'n Ondersoek na die regsbeskerming van die vrou se huweliksverhouding tydens die klassieke Romeinse reg

Text in Afrikaans / In hierdie ondersoek is navorsing gedoen oor die Romeinse huweliksverhouding ten einde vas te stel of die klassieke Romeinse reg die Romeinse vrou se huweliksverhouding beskerm het indien dit deur haar man se wangedrag geskend is. Die navorsing het getoon dat, soos in die Suid-Afrikaanse reg, die Romeinse huweliksverhouding teen die klassieke tydperk 'n consortium omnis vitae met veral morele huwelikspligte was en dat die nie-nakoming van hierdie pligte op wangedrag en skending van die huweliksverhouding neergekom het. Daar is tot die gevolgtrekking gekom dat, soos in die moderne reg, ook die Romeinse man die huweliksverhouding kon skend deur wangedrag, beperkte vorme van seksuele wangedrag, iniuria en bigamie. Die klassieke Romeinse reg het egter nie aan die Romeinse vrou direkte regsbeskerming verleen by die man se skending van die huweliksverhouding deur wangedrag nie. Sy het egter wel indirekte regsbeskerming in die vorm van toevlugof afskrikmiddels (soos egskeiding en die dos) geniet. / In this study research has been done on the Roman marital relationship in order to determine whether classical Roman law protected the Roman wife's marital relationship if it had been breached by her husband's misconduct. Research has shown that by the classical period, as in South African law, the Roman marital relationship was a consortium omnis vitae with primarily moral marital duties. Non-compliance with these duties amounted to misconduct and breach of the marital relationship. It was concluded that, as in modern law, the Roman husband too could be in breach of his marital relationship through misconduct, limited forms of sexual misconduct, iniuria and bigamy. However, classical Roman law did not grant the Roman wife any direct legal protection where her husband was in breach of the marital relationship because of misconduct. She nevertheless enjoyed indirect legal protection in the form of deterrents (such as divorce and the dos). / Law / LL.M.

The dismantling of the rule of law in the United States: systematisation of executive impunity, dispensation from non-derogable norms, and perpetualisation of a permanent state of emergency

Scholars of human rights and constitutional law have described in great detail the abuses perpetrated by the armed forces and secret services of the United States in the context of the ‘war on terror’. There is copious literature explaining why these violations of fundamental human rights are not justifiable, and why they are not consistent with international treaties or that nation’s constitution. This thesis builds upon this research, but strikes out in a new direction. It does so by asking whether these abuses, combined with the changes to the legal order of the United States that made them possible, have produced a qualitative transformation of its constitutional structure. In particular, this thesis tracks the empowering of the executive. Increasingly, whenever it purports to act in the interests of national security, the executive claims the authority to act unilaterally in a manner that overrides even non-derogable rights. These novel constitutional reserve powers, which this thesis demonstrates were derived from President Nixon’s theory of the executive, were used to justify indefinite arbitrary detention, torture, mass surveillance without warrants, and extra-judicial execution. This thesis seeks to determine if the constitutional crisis inaugurated by this theory of executive supremacy over the laws has been terminated, or whether it has continued into the Obama Administration. If this theory is current within the executive branch, and especially if the violations of jus cogens norms has continued, it signifies a cross-party consensus about a paradigm shift in American constitutionalism. Accordingly, given the fact that the abuse of executive supremacy is what led to the development of the rule of law, this thesis will ask the question of whether the United States is being governed in accordance with its basic minimum norms. This thesis explores whether the executive is still subject to checks and balances from the legislature and the judiciary, such that it cannot violate non-derogable rights at will and with impunity. If the contrary proposition is true, it demonstrates that the crisis of the rule of law in the United States is ongoing, and this permanent state of exception demands significantly more scholarly attention. / Public, Constitutional, and International Law / LLD

Perceptions on fraud and corruption policies and strategies in public procurement within the Western Cape Provincial Treasury (WCPT)

