Despite the continuous and exhaustive debate on the subject in academia in the last ten years, spreading with the decisions of the Superior Court of Justice and the Supreme Federal Court, the study is justified to the extent that, although the combination of understandings signed both in doctrine, as the case law on its importance for the existence of bills in Congress that seek to delineate the contours of the Institute, and should receive highlight the Bill n° 6.583/2013, named the Family Status and the Senate Bill n° 470/2013, without forgetting the other pretensions of Congressmen in the regularisation of affection in the Statute of the Child and Adolescent. Other points to be briefly addressed are the affection principle and the phenomenon of parenting affection in view of the Courts and of the doctrine. Analyze the constitutional parameters, as well as the acts and legal facts that characterize the paternity affection and its effects, both patrimonial and personal. There is still a brief comparative study of the existence of the phenomenon in other legal systems of other countries. It is concluded that it is permissible to talk about fatherhood as an affection acclaimed both in doctrine, both in doctrine and in jurisprudence, as a precondition for the formation of family links currently assumed and respected (despite contrary voices) and its effects on family law / O presente trabalho tem por objetivo o estudo da paternidade sob a ótica do afeto e de seu alcance no Direito Civil Brasileiro. Apesar do contínuo e exaustivo debate sobre o tema no mundo acadêmico nos últimos dez anos, difundindo-se com as decisões do Superior Tribunal de Justiça e do Supremo Tribunal Federal, o estudo se justifica na medida em que, apesar da conjugação dos entendimentos firmados tanto na doutrina, quanto da jurisprudência sobre sua importância, há a existência de projetos de lei no Congresso que procuram delimitar os contornos do instituto, devendo merecer destaque o Projeto de Lei nº 6.583/2013, denominado Estatuto da Família e o Projeto de Lei do Senado nº 470/2013, conhecido como Estatuto das Famílias, sem deixar de olvidar as demais pretensões dos congressistas em regulamentar o instituto da socioafetividade no Estatuto da Criança e do Adolescente. Outros pontos a serem brevemente abordados são a socioafetividade como princípio e o fenômeno da paternidade socioafetiva na visão dos Tribunais e da doutrina. Analisar-se-ão os parâmetros constitucionais, bem como os atos e fatos jurídicos que caracterizam a paternidade socioafetiva e seus efeitos tanto patrimoniais quanto pessoais. Verifica-se, ainda breve estudo comparativo sobre a existência do fenômeno jurídico em outros ordenamentos de outros países. Conclui-se que é permitido falar em paternidade socioafetiva como instituto já consagrado tanto na doutrina, quanto na jurisprudência, como pressuposto necessário para formação de vínculos familiares atualmente assumidos e respeitados (apesar das vozes contrárias) e seus efeitos no Direito de Família

