A ordem jurídica internacional e a sociedade da informação / Information society and the international legal order

O desenvolvimento da tecnologia da informação e das comunicações em todo o mundo propicia condições para que a comunidade internacional possa vir a se relacionar sem enfrentar os obstáculos oferecidos pelas barreiras geográficas ou temporais, bem como possa vir a atuar diretamente na defesa de seus interesses, acrescentando novas formas de disciplina do seu comportamento além dos tradicionais mecanismos normativos oferecidos pelo Estado. O direito fundamental de livre acesso à informação por intermédio da tecnologia digital deve ser garantido em igualdade de condições a todos os indivíduos, na qualidade de participantes da sociedade global, em obediência aos princípios e disposições contidos na Declaração Universal dos Direitos Humanos, bem como da Declaração do Direito do Desenvolvimento e sua atualização na Declaração do Milênio. Ocorre, que, os países em desenvolvimento não participam dos beneficios da evolução tecnológica e por não estarem conectados à rede mundial, estão alijados do processo e excluídos do acesso à informação transmitida por via digital. Os Estados, que originalmente foram considerados os únicos sujeitos de direito na ordem internacional, não se mostram mais aptos a gerir, com eficácia, os interesses da sociedade, tornando-se incapazes de oferecer as condições necessárias para o exercício pleno da cidadania. O presente estudo visa ampliar os limites da discussão acadêmica a respeito dos efeitos produzidos pelo avanço tecnológico e pela globalização transpondo o debate para a ordem jurídica internacional. O exame dos documentos produzidos pela Cúpula Mundial da Sociedade da Informação, organizada pela UIT, por intermédio da ONU, demonstra que os representantes dos países membros, juntamente com a iniciativa privada e a sociedade civil foram capazes de produzir Declarações de Princípios e Planos de Ação contendo regras de utilização da tecnologia da informação e das telecomunicações de forma a eliminar as desigualdades, e criando a possibilidade de que a humanidade possa, finalmente, vir exercer seu direito ao desenvolvimento. Ademais, criação do Fórum de Governança da Internet, como decorrência da Cúpula Mundial da Sociedade da Informação, evidencia que as regras para a utilização da rede mundial dos computadores permanecem sob a responsabilidade da comunidade internacional, restando, portanto, demonstrado que atuação da sociedade civil, através de mecanismos próprios para proteger seus interesses, repercute diretamente na esfera internacional e merece ser levada em consideração no estudo das fontes de Direito Internacional. / The development of information technology and communications all over the world created the ideal conditions for the international community to the improvement of relationship without any of the obstacles caused by geographical or chronological barriers, and turned possible to civil society to act directly in the defense of its own interests, adding new forms of ruling its behaviors besides the traditional legal mechanisms offered by the State. The free and direct access to information in digital format must be guaranteed in equal conditions as a fundamental right to all individuals, in their condition of members of global society, in accordance with the principles and provisions established by the Universal Human Rights Declaration, as well as of the Declaration of the Right to Development, dully amended by the Millennium Declaration. Nevertheless, the developing countries cannot benefit from technological revolution and since they cannot not connect to the Internet they are maintained apart from this process and therefore are prevented to exercise their right of access to information transmitted in digital format. On the other hand, the States that originally were considered the sole subjects of rights in the international order are not capable anymore to efficiently manage the interests of civil society and therefore cannot offer the necessary conditions to the plain exercise of citizenship. This paper intends to wide the limits of the academic discussion already in place analyzing the effects of the technological revolution and globalization enlarging the debate to the level of the international legal order. The exam of the documents produced by World Summit of Information Society, organized by ITU, dully authorized by UN, demonstrates that the representatives of the member States, jointly with the private sector and the civil society, were able to prepare the Declaration of Principles, Plan of Action and other related documents disciplining the use of information technology and communications in order to eliminate the differences and conduct the human beings to the plain exercise to of their right to development. Furthermore, the establishment of the Internet Governance Forum as a consequence of the World Summit of Information Society provides strong evidences that the rules for Internet access shall remain in the hands of Non Governmental Organizations and moreover demonstrates that the utilization by civil society of specific legal mechanisms in order to protect its own interests, may generate important consequences for the international legal order and therefore deserves to be examined as a phenomenon affecting the sources of International Law.

