The South African copyright law does not define plagiarism, only copyright infringement. The issue of plagiarism is a complex one, due to the conflicting views within professional, intellectual, social, moral and legal contexts. The advent of the Internet era saw the eradication of the boundaries guarding copyright ownership. Also, the Internet offers infinite access to information which makes it tempting for any journalist to “borrow” quotes, facts, stories and articles freely and under the auspices of a post-modernist approach to knowledge and copyright ownership. Most media companies have ethical codes which cover plagiarism, but there is no working document that can empower media managers and journalists to combat the problem effectively. This document should define the boundary between negligence and plagiarism and offer suggestions on how to approach cases of plagiarism. This study investigates different theories on plagiarism, specifically with regard to the cases of Darrel Bristow-Bovey, Cynthia Vongai and Willem Pretorius. It will also study the ethical codes of media companies and will try to formulate a document which can address the problem of plagiarism. / AFRIKAANSE OPSOMMING: Talle voorvalle van plagiaat in die Suid-Afrikaanse drukmedia het sedert 2003 plaasgevind. Die Suid-Afrikaanse wet omskryf nie plagiaat nie, slegs outeursregskending en met die talle teenstrydige opvattings oor plagiaat binne professionele, intellektuele, sosiale, morele en regskringe, word plagiaat moeilik gedefinieer. Met die toeganklikheid van inligting danksy die koms van onder meer die Internet, het die grense van eienaarskap van geskrewe werke begin vervaag. Veral die Internet bied ’n magdom inligting aan. Dit word al hoe makliker vir joernaliste om met gemak aanhalings, feite, stories en artikels te “leen” sonder die nodige erkenning. Die meeste media-instellings beskik oor etiese kodes wat plagiaat dek, maar daar is nie werksdokumente wat bestuurders en joernaliste kan bemagtig om plagiaat te bekamp nie. Die werksdokument of handleiding behoort die grense tussen nalatigheid en plagiaat te definieer, en om voorstelle te bied oor hoe gevalle van plagiaat hanteer kan word nie. Hierdie studie ondersoek verskillende teorieë oor plagiaat, bespreek die plagiaatgevalle van Darrel Bristow-Bovey, Cynthia Vongai en Willem Pretorius, bestudeer die etiese kodes van media-instellings en poog om ’n werksdokument saam te stel wat plagiaat kan bekamp.

