The goal of master thesis is evaluation of efficiency of state aid in the agriculture focusing on food quality marks. At the beginning of the work are described state institutions supporting Czech producers and their products. Evaluation of efficiency is made based on telephone interview with producers and quantitative research among consumers. Telephone interview is conducted with producers who can use a logo Regionalni potravina on their foodstuff. The aim of this research is to find out, if the producers achieved positive results in their sales after obtaining food quality mark. Quantitative research is made among consumers, where the key question is what awareness consumers have about food quality marks, what is the key factor in buying decision and if consumers noticed promotional campaigns of the Ministry of Agriculture focusing on aid of Czech producers with food quality marks. After making research it will be easier to say if state aid is effective or if there are spotted flaws or what.

The study arose from clinical listening of two patients followed up in psychotherapy for marking their skin with such wound. This phenomenon, known as cutting on social networks, advances reaching proportions of a worldwide epidemic. This project aimed to understand this issue, widespread among teenage audiences, from listening them. To achieve this purpose four students of both sexes were interviewed, aged from fifteen to seventeen, and added the clinical cases which led to the investigation, to sign the possible therapeutic effects for this demand. Psychoanalysis, through metapsychological concepts, served as theoretical goal and backup for the interviews. It was found that adolescents use the body to stage the psychic malaise due to a symbolic precariousness and express a thought directed to acting, without the operation of an intermediary. The wounds and scars are hieroglyphics, marked on the epidermis, addressed to the Other, by seeking recognition and intervention. Despite the peculiarities of each case, the cuts work as strategy to ensure survival face an overwhelming anxiety. They can also be considered an act of passage and continuation of itself as an alternative to circumvent annihilation. It is concluded that scarification are not suicidal acts, but are preceded by milder self-injurious behavior and, if not translated in time, can become more violent acts against themselves. / A presente pesquisa versa sobre os adolescentes que apresentam comportamentos autolesivos, especificamente o de cortar a própria pele. O estudo surgiu a partir da escuta clínica de dois pacientes acompanhados em psicoterapia que marcavam a superfície cutânea com tais lesões. O fenômeno, conhecido nas redes sociais como cutting , avança, atingindo proporções de uma epidemia mundial. Por estar difundido entre os adolescentes, este projeto teve como principal objetivo compreender esta questão, a partir da escuta desse público. Para atingir esta finalidade foram entrevistados quatro estudantes, de ambos os sexos, com idade entre 15 e 17 anos, além dos dois casos clínicos que motivaram a investigação, para sinalizar os efeitos terapêuticos possíveis para esta demanda. A psicanálise, através dos conceitos metapsicológicos, serviu como baliza teórica e como respaldo para as entrevistas. Verificouse que os adolescentes empregam o corpo como palco para encenar o mal-estar psíquico por uma precariedade simbólica e por expressarem um pensamento voltado para o agir, sem que se opere uma intermediação. As feridas e cicatrizes são hieróglifos, marcados na epiderme, endereçados ao Outro, por buscarem reconhecimento e intervenção. Apesar das singularidades de cada caso, os cortes funcionam como uma estratégia para garantir a sobrevivência frente a uma angústia avassaladora. Também podem ser considerados um ato de passagem e continuação de si mesmo como alternativa para driblar o aniquilamento. Conclui-se que as escarificações não são atos suicidas, porém são antecedidas por comportamentos autolesivos mais brandos que, caso não sejam traduzidas a tempo, podem evoluir para condutas mais violentas dirigidas contra si.