Fraud and corruption especially in the procurement systems is one of the major contributors of annual losses the Western Cape Provincial Government incurs. Since the introduction of computerised procurement systems, also known as e-procurement, the occurrence of fraud and corruption has substantially increased as soon as individuals familiarize themselves with the system. The Western Cape Provincial Government will save a huge amount of money if fraud and corruption could be prevented and limited. These funds could be put to better use and result to better service delivery. The Government has therefore developed many policies and strategies to try to combat and prevent corruption in procurement both in the public and private sector. This study examines the perceptions of key stakeholders on the appropriateness of the strategies in place to prevent fraud and corruption in the provincial procurement system by particularly looking at the achievements and limitations that have been experienced. The focal point is the Western Cape Provincial Treasury since they are currently the owners of the computerised procurement system. The study also includes an assessment of the role of the Western Cape Provincial Treasury in general in fighting fraud and corruption in public procurement. The research methods utilised include a comprehensive review of documentation published by the provincial government with regard to fraud and corruption as well as perceptions of key stakeholders on the appropriateness of anti-corruption policies and strategies in the Western Cape Provincial Government. Government has, in its commitment to fight corruption, established various anti-corruption agencies, developed a number of programmes and introduced numerous legislative frameworks. The Western Cape Government in particular has developed a transversal Anti-corruption Strategy to provide a framework within which to combat fraud, corruption and theft in the province. All provincial departments are encouraged to maintain a zerotolerance against corruption by developing and implementing a Fraud and Corruption policy within their various departments. The proper implementation of the anti-corruption policy is imperative for the prevention of fraud and corruption. Western Cape Provincial Treasury, as the custodian of the LOGIS procurement system in the Western Cape, plays a vital role in promoting compliance to relevant legislation by implementing anti-corruption strategies. It is apparent that different anti-corruption strategies to control and manage fraud and corruption in procurement do exist, but its appropriateness differs from department to department. Anti-corruption strategies will only be successful when it eliminates the occurrence of fraud and when perpetrators are caught and executed. Management should play a vital role in identifying and combating corruption in departments. Employees should be made aware of the consequences if they should commit any fraudulent acts. Furthermore, all officials should be encouraged to report any fraudulent incidents. / AFRIKAANSE OPSOMMING: Korrupsie beïnvloed die lewens van almal in Suid-Afrika en kan dus gedefinieer word as 'n gemeenskaplike vyand. Bedrog en korrupsie, veral in die verkryging stelsels is een van die grootste bydraers van die jaarlikse verliese die wat die Wes-Kaapse Provinsiale Regering aangaan. Sedert die bekendstelling van die gerekenariseerde verkryging stelsels, ook bekend as e-verkryging, het die voorkoms van bedrog en korrupsie aansienlik verhoog sodra individue hulself vertroud maak met die stelsel. Die Wes-Kaapse Provinsiale Regering sal 'n groot bedrae geld bespaar as bedrog en korrupsie voorkom en beperk kan word. Hierdie fondse kan op op sy beurt beter aangewend word en kan tot beter dienslewering lei. La déontologie policière au Québec : les facteurs associés aux jugements de culpabilité et aux sanctions imposées aux policiers

