A model for the prevention of corruption and corruption-related offences at Gauteng police stations

The research entailed an exploration of the reasons behind corruption and related offences in selected Gauteng police stations of the South African Police Service (SAPS). Corruption refers to the illegal and unlawful activities performed by police officials when they enrich themselves by taking money and other valuable property from offenders, victims and other people they come into contact with. The participants in this study were purposefully chosen and comprised of two groups. The first group included ex-police officials convicted and sentenced for committing corruption and related offences. The second group were active police officials suspected to have committed corruption and related crimes and some in this group were dismissed by disciplinary tribunals. The research was done at four of the police stations in Gauteng Province. There were 18 participants interviewed and nine were chosen from these police stations, with the remaining nine from two correctional facilities in Gauteng. The participants were asked an open-ended question which aimed at exploring convicted police officials’ reasons for having committed corruption. The interviews were recorded with the participants’ permission. The recorded data were transcribed verbatim and analysed. The five main themes that emerged are the high incidence of corruption involving all levels of police, multiple environmental factors which contribute to corruption, forms of corruption, dynamics resulting from corruption and anti-corruption mechanisms to prevent corruption. The themes were described using “in vivo” quotes from the transcribed data. To learn other trends about corruption, the nature and extent of corruption in the political, economic and the governmental sphere were discussed. In the summary of the research recommendations and conclusions were provided. A model has been identified which consists of preventative and reactive mechanisms, including selection, recruitment, the code of conduct, supportive leadership, supervision, mentoring and coaching, targeted inspections and auditing. Life style audits, disciplinary measures, dismissals and prosecution in these corruption case hearings also form part of the proposed model. / Corrections Management / D.Litt. et Phil. A criminological examination of police criminality

The primary objective of this research was to study and explain police criminality from a criminological point of view. Police criminality was addressed from a scientific perspective and this was achieved by using scientific measures and procedures including theoretical explanations and recognised research methodology. The secondary objectives included the undertaking of a comprehensive literature study on police criminality in addition to conducting interviews with specialists in order to gain expert information from knowledgeable sources in the field of police criminality. Interviews conducted with police offenders addressed police criminality from the viewpoint of the individual offender. The findings of the empirical study reflect significant individual and organisational factors. The individual factors highlighted characteristics such as power, greed, aggression, feelings of invincibility, gullibility, propensity to criminality and psychological factors including Post Traumatic Stress Disorder, which contributed to crimes committed by police members. Perhaps the most significant organisational contributors highlighted by this study related to managerial shortcomings. It is evident that police organisations with high levels of untrained, inexperienced and incompetent managers experience high levels of internal criminality. Poor supervision and the lack of corruption controls create an enabling environment for the perpetuation of police deviance. Additional organisational factors that encourage criminality include negative aspects of police culture such as the code of silence, where police members are more apt to protecting corrupt colleagues than reporting them. The lack of discipline gives rise to insubordination and familiarity, which encourages impunity. In the South African Police Service at present, the policy of Affirmative Action is causing widespread dissatisfaction and the lowering of morale amongst certain members. Inadequate recruitment and training do not prepare members adequately for their job and it literally allow the "worm into the apple." The researcher's contribution to this study is an interventionist model, which contains essential recommendations primarily for the benefit of the South African Police Service. These include the expeditious implementation of a comprehensive anti-corruption strategy and the creation of an independent investigation unit. Management shortcomings must be rectified and professionalism encouraged. Evaluating the application of human rights principles in crime investigation in Ethiopia : a case study of the Addis Ababba city police

In any society the police are organized with the responsibility of keeping peace and order, ensuring the rule of law, justice, prevention of crime as well as protection of human rights. Regardless of the circumstances in which the police find them, they should act towards every human being with a sense of duty and care for human rights; it is the responsibility of the police to conduct the process of arrest, search and seizure according to the law with no neglect of duties. The police are expected to comply with the arrest, search and seizure procedures designed to ensure the protection of human rights. Nevertheless, usually, the task of investigation is vulnerable to human right violation. This is particularly true in the case of the developing countries where the process of democratization is so infant that most of them not only lack the required level of awareness/understanding pertaining to the human right principles but also the necessary institutional mechanisms that contribute to the proper application of human right principles are missing. The report of the Ethiopian Federal Police Inspection Service conducted in the year 2003 indicated that there were some suspects arrested without court warrant and with the existence of reasonable doubt for their guiltiness. Moreover, findings of a research conducted in the same year on certain Addis Ababa sub-city police stations also clearly indicate this fact. The objective of the this research is to evaluate the extent to which crime investigator, who are duty bearers in the Addis Ababa city police, adhere to the human right principles pertaining to the rights of suspected, accused and arrested person that are recognized in pertinent international instruments and enshrined in the Federal Democratic Republic of Ethiopia (FDRE) constitution and other related laws of the country while fulfilling their duties and responsibilities throughout the crime investigation process. Specifically the study is also aimed at exploring the form and type of commonly violated human right, if any and the determinant factors behind the respective types of human right violation by crime investigation belong to the Addis Ababa police .Methodologically the study followed and is mainly relied on the qualitative empirical approach to social science research. / Police Practice / M. Managing learner misconduct in Ntoane Village secondary schools