En los últimos años, las marcas blancas han ido revolucionándose en diferentes categorías del mercado, principalmente en las de alimentos y farmacias. Es por ello, que en esta investigación se desea saber cuál es la relevancia de productos de marcas blancas en otras categorías, como es la de televisores en lugares como tiendas por departamento y supermercados con factores de marketing mix como precio, calidad percibida, innovación, asesoría en el punto de venta, forma de pago y promociones. Se comenzará justificando el tema elegido, citando a autores que respaldan con conocimientos previos la investigación y brindan un contexto. Se expondrá hasta donde se quiere llegar con la investigación y de la misma manera cuales con las limitaciones que se han encontrado en el camino. Por otro lado, se desarrollará la matriz de consistencia, donde está la pregunta de investigación, seguida de las variables (dependientes e independientes), KPI’s, hipótesis y finalmente los objetivos. La metodología a utilizar será de tipo exploratoria correlacional, dividiéndose en cualitativa y cuantitativa. / In recent years, private labels have been revolutionizing in different market categories, mainly food and pharmacy. That is why, in this research, we want to know which is the relevance of private label products in other categories, such as televisions, in places such as department stores and supermarkets with marketing mix factors such as price, perceived quality, innovation, advice at the point of sale, payment method and promotions. We will begin by justifying the chosen topic, citing authors who support the research with prior knowledge and provide context. It will be exposed to where we want to go with the investigation and in the same way as with the limitations that have been found along the way. On the other hand, the consistency matrix will be developed, where the research question is, followed by the variables (dependent and independent), KPIs, hypotheses and finally the objectives. A fire station is a building where not too many things happen. But the few that do are either too forgettable or too memorable. This thesis tries to achieve time, innovation and realism. There's a redundancy in this building, in people's actions that makes it memorable. This building is the evidence of my way of thinking architecture. It reflects my memory as student and architect. It shows an undeniable background. It's questioning why buildings don't endure in time, why they are disposable objects. I'm trying to find reasons to make a building respectful, socially involved with its surroundings. The project is a midsize fire station. It answers to an actual necessity to relocate the existing fire station on Prince St. (Alexandria, VA) giving more space for firefighters and better access for two trucks. The new site is an existing parking lot that crosses a whole block from South Washington St. to South Columbus St. between Wilkes St. and Wolfe St. This site gave me the possibility to create a building where trucks can access and leave it without turning or maneuvering too much. / Master of Architecture

SANTRAUKA Šiame darbe analizuojama Europos Teisingumo Teismo ir Lietuvos teismų praktika, siekiant identifikuoti prekių ženklų tapatumo ir panašumo nustatymui reikšmingus kriterijus, šių kriterijų taikymo sąlygas bei įtaką vertinant bendrą prekių ženklų įspūdį, taip pat atkreipiamas dėmesys į teorinius ir praktinius probleminius prekių ženklų tapatumo ir panašumo nustatymo klausimus ir siūlomi jų sprendimai. Pirmojoje dalyje labai koncentruotai nurodomas su prekių ženklų tapatumu ir panašumu susijęs teisinis reglamentavimas. Antrojoje dalyje atskleidžiama prekių ženklų tapatumo sąvoka bei prekių ženklų tapatumo vertinimas buvusio Pirmosios Instancijos Teismo, dabartinio Bendrojo Teismo ir ETT praktikoje, taip pat, siekiant tapatumo klausimą išnagrinėti visapusiškai, pasiremiant pavyzdžiais ir iš Vidaus rinkos harmonizavimo tarnybos praktikos. Trečioji darbo dalis skirta aptarti prekių ženklų panašumą bei išnagrinėti jam nustatyti reikšmingus kriterijus. Šioje dalyje Bendrijos ir Lietuvos teismų sprendimų analizė atlikta pagal bendriausius prekių ženklų panašumo nustatymo kriterijus: skiriamuosius ir dominuojančius elementus, vaizdinį, fonetinį bei konceptualų lyginimą. Darbo pabaigoje atskirai aptariama netradicinių prekių ženklų panašumo nustatymo specifika. / SUMMARY Establishment of Identity and Similarity of Trade Marks in the Case Law of the European Court of Justice and Lithuanian Courts This master thesis is dedicated to analyze case law of the European Court of Justice and Lithuanian courts, with the aim to identify criteria significant for establishment of identity and similarity of trade marks, conditions for application of those criteria as well as influence upon evaluation of the general impression created by trade marks. In addition, attention is drawn to theoretical and practical problem issues in establishment of identity and similarity of trade marks and suggestions on their solution are made. In the first part, a list of condensed references is made to laws pertinent to the identity and similarity of trade marks. The second part reveals the concept of identity of trade marks and judgment of identity of trade marks in the case law of the former Court of First Instance, currently the General Court, and the European Court of Justice, supplemented by additional illustrations from the practice of the OHIM, in attempt of painting the full picture of the identity issue. The third part of the thesis focuses on the discussion of the similarity of trade marks and analysis of criteria for establishment of similarity of trade marks. The marks I make in clay have different characteristics, and the physical mark of one’s fingertips or visual record of the hand is personal and intimate. This visible activity is the evidence of my constant presence and control within each object. Its repetitive meditation produces a private relief from my persistent anxieties. This exploration for me is not only visual, but also physical. This is the start of my infatuation with the idea of pattern. It has its own discrete visual language and modes of communication; and through my research I am developing a method of intercommunication.