First, it presents issues for basic understanding of the issue in comment, basic concepts, general characteristics of the treaties, theories, monist and dualist, on the reception of treaties in domestic law and the way how it is operationalized. It follows the evolution of the topic in the field of hierarchy, with the aim of entering the reader on aspects peculiar to the rule of parity and the case law regarding positioning, addressing the normative species, starting immediately for the Exception to the Rule of Parity in tax, which addresses the criteria to be used in case of contradiction between the treaty and domestic law. Care was taken of the exemptions from state and local taxes granted by international treaties, and the concept of exemption and heteronomous positioning of jurisprudence on the matter, as well as the importance of agreements to avoid double taxation and tax evasion / O presente trabalho tem o escopo de delinear dentro do epítome do Direito Internacional, a Exceção à Regra de Paridade deferida ao Direito Tributário, pela existência do artigo 98, do Código Tributário Nacional e suas implicações. Apresenta, inicialmente, assuntos basilares para compreensão do tema em comento, conceitos básicos, características gerais dos tratados, as teorias - monista e dualista - sobre a recepção dos tratados no direito interno e a forma de como ela é operacionalizada. Segue-se pela evolução do tema no campo da hierarquia, com o fito de inserir o leitor nos aspectos peculiares à regra de paridade e o posicionamento jurisprudencial a respeito, abordando as espécies normativas, partindo-se imediatamente para a Exceção à Regra de Paridade no âmbito tributário, que aborda os critérios a serem utilizados no caso de antinomia entre tratado e lei interna. To this end, the contemporary concept of development is taken as a basis, since it is related to human and social criteria, and not simply to economic criteria. In this way, the standards aimed at improving the welfare of the population and individuals that is, aimed at the achievement of the human being in its fullness are understood from the perspective of the right to development. Considering such aspects, the general characteristics of international treaties will be addressed with focus on the peculiarities of the judicial procedures in the incorporation of international human rights treaties. It is concluded that treaties involving the right to development should be incorporated into domestic law with constitutional and hierarchical status and direct and immediate applicability. This thesis is supported on the basis of the humanistic economic theory and the internationalization of human rights, which recognizes the right to development as a universal right of full satisfaction of man / Esta pesquisa investiga os aspectos da incorporação dos tratados no plano interno, mais especificamente de normas convencionais internacionais que versem sobre o direito ao desenvolvimento, considerando que o mesmo possui natureza de direitos humanos e que, sob tal perspectiva, deve ser recepcionado diferentemente dos tratados internacionais comuns. Para tanto, toma-se como base o conceito contemporâneo de desenvolvimento, que o relaciona a critérios sociais e humanos, e não simplesmente a critérios econômicos. Assim, são compreendidas na perspectiva do direito ao desenvolvimento as normas que visem à melhoria e ao bem-estar da população e dos indivíduos ou seja, que visem à realização do ser humano em sua plenitude. Considerando tais aspectos, serão abordadas as características gerais dos tratados internacionais, tendo como escopo as peculiaridades da processualística de incorporação dos tratados internacionais de direitos humanos. Conclui-se que as tratativas que envolvam direito ao desenvolvimento devem ser incorporadas ao direito interno com status hierárquico constitucional e aplicabilidade direta e imediata. Defende-se esta tese com base na teoria econômica humanista e da internacionalização dos direitos humanos, em que se reconhece o direito ao desenvolvimento como direito universalista, de satisfação integral do homem