We have concentrated on the second part of this constitutional precept and only the common-law marriage between man and woman. There have been new judgments by the Brazilian Federal Supreme Court (STF) based on this modification. Although the Constitution has oriented to the law enactment, that facilitated the conversion of the common-law marriage, between man and woman, into civil marriage, the legislators haven`t accomplished their mission, or at least, they haven`t done it properly. Not even with the enactment of the law n. 9.278 from 05-10-1996, nor the Civil Code from 2002, article n. 1.726. There some bills about the theme mentioned above that have been examined by the National Congress. These omissions on the laws cause many problems and the Justice Court-inspecting Authority of each State has tried to supply them. We have observed, since antiquity, there is a concern about formalizing marriages among the couples who have informal relationships. Moreover, according to the Brazilian Geography and Statistics Institute (IBGE) more than 1/3 (one-third) of the Brazilian couples haven`t got the civil registry to legalize their common-law marriage. This constitutional law being examined has been created for their assistance. We consider the conversion of the common-law marriage into civil marriage similar to the conversion of religious marriage into civil marriage. Our research has involved comparative law and revealed many similarities between Brazilians Laws and those of other nations, but they have less detail and are not expressed at the Constitutional level, as seen in Brazil, where it is established that the law should facilitate the conversion of the common-law marriage into civil marriage. We have indicated the possible reasons, judicial and practical, to think about the right to convert common-law marriage into civil marriage; the indispensable constitutional and legal requirements for it; the adequate procedures to be within the constitutional law; beyond the effects derived from exercising of this right / A Constituição Federal de 1988, no que se refere ao direito de família, inovou ao dispor, no art. 226, § 3º, que: Para efeito de proteção do Estado, é reconhecida a união estável entre o homem e a mulher como entidade familiar, devendo a lei facilitar sua conversão em casamento . Dedicamo-nos à segunda parte desse preceito constitucional e apenas à união formada entre o homem e a mulher. Assim procedemos considerando os recentes julgamentos do Supremo Tribunal Federal. No que diz respeito ao tema do nosso trabalho, constatamos que, embora o Poder Constituinte haja orientado para a edição de lei que facilite a conversão da união estável, entre o homem e a mulher, em casamento, o legislador ordinário ainda não cumpriu essa missão ou, ao menos, assim não o fez adequadamente, nem ao editar a Lei n. 9.278, de 10 de maio de 1996, muito menos o art. 1.726 do Código Civil de 2002. É certo que há proposições legislativas, a esse respeito, tramitando no Congresso Nacional. Essa situação, de lacuna no direito, gera problemas, que normas das Corregedorias-Gerais de Justiça dos Estados procuram suprir. Observamos que, desde a antiguidade, há preocupação no sentido de que os casais afeitos ao relacionamento informal venham a formalizar matrimônio. Ademais, conforme mostram os registros do IBGE Instituto Brasileiro de Geografia e Estatística, dos casais brasileiros, mais de 1/3 (um terço) não tem vínculo inscrito no Registro Civil e são os destinatários imediatos da norma constitucional em estudo. Consideramos a similaridade que pode haver entre a conversão da união estável em casamento e o reconhecimento de efeitos civis do matrimônio religioso. Nossa pesquisa abrangeu o direito comparado, que revelou previsões normativas semelhantes à brasileira, embora sem a peculiaridade de, em sede constitucional, estabelecer que a lei deva facilitar a conversão da união estável em casamento. Apontamos algumas das possíveis razões, jurídicas e práticas, para se pensar no direito à conversão da união estável em casamento; as indispensáveis exigências constitucionais e legais para tanto; o procedimento mais adequado para ser atendido o mandamento constitucional; além dos efeitos decorrentes do exercício desse direito

Busca-se no presente estudo tecer alguns comentários sobre tema muito controvertido: a possibilidade, ou não, de condenação à reparação de danos morais nas relações de família envolvendo idosos. Primeiramente, o objetivo será traçar notas sobre a evolução do direito de família e a importância da Constituição de 1988 nesse contexto. Também será dado destaque para os elementos da responsabilidade civil, a noção de dano moral e os direitos garantidos pelo Estatuto do Idoso. Apontado como paradigma para uma melhor análise do tema principal, será analisada a obrigação de reparar danos morais em razão de abandono afetivo de filho menor. O terceiro ponto, por sua vez, pretende trazer à baila a discussão acerca da responsabilidade civil nas relações com idosos no seio da família. Serão enfrentadas questões importantes, introduzidas por uma análise psicanalítica do processo de envelhecimento. Serão estudados qual o conceito de família e de idoso para os fins da responsabilidade civil, os seus elementos aplicados à hipótese, bem como a possibilidade de reparação pecuniária nestes casos. / In this paper we seek to make some comments on a very controversial topic: the possibility or not of condemnation for compensation for pain and suffering damage in family relationships involving the elderly. First, the goal is to plot notes on the evolution of family law and the importance of the 1988 Constitution in such context. The elements of liability, the notion of pain and suffering damages and the rights guaranteed by the Elderly Statute will be highlighted. Appointed as a paradigm for a better analysis of the main theme, we will analyze the obligation to repair damages due to emotional abandonment of minor child. The third point, in turn, intends to bring up the discussion of liability in dealings with elders in the family. Important issues will be faced, introduced by a psychoanalytic analysis of the aging process. The concept of family and elderly for the purposes of civil liability will be studied, as well as the elements applied in the event, and also the possibility of monetary compensation in such cases

