Le principe de subsidiarité est ici étudié en droit canonique, et au cours de son histoire contemporaine. Le catholicisme romain procède, depuis moins d’un siècle, à une complexe acculturation et inculturation, certes conditionnelle par respect envers sa spécificité religieuse, à propos de procédures de subsidiarité. Et, y compris, afin que de telles procédures puissent être assumées dans les rapports de pouvoirs internes à cette Église chrétienne. Car la meilleure des mises en œuvre de subsidiarité a acquis une réputation de précieuses contributions pour rendre le vécu en sociétés plus humain : un savoir procédural pour articuler les différents ordres supérieurs et inférieurs. Que ces subsidiarités articulent davantage de participation effective de tous et de toutes aux décisions les concernant. Aussi les formes de subsidiarités les plus ajustées et opportunes peuvent en principe faciliter un exercice plus libre et plus responsable des compétences légitimement réparties. Mais, leurs applications concrètes ne sont pas sans soulever des difficultés, des confusions indues et équivoques de compétences. L’Église catholique romaine recommande l’application du principe de subsidiarité à la société civile (ad extra). À quelles conditions institutionnelles des procédures de subsidiarités dans l’Église catholique romaine contemporaine (ad intra) ? / The principle of subsidiarity is studied here in canonic law, and during modern history. The Roman Catholicism has proceeded, less than a century, in a complex acculturation and inculturation, admittedly conditional with respect for religious specificity, about the procedures of subsidiarity. And, furthermore, in order such procedures to be assumed in the power relations internal to this Christian Church. Because the best practice of subsidiarity has acquired, in a real-world situation and in the Church, a reputation of precious contributions to make society more human: a procedural knowledge to articulate the different superior and inferior orders. That this subsidiarity leads to a more efficient participation of everybody to the decisions concerning them. Thus the most adjusted and appropriate forms of subsidiarity can in principle make easier the exercise of the competences legitimately distributed. But, their concrete application is not without raising some difficulties, undue confusion and equivocal competences. The Roman Catholic shaping of this principle of social and political moral of subsidiarity, addressed to all the good societies possibly well-disposed, is advocated, firstly and mostly, since the encyclical letter Quadragesimo Anno of May 15th 1931 from Pie XI. The Roman Catholic Church teaches and recommends steadfastly the application of the principle of subsidiarity to the civil society (ad extra).What about its existence in the modern Roman Catholic Church (ad intra)?