O presente trabalho busca analisar a evolução da discussão dogmática sobre a relação entre direito interno e direito internacional na jurisprudência do Supremo Tribunal Federal. A pesquisa dedica especial atenção a três casos específicos, julgados entre 2008 e 2010, que são representativos de uma nova fase no entendimento corte, em que o Supremo Tribunal Federal tratou de uma série de questões inéditas na sua jurisprudência. São eles a decisão, em 2008, sobre a prisão civil do depositário infiel, proibida pela Convenção Americana de Direitos Humanos; a ADPF no 101, de 2009, sobre a importação de pneus usados e remoldados, cuja regulamentação também foi objeto de decisões no âmbito do Mercosul e da OMC; e a ADPF no 153, de 2010, que discutiu a Lei da Anistia, também tratada na Corte Interamericana de Direitos Humanos. Mapeando as discussões dogmáticas nesses casos, busca-se identificar as implicações dos tratados internacionais e das decisões de tribunais internacionais para o ordenamento jurídico brasileiro, bem como as contradições e omissões de tais decisões. A análise do desenvolvimento da jurisprudência do Supremo Tribunal Federal considera as transformações ocorridas no direito internacional a partir do final da Segunda Guerra Mundial e as mudanças incorporadas às constituições brasileiras, e em especial a Constituição de 1988 e a sua Emenda no 45, de 2004. / This study seeks to analyze the evolution of the dogmatic debate on the relationship between domestic and international law in the Brazilian Supreme Courts case law. The research devotes special attention to three specific cases, decided between 2008 and 2010, which are representative of a new phase in the courts understanding, in which the Supreme Court has dealt with completely new issues. These cases are the following: the decision in 2008 on the civil imprisonment of an unfaithful trustee, prohibited by the American Convention on Human Rights; ADPF No. 101, from of 2009, on the import of used tires, which had also been the subject of decisions within Mercosur and WTO; and ADPF No 153, from 2010, which discussed the Brazilian Amnesty Act, also addressed by the Interamerican Court of Human Rights. By mapping dogmatic discussions of these cases, I seek to identify the implications of international treaties and decisions of international tribunals for the Brazilian legal system, as well as the contradictions and omissions of such decisions. The analysis of the development of the Supreme Courts case law considers the transformation occurring in international law since the end of World War II and the changes incorporated into the Brazilian constitutions, and in particular the Constitution of 1988 and its Amendment No 45 of 2004.

Canadian federalism and treaty powers: existential communities, functional regimes and the Canadian constitution

La Loi constitutionnelle de 1867 ne contient aucune disposition expresse concernant un quelconque pouvoir pour les gouvernements fédéral et provinciaux de conclure des traités internationaux - ce pouvoir étant réservé, à l'époque de l'adoption de la Loi constitutionnelle de 1867, au pouvoir impérial britannique. Aussi, une seule disposition prévoyait les modalités de mise en oeuvre des traités impériaux au sein de la fédération canadienne et cette disposition est aujourd'hui caduque. Puisque l'autonomie du Canada face à l'Empire britannique ne s'est pas accompagnée d'une refonte en profondeur du texte de la constitution canadienne, rien n'a été expressément prévu concernant le droit des traités au sein de la fédération canadienne. Le droit constitutionnel touchant les traités internationaux est donc Ie fruit de la tradition du «constitutionnalisme organique» canadien. Cette thèse examine donc ce type de constitutionnalisme à travers le cas particulier du droit constitutionnel canadien relatif aux traités internationaux. Elle examine ce sujet tout en approfondissant les conséquences juridiques du principe constitutionnel du fédéralisme reconnu par la Cour suprême du Canada dans le Renvoi relatif à la sécession du Québec, [1998] 2 R.C.S. 217. De manière plus spécifique, cette thèse analyse en détail l’affaire Canada (P.G.) c. Ontario (P. G.), [1937] A.C. 326 (arrêt des conventions de travail) ou le Conseil prive a conclu que si l'exécutif fédéral peut signer et ratifier des traités au nom de l'État canadien, la mise en oeuvre de ces traités devra se faire - lorsqu'une modification législative est nécessaire à cet effet - par le palier législatif compétent sur la matière visée par l'obligation internationale. Le Conseil Prive ne spécifia toutefois pas dans cet arrêt qui a compétence pour conclure des traités relatifs aux matières de compétence provinciale. Cette thèse s'attaque donc à cette question. Elle défend la position selon laquelle aucun principe ou règle de droit constitutionnel canadien ou de droit international n'exige que l'exécutif fédéral ait un pouvoir plénier et exclusif sur la conclusion des traités. Elle souligne de plus que de très importants motifs de politique publique fondes notamment sur les impératifs d'expertise, de fonctionnalité institutionnelle et de démocratie militent à l’encontre d'un tel pouvoir fédéral plénier et exclusif. L'agencement institutionnel des différentes