Firstly, it is a paradoxical scientific activity since the modern scientific discovery in ethnopharmacology is produced by a non-scientific knowledge. This controversial research strategy intends to produce a socially legitimized knowledge through a process of epistemic standardization. Secondly, although the use of traditional knowledge is a typical activity, to access it and to use it requires the signature of a contract for the equitable sharing of benefits as well as the signature of a term of prior consent access. These two juridical requirements are at the same time a new ethical parameter in scientific research and a barrier to the autonomy of the scientific field. Therefore, through the politic action scientists and researches seeks new social strategies to recovery the autonomy of the scientific field in ethnopharmacology and ethnobiology areas. Thus, this sociological research analyzes the internal conflicts between scientists in the scientific field through the examination of the social controversies in the use of two distinct research models, the vertical and the horizontal research models, as well as the examination of the external social disputes of the scientific activity, specially the politic action of scientists concerning to the autonomy question. In this research, the question of access, use and equitable sharing of benefits in R&D processes emerges as an interesting strategy used by scientists to legitimate the appropriation of the traditional knowledge. As non-knowledge, the traditional knowledge is transformed by the modern commercial science in generic information without significance. At the same time, this traditional generic information would be liable to be manipulated and appropriated by pharmaceutical multinationals trough the application of intellectual property rights. Finally, the appropriation of the traditional communities claim intends to legitimate socially the controversial scientific activity of ethnopharmacologists, ethnobiologists and pharmaceutical industries. / A pesquisa e desenvolvimento (P&D) nas áreas de etnofarmacologia e etnobiologia, guiada por informações terapêuticas levantadas junto as comunidades locais e indígenas, detentoras do conhecimento tradicional, acarreta uma série de disputas e conflitos sociais. Em primeiro lugar, trata-se de uma atividade científica paradoxal, pois a descoberta científica moderna é produzida a partir de um conhecimento nãocientífico. Esta controversa atividade de pesquisa busca um conhecimento socialmente legitimado através de um processo de padronização epistêmica. Em segundo lugar, embora o emprego de conhecimento tradicional seja uma atividade usual, acessá-lo e utilizá-lo requerem a assinatura de um contrato para a divisão justa e eqüitativa de benefícios e do termo de consentimento livre e esclarecido. Estes dois pré-requisitos jurídicos são, ao mesmo tempo, um novo parâmetro ético na pesquisa científica e uma barreira para a autonomia do campo científico. Neste universo, através da ação política, cientistas e pesquisadores buscam novas estratégias para recuperar a autonomia perdida do campo científico nas áreas de etnofarmacologia e etnobiologia. Assim, esta pesquisa sociológica analisa os conflitos internos entre cientistas no interior do campo científico através do exame das controvérsias sociais no uso de dois modelos distintos de pesquisa, o modelo vertical e o modelo horizontal de pesquisa, bem como examina as disputas sociais externas à atividade científica, especialmente a ação política de cientistas sobre a questão da autonomia. Nesta pesquisa, a questão do acesso, do uso e da repartição justa e eqüitativa de benefícios nos processos de P&D emerge como uma interessante estratégia utilizada por cientistas para legitimar a apropriação do conhecimento tradicional. Como um não-conhecimento, o conhecimento tradicional é transformado pela moderna ciência comercial em uma informação genérica sem significado. Ao mesmo tempo, esta informação tradicional genérica seria passível de ser manipulada e apropriada por multinacionais farmacêuticas através da aplicação de direitos de propriedade intelectual. Finalmente, a apropriação das reivindicações de comunidades tradicionais objetiva legitimar socialmente a controversa atividade científica de etnofarmacólogos, etnobiólogos e indústrias farmacêuticas.

These studies can be performed by one or more instruments of research. They include books, magazines, patents, statistical and economic data and other documents. Nowadays there are few technological prospecting studies realized through patent documents, particularly those focused on innovation for the environment. The concern with environmental questions is receiving great visibility in the political, economic and industrial sectors. The society is national and international interest, since the environmental impact often pervades the place of origin the authors, members of society and businesses. In order to contribute to the current green setting, the aim of this study was to conduct technological prospecting in green patent documents. Metric studies of information were used, especially patentometric to analyze information related to green technology patent. This was done through technological prospecting by outlining a national picture of green innovation. The analysis of patentometric research of green patents outlines a possible perspective of technology trends, the region and the authors who conduct research. This allowed us to identify those who develop green research in Brazil. The tendency of these researches under development in green innovation is focused on exploitation of natural resources, such as solar energy, wind energy, biofuels, agriculture and waste management. It‟s based on the inventory listing WIPO technologies that are considered green. It was found that the growth of the area with the highest number of patents is directly related to expenditures and investments made by the government and/or companies in each sector. As identified by region was observed that the greater investment in education and scientific and technological infrastructure, greater development results of searches for cities and/or regions. There was no novelty for the individual inventor author category, because they are the ones who hold patents applications. The author company was identified some international companies; the university author, which in turn, is well represented. The trend is that with the success of these green research can to arise other research in many areas and technological landscape. Thus it‟s expected that work can contribute to patentometric studies and the state of the art of information science in industrial property . / Estudos de prospecção constituem a ferramenta básica para a fundamentação nos processos de tomada de decisão em distintas áreas, setores e níveis da sociedade. Tais estudos podem ser realizados por um ou mais instrumentos de pesquisas, entre eles, livros, revistas, dados estatísticos e econômicos, patentes e demais documentos. Atualmente são poucos os estudos de prospecção tecnológica, realizados através de documentos de patentes, em especial as voltadas à inovação em prol do meio ambiente. A preocupação com as questões ambientais recebe bastante visibilidade nos setores político, econômico, industrial e é de interesse nacional e internacional, pois o impacto ambiental geralmente perpassa o local de origem de autores, membros da sociedade e empresas. Com o intuito de contribuir com o cenário atual este trabalho objetiva realizar prospecção tecnológica em documentos de patentes verdes, utilizando estudos métricos da informação, em especial a patentometria para através dos procedimentos de prospecção tecnológica esboçar um panorama nacional de inovação verde. A análise das pesquisas sobre as patentes verdes possibilita traçar uma perspectiva das tendências tecnológicas, das regiões e dos autores que mais realizam pesquisas, inclusive permitindo identificar quem desenvolve pesquisas verdes no Brasil. A tendência das pesquisas em desenvolvimento em inovação verde volta-se ao aproveitamento dos recursos naturais, como: energia solar; energia eólica; biocombustíveis; agricultura e gerenciamento dos resíduos, de acordo com a listagem do inventário da OMPI de tecnologias que são consideradas verdes. Constatou-se que o crescimento da área com maior quantidade de patentes está diretamente relacionado aos gastos e investimentos realizados pelo governo e/ou empresas, em cada setor. Quanto a identificação por região observa-se que quanto maior o investimento em educação e infraestrutura científica e tecnológica, maior os resultados de desenvolvimento de pesquisas por cidades e/ou regiões. Não houve novidade quanto autor/inventor individual, categoria que mais realiza depósitos de patentes. Quanto ao autor/empresa identificaram-se algumas empresas internacionais por sua vez o autor/universidade está bem representado. A tendência é que com o sucesso dessas pesquisas verdes possam surgir outras em diversos âmbitos e panoramas tecnológicos. Por outro lado, espera-se que o trabalho contribua para ampliação dos estudos patentométricos e para o estado da arte da Ciência da Informação em propriedade industrial. Spurious Victorians : imitation and the nineteenth-century novel