La présente étude s’intéresse aux facteurs associés aux différents types de décisions rendus par le Comité à la déontologie policière du Québec. Pour ce faire, 267 jugements rendus entre 2009 et 2013 sont analysés. La régression logistique est utilisée pour déterminer les facteurs associés (1) à la décision de culpabilité (2) à la décision sur sanction et (3) à la sévérité de la sanction (sanction de courte durée ou de longue durée). Les facteurs utilisés dans les modèles sont des facteurs légaux (nature, gravité de l’inconduite et plaidoyer de culpabilité) ainsi que des facteurs extra-légaux -tels que les caractéristiques des policiers et des plaignants, le contexte de l’intervention ainsi qu’un facteur lié au processus décisionnel du comité (la durée des procédures)- disponibles dans les jugements. Les résultats montrent que le verdict est majoritairement influencé par la qualité de la preuve et que la sévérité de la sanction dépend principalement des facteurs légaux. Toutefois, certains facteurs extra-légaux influencent le verdict, dont le grade du policier. Parmi les facteurs extra-légaux qui influencent la décision sur sanction, il y a le grade, le sexe et le service de police du policier. Malgré tout, le Comité à la déontologie policière prend des décisions relativement cohérentes et les décisions prises sont justifiables légalement sauf pour quelques caractéristiques du policier et pour la durée des procédures. Ces derniers montrent la nécessité de faire davantage d’études sur le sujet. / Even though disciplinary systems are criticized for their lack of coherence and fairness, there is currently no study specifically focusing on the predictive factors related to the outcome of the officers’ sentencing process. The present research aims to investigate the factors associated with the different types of decisions rendered by the Deontology Committee of Quebec. A total of 267 hearings were analyzed between the year 2009 and 2013. Logistic regression models are used to predict the outcomes of the sentencing on three levels: (1) the determination of guilt, (2) the decision on the sanction, and (3) the severity of the sanction (short- or long-term sanction). The factors used in the models are legal factors - specific to the nature and the severity of the misconduct - and extralegal factors - related to the complainant’s and officer’s characteristics, the situation and the length of procedures - available in the judgments handed down by the Committee. The analyses in this paper show that the different outcomes are mostly due to the legally relevant factors. On the other hand, some extralegal factors like the officers’ rank have an influence on the determination of guilt. And, some officers’ characteristics like the officers’ rank, sex, police department and the length of procedures tend to influence the outcomes of the sentencing. Thus, the findings show that decisions rendered by the Committee are mostly taken in accordance with its mandate and are legally justifiable. The latter results show that more research is needed concerning the impact of extralegal factors on the outcomes.

Les rétractations et leurs conséquences sur la carrière des coauteurs : analyse bibliométrique des fraudes et des erreurs dans le domaine biomédical

Ces dernières années, la découverte de fraudes scientifiques majeures a créé des ondes de choc dans la communauté scientifique. Le nombre annuel de rétractations a considérablement augmenté, et la plupart sont dues à des cas de fraude. Bien qu’il soit généralement pris pour acquis que tous les coauteurs sont affectés par ces rétractations, l’objectif de cette étude est de vérifier cette présupposition empiriquement. Nous avons recensé toutes les rétractations du domaine biomédical (443) de 1996 à 2006 dans PubMed et mesuré, à l’aide du Web of Science (WOS), la productivité, l’impact et les pratiques de collaboration des coauteurs (1 818) sur une période de cinq ans avant et après la rétractation. Nos résultats montrent que les rétractations ont des conséquences sur la carrière des coauteurs, surtout au niveau du nombre de publications des années subséquentes. Cet impact est plus grand dans les cas de fraude, et pour les premiers auteurs. / Over the last few years, major cases of scientific fraud shocked the scientific community, and the number of retractions each year increased considerably. Scientific misconduct accounts for approximately more than half of those retractions. It is assumed that co-authors of retracted papers are affected by their colleagues’ misconduct, and the aim of this study is to provide empirical evidence of how researchers’ careers are affected by a retraction. We retrieved all (443) publications retracted from 1996 to 2006 from PubMed, signed by 1818 authors. Using the Web of Science (WOS), we measured the productivity, impact and collaboration of each of those authors for a period of five years before and after the retraction. Our results show that retractions affect the career of co-authors, mostly in terms of scientific output. This impact is felt more strongly in cases of fraud and for first authors.

Acordos incentivados: uma contribuição britânica nos caminhos buscados pelo Judiciário brasileiro / Incentives to settlements: a British contribution in the paths sought by the Brazilian judiciary

