survie et de débrouille prennent pour l’essentiel la forme des échanges de type économique et/ou social intramuros. Ces échanges impliquant tant les détenus que le personnel pénitentiaire, dépendent en grande partie des contacts que la prison (gardiens et gardés) a avec le monde extérieur qui est principalement représenté par les visiteurs des détenus. / Doctorat en Criminologie / info:eu-repo/semantics/nonPublished