In 'A Critique of Modern Textual Criticism', Jerome J. McGann writes, '[A]n author's work possesses autonomy only when it remains an unheard melody'. For the published and successful writer in the nineteenth century, such autonomy was often unattainable. Publications such as The Pickwick Papers inspired an array of opportunistic successors, including stage plays, unauthorized sequels, jest books, song books, and shilling and penny imitations. Despite the proliferation, this strain of writing is rarely studied. This thesis recovers ephemeral, scurrilous texts, often anonymous or pseudonymous, and reads them in the context of their canonical sources. Retrieving bibliographical environments, it demonstrates how plagiaristic, parodic, and willfully unoriginal works impacted on the careers of three novelists: Charles Dickens, Edward Bulwer Lytton, and George Eliot. The thesis argues that formal distinctions among modes of Victorian writing - criticism, parody, and plagiarism - often blur. Further, it argues that our understanding of a particular novelist's work must be broadened to include sequels, spinoffs, and imitations: to know a particular author means to know the spurious and oftentimes bad (morally or aesthetically) works that the author inspired. The Spurious Victorians of the title form something of countercanon to the 'major' writers of the period. Thomas Peckett Prest, Rosina Bulwer Lytton, and Joseph Liggins, among many others, informed and influenced the literary history that has in turn denied them admission. William Makepeace Thackeray wrote, 'If only men of genius were to write, Lord help us! how many books would there be?' Of course, Victorian print culture found room for the genius and the subgenius, Boz as well as Bos. 'Spurious Victorians' recovers works that have been lost from view in order to better understand the process by which an individual authorial voice emerged amid an echo chamber of competing, imitative voices.

