Convergence of Copyright and Trademark Protection Key Words: Copyright, Trademark, Protection, Convergence Abstract: The thesis analyzes the concept of copyright and trademark protection in Czech law and the consequences of their simultaneous operation. The aim is to determine whether the existing legislation responds the current trends and demands in our society, where business and arts are becoming interconnected and where the boundaries between those disciplines are blurred. Both protections are initially assigned to theoretical context of legal branches of intellectual property and intangible property. The author also deals with current conception of ownership in Civil Code. Following chapters are based on the principles of civil (continental) law concepts of copyright law and industrial property law established in this part. Subsequently the regulation of copyright protection and trademark protection is discussed in two separate chapters. Those chapters are divided into identical sub-chapters to highlight similarities and differences of both legal institutes. The focus is on subjects of both protections, their beneficiaries, formation, content, duration, means, limitations, international context and the issues of licensing. The first chapter of this thesis discusses the recent development of climate change law. It explores the reason as to why it is at the centre of a global debate, which is predominantly due the increasingly pronounced consequences of climatic changes on human society and the environment. Furthermore, it describes the most important requirements in tackling the issues presented by international climate change treaties. This includes the United Nations Framework Convention on Climate Change, acting as a base for the whole international climate change regime, the Kyoto Protocol as a legal tool with specified emission targets and most recently, the Paris Agreement, which serves as an independent international treaty however is still under the guidance of the framework convention. The author predicts that the Paris Agreement will determine the future direction of this legal field and therefore puts particular focus on this treaty in the first chapter of the thesis. The paper aims to uncover its weaknesses - questioning the enforceability of some of the measures that rely on the autonomy of states to implement and the lack of ambition in some of its targets. La loyauté occupe une place dans notre droit que l’on ne peut plus ignorer. Les références à la loyauté n’ont cessé de se multiplier. En droit de la propriété intellectuelle, ce sont d’autres mécanismes correcteurs tels que la fraude ou l’abus qui ont occupé jusqu’ici le devant de la scène. Or, la loyauté ne peut être réduite à l’absence d’abus ou de fraude. Elle est une notion autonome dotée de critères et de fonctions qui lui sont propres. L’ambition de cette étude est de démontrer que la loyauté, sous ses différentes formes, investit l’ensemble du droit de la propriété intellectuelle et est mobilisée pour répondre à des problématiques actuelles de la matière. Prenant sa source dans divers instruments juridiques, le devoir de loyauté se met au service du droit de la propriété intellectuelle. D’une part, le devoir de loyauté renforce la protection des titulaires. Il complète le monopole d’exploitation, conditionne ses limites et impose un devoir de coopération aux cocontractants ou aux plateformes Internet. D’autre part, le devoir de loyauté encadre le droit de propriété intellectuelle. Il module l’exercice du droit de propriété intellectuelle afin que celui-ci se déploie dans de justes limites et tienne compte des intérêts des contractants, des concurrents, voire de présumés contrefacteurs. Par l’application d’un droit de propriété intellectuelle efficace, raisonnable et équilibré, le devoir de loyauté contribue à la légitimité de ce droit. References to loyalty have continuously increased in all areas of the law. In intellectual property law, other corrective mechanisms such as fraud or abuse have taken centre-stage so far. But loyalty cannot be reduced to the absence of abuse or fraud. It is an autonomous concept with its own criteria and functions. The aim of this study is thus to demonstrate that loyalty, in its different forms, surrounds the entirety of intellectual property law and is used to resolve current issues in this subject. Stemming from various legal instruments, the duty of loyalty serves intellectual property law. On one hand, the duty of loyalty strengthens the protection of right-holders. It complements the monopoly of exploitation, conditions its limitations and imposes a duty of cooperation on some contract partners or on internet platforms. On the other hand, the duty of loyalty frames intellectual property rights. It regulates the exercising of intellectual property rights so that it unfolds within fair boundaries and takes account of the interests of contractors, competitors, and even alleged infringers. By applying intellectual property law in an effective, reasonable and balanced manner, the duty of loyalty contributes to the legitimacy of this law. La propriété intellectuelle est suffisamment polymorphe pour s’appliquer tant aux personnes privées qu’aux personnes publiques. Il n’est pas question de nier la spécificité de la personne publique, qui en raison de son identité et de la nature des missions qui lui sont confiées dispose de prérogatives particulières, et est soumise à des règles spécifiques. L’objet de notre étude est de démontrer que la propriété intellectuelle soumet les personnes publiques et privées à un régime juridique commun, qui est aménagé pour répondre aux exigences propres aux personnes publiques. Ainsi, ces dernières disposent de prérogatives élargies par rapport aux personnes privées, notamment dans le cadre de l’acquisition et de l’exploitation de leurs créations intellectuelles. Cependant, les personnes publiques sont également soumises à des obligations renforcées, qui résultent des obligations plus générales qui pèsent sur elles, telles que, notamment, la protection du domaine public. En outre, l’apparition de nouvelles politiques publiques telles que l’open data doit être appréhendée par les personnes publiques pour s’adapter aux nouveaux enjeux de la propriété intellectuelle publique. / Intellectual Property (IP) is enough polymorphic to be applied to both private individuals and publicentities (understood as the State, administrative districts having legal personality, and public institutions). This is not about denying the specificity of public entities, who are entrusted with particular prerogatives, and subjected to specific rules because of their identity and the nature of their missions. The purpose of our study is to demonstrate that IP submits both public entities and private individuals to a common legal system, which is set to meet the requirements inherent to public entities. Thus, public entities have expanded powers over private individuals, through acquisition and exploitation of their intellectual assets. This is the expression, in IP, of the specific prerogatives thatpublic entities enjoy as part of their missions. However, public entities are also subjected to strengthened bonds, which are the result of general obligations placed upon them, such as the protection of public assets. Finally, the emergence of new dynamics related to IP such as open data represents a major evolution of this science that public entities must understand to adapt to new challenges of public IP.