L’organisation africaine de la propriété intellectuelle (OAPI) a consacré la théorie de l’épuisement des droits depuis sa révision de 1999. Elle en a posé les conditions légales. On découvre que ses conditions, qui sont une limitation du droit exclusif de commercialisation des titulaires, n’en préservent pas moins la quintessence. À travers une mise en circulation limitée au territoire national pour la marque et au territoire régional pour le brevet, le législateur a fait partiellement échec au libre commerce des produits protégés. L’existence des zones de libre-échange peut néanmoins contribuer à élargir le domaine de l’épuisement qui deviendra alors communautaire dans l’UEMOA et la CEMAC. L’encadrement de l’épuisement des droits est rigide mais maîtrisé. Il est cohérent avec le principe de départ qui est la protection des droits de propriété industrielle. Aussi l’épuisement international est-il tout simplement rejeté, alors même qu’il aurait pu constituer un moyen de régulation de la libre circulation des produits protégés. Néanmoins, il faut relativiser ce rôle et se tourner vers une véritable quête de transfert de technologie qui est le seul moyen de transformer le sort de la propriété industrielle sur le continent africain. / The African intellectual property Organization (AIPO) consecrated the theory of exhaustion right since the revision of 1999. It puts the legal conditions of the theory. It seems that these conditions, which are considered as a limitation of the monopolistic right of the t industrial property owners, after all, protect this right and give consistency to it. Through the right of commercialization that is limited to the national territory for marks and to the regional territory for patents, the African legislator keeps the products from free-trade. Nevertheless, the existence of the free-trade areas like UEMOA and CEMAC could enlarge the domain of the trade of the merchandises. The theory of exhaustion is stringent, without a far-reaching influence. It is consistent with the principle of the protection of the intellectual property rights that is of paramount importance. The international exhaustion is rejected even though it can be a means of the regulation of the free trade of the marked or patented products. So, the impact of international exhaustion may be itself relativized. The African countries have to search the transfer of technology that appears as the one means which can transform the industrial property in Africa.

Esta tesis muestra una radiografía de las evaluaciones de Historia de España en COU y Bachillerato (a través de los recuerdos de 1523 alumnos entre 1993-2003), y de los protocolos de los exámenes (410 realizados por el profesorado entre 2002-2004), en la CC.AA. de la Región de Murcia. Entre los resultados más relevantes, destacar: la influencia que los aspectos formales de las evaluaciones y los exámenes tienen tanto en los contenidos por los que se les pregunta a los alumnos como en el tipo de aprendizaje que éstos adquieren; la presencia predominante de preguntas que requieren principalmente la memorización de los conocimientos; las relaciones existentes entre los tipos de preguntas y las capacidades cognitivas solicitadas en las pruebas; la evaluación de unos temas de la Historia de España en detrimento de otros; y la influencia que dos referentes como son selectividad y decreto de currículum, tienen en las pruebas estudiadas. / This thesis shows a radiograph of the assessments of History of Spain in COU and Bachillerato (through the memories of 1523 students between 1993-2003), and the protocols of the examinations (410 made by teachers between 2002-2004) in the Autonomous Community of the Region of Murcia. Among the most relevant results, include: the influence of the formal aspects of assessments and examinations have so much in the content for which one asks the students as the type of learning that they acquire, the predominance of questions mainly require the memorization of knowledge, relations between the types of questions and cognitive abilities tests requested and the evaluation of the subjects of the History of Spain at the expense of others, and the influence of two references such as selectivity and Decree of the curriculum, the tests are studied.