Dans le Cloud, peu de travaux traitent de l’analyse de l’usage réel et dynamique des logiciels consommés afin de déterminer les coûts réels engendrés et le respect des droits acquis auprès des fournisseurs de ces ressources. L’émergence de la pratique du Software Asset Management (SAM) traduit pourtant la préoccupation grandissante des industriels et des ‘Telcos’ (Entreprises de télécommunications) face à la complexité des modèles de licences dans des environnements virtualisés qui bouleversent nos usages de logiciel.La réponse des éditeurs de logiciel est souvent une incitation à ne plus suivre la consommation de licences, par le biais de contrats onéreux de consommation illimitée, rendant impossible une politique de maîtrise des coûts. Pour les utilisateurs finaux comme pour les fournisseurs de services cloud, il devient impératif de maîtriser et d’optimiser le déploiement des licences dans le Cloud.L’objectif devient celui de maitriser les besoins logiciels, au plus proche du temps réel, puis de générer des scénarii d’optimisation basés sur l’évolution de la consommation en modélisant les coûts réels afférents. Cela représente un levier de gains considérables pour tous les acteurs du cycle de vie du logiciel.Le contexte d’étude couvre l’ensemble du scope du Cloud (applications, plateformes, infrastructures et réseaux). Les travaux présentés ici s’attache à reconstituer tout le cycle de vie du logiciel, de l’achat jusqu’à la désinstallation, en intégrant les contraintes liées à sa nature ou à son usage. Nous proposons de résoudre le verrou majeur de l’identification du logiciel et de ses droits d’usage par la création et le suivi d’un tag.Nous proposons également une modélisation innovante s’appuyant sur une base de données graphe qui permet d’intégrer l’instantanéité des changements de configuration, de prendre en compte les différentes responsabilités impliquées par les niveaux de services offerts, tout en offrant la souplesse nécessaire pour supporter à la fois des modèles de licence classiques, ou à l’usage.Deux cas d’usages seront envisagés pour juger de la pertinence des modèles proposés : la gestion des licences dans un contexte de Plateforme as a Service (PaaS) et dans un cas de virtualisation de réseau (NFV). / Bout Cloud, only few works deals with dynamic and real usage analyse of deployed software in order to determine the true related costs, and licensing compliance with acquired rights from the software editors.However, the emergence of Software Asset Management (SAM) shows the growing concerns of the industry and carriers facing the licensing model complexity especially in virtualized environments where the software usage is disrupted.Editor’s answer consists in proposing to stop following this consumption via very expensive illimited-usage contracts. For final users like for cloud service providers, it is crucial to manage and optimize license deployment in cloud environments.The aim is first to control Software need, as close as possible to real time, then to generate optimization scenario based on consumption evolution by cost modelization.It represents a valuable saving leverage and may let spring up new licensing model, more profitable for each software lifecycle’s stakeholders.Usage context covers all scope of Cloud (application, infrastructure and network). Our works propose to rebuild the Software life-cycle, from procurement to deinstallation, encompassing the constraints of it nature and usages. We propose to solve software identification issue by creation and monitoring of tags.Additionally, we propose an innovative modeling based on a graph database which allows instant integration of configuration changes, to take into account the different level of responsibility induced by the different level of granted services. It offers enough flexibility to handle classical licensing models as use-based model which are often more attractive for cloud-users.Two use-cases will be developed to evaluate our models ‘efficiency : the software licensing management in PaaS (Plateform as a Service) context and in NFV environments (Network Function Virtualization).

Systems within systems : free and open source software licences under German and United States law

Free and Open Source Software (FOSS) licences channel the exclusionary and individualising force of copyright to establish a qualitatively different, somewhat subversive, system for the exploitation of software. This thesis examines how it is that FOSS licences establish this 'system within a system' under both German and United States law. The inquiry begins with a detailed examination of FOSS licence templates as the instruments which transform code from its default position as the 'res' of proprietary relations to its status as 'open' or 'free'. The thesis then considers whether FOSS licence templates, as the legal basis for this subversive move, are valid and enforceable under domestic law. In addressing this question, the thesis undertakes a critical analysis of the leading case law in each jurisdiction. Going beyond the immediate case law, the thesis considers the broader systemic effects of FOSS licence enforcement. It highlights how building a system within a system foments certain tensions and contradictions within the law, in turn giving rise to unintended consequences and legal uncertainty. By highlighting these tensions, the thesis argues that the questions of FOSS licence enforcement in Germany and the United States may not be as settled as some may think.