The purpose of this study was to investigate the misconduct of learners in secondary schools in the Ntoane village. It served to determine the • extent to which teenage fall pregnant; • the intensity in which teachers tackle gender violence in schools; • the manner in which the parents’ culture and values are enforced by the teachers. Recommendations are made on how to overcome these barriers and to improve the level of misconduct. A literature study was carried out to gain an understanding of misconduct, and covered the following issues: • What is misconduct? • The causes of misconduct. • An overview of learner misconduct. • The origins of learner misconduct. • Manifestations of learner misconduct in the classroom. • The factors which cause learner misconduct. A qualitative research method was used in this research. The targeted population groups are teenagers in grades 9 and 10 in the Ntoane village. v Interviews were conducted at two schools in the Ntoane village where educators, the school governing bodies and members of the representative council of learners were interviewed. The findings were discussed at length to determine the research objectives. Conclusions were drawn after analysing these findings, and recommendations were formulated. / Education Management / M. Ed. L'encadrement juridique du droit de grève : étude comparée Benin - France / The legal framework for the right to strike : comparative study Benin-France

Délit pénal puis faute contractuelle, la grève est devenue un droit constitutionnel en France et au Bénin. Le législateur français a assorti l’exercice du droit de grève de garanties en optant pour le principe de la suspension du contrat de travail du salarié faisant grève, le maintien de l’emploi dès lors que la grève se déroule dans certaines conditions. Seule la faute lourde imputable au salarié rend possible la rupture du contrat de travail. Le législateur béninois n’a pas édicté expressément les mêmes règles laissant à la jurisprudence le soin de protéger et garantir l’exercice de ce droit constitutionnel. Pour exercer valablement le droit de grève, les grévistes doivent informer préalablement de l’employeur de leur revendication afin qu’il puisse y répondre et éviter si possible le déclenchement de la grève. Le droit de grève doit s’exercer dans la quête permanente d’une compatibilité avec d’autres libertés constitutionnelles (droit de propriété, liberté d’entreprendre, liberté du travail,…). Il existe dans les deux pays des procédures facultatives de prévention et de résolution de conflit. L’exercice du droit de grève s’incline devant l’invocation d’un intérêt supérieur tel que l’intérêt général ; ceci conduit à la prévision d’un service minimum, parfois à un ordre de réquisition. Par ailleurs, l’obligation d’observer un préavis tout comme la multiplication de recours préalable peut participer, singulièrement au Bénin, de stratégies visant à différer ou à rendre difficile l’entrée en grève. Enfin, de façon variable en droits béninois et français, sont interdits certains motifs ou certaines modalités de grève. Dans les deux pays, en cas d’exercice anormal du droit de grève, le gréviste peut voir mis en jeu sa responsabilité tant au plan civil que pénal. Respecter le droit de grève tout en limitant les débordements les plus nuisibles liés parfois à son exercice, conduit à voir affirmer une véritable démocratie sociale, adjuvant nécessaire de la démocratie politique. / Penal offense and then contractual fault, the strike became a constitutional right in France and Benin. This consecration comes in paragraph 7 of the Preamble of the French Constitution: "the right to strike is exercised within the framework of the laws that regulate it". Article 31 of the Beninese Constitution of 11 December 1990 states: "The State recognizes and guarantees the right to strike. Any worker may defend his interests, either individually or collectively or through trade union action, as provided by law. The right to strike shall be exercised in accordance with the conditions laid down by law ". As the formulas adopted by the French and Beninese constituents were almost similar, it was the legislator who had the task of clarifying the scope of beneficiaries. In common, apart from some variable legal limitations, the right to strike is found both in the public sector and in the private sector. The Beninese and French legislators have specified the conditions under which the right to strike can be exercised and the formalities or procedures to be respected before the strike begins. The French legislature imposed guarantees on the exercise of the right to strike by opting for the principle of the suspension of the employment contract of the striking employee and the maintenance of employment if the strike takes place under certain conditions. Only the gross negligence attributable to the employee makes it possible to terminate the employment contract. The Beninese legislature has not expressly enacted the same rules, leaving the case law to protect and guarantee the exercise of this constitutional right. The powers traditionally recognized by the employer are subject to scrutiny when disciplinary proceedings are instituted against strikers or in the event of a pay deduction for strike action. Protection is only in favor of a strike based on professional demands. In order to properly exercise the right to strike, strikers must inform the employer in advance of their claim so that they can respond to it and avoid the strike if possible. The right to strike must be exercised in the permanent search for compatibility with other constitutional freedoms (property rights, freedom of enterprise, freedom of labor, etc.). There are voluntary conflict prevention and resolution procedures in both countries. The exercise of the right to strike is subject to the invocation of a superior interest such as the general interest, but also sometimes to the obligation imposed on employees to observe a minimum service or even to respond to a requisition order. The system of requisitioning strikers differs in its implementation in Benin and French law. On the other hand, the obligation to observe a long notice as well as the multiplication of preliminary remedies is part of strategies to delay or make difficult the strike. In Beninese law, as in French law, certain grounds or methods of strike are prohibited. By way of indication, the requirement to call a strike by a representative trade union in the public sector constitutes a point of divergence between Beninese and French rights. On the other hand, in both countries, the "statute" of an employee's striker does not preclude the possibility that, in the event of an abnormal exercise of the right to strike, civil or criminal liability may be exercised.

La complexité de la conduite du navire marchand impose aux opérateurs d’avoir de nombreuses connaissances dans différents domaines. La standardisation de la formation maritime au niveau international par la convention STCW est un élément qui participe à garantir de leur capacité à conduire l’expédition maritime. Mais il n’est pas suffisant