O presente trabalho propôs-se a investigar a conveniência e a possibilidade de introdução, no ordenamento brasileiro, de iniciativas à semelhança dos pre-action protocols (Protocolos) e da Part 36 Offer (Oferta) do direito inglês, em vigor desde o advento das Civil Procedure Rules, em 1999. Aqueles, uma espécie de procedimento que se desenrola antes do processo judicial, incentivando o diálogo e a troca de informações e produção de prova entre as partes, cujo descumprimento importaria a incidência de multa; esta, uma oferta de acordo cuja rejeição ou aceitação traria consigo conseqüências patrimoniais às partes envolvidas na controvérsia, também representada pela aplicação de uma (outra) multa. Embora não indissociáveis, acredita-se que, juntos, potencializam-se mutuamente. Observaram-se os efeitos práticos da experiência inglesa, contemplando seus pontos fortes e fracos, chegando-se a um balanço positivo. Justificados os méritos dos institutos, entendeu-se possível a implantação de sistemática semelhante no Brasil, feitos certos ajustes. Observou-se, ainda, que um dos grandes méritos dos protocolos é a promoção do acordo informado, não do acordo motivado principalmente pela ineficiência e pela demora na prestação jurisdicional. Assim, propôs-se a elaboração de protocolos, preferindo-se os específicos ao genérico, incutindo na população e nos operadores do direito a cultura do diálogo e da cooperação na troca de informações. Observaram-se, ainda, os efeitos que a conduta das partes no desenrolar do protocolo geraria dentro do processo. Propôs-se, ainda, a introdução do que se chamaria de OPAc Oferta Potencializada de Acordo, à semelhança da Oferta inglesa, mas com conseqüências patrimoniais (multa) calculadas sobre a diferença apurada entre a OPAc e a condenação final, no processo, como forma de criar incentivos suficientes, mas não opressivos. / This paper seeks to investigate the desirability and the possibility of introducing, in the Brazilian law, initiatives such as the pre-action protocols (\"Protocols\") and Part 36 Offer (\"Offer\") of the English law, in force since the advent of the Civil Procedure Rules in 1999. The former, a kind of procedure that takes place before the judicial proceedings, encouraging the dialogue, the exchange of information and the disclosure of evidence between the parties, and which failure results in the application of a fine; the latter, a settlement offer which rejection or acceptance would entail financial consequences to the parties to the dispute, also represented by the application of a (another) fine. Although not inseparable, it is believed that, taken together, Protocols and Offer enhance each others effects. The analysis of the practical results of the British experience, considering its strengths and weaknesses, led to a positive balance. Once the merits of those mechanisms have been justified, the implementation in Brazil of a similar systematic provided certain adjustments are undertaken was considered possible. It was also observed that one of the great values of the Protocols is promoting well-informed agreements, instead of settlements mainly motivated by the inefficiency and delay of adjudication. Thus, the drafting of protocols was proposed, preferably the specific over the generic ones, introducing to the people as well as to the legal community a culture of dialogue and cooperation in the exchange of information and evidence. The effects that the conduct of the parties while following the Protocol would generate in the judicial proceedings were also analyzed. Moreover, we proposed the introduction of the so-called OPAc - Oferta Potencializada de Acordo (Enhanced Settlement Offer) - similar, in its concept, to the British Offer, albeit bearing financial consequences (fines) calculated over the difference between the OPAc and the amount as per the decision handed down by the judge, in order to create sufficient - but not oppressive - incentives.

The Prevention of Police Corruption and Misconduct: A Criminological Analysis of Complaints Against Police

