L'étude de l'apport en société des créations intellectuelles permet de dynamiser le schéma contractuel classique de la propriété intellectuelle reposant sur le couple cession-licence et contribue à l'analyse du mécanisme de l'apport en société. Malgré une similitude certaine avec les contrats usuels d'exploitation des biens intellectuels, l'apport des créations intellectuelles en société est une convention originale. Cette originalité se traduit par une nature et un régime hybrides. Du point de vue du droit de la propriété intellectuelle, il s'agit d'un contrat particulier d'exploitation des biens intellectuels. Du point de vue du droit de sociétés, il s'agit du contrat qui permet de mettre les biens intellectuels à la disposition de la société et de l'un des éléments constitutifs de celle-ci. Cette dualité a une incidence directe tant sur les conditions de réalisation de l'apport en société des créations intellectuelles que sur les effets de l'apport. Si le régime applicable s'appuie sur celui des contrats classiques d'exploitation des biens intellectuels, à savoir sur les règles prévues par le droit civil pour le contrat de vente et de louage des choses, il n'y a pourtant pas assimilation. D'une part, la réalisation de la convention d'apport obéit à de nombreuses contraintes dont celles résultant du droit des sociétés et du droit de la concurrence. D'autre part, l'appréhension des droits et des obligations des parties est différente. La relation entre la société et l'apporteur est imprégnée de l'intuitu personae inhérente aux biens intellectuels et de l'affectio societatis dû à la nature du contrat de société. En l'absence d'une règlementation adaptée à la spécificité du contrat, la liberté contractuelle s'exerce dans le respect des principes d'ordre public. / The study of the contribution agreement dynamizes the classic contractual scheme of intellectual property exploitation based on the pair licence- assignment and provides a detailed analysis of the mechanism of the contribution to a company. Despite a certain similarity to conventional intellectual property exploitation contracts, the contribution agreement is an original contract. This originality is reflected legally by a hybrid nature as well as a heterogeneous applicable system. Regarding intellectual property, the contribution agreement is a specific act of exploitation of intellectual goods. Regarding company law, it is the agreement which enables delivery of the intellectual goods to the company and constitutes an essential element of the company¿s constitution. This duality directly affects the conditions of contract formation as well as its effects. Although the applicable system is based on the traditional contracts of exploitation of intellectual goods, in particular the articles of civil law relating the sale and lease of tangible assets, there is no further similarity. On the one hand, the formation of the contribution agreement follows numerous constraints posed by company law and competition law. On the other hand, the understanding of the parties¿ rights and obligations differs. The relationship between the company and the contributor is imbued with the intuitu personae attached to intellectual goods as well as the affectio societatis resulting from the nature of the partnership agreement. Given the lack of regulation adapted to the specificity of intellectual property contribution agreements, the emphasis has been put on contract drafting. Such a legal deficiency must be supplemented by contractual freedom without breaking the principles of public policy.

Aspects of the nature and online resolution of domain-name disputes

The thesis analyses selected aspects of domain-name law, mainly from the perspective of trade-mark law. It discusses the evolution of the domain-name system and how it operates as background to a more detailed discussion of the theoretical classification of domain names. The thesis then examines the interplay between trade marks and domain names, and the resolution of domain-name disputes resulting from the inherent tension between these two systems. The main principles of domain-name dispute resolution are identified by way of an analysis of the panel decisions handed down in terms of the international Uniform Dispute Resolution Policy (UDRP) and the South African domain name dispute resolution regulations. This analysis always addresses, too, the extent to which national trade-mark law principles (with reference to the laws of South Africa, the United Kingdom, and the United States of America) apply, and the extent to which this is appropriate. / Private Law / LL.D.

The admissibility and evaluation of scientific evidence in court

Increasing use is being made of various types of scientific evidence in court. The general requirement for the admissibility of such evidence is relevance. Although expert evidence is considered to be opinion evidence, it is admissible if it can assist the court to decide a fact in issue; provided that it is also reliable. In South Africa, the initial wide judicial discretion to either admit or exclude unconstitutionally obtained evidence, has developed into a more narrowly defined discretion under the final Constitution. Examples of scientific evidence, namely, DNA evidence, fingerprints, psychiatric evidence, bite-mark evidence and polygraph evidence are considered and problems inherent in the presentation of such evidence in courts in various jurisdictions are highlighted. An investigation of the presentation and evaluation of evidence in both the accusatorial and inquisitorial systems seems to indicate that the adversarial procedure has a marked influence on the evaluation of evidence / Criminal and Procedural Law / LL.M. The aim of the diploma thesis is to give a partial characterization of speech of several age groups: ninth grade students, people aged 19-24 years, people aged 44-50 years and people aged 65 or more years and also draw a comparison between them in certain areas. The thesis contains the theoretical part, which focuses on simple functional communication style in general, non-verbal communication elements, symptoms suprasegmental speech marks and vocabulary range. The practical part is divided into two chapters. The first one describes necessities and areas of research. The second one provides a summary of speech specifics of individual age groups and mutual comparison of them. The practical part focuses on expression quality, ie., accuracy and linguistic correctness. It is also focused on the periphery of the vocabulary range.