Bygglov och strandskyddsdispens : Hur kan tillståndsprövningarna samordnas?Tornler, Marlene, Widén, Erika January 2023 (has links)
Building permits and dispensation from shore protection are today two, separate permits, which are legally independent of one other. Despite this, both a building permit and a dispensation from shore protection are normally required for proceedings measures within a shore protection area. This means that a building permit applicant, despite have been granted a building permit, cannot begin the proceedings until dispensation from shore protection has also been granted. The fact that both permits are usually handled by the same authority, i.e. the municipality, can lead to confusion for individual property owners. The municipalities' handling of the permits can also affect the cadastral authority's handling of property registration procedures within shore protection areas.The purpose of this study is to investigate how the permit examinations can be coordinated; partly to clarify the process for the public and partly to simplify the handling of the cadastral authority's handling of property registration procedures. The goal of the study is to present proposals for how the permit examinations can be coordinated.To achieve the purpose and goals of the study, a literature review was carried out as well as a qualitative study consisting of semi-structured interviews with municipalities, cadastral surveyors, and the county administrative board. In addition, a legal dogmatic method was implemented, implying that court decisions, municipal decisions on building permits, and dispensations from shore protection as well as proposals and the state's public investigations were reviewed.The results of the study show that the awareness that a measure may require a dispensation from shore protection is lower among the general public than the understanding that a building permit may be required. The results also show that the municipalities, the county administration, and the cadastral authority sometimes make different assessments in shore protection issues and that the need for a dispensation from shore protection is often only discovered in connection with property registration procedures. Many municipalities do not experience any major problems with how the current legislation is designed, however, the results show that some municipalities have established their own routines to simplify permit examinations. The study also shows that the consequences of a building permit applicant neglecting to apply for a dispensation from shore protection can be great, not least financial. In the worst case, property owners can be prosecuted for environmental crimes or forced to demolish an already constructed building.Overall, there is a need to change the legislation; a building permit according to the Planning and Building Act should be able to be declared suspended while waiting for the issue of a dispensation from shore protection to be decided.ivIn addition, the study shows that there is a need for increased competence development regarding shore protection legislation at both the municipal and the cadastral authorities. / Bygglov och strandskyddsdispens är idag två, från varandra, oberoende tillståndsprövningar. Trots det fordras normalt såväl bygglov som strandskyddsdispens för åtgärder inom strandskyddsområde. Det innebär att en bygglovssökande, trots att denne beviljats bygglov, inte kan påbörja åtgärden förrän strandskyddsdispens har beviljats. Att de båda tillståndsprövningarna vanligtvis handläggs av samma instans, kommunen, kan dessutom leda till förvirring för enskilda fastighetsägare. Kommunernas hantering av tillstånden kan även påverka lantmäterimyndighetens handläggning av fastighetsbildningsförrättningar inom strandskydd.Syftet med studien är att undersöka hur tillståndsprövningarna hanteras idag samt hur de bättre kan samordnas, dels för att förtydliga processen för allmänheten, dels för att förenkla handläggningen vid fastighetsbildningsförrättningar. Målet med studien är att presentera förslag på hur tillståndsprövningarna kan samordnas.För att uppnå studiens syfte och mål genomfördes en litteraturstudie samt en kvalitativ studie bestående av semistrukturerade intervjuer med kommuner, förrättningslantmätare och länsstyrelsen. Därtill genomfördes en rättsdogmatisk metod innefattande en granskning av domstolsavgöranden, kommunala beslut om bygglov- och strandskyddsdispenser samt propositioner och statens offentliga utredningar.Resultatet av studien visar att kännedomen om att en åtgärd kan kräva strandskyddsdispens är lägre hos allmänheten än kännedomen om att det kan krävas bygglov. Resultatet visar också att kommunerna, länsstyrelsen och lantmäterimyndigheten stundtals gör olika bedömningar i strandskyddsfrågor och att behovet av strandskyddsdispens många gånger uppdagas först i samband med lantmäteriförrättningar. Flertalet kommuner upplever inte någon stor problematik kring hur nuvarande lagstiftning är utformad, däremot visar resultatet att vissa kommuner har upprättat egna rutiner för att förenkla tillståndsprövningarna. Studien visar även att konsekvenserna av att en bygglovssökande förbiser att söka strandskyddsdispens kan bli stora, inte minst ekonomiska. I värsta fall kan fastighetsägare åtalas för miljöbrott eller tvingas riva en redan uppförd byggnad.Sammantaget finns det ett behov av att ändra lagstiftningen; ett bygglov enligt plan- och bygglagen bör kunna vilandeförklaras i väntan på att frågan om strandskyddsdispens avgörs. Dessutom visar studien att det finns det ett behov av ökad kompetensutveckling gällande strandskyddslagstiftningen hos såväl kommunerna som hos lantmäterimyndigheterna.

<p>Eutrophication was recognized in the early 1900's and results in severe algal blooms, increased biomass production and eventually leads to an altered ecosystem. In Mälardalen we find the most eutrophic lakes. Most of the applied phosphorus and nitrogen into seas and oceans comes from agriculture, and the nutrients losses are affected by local weather conditions and soil type. Guidelines for storage and distribution of manure were introduced in the 80s, and the rules were strengthened January 1, 2010. Localities and previous county administrations can whether there are special reasons, grant an exemption for manure application during winter-periods despite the current ban.</p><p>In this essay I have examined how many exemptions of manure application that has been granted at the Sagån river, and what implications it has for the eutrophication of Lake Mälaren. Sagån’s catchment area extends through Enköping, Sala, Heby, Västerås and Uppsala. Since 2000, 23 waivers of manure application have been granted, most of these deviations have occurred on snow-covered ground or when the weather change considerably. This means that much of the nutriment in the manure went down to the nearby water when the snow melted. Computations were made In order to find out how much phosphorus was spread each time. The conclusion is that the pig manure contains significantly more phosphorus, meaning greater phosphorus losses. However, these calculations are only estimates.</p><p>Several farmers were contacted to find out what they think about the regulation of the management and application of manure. They believe that the new legislation does not pose a problem for them. But farmers with small distribution areas in relation to the number of animals could have some problems.</p>