communautés existentielles présentes au Canada exige une telle décentralisation. Cette thèse démontre de plus que les provinces canadiennes sont les seules à posséder un pouvoir constitutionnel de conclure des traités portant sur des domaines relevant de leurs champs de compétence - pouvoir dont elles peuvent cependant déléguer l'exercice au gouvernement fédéral. Enfin, cette thèse analyse de manière systématique et approfondie les arguments invoques au soutien d'un renversement des principes établis par l'arrêt des conventions de travail en ce qui concerne la mise en oeuvre législative des traités relatifs à des matières provinciales et elle démontre leur absence de fondement juridique. Elle démontre par ailleurs que, compte tenu de l'ensemble des règles et principes constitutionnels qui sous-tendent et complètent le sens de cette décision, renverser l’arrêt des conventions de travail aurait pour effet concret de transformer l'ensemble de la fédération canadienne en état quasi unitaire car le Parlement pourrait alors envahir de manière permanente et exclusive l'ensemble des champs de compétence provinciaux. Cette conséquence est assurément interdite par le principe du fédéralisme constitutionnellement enchâssé. / The Constitution Act, 1867 contains no express provision on federal or provincial treaty-making powers. These powers were reserved to the Imperial government at the time when the Constitution Act, 1867 was adopted by the Imperial Parliament. The Constitution Act, 1867 also contained only one provision that dealt with the implementation of Imperial treaty obligations in the Canadian federation and that provision is now obsolete. Because Canada's gradual autonomy from the British Empire was not accompanied by a thorough modification of the text of the Canadian constitution, nothing has been expressly provided in relation to treaty powers in the Canadian federation. Canadian constitutional law dealing with treaty powers is therefore a pure product of the Canadian "organic constitutionalism" tradition. This thesis examines this form of constitutionalism through the specific case of the treaty powers in Canada. In particular, this study hopes to deepen our understanding of the multiple legal consequences of the constitutionally entrenched principle of federalism recognized by the Supreme Court of Canada in the Reference re Secession of Quebec, [1998] 2 S.C.R. 217. More specifically, the thesis presents an in-depth analysis of Canada (A. G.) v. Ontario (A.G.), [1937] A.C. 326 (the Labour Conventions case) where the Privy Council decided that the federal executive power could sign and ratify treaties in the name of Canada but that the implementation of treaty obligations - when legislative action is required - is the responsibility of the legislature that has jurisdiction over the obligations' subject-matters. The Privy Council did not specify, however, which institution(s) has the power to conclude treaties in relation to provincial subject-matters. This thesis tackles this problem. It is demonstrated in this thesis that no rule or principle of Canadian constitutional law nor of international law grants plenary and exclusive treaty-making powers to the federal executive. It highlights some very important policy reasons based on the needs for expertise, for institutional effectiveness and for respect for democracy not to recognize such plenary and exclusive treaty-making powers to the federal executive. The institutional arrangements necessary for the survival and flourishing of the diverse existential communities require that the federal executive does not possess such powers. It is moreover demonstrated that only provinces possess the constitutional powers to conclude treaties related to their subject-matters - the exercise of which powers may however be delegated to the federal government. Finally, the thesis presents a systematic and in-depth analysis of the arguments invoked in favour of reversing the rules set out in the Labour Conventions case in relation to legislative implementation of treaty obligations related to provincial subject-matters. It demonstrates that those arguments have no legal basis. Moreover, the thesis shows that because of the many underlying and interconnected constitutional rules and principles that support and give meaning to the Labour Conventions case, reversing that decision would have the concrete effect of transforming the Canadian federation into a quasi-unitary state because Parliament would thus be allowed to oust provinces from the entirety of their legislative jurisdiction. This consequence is most certainly prohibited by the federal principle entrenched in the Constitution.