This diploma work completely deals with problems of the evaluation by a teacher. In the introductory part there are described specifics of the school evaluation, its importance and sense. There is also mentioned a survey of many types, functions of the evaluation and methods, which are mostly being used for the pupils{\crq} evaluation at school. It also discusses an influence of the evaluation on the pupil. It summarizes principles and processes of the pupils{\crq} evaluation, which are established and obligatory for schools in the Czech Republic. It analyzes the problems of basic forms of the evaluation, which are mostly being used at our schools; those are the word evaluation and the classification by marks; and it also describes the portfolio that is a new alternative form of the evaluation. It concentrates on important aspects of pupil{\crq} evaluations, principles, those are important to know and they must be observed. It devotes to an importance of positive and negative evaluations and also to a smart question of the evaluation objectivity. It refers to mistakes which are important to avoid. It points out the importance of individual approach to pupils, especially to pupils with specific learning difficulties. It analyzes the evaluation problems of the pupils with learning disability and it refers to the mistakes that are necessary to remember in the evaluation of pupils with specific learning difficulties.

Subsequently, as a conclusion of the thesis, is drafted implementation of the Balanced Scorecard concept to this company. In this section are draw up strategic goals of selected perspectives, strategic map, budget, time schedule of the project implemen-tation and evaluation of the benefits of adopting this method to the enterprise.

La présente étude propose d'envisager la publicité dans son ensemble, à l'épreuve de la directive du 11 mai 2005 relative aux pratiques commerciales déloyales. L'étude s'efforcera de mettre en relief les apports de la directive au droit français de la publicité. La directive du 11 mai 2005 entend s'appliquer aux pratiques commerciales déloyales des entreprises vis-à-vis des consommateurs. Pour ce faire elle instaure un cadre juridique inédit. Elle consacre une nouvelle expression : celle de « pratiques commerciales » comprenant la publicité. Cette approche extensive, est accompagnée d'une liste détaillée et conséquente des pratiques déloyales sachant que la directive dont l'objectif est d'assurer un niveau de protection élevé au consommateur tout en contribuant à la réalisation du marché intérieur, s'impose aux États sans que ceux-ci ne puissent prévoir de mesures plus strictes que celles qu'elle prévoit. De ces considérations, émerge l'idée d'absorption de la notion de publicité par celle de pratiques commerciales. Celle-ci s'accompagne de l'absorption du régime juridique de la publicité par celui des pratiques commerciales d'une part, en raison de l'harmonisation prescrite par la directive et d'autre part, en raison de la liste pléthorique de pratiques commerciales déloyales établie par la directive. Ceci permettant de conclure que désormais la publicité n'est qu'un sous-ensemble compris dans l'ensemble plus vaste de celui des pratiques commerciales déloyales. / The present study proposes to consider advertising as a whole, the test of the directive of 11 May 2005 concerning unfair commercial practices. The study will seek tohighlight the contributions of the directive in the french advertising law. The directive of 11May 2005 is intended to protect european consumers against unfair commercial practices.This directive is intended to creates a unique legal framework. It involves a new term: the “commercial practices” including advertising. This broad approach is accompanied by adetailed and consistent list of unfair practices, knowing that the directive which aims to ensure a high level of consumer protection while contributing to the achievement of the internal market, is obligatory for states without that they can not provide more stringentmeasures than those provided. These considerations, the idea emerged to absorb the conceptof advertising that commercial practice. This is accompanied by the absorption of the legal regime of the advertising commercial practices, firstly, due to the harmonization required by the directive and secondly, because of the bloated list of unfair trade practices established by the directive. This allows to conclude that advertising is now a subset included in the larger whole of the unfair trade practices.

PhD thesis solves problems of mutual comparison of real estate market prices with prices found out in a comparison way according to price regulations. The thesis is focused on real estates of type housing units, flats which are found within the area of former district city Havlíčkův Brod. From time point of view, years 2009 - 2014 were solved. Within this period, first of all data collection was under way followed by grouping information on separate trading in housing units, flats. Obtained market prices were consequently confronted with prices found out in a comparison way according to relevant price regulations. Obtained results were analyzed, this analysis was focused on chosen marks and their qualitative zones at separate indexes. Upon achieved results and newly gained knowledge, partial modifications or corrections in price regulations are proposed. Another output of this thesis is a proposal for introducing new coeficients. These make provision for difference of market and found out prices of housing units, flats in area of former district city Havlíčkův Brod in years 2009, 2010, 2011, 2012, 2013 and 2014. Thanks to this, common price is possible to estimate retrospectively with the help of price regulations. At the very conclusion of the thesis, these coeficients were applied in different former district city in Vysočina Region, in concrete terms in Žďár nad Sázavou. In this way, possible use of these newly proposed coeficients was introduced in other former district cities as well which is, nevertheless, necessary to be verified in practice or subject to other research.

Low cycle fatigue is an important valving parameter of materiale which are exposed random alternate strain during their operation. The alternate strain in that material is caused by temperature fluctuations during operation and outages such as aircraft engines. Tests of low cycle fatigue were performed on samples of superalloy Inconel 738LC at stable room temperature at 23°C. The actual experiment took place at certain intervals, consisting of cycling itself, and observing changes in surface relief by light and electron microscopy. There was observed significant surface relief at an early stage of low cycle fatigue. We compared results of measurement with other different observation methods.