Magister Legum - LLM / Land allocation and administration is a crucial role for traditional leaders, because it has remained one of the few de facto powers and sources of influence still available to them in their areas of jurisdictions.1 This role has been played by traditional leaders from time immemorial. Furthermore, the Constitution of the Republic of South Africa recognises the existence of traditional leaders.2 Moreover, the Constitution seeks to integrate the institution of traditional leadership by expecting national legislation to be put in place so that the roles of traditional leaders are known in society.3 However, roles with regard to the allocation and administration of land by traditional leaders have not been promulgated in legislation. Therefore, this research will look at the issues of land allocation and administration by traditional leadership in the democratic dispensation.

The purpose of the study was to explore the lived experiences of nurses on the implementation of occupational specific dispensation (OSD). Qualitative research using hermeneutic phenomenology was conducted in the three selected public hospitals in the Umgungundlovu district in KwaZulu-Natal (KZN).
Data was collected by means of in-depth interviews with professional nurses, enrolled nurses and nursing assistants and focus group discussions with nurse managers purposively selected at the public hospitals in the Umgungundlovu district. Parse’s extraction synthesis analysis of data was done and seven (7) themes emerged from the participants’ dialogical conversation exploring the experiences of the implementation of OSD.
The findings suggested that nurses viewed OSD as unfair labour practice because it divided nurses; there are those who grossly benefitted and those who benefitted less. The researcher concluded that the study will assist the authorities in the department of health both nationally and provincially to review OSD for nurses and close the gaps identified during the implementation as they were the pilot group. / Health Studies / M.A. (Health Studies)

Brink, with specific reference to his historiographical texts `n Oomblik in die wind, Houd-den-Bek, Die eerste lewe van Adamastor, Inteendeel, Sandkastele and Donkermaan. The texts can be described as links in a textual history of South Africa: a history corresponding to the official version, revisioning it in an imaginative way. The texts also criticize political (mal)practices, and the pre-colonial, colonial and postcolonial social contexts of the country are critically scrutinized. The texts offer suggestions for a new political dispensation. Since the seventies the Brink oeuvre has developed a multi-dimensional postcolonial approach. Aspects of post-colonialism, post-structuralism, magical realism and feminism as articulated in the texts, are analyzed and interpreted. This study theoretically presupposes that the individual is an integral entity, therefore,
education should take place according to the harmonious development of all the facets of a child's
being. Even in antiquity, physical education and sport were seen to be important for a balanced
education. Every society implements physical education and sport according to own needs and
requirements, according certain values to sport, which values are reviewed in this study. A
literature study corroborates that the intellectual, physical and social development of the child
undoubtedly forms part of the total environment of the educative process. Exclusion of any facet
could cause an imbalance in the development of the child. Incorporation of physical education and
sport in the post-apartheid educational dispensation of South Africa forms the later part of the
investigation. Various factors in South Africa have an influence on the role and place of physical
education and sport within the curriculum. Government involvement in sport can determine the place
of sport in society and in the curriculum. The readmittance of South Africa into international
participation and changes in the political policy also play a role. These factors pose the challenge and facilitate the
possibility to reinstate physical education and sport at schools. The structure of South African
sport is undergoing a total change and the role players in the sports fraternity are now faced with
numerous challenges and opportunities. Reinstating physical education and sport in the school
curriculum serves a vital role in the reconstruction and development of a healthy and well-balanced
society. Furthermore, reinstatement could reverse the consequences of social and economic
injustices. Research undertaken in Australia, also provides some answers to problems for the South
African situation. It proposes new initiatives that could be of help to the relevant role players
in the planning of physical education and school sport in the post apartheid educational