Komparácia právnych úprav peňažitých nárokov z porušenia práv k duševnému vlastníctvu / The comparison of legal provisions setting down monetary remedies in intellectual property infringement casesSedláček, Václav January 2008 (has links)
The thesis deals with monetary remedies in intellectual property infringement suits, focusing on industrial property rights. On the background of enacting of the czech Act number 221/2006 Sb. which implements the directive 2004/48/EC of the European parliament and of the Council, the thesis compares these two texts with each other and also with the proposal for the directive KOM(2003) 46 final in their relevant parts. By doing this, it evaluates the directive and the czech act as the directive's implementation. This evaluation represents the secondary aims of the thesis. Comparison, analysis of factual articles and interviews with relevant experts practicising in the area show that by setting the damages as double the "customary" royalties, the czech Act in his § 5 ods. 2 represents a sanction, which confirms the hypothesis of the prevailance of an analogy between the czech provison and the punitive damages in american law. This fact creates scope for the hypothesis of existance of further analogies, the verification of which is the central aim of the thesis. Therefore, the second part of the thesis analyzes american provisions of the United States Code concerning copyright, trademark and patent law, and related caselaw. This is compared both to the directive and the proposal for it, moreover to the czech copyright Act number 121/2000 Sb. and in particular to the czech Act number 221/2006 Sb. The third part supplements the analysis of relevant czech court decisions. The second and third part identify similar and distinct elements of the provisions and reveal analogies in seemingly different institutes. Differences are spotted in the construct used to achieve the punitive function, furthermore between the terms "customary royalty" and "reasonable royalty" and also between the terms "bezdôvodné obohatenie", "infringer's profits" and "unjust enrichment". Conversely, an analogy is identified between the discretionary power of american courts to increase proven damages or determine statutory damages and the czech institute of "primerané zadosťučinenie" (appropriate satisfaction). The prevailance of prohibition of double recovery is another existing analogy between the american and czech law.

Different ways how to protect our rights in this area are also covered in this section. The second part describes the current situation in China and compares it with some developed countries. The third part at the beginning try to find the connections between IPR system and economic growth. Then it describes the process of the implications of IPR system on the Growth of Chinese Economy and in conclusion explains the strategic importance of Intellectual Property Rights system in chinese economic growth.

