L'accord de Cotonou et les contradictions du droit international : l'intégration des règles de l'Organisation mondiale du commerce et des droits humains dans la coopération ACP-CE

Ce travail poursuit deux objectifs principaux: un objectif juridique et un objectif d'ordre épistémologique. Il s'agit tout d'abord de rendre compte d'un point de vue juridique et empirique les implications du passage des Conventions de Lomé à l'Accord de Cotonou. Nous examinons les implications de la redéfinition des accords de coopération sur les politiques de développement des Etats ACP, et plus précisément l'évolution des obligations à la charge des deux groupes de pays dans les domaines du commerce international et des droits humains. Dans un premier temps, nous montrons que la non réciprocité des obligations commerciales entre les deux groupes de pays qui caractérisait les Conventions de Lomé est définitivement écartée au profit d'obligations réciproques et identiques pour les deux groupes de pays en conformité des dispositions de l'Organisation mondiale du commerce. Le principe de l'inégalité compensatrice est abandonné au profit de la libéralisation commerciale. Le traitement spécial et différencié, pourtant consacré dans l'Accord instituant l'OMC, apparaît ainsi dépourvu d'une grande partie de son intérêt. Dans un deuxième temps, ce sont les obligations relatives au respect des droits humains qui retiennent notre attention. L'élargissement du champ de la coopération à des questions considérées depuis l'indépendance comme des questions relevant de la compétence interne des Etats, se traduit par une remise en cause de la souveraineté des Etats ACP. Le principe de non-ingérence dans les affaires intérieures, héritage de la décolonisation, est ainsi remis en question. Mais surtout, nous établissons que tous les droits humains ne sont pas concernés par cet élargissement. Le deuxième objectif de ce travail est d'ordre épistémologique. Il VIse à démontrer le caractère heuristique d'une analyse constructiviste du droit pour la compréhension de notre objet mais aussi l'intérêt de ce type d'approche au regard des débats qui structurent le champ disciplinaire sur les rapports entre les droits humains et le droit du commerce international. A travers l'étude de l'Accord de Cotonou, nous tentons de mettre en lumière le fait que les droits humains et règles de l'OMC n'évoluent ni de manière complémentaire ni séparément et qu'il ne suffit pas de raisonner en termes de «rattrapage» et de correctifs ponctuels afin d'harmoniser ces deux champs de règles. En conclusion nous constatons que cinq ans ont suffi aux institutions européennes pour réaliser un véritable «exploit» politique. Elles ont réussi à renverser l'ensemble des obligations économiques qui étaient à la charge des deux groupes de pays, à supprimer les protocoles produits en faveur des ACP, à faire adopter un programme de libéralisation commercial qui va au-delà de tout ce qui a été négocié jusqu'ici au niveau multilatéral et ce, sous couvert de mise en conformité avec les dispositions de l'ÜMC. Enfin, l'DE a fragilisé le Groupe ACP en le morcelant en six régions, dont certaines n'ont aucune existence institutionnelle, avec lesquelles elle négocie actuellement un vaste programme de libéralisation commerciale. En ce qui a trait au respect des droits humains on constate qu'à la différence des normes de l'OMC qui font l'objet de négociations permanentes et structurent le cadre institutionnel et le fond de la coopération, le respect des droits humains ne fait pas ou peu l'objet de négociations entre les deux groupes de pays. De plus, s'ils occupent désormais une place centrale dans le discours des institutions communautaires en charge du développement, le seul mécanisme mis en oeuvre pour sanctionner leurs violations est utilisé d'une manière partiale et sélective. Seule l'DE peut l'utiliser et elle ne choisit de le faire que quand la sanction infligée à un pays ACP ne met pas en péril ses propres intérêts. Bref, l'intégration des droits humains dans le cadre de la coopération contribue davantage aujourd'hui à une remise en cause de l'égalité souveraine des Etats qu'à la promotion des Pactes de 1966, au respect des normes de l'OIT ou du droit des réfugiés. / This work pursues two aims. The first one is to seek to understand and to explain the stakes and the implications of the transformation of the Lomé convention into the Cotonou agreement, from a constructive approach of law. It is then a question of contributing to the legal thought concerning the degree of complimentary and coherence between the two fields of the internationallaw, human rights and international trade law. The second aim led us to look into the question of the real integration, which proved to be selective, of the standards coming from these two fields of law into the Cotonou Agreement. In the cooperation, the breach of human rights, as the OMC standards, is appreciated in a subjective and unilateral way by the E.U. Baigiamojo magistro darbo tema – „Perdirbimo