Canadian federalism has experienced pressure for change in recent years. By the end of the twentieth century, collaboration became the catch word and federations throughout the world, including Canada, witnessed an emergent movement toward collaborative governance, collaborative public service delivery, collaborative management and collaborative approaches to addressing social and economic issues. But even if the number of collaborative arrangements has grown since the 1990s, the understanding of the design, management and performance of collaborative arrangements in the Canadian federation remains weak. Accordingly, this dissertation argues that, in order to understand and open the black box of intergovernmental collaboration, it is necessary to put collaboration in a historical context and explore the roles of elites and political institutions in shaping intergovernmental collaborative practices. The role of the former provides the necessary complement of agency, while that of the latter represents a perspective that gives theoretical importance to political institutions. The integration of the two theoretical schools, elite theory and historical institutionalism, into one approach constitutes an attractive solution and offers the tools necessary to explore the complex processes of intergovernmental collaboration. The theoretical framework constructed in this dissertation is then applied to analyze whether the Agreement on Internal Trade, the Social Union Framework Agreement and the Council of the Federation can be considered in reality as examples of collaborative federalism.

This thesis explores the transparency in public procurement processes in Sweden. The purpose of the thesis is to evaluate the procurement process in the case of framework agreements on consultancy services and the focus is on exploring perceptions on the procurement process from both suppliers and procurers. The thesis contributes with findings to a research area that is not well studied, and where there is a need for more research. Previous research has focused on evaluating the regulations rather than the process. The results suggest that the specific procurement process studied is perceived to work well and being transparent. There might be information asymmetries present in the process which could potentially threaten the transparency. To further improve the procurement process both suppliers and procures would like to see more room for dialogue and less focus on following the regulations to the letter.

With the development of economic globalization, the threat of international financial crisis is rising. In order to address the challenge of financial crisis, the regional financial cooperation is becoming important mechanism for political elite in East Asia. Although Taiwan has important status of international economics and trade in East Asia and close economic and trade relations with China, but it is still difficult for Taiwan to join East Asia financial cooperation due to Cross-Strait political factor. This thesis analyses the political consensus of political elite in East Asia through the perspective of ¡§Neo-functionalism¡¨ on the impact of two stages of East Asia financial cooperation after international financial crisis in 1997 and 2008, and on the difficulty for Taiwan to take part in regional financial cooperation of ASEAN+3 with China¡¦s increasing political and economic influence in East Asia. Therefore this thesis analyses above issues for providing advices to Taiwan government regarding policymaking on participation in East Asia financial cooperation.

Prieš nagrinėjant tendencijas, vyraujančias Lietuvoje, pateikiamos išsamios ikisutartinės atsakomybės Vakarų valstybėse reguliavimo tradicijos bei tokios atsakomybės istorinė raida. Ikisutartinės atsakomybės instituto teisinio reguliavimo įvairovė - culpa in contrahendo doktrina nepripažįstama bendrosios teisės tradicijos šalyse – leidžia daryti išvadą, kad ikisutartinės civilinės atsakomybės taikymo ribos kontinentinėje teisėje yra platesnės. Tačiau iš esmės visose šalyse nesąžiningas šalių elgesys ikisutartiniuose santykiuose yra netoleruojamas ir atsakomybė už pareigos elgtis sąžiningai ir rūpestingai ikisutartiniuose santykiuose pažeidimą yra pripažįstama, tačiau grindžiama skirtingais pagrindais. Darbe taip pat aptariamas reikšmingas ikisutartinės atsakomybės vietos civilinės atsakomybės sistemoje klausimas. [toliau žr. visą tekstą] / The aim of this thesis is to discuss the question of pre-contractual liability, the problem of it‘s application and regulation sufficiency in Lithuanian legal system. Before dealing with this point the study presents detailed regulatory traditions of pre-contactual liability in western countries and it‘s historical development. The fact that doctrine culpa in contahendo is not recognized in common law systems leads to conclusion that application of pre-contactual liability is wider in continental system of law. On the other hand, almost all countries declare not tolerating unfair dealing in pre-contactual relations, but the legal liability in cases for breach of general obligation of good faith in pre-conractual negotiations is based on different grounds. The study also examines the problem of the determination of pre-contactual liability in general civil liability system. After the evaluation of the features and legal regulation of pre-contactual liability, the research leads to the conclution that this type of liability cannot be qualified as the third – sui generis – separate type of liability. The second chapter analyzes the principle of good faith which is essential in pre-contactual stage. SABO – the Swedish Association of Public Housing Companies – is the organization of the municipality owned public housing companies in Sweden. One of SABO’s main objectives is to increase the housing construction, which the Kombohus project is an example of. SABO’s Kombohus are multi-dwelling building agreements from which member companies can make contract calls to a set price. There is a demand among the members for a new Kombohus concept targeting smaller houses. The demand comes from smaller member companies outside cities. The demand from smaller member companies can be explained by a higher availability of ground and a lower demand of multi-dwelling buildings. The purpose of this report is to look into basic conditions for a new Kombohus, which will help SABO in a future procurement. Experiences and requests have been gathered through interviews with member companies and housing suppliers. Collected data have been compiled to create a target image of how a new Kombohus could be designed. SABO verkar bland annat för ett ökat bostadsbyggande, vilket Kombohusen är ett exempel på. Syftet med denna rapport är undersöka förutsättningar för ett nytt Kombohuskoncept, vilket ska mynna ut i ett underlag för SABO att ta med sig vidare i en kommande upphandling. La recherche est consacrée à l’analyse du régime juridique d’adhésion appliqué par l’UE dans le cas de la Macédoine. L’étude est divisée en deux volets – la stabilisation et l’association –, conformément aux objectifs de la politique du PSA de l’UE envers les États des Balkans occidentaux. En ce qui concerne la politique de stabilisation, sont abordées les modifications constitutionnelles et législatives provenant de l'accord-cadre d'Ohrid – l’élément central du cadre de la conditionnalité d’adhésion à l’UE posé à la Macédoine – ensuite, est recherchée l’application du principe de bon voisinage dans le cas de la Macédoine, notamment en ce qui concerne les divergences avec deux États voisins – le Grèce et la Bulgarie. Le volet association de la thèse est consacré à l’analyse du rapprochement du droit de la Macédoine de l’acquis communautaire en ce qui concerne le droit économique, ainsi que le droit non économique. La thèse vise à combler une lacune dans la littérature existante concernant les relations entre la Macédoine et l'Union européenne. / The research is dedicated to the analysis of the application of the legal regime regulating the enlargement of the European Union toward Macedonia. The work is divided in two parts – the stabilisation and the association –, in accordance to the objectives of the policy of SAP of the UE towards the states of the Western Balkans. The research of the policy of stabilization concerns the constitutional and legislative modifications introduced by the Ohrid Framework Agreement – the central element of the enlargement conditionnality framework imposed on Macedonia –, as well as the application, in the case of Macedonia, of the principle of good neighborliness, in particular the bilateral disputes with its two neighbors – Greece and Bulgaria. The part of the thesis dedicated to the policy of association analyses the rapprochement of the national law of Macedonia to the acquis communautaire in the fields of economic law, as well as the non-economic law. The thesis therefore fills a certain gap in the literature concerning the relations between Macedonia and the European Union.