Accounting Strategies for Small Business Law Firms' Sustainability

Small business family law firms generate jobs within the local community, but often fail because of suboptimal accounting strategies. A multiple case study was used to research the accounting strategies small business family law firm owners use to succeed in business beyond 5 years. The population for this study was three small business owners of family law firms located in West Chester, Pennsylvania. The small business family law firm owners had achieved and maintained profitability of their businesses for a minimum of 5 years. Financial literacy theory and the leadership skill model comprised the conceptual framework for this study. Data collection included semistructured face-to-face interviews with the small business family law firm owners, a review of company documents, and field notes. Thematic analysis included data from face-to-face interviews, document collection, field notes, and current literature. Themes that emerged were (a) having or obtaining some formal accounting education, (b) working with an accounting professional, (c) categorizing expenses and using formal financial reporting, (d) developing and maintaining ethical standards of billing and unearned income, and (e) utilizing accounting software. Recommendations for action included investing in accounting courses and seeking professional assistance. Small business family law firm owners may apply these results to spend more time working with clients to increase income. Increasing the success of small business family law firm owners may contribute to positive social change by providing increased employment and economic health within communities.

Smoothing the Way: Investigating the Enforcement of Parenting Orders

Family Law within Australia has undergone extensive legislative and operational changes since its inception. It is an area of law that impacts upon a number of stakeholders such as children, parents, law enforcement agencies, the Government and judicial officers. The research took a small facet of the operation of the Family Law Act 1975, namely the enforcement of parenting orders by police services. The focus of the research was to unfold the process and difficulties encountered by police services when executing a recovery order issued by the Courts under s. 67 of the Family Law Act 1975. It further explored police perspective, training and organisational service delivery, in carrying out their duties. Two qualitative methodological approaches were used in this research. The main approach used was Grounded Theory. Narrative Inquiry was also incorporated into the research. The objective of Narrative Inquiry is to create social context from story telling. Participants were asked to describe their experiences when executing recovery orders. Interviews were undertaken with members from the Victoria Police and the Australian Federal Police (AFP) who have had experience with the execution of recovery orders. These participants were also asked to construct the process when a recovery order is executed and to describe the atmosphere. In addition, journaling and observations were used. These observations took place in the Family Court and Federal Magistrates' Court in Victoria. The findings and relevant literature indicated that police disliked becoming involved in executing recovery orders. The Police perceived family law in general not to be a central area of policing. These findings parallel earlier findings from an Australian Parliamentary report in 1992. Furthermore, the findings indicated that little organisational commitment was placed on the function of enforcing recovery orders. This was indicated by the limited and inconsistent resources provided by the Australian Federal Police (AFP) to fulfil their obligations, and the lack of training offered to police members. The findings indicated that the Police would take initial steps prior to executing the order. They would contact the applicant parent to assist with inquiries to locate a child, assess variables such as the potential for violence and arrange with the applicant parent where the child would be delivered. In addition, even though the findings outlined that recovery orders were fairly non-complex to execute, at times there would be difficulties in locating a child and finalising arrangements for a child to be returned to a parent. The findings also indicated that there was no clear practice as to which section of the Victoria Police would execute a recovery order if requested by the AFP. Whilst the findings need to be considered carefully in light of the small sample group, it did indicate that there are some difficulties with the process and value placed by police services within Australia on the execution of recovery orders.