The diploma thesis investigates issues of releasing a product on the market. It deals with its general safety and indicates its position in the area of intellectual property law. The main goal of the thesis is to offer a complex review of a means and ways of various products protection while they are being released on a consumer market by individual entrepreneuers with respect to different legal systems. One of the minor goal will discover the difficulty of product release on the market and will define in terms of legislation what each step includes and means for companies. The reader should understand the complexity of international law in the area of intellectual property law. The first chapter follows the prologue part and provide more information about the importance of product legal protection. The second chapter will enlighten complexity and difficulty of the term intellectual property itself. The third chapter is devoted to an analysis of international legal norms with respect to general legislation - international binding contracts and agreements. The fourth chapter is focused at term of trademark. The czech and european legislation will be compared. The fifth chapter describes computer legal protection and license contract. Again we will look into this issue from perspective of czech and european legislation. The sixth chapter will show the proper way of legal protection of actual american products.

The theme of this diploma thesis is Knowledge Management that is becoming the focus of business companies. The theoretical part of the work is divided into several chapters that discuss the basic principles of Knowledge Management. The aim of this work is to describe the principle of knowledge management and create a basic draft of the knowledge base for the KPMG company. In the introductory part of the work, terms commonly used in knowledge management are explained. Further, the knowledge capital of the company, types of knowledge management and the related knowledge strategies are described. Second half of the theoretical part concerns the responsibilities, tasks and roles in knowledge management. The last chapters of the theoretical part describe the individual phases of knowledge management introduction in a company. The practical part of this thesis is focused at analysis of KPMG company knowledge management and design of a knowledge base that can substantially reduce the time necessary for completion of certain deliverables. The chapter concerns mainly with description of the system architecture of the knowledge base, that the author has designed for the KPMG company.

The main objective is to evaluate the current situation in the various types of piracy, focusing on product piracy especially in the forms of counterfeiting and product imitation. The work consists of a theoretical and a practical part. The first chapter of this part concentrates on the general overview of brand policy. The important role and the value of the brands very much influence the purchasing behavior of consumers and support the presence of non-original products. The second theoretical part is further dedicated to the different types of piracy and legal protection of brands falling under the scope of intellectual property rights. To achieve a more comprehensive view, the practical part considers attitude, shopping behavior and opinions of Czech consumers on this issue.

This dissertation theses addresses the phenomenon of the unregistered mark for goods and services in accordance with trade mark law of the Czech Republic, while taking into consideration the given scope of EU law and its comparison with the legal protection of applied trade marks in the framework of the "passing-off" doctrine of the legal systems of the United Kingdom of Great Britain and Northern Ireland. While the subject of trade marks has already been thoroughly established in juristic theory and has also become commonplace in legal practice, the institute of the unregistered trade mark has not yet to be comprehensively examined, and as such it presents significant difficulties in applied practice, as it bears no solid legal foundation, and in the context of the regulations of trade mark law it is always possible to identify specific special entitlements arising from the existence or application of unregistered trade marks, whereas the nature of their verbal formulations and systematic classification presents difficulties in the interpretation and application of such entitlements. The basis for this reasoning is namely the historical evolution of the phenomenon of the unregistered mark in trade mark law in Austrian, respectively in subsequent Cisleithania, and its reception and evolvement within Czechoslovak law as the legal predecessor to the Czech Republic. The goal of the research presented herein is to identify answers to the underlying theoretical questions concerning unregistered marks of fundamental significance to applied practice, and in so far as they concern the nature of the unregistered mark as perceived by trade mark law and its definitional attributes, terms of origin, duration, and expiration of unregistered marks, or more precisely as they concern rights to them, as well as the terms and scope of disposition with unregistered marks, namely in so far as they in turn relate to transfer or conversion and the grant of license or other temporary right of use. Subsequently, the establishment of answers to the aforementioned questions addresses the problem of the absence of an explicit legal principle to the phenomenon of the unregistered mark and the interpretation difficulties offered in the poorly formulated laws and subsequent fluctuations in legal practice. This problem is examined within the legal setting of the Czech Republic as a democratic nation with a market economy, in which holds true the classic legal rudiment of "that which is not prohibited by law is permitted", and in which hold true the fundamental and indefeasible rights of man, a component of which is the right to freely pursue economic activities and possess property within a framework of restrictions favouring the preservation of the rights of others as set forth by the law.