Critical analysis of the justification and economic fundamentals of the intellectual property rights system / Análisis crítico de la justificación y fundamentos económicos del sistema de derechos de propiedad intelectual

The author claims that, from a general perspective, the economic analysis of infonnation and its relation with law presents a strong inefficiency. The author develops a study ofthe economic incentives in general and the manner how prívate property is constituted as the principal but is not the only one of the economic incentives for the production of information and innovation. In strict sense, the author explores the ontology of property, showing that it does not allow the inclusion of immaterial and intangible goods since the modern fundamentals of such institution come form the appropriation and the homesteading rule, categories incompatible with the ontology of information. Into such argumentation, the author studies the economic incentive theories for information and innovation, initiating with the study of the characters of information and the fallacies that always had surrounded such good. The author concludes showing that intellectual property rights are not the product of an evolutionary process, but, on the contrary, they come from privileges conceded by the State, which its justification and fundament is invalid and equivocal due to the incompatibility of the property and the homesteading rule with the ontology of information. / El autor argumenta que, desde una perspectiva general, el análisis económico de la información y su relación con el derecho presenta una ineficiencia liminar. Para ello, desarrolla un estudio de los incentivos económicos en general y de la manera como la propiedad privada se constituye en el principal pero no el único de los incentivos económicos a la producción de información e innovación. En sentido estricto el autor hace una ontología de la propiedad, demostrando que ella no permite la inclusión de bienes inmateriales o intangibles en tanto que el fundamento moderno de tal institución proviene de la apropiación y la ocupación, categorías incompatibles con la naturaleza de la información. Dentro de tal argumentación, el autor se fundamenta en el espectro de los incentivos económicos para la producción de información e innovación, iniciando con un estudio de la naturaleza de la información y las falacias que siempre han rodeado a dicho bien. El autor concluye mostrando que los derechos de propiedad intelectual no son el producto de un proceso evolutivo de una institución como la propiedad, sino que, por el contrario, ellos proceden de privilegios concedidos por el Estado, cuya justificación y fundamento es inválido y equivoco debido a la incompatibilidad del ser de la propiedad y la ocupación con la ontología de la información

This article analyzes the missing rule and ruling about the protection of characters and fictional objects which are part of works covered by copyright. The author systematizes the criteria used in the administrative jurisprudence for conflicts between the intellectual property and the industrial property to extract specific rules in cases that involve fictional objects and characters, establishing and proposing criteria to find out the originality of these elements. / El presente artículo analiza la omisión normativa y jurisprudencial sobre la protección de los personajes y objetos de ficción que son parte de las obras protegidas por el régimen de derecho de autor. El autor sistematiza los criterios utilizados en los casos de jurisprudencia administrativa en conflictos existentes entre la propiedad intelectual y la propiedad industrial para extraer las reglas específicas existentes en casos que involucran objetos de ficción y personajes, estableciendo y proponiendo criterios para encontrar la originalidad de estos elementos.

Towards effective Multilateral protection of traditional knowledge within the global intellectual property framework

Magister Legum - LLM (Mercantile and Labour Law) / Traditional Knowledge (TK) has previously been considered a 'subject' in the public domain, unworthy of legal protection. However, the last few decades have witnessed increased discussions on the need to protect the knowledge of indigenous peoples for their economic sustenance, the conservation of biodiversity and modern scientific innovation. Questions remain as to how TK can best be protected through existing, adapted or sui generis legal frameworks. Based on an examination of the formal knowledge-protection mechanisms (i.e. the existing intellectual property system), this mini-thesis contends that these existing systems are inadequate for protecting TK. As a matter of fact, they serve as veritable platforms for incidences of biopiracy. It further argues that the many international initiatives designed to protect TK have so far failed owing to inherent shortcomings embedded in them. Furthermore, a comparative assessment of several national initiatives (in New Zealand, South Africa and Kenya) supports an understanding that several domestic efforts to protect TK have been rendered ineffective due to the insurmountable challenge of dealing with the international violations of local TK rights. It is therefore important that on-going international negotiations for the protection of TK, including the negotiations within the World Intellectual Property Organisation's Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC), do not adopt similar approaches to those employed in previous initiatives if TK must be efficiently and effectively protected. This mini-thesis concludes that indigenous peoples possess peculiar protection mechanisms for their TK within the ambit of their customary legal systems and that these indigenous mechanisms are the required anchors for effective global protections.