muitinės procedūrų taikymo įtakos prekių eksportui ir importui analizė ir perspektyvos”. Tokia tema aktuali tarptautinės prekybos kontekste, kadangi minėtų procedūrų vykdymas leidžia ūkio subjektams naudotis pigesnėmis žaliavomis arba pigesne darbo jėga bei teikia kai kurių kitų privalumų ir tokiu būdu padidinamas prekių konkurencingumas pasaulinėje rinkoje. Perdirbimo procedūrų taikymas teigiamai įtakoja bendras valstybės eksporto apimtis, gerina darbo rinkos padėtį ir prisideda prie tarptautinės prekybos liberalizavimo. Darbe siekiama išanalizuoti perdirbimo muitinės procedūrų teisinį reglamentavimą (pradedant tarptautinėmis konvencijomis ir baigiant Lietuvos Respublikos teisės aktais) ir įvertinti kokią realią įtaką šių procedūrų vykdymas turi šalies eksporto ir importo apimtims. This topic is relevant in the context of international trade since the implementation of the aforementioned procedures allows for the economic agents to use cheaper materials or cheaper labor force as well as provides some other advantages and thus increases the competitiveness of goods in the global market. The application of processing procedures positively affects the total country’s export volume, improves the situation in labor market and contributes towards the liberalization of the international trade. The thesis aims to analyze the legal framework of processing under customs procedures (from international conventions to legal acts of the Republic of Lithuania) and evaluate real impact of these procedures on the country’s export and import volumes. Another objective of the work is to assess the changes of legal framework of processing under customs procedures and future development forecasts. <p>The Member States of the Southern African Customs Union (SACU) have set as their objectives, amongst others, the facilitation of cross-border movement of goods between the territories of the Member States and the promotion of the integration of Member States into the global economy through enhanced trade and investment. Different approaches to the recognition and enforcement of foreign judgments by Member States and the risk of non-enforcement may lead to legal uncertainty and increased transaction cost for prospective traders, which ultimately act as non-tariff barriers to trade in the region. Trade is critical to Southern Africa, and the ideal is that barriers to trade, of which uncertainty concerning the recognition and enforcement of foreign judgments among Member States is one, should be removed. Certainty, predictability, security of transactions, effective remedies and cost are important considerations in investment decision-making / and clear rules for allocating international jurisdiction and providing definite and expedited means of enforcing foreign judgments will facilitate intraregional as well as interregional trade. In addition to trade facilitation, a harmonised recognition and enforcement regime will consolidate economic and political integration in the SACU. An effective scheme for the mutual recognition and enforcement of civil judgments has been regarded as a feature of any economic integration initiative likely to achieve significant integration. While the harmonisation of the rules on the recognition and enforcement of foreign judgments has been given priority in other regional economic communities, in particularly the European Union, any similar effort to harmonise the rules on recognition and enforcement of Member States have been conspicuously absent in the SACU &ndash / a situation which needs to receive immediate attention. The thesis considers the approaches followed by the European Union with the Brussels Regime, the federal system of the United States of America under the &lsquo / full faith and credit clause&rsquo / the inter-state recognition scheme under the Australia and New Zealand Trans-Tasman judicial system / as well as the convention-approach of the Latin American States. It finds that the most suitable approach for the SACU is the negotiation and adoption by all SACU Member States of a multilateral convention on the recognition and enforcement of foreign judgments, comparable to the 1971 Convention of the Hague Conference on Private International Law / the EU Brussels I Regulation and the Latin-American Montevideo Convention, as complemented by the La Paz Convention. It is imperative that a proposed convention should not merely duplicate previous efforts, but should be drafted in the light of the legal, political and socio-economic characteristics of the SACU Member States. The current legislative provisions in force in SACU Member States are compared and analysed, and the comparison and analysis form the basis of a proposal for a future instrument on recognition and enforcement of foreign judgments for the region. A recommended draft text for a proposed Convention on the Recognition and Enforcement of Foreign Judgments for the SACU is included. This draft text could form the basis for future negotiations by SACU Member States.</p>