Women's Advancement in Francophone West Africa: A Comparison of Mali and Senegal

This research begins to explore what political tools are necessary to elevate women’s position in society by transforming legislation. Women in Francophone West Africa do not enjoy certain basic rights and there is need to improve their status. The promotion and appointment of women to the position of prime minister, Mame Madior Boyé in Senegal in 2001 and Mariam Kaidama Cissé Sidibé in Mali in 2011, gives us hope that women-friendly agendas will be given priority. I pose the question: Did the appointment of these two women to the heads of their respective governments improve the status of women and their political representation in West Africa? There is existing research that suggests that more women in government increases the visibility of women’s issues. I argue that simply having women in positions of power is not sufficient; participation in informal politics and civil society is imperative. These women have to go into the position with a commitment to women’s issues and a willingness to work with the already existent networks of women’s associations dedicated to furthering women’s rights. I study the successful passage of a new woman-friendly constitution in Senegal. In particular, I look at each participant’s role in making this happen, the associations who pushed for reforms for many years, the reformist president Wade, and Boyé who was a founding member of one of the central women’s associations, the Association of Senegalese Female Legal Practitioners. I compare this with the unsuccessful signing of new family code in Mali. I discuss the disinterest and indecisiveness of the president and Sidibé, as well as the influence of the strong opposition from the conservative High Islamic Council. There are also institutional barriers to change, namely the pluralist legal system of customary law, Islamic law, and state law. Finally, I discuss other possible reasons for the differences in these two countries’ results, such as Senegal’s longer history of democracy and general acceptance of modernity and women’s rights.

State-building, Systemic Shocks and Family Law in the Middle East and North Africa

Family law regulates the formation of marriage, divorce, marital property rights, child custody, inheritance, and spousal duties. This study aims to demonstrate how family law formation in the Middle East and North Africa reflects the struggle among social and political forces to capture the state and assert authority. The balance of power between competing social forces impacts both the timing (short-term versus long-term struggle) and type (progressive or regressive) of family law after independence. The ability of one of two competing forces, broadly categorized as traditionalist versus modernist, to capture the state is necessary for codification and is predictive of family law content. Case studies reveal that systemic shocks (e.g. revolution, social unrest, or foreign intervention) tip the balance of power in favor of traditional or modernizing forces in the post-independence state-building process and facilitate the successful consolidation of power and the codification of family law.

Syftet med studien var att undersöka hur familjerättsekreterarna upplever barns situation i samband med deras uppdrag med vårdnads-, boende- och umgängesärenden. Frågeställningarna var; Hur definierar familjerättssekreterarna sitt uppdrag vid vårdnads-, boende- och umgängesärenden vid föräldrars separation? Vilka instrument/verktyg använder familjerättssekreterarna för att ta reda på barns situation i samband med vårdnads-, boende- och umgängesärenden vid föräldrars separation? Hur upplever familjerättssekreterarna att barns fysiska och psykiska hälsa samt relation till föräldrarna påverkas i samband med föräldrarnas separation? Studien utfördes med en kvalitativ forskningsmetod där undersökningen innefattade åtta semistrukturerade intervjuer med familjerättssekreterare. I vår studie har vi utgått från systemteorin och gräsrotsbyråkratin. Detta för att familjerättssekreterarna har myndighetsutövning och att de vid utredningsärenden tittar på hur familjemedlemmarna samspelar med varandra. Resultatet tolkades utifrån den fenomenologiska ansatsen som visade att det fanns väsentliga skillnader i hur familjerättssekreterare tolkade vad som ingick i deras uppdrag. Familjerättssekreterarnas främsta instrument vid ärendehanteringar visade sig vara samtal. Ett annat viktigt resultat var att alla familjerättssekreterare ansåg att barns hälsa påverkades av sina föräldrars separation samt att deras relation till föräldrarna också påverkades både negativt och positivt, på kort och långt sikt. / The purpose of this study was to examine how family law secretaries experience the situations of the children in accordance with their assignments in the custody, residence and contact cases. These questions were asked: What instruments/tools are used to determine the children’s situation in the custody, residence and contact cases during the parental separation? How do family law secretaries define their role in custody, residence and contact cases at the parents’ separation? This study was conducted by using a qualitative research method which included eight semi-structured interviews with family law secretaries. As a basis for our study we have used the systems theory and street-level bureaucracy. This is because the family law secretaries have authority and in the case investigations they observe how the family members interact with each other. The results were interpreted by the phenomenological approach, which showed that there were significant differences in how family law secretaries interpreted what was included in their assignment. The family law secretaries’ foremost instrument during case handling was shown to be conversation. Another important result was that all family law secretaries felt that the childrens health was affected by their parents’ separation and that the childrens relationship to their parents was also affected, both negatively and positively in the short and long term.