By mapping dogmatic discussions of these cases, I seek to identify the implications of international treaties and decisions of international tribunals for the Brazilian legal system, as well as the contradictions and omissions of such decisions. The analysis of the development of the Supreme Courts case law considers the transformation occurring in international law since the end of World War II and the changes incorporated into the Brazilian constitutions, and in particular the Constitution of 1988 and its Amendment No 45 of 2004.

The role of international, regional and domestic standards in monitoring children's rights

The study provides a brief overview of the most important legal instruments in the international, regional and national framework on the development and promotion of children’s rights. Basically, it examines the continuous and pervasive violation of children’s rights despite the progressive instruments that have been adopted to ensure the proper and effective realization of these rights. It focuses on three different countries in Africa: South Africa, Ethiopia and Nigeria because of the value-laden nature of the progressive laws adopted by these countries in the protection of children’s rights. Specific roles and actions taken by international, regional and national monitoring bodies are highlighted to indicate their effectiveness in promoting and fulfilling rights for children. Country reports on the situation of children are examined in the context of realization of salient rights for children amidst the different judicial, political and socio-cultural settings. Emerging judgments and judicial developments that have limited and advanced the realization of rights for children in the specific country context were explored. 1 Abstract Trademarks and their territorial limits The purpose of my thesis is to analyze the ways that are used for overcoming territorial limits of trademarks, to point out the pros and cons of these methods. Likewise, I'd like to point out the fact that the various systems of trademarks - national and international systems and system of Community trade mark are interconnected and they complete each other. Therefore, it is necessary to focus on the quality of national legislation, to match the European Union standards and international standards, as well. I chose this topic, because the issue of trademarks is in my opinion very interesting, I like the fact that they can connect designers and businessmen, I am fascinated by their overlap into the art sphere, too. The topic of marks is very broad and quite specific, for understandable reasons it cannot be given so much time within the subjects taught at the Faculty. Also this was one of the reasons I chose this topic. My work is divided into six major thematic units, together there are 25 chapters, some of them are further divided into subchapters and sections. Après la chute de l’Union des Républiques Socialistes Soviétiques en décembre 1991, la Fédération de Russie affirme à maintes reprises son engagement à suivre un développement démocratique et à faire partie de « l’Europe sans frontières ». Pour atteindre cet objectif, elle adhère à toute une série de traités européens, entre autres, à la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales. Toutefois, malgré la volonté affichée par la Russie de faire partie du système européen de protection des droits fondamentaux, les problèmes de transition politique, institutionnelle et économique rendent cette tâche très difficile. Entre autres le fédéralisme, qu’on peut qualifier de « complexe », crée un système juridique très singulier dont certains éléments ne sont pas toujours compatibles avec les instruments internationaux en matière des droits de l’homme ratifiés par la Russie. L’objectif de ce travail est d’étudier les problèmes de la mise en œuvre de la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales et des décisions de la Cour européenne des droits de l’homme en Fédération de Russie et leur possible influence sur le développement des instruments de protection des droits fondamentaux dans les conditions du système fédéral existant en Russie. / After the fall of the Union of Soviet Socialist Republics in December 1991, the Russian Federation stated repeatedly its commitment to democratic development and to be part of "Europe without borders". To achieve this goal it joins a number of European treaties, among others, the European Convention for the Protection of Human Rights and Fundamental Freedoms. However, despite the willingness of Russia to be part of the European system of protection of fundamental rights, the problems of political transition, economic and institutional development make this task very difficult. Among other the federalism, which could be qualified as "complex", creates a very singular legal system. Some of its elements are not always compatible with international instruments on human rights protection ratified by Russia. The objective of this work is to study the problems of implementation of the European Convention for the Protection of Human Rights and Fundamental Freedoms and the decisions of the European Court of Human Rights in the Russian Federation and their possible influence on the development of national instruments for the protection of fundamental rights under the Russian federal system.