Political equality and global poverty: an alternative egalitarian approach to distributive justice

I apply the approach to some issues in global justice relating to global poverty and to the inability of some countries to develop as they would like. In this connection I discuss institutions of international trade, sovereign debt and global reserves and I focus particularly on the WTO, IMF and World Bank.

Zur Versorgung ausländischer Märkte bedienen sich Unternehmen unterschiedlicher Versorgungsformen. Die proximity-concentration trade-off-Literatur betrachtet die Wahl zwischen Export und Auslandsproduktion und erklärt die Entstehung von internationalem Handel und horizontalen ausländischen Direktinvestitionen. Das Standardmodell von Brainard (1993) integriert die Auslandsproduktion als alternative Versorgungsform zum Handel in ein allgemeines Gleichgewichtsmodell mit zwei Ländern, monopolistischer Konkurrenz, steigenden Skalenerträgen und Transportkosten. Im Gleichgewicht versorgen Unternehmen ausländische Märkte entweder durch Exporte oder eine Auslandsproduktion. Die real zu beobachtende Ko-Existenz von internationalem Handel und ausländischen Direktinvestitionen auf der Unternehmensebene kann mit diesem Modell nicht erklärt werden. Im Rahmen dieser Arbeit wird die Exportplattform (EP) als mögliche Antwort auf dieses Phänomen herangezogen. Eine Exportplattform ist eine Auslandsproduktion, durch die nicht nur der lokale Auslandsmarkt, sondern auch Drittländer versorgt werden. Im modelltheoretischen Teil dieser Arbeit wird ein partialanalytisches EP-Modell formuliert, dass auf Brainard (1993) aufbaut. Dabei wird ihr Modell um eine Mehr-Länder-Welt mit heterogener Verteilungsstruktur erweitert und die Versorgungsalternative der EP-Exporte nach dem Beispiel von Neary (2002) integriert. Durch die analytische Lösung des partiellen Gleichgewichts lässt sich die substitutive Beziehung zwischen Heimatexporten, Auslandsproduktion und EP-Exporten aufzeigen. Ferner kann die Wirkung der Versorgungskosten auf die Versorgungswahl analysiert werden. Dabei wird neben der analytischen Modellbeschreibung besonders auf die Gleichgewichtsbestimmung und die Existenz der Gleichgewichte eingegangen. Aufbauend auf den analytisch abzuleitenden Hypothesen wird das EP-Modell ferner einem empirischen Signifikanztest unterzogen. Unter Anwendung von nicht-linearen Regressionsverfahren wird die Wahl zwischen EP-Exporten und Auslandsproduktion, zwischen EP- und Heimatexporten sowie zwischen EP-Exporten und der EP-Produktion separat geschätzt. Hierfür wird auf Daten der Automobilindustrie zurückgegriffen, welche die regionalen PKW-Produktions- und -Absatzdaten sämtlicher Automobilhersteller in Osteuropa, Asien und Ozeanien umfassen. / The proximity-concentration trade-off literature explains the choice between international trade and foreign direct investments. In this book, the co-existence of international trade and foreign direct investments is explained by analyzing the choice of export platforms. First, a partial equilibrium model with monopolistic competition, increasing economies of scale, trade costs and fixed costs is developed and enhanced with a heterogeneous, spatial distribution of regions. The United Nation's Convention on Contracts for the International Sale of Goods : Why is it being excluded from International Sales Contracts?

The development of the United Nation’s Convention on Contracts for the International Sale of Goods (CISG) started at the beginning of the 20th century in order to provide a uniform legal regime for international sales contracts. The development started because of a belief that a uniform international sales convention would contribute certainty in commercial trade and decrease transaction costs for the contracting parties. The Convention was signed in Vienna 1980 and came into force in 1988 after securing the necessary number of ratifications. The CISG is automatically applied to international sale contracts in certain given situations but the contracting parties are free to exclude the Convention as applicable law in favour of another regulation. As of today, more than 25 years after the CISG came into force, the Convention is commonly being excluded as the governing law of international sales contracts. By studying surveys and academic writings, certain factors can be derived as reasons prior to an exclusion of the CISG. The factors can be referred to as unfamiliarity, time and costs, negotiation strength and standard form contracts or standard terms. Regarding unfamiliarity, the importance given to the Convention in law faculties within the signatory states, together with time and costs attributed to a familiarization process, seems to play an important role. Moreover, the Convention is associated with problems regarding a non-uniform interpretation of the Convention’s provisions within the national courts and arbitral tribunals, as well as regarding its incompleteness, meaning that there are gaps that need to be filled by national law. These problems affect the Convention’s ability to provide potential users with legal certainty and predictability, which in turn may affect the familiarity with the Convention and hence have an impact on an exclusion of the CISG.