The reform measures recommended by the Commission of Inquiry into Possible Illegal Activities and Associated Police Misconduct (referred to as the "Fitzgerald Inquiry") radically transformed the face of policing in Queensland. The most significant of these recommendations was the establishment of an external oversight body, the Criminal Justice Commission (CJC), which has independence from executive government and holds the power to investigate not only police but any public servant or politician. Other recommendations included "Whistleblower" legislation, increasing sanctions for serious misconduct, lateral recruitment and promotion by merit rather than seniority. The first main research question tested in this thesis is whether these reform measures have produced improvements in the following areas: the efficiency and effectiveness of the processes for dealing with complaints against police; public confidence in those processes and the public standing of the Queensland Police Service (QPS) generally; standards of police behaviour; the incidence of corrupt conduct; and police attitudes towards reporting misconduct by their fellow officers. These Fitzgerald Inquiry reforms were strategies primarily derived from two schools of thought describing the nature and cause of police corruption: deterrence based theory (including "individual" or "rotten apple" theory) and cultural (also labeled "cultural" or "socialisation") based theory. To date most strategies used to combat police corruption have been underpinned by these theories. A third theory - situational based theory (sometimes titled "environmental" or "opportunity" theory) - which has had success in crime prevention, has been scarcely used in the area of police corruption. However, an extensive body of research has affirmed the effects of situational factors on police behaviour, suggesting the potential for the application of situational crime prevention initiatives in combatting police corruption. The second research question proposed in this thesis is whether situational based theory could also be beneficial in the prevention of police corruption. Data drawn upon to test the first research question were interviews and surveys with police officers, public attitude surveys and statistics from the processing of complaints against police. Although each source has limitations, collectively the data are sufficiently comprehensive - and robust - to defend conclusions about the general direction of the changes which have occurred. These data indicate that the Fitzgerald Inquiry reforms have, at least to some degree, had their intended impact on the QPS. These reforms have contributed to an apparent improvement in public confidence in the complaints system and the QPS generally. Moreover, the available evidence suggests that the Fitzgerald Inquiry reforms have resulted in a weakening of the police code of silence. As far as the specific issue of corruption in the QPS is concerned, it is difficult to draw firm conclusions from existing data sources. However, the weight of the available evidence is that such conduct is less pervasive and occurs at lower levels than was the case in the pre-Fitzgerald Inquiry QPS. It is very difficult to ascertain which reform components were the most effective and which were not helpful at all, as these reform measures were initiated simultaneously. For example, the negative elements of the police culture may have been eliminated or reduced but whether it was the cultural strategies or one of the deterrence based strategies influencing officer behaviour remains unknown. The second main research question the thesis poses is that the use of situational crime prevention techniques has potential for contributing to the prevention of police corruption. A situational analysis of complaints against police data, including the development of a typology for classifying types of police corruption and misconduct, was used as an example of how this may be accomplished in Queensland. The study provides some, albeit limited, support for the hypothesis that situational crime prevention methods are applicable to police corruption. Based upon three years of complaints data, enough homogenous cases were gathered to enable the analysis of four categories of police corruption - Opportunistic Thefts, Driving under the Influence, Assault (while off-duty), and Theft from Employer. Given that this study only used three years of complaints data held by the CJC and more than nine years of data exist, productive situational analyses of many other categories of corruption is probable. This study also illustrated that complaints against police data are being under utilised by the QPS and the CJC. For future research in the situational analysis of complaints data, I recommend improving the gathering of data from complaints files for storage in electronic form to enable situational prevention analysis to be conducted more readily. A geographical example was used to illustrate further how complaints against police data could be more extensively utilised as a prevention tool. This analysis was conducted at an organisation unit level determined primarily by geographical factors. The complaint patterns of units of similar "task environments", as measured by unit size and type of duties performed, were compared in an attempt to identify those units experiencing the presence or absence of "bad apples" or a "negative culture". This study led to the conclusion that a divisional analysis of complaints data can provide information valuable in combatting police corruption. When task environment was held constant, it was possible to identify units experiencing the effects of possible "bad apples" and/or "negative cultures". Once these particular units were identified, intervention strategies to address the units' particular problem could be constructed. Future research in this area would involve ongoing divisional data analysis followed-up by individual assessment of officers identified as "bad apples", or a "compare-and-contrast" procedure to distinguish features requiring correction in units identified as having a "negative culture". The research findings presented in this thesis are that progress has occurred in a number of areas in addressing the problems identified by the Fitzgerald Inquiry, but that there is undoubtedly scope for more to be achieved. Despite the very significant increase in the resources and powers available to investigators post-Fitzgerald, it is still difficult to prove that a police officer engaged in misconduct, or that other officers were aware of this fact and had failed to take action, because of the constraints imposed by evidentiary and legal requirements. Thus, while it is vital to maintain an effective and credible independent complaints investigation system and ensure that there is a proper internal discipline process in place, the scope for increasing the "deterrent power" of the present system is limited. Putting more resources into complaints investigations might make a difference at the margins, but is unlikely to lead to a significant increase in the probability of a complaint being substantiated and a sanction imposed. Investing more resources in investigations has an additional cost in that such resources are then lost to other efforts to combat corruption that may provide more fruitful results in the long term. The value of an occasional substantiation is placed above the ability to engage in a large amount of prevention work. Inevitably then, three clear messages are apparent. First, continued effort must be made to modify the organisational climate of the QPS in terms of commitment to integrity. Recommended strategies to accomplish this end are to continue the recruitment of more educated, female and older officers to reduce police-citizen conflict and the negative elements of the police culture, and also to develop a comprehensive, integrated approach to ethics education for QPS officers at all ranks and positions. Second, other forms of deterrence against misconduct are needed such as the use of covert strategies like integrity testing which could be conducted in conjunction with the CJC. Third, a greater emphasis needs to be placed on developing and implementing preventive strategies. This thesis has shown that valuable prevention strategies can be gained from situational and divisional analysis of complaints data, and a range of proactive management options based upon situational crime prevention theory are recommended. These strategies have application in any police service.