Since the Cold War ended with the collapse of the Soviet Union, China has become a nation that rises to strong power. While the USA, Japan, the EU and Russia marvel at China¡¦s progress and improvement, its neighboring countries in Asia were worried. They question whether the rise of China will bring about peaceful co-operation between nations or it will lead to potential threats. But China in 2005 claimed to take the path of peaceful development in order to improve the image of China. At the time the formation of the European Union, for its member countries to enjoy the advantage over import and export trade with each other, Asia also started a new union of its own, the ASEAN. Although there were negative impacts on China with Tiananmen Square Incident and poisonous milk incident, the Beijing 2008 Olympics games and the World Expo 2010 Shanghai have helped to improve the China¡¦s image which has brought the attention of the ASEAN. China signed the free trade agreement with the ASEAN in 2010 resulted in ASEAN Plus One. In addition, zero tariff trade agreement starting has further improved the development of China¡¦s economy. The Taiwanese government has signed the ECFA with China in June 2010 which relates to the development of the nation in the next ten years to a large extent. However, will ECFA really prevent the marginalization of Taiwan in the global economy or will Taiwan become more marginalized? Will China exploit the economy of Taiwan due to ECFA? Or will it help the Taiwanese economy to reach its peak? In this thesis, the theory of international relations will be examined at the global, international, local and individual levels and the analysis on the future development of the ASEAN and the Cross-strait political and economic relations of China and Taiwan from the perspectives of improving the image of China and ECFA will be carried out. The prediction of the future development of relations among the ASEAN, Mainland China and Taiwan will also be included in this research. Finally, suggestions will be provided in the conclusion for the leaders to make any future decisions on the issues discussed. It is unquestionable that most ¡§peaceful co-operation¡¨ between Taiwan and Mainland China has ever existed is happening today in the past 62 years of Cross-strait co-operation history. As such, it is hoped that the developments of both Mainland China and Taiwan can be sustained and they can co-operate to explore the resources of South East Asia.

In the last years, we are witnessing an increasingly intense process of creating instruments on labor management in the transnational scope by the multinational companies, aimed at confronting from its autonomy to the very diverse needs generated by its integrated functioning at the global scale. Currently, the physiognomy of these instruments is not yet sufficiently defined; there are notable differences between one another, depending on the company that promotes them and function that assigns them. The present paper carries out a systematization of the criteria that have been presiding its construction, as well as the lines of evolution that are drawn through them. / En los últimos años asistimos a un proceso cada vez más intenso de creación de instrumentos de gestión laboral de ámbito transnacional por parte de las empresas multinacionales, dirigido a hacer frente desde su autonomía a las muy diversas necesidades generadas por su funcionamiento integrado a escala global. Actualmente la fisonomía de estos instrumentos no se encuentra todavía suficientemente definida, existiendo diferencias notables entre unos y otros, en función de la compañía que los impulsa y la función que esta se les asigna. El presente artículo lleva a cabo una sistematización de los criterios que vienen presidiendo su construcción, así como de las líneas de evolución que a través de ellos se dibujan.