本研究係針對會計師及會計系學生之不當學習行為是否會影響其日後對一般工作不道德行為與審計專業不道德行為之認知與意圖進行探討,並試圖瞭解兩者形成從事審計專業不道德行為意圖之考慮因素。 本研究係以問卷方式蒐集資料,其中,會計師樣本係從台北市會計師公會登錄之會計師進行隨機選取,學生樣本則係從北部四所大學會計系四年級學生為對象進行問卷調查。研究結果顯示: 一、 會計師相對於會計系學生而言,較能確定不會從事審計不道德行為,且對於不當學習行為之認知亦較學生嚴重。 二、 會計師與會計系學生若認為他人亦有從事審計不道德行為之意圖時,就愈有可能從事該審計不道德行為;且不論是會計師或是會計系學生,曾經做過愈多不當學習行為者,就愈可能存有從事審計不道德行為之意圖。 三、 對於不當學習行為認知愈不嚴重之會計師,對於一般工作不道德行為之認知亦愈不嚴重;而對不當學習行為的認知愈不嚴重之會計系學生,對於一般工作不道德行為或是對審計專業不道德行為之認知亦愈不嚴重。 / This research was aimed to examine relationship among academic misconduct, improper business practice and morally questionable behavior in auditing of CPAs and auditing students. In addition, this research also examined the factors affecting the intention of CPAs and auditing students to behave unethically in auditing. The data were collected by questionnaires. The CPA samples were chosen randomly from CPAs registered in the CPA Association of Taipei City and the student samples were auditing students from four universities in northern Taiwan. Empirical results were summarized as follows: 1. CPAs appeared more certain about refraining from morally questionable behavior in auditing and perceived academic misconduct more seriously than auditing students. 2. When CPAs or auditing students deemed that others would breach ethics in auditing, they appeared to be more prone to do the same. Besides, if they had committed academic misconduct previously, it was more likely for them to choose morally questionable behavior in auditing. 3. CPAs who took academic misconduct less seriously perceived improper business practice less seriously. Auditing students who took academic misconduct less seriously perceived improper business practice and morally questionable behavior in auditing less seriously.

探討犯罪公司定罪前後銀行貸款利率之差異 / The Impact of Corporate Convictions on Syndicated Bank Loan Prices

近年來知名公司面臨起訴或遭到定罪的消息層出不窮,然而在公司定罪的相關研究中,多數文獻著重於探究遭受定罪之事實對公司價值的影響,較少研究聚焦於定罪事實對公司所參與之聯貸案契約條件的影響,有鑑於此,本篇文章旨在探討犯罪公司於定罪前後其聯貸借款條件之借款利率是否有顯著差異。本篇研究發現事件前後犯罪公司之借款利率差異並不顯著。當我們試以修正資料庫登錄與犯罪新聞時間差的問題後,結果顯示犯罪公司之借款利率於犯罪相關新聞發布後顯著上升,除此之外,考量交乘作用後發現犯罪公司間,犯罪罪刑為詐欺類以及受判罰金較高的犯罪公司於事件後,相較於其他犯罪公司,該類公司更傾向面臨較高的借貸成本。 / A number of well-known corporate prosecutions have been raised in recent years. Previous literature focuses more on the valuation impact of corporate convictions. Empirical evidence on how corporate convictions affect the contract terms of syndicated loan is sparse. We examine how corporate misconducts affect the pricing of bank debt after corporate convictions. We find that the difference of loan spreads between facilities initiated before and after conviction are insignificant. Taking potential lag of initial announcement time into consideration, we find significant evidence that the effect of corporate conviction is positively associated with the increases of loan spreads. Moreover, interaction terms with conviction variable show that firms with large fines or convicted of fraud-related crimes tend to face higher loan spread after convictions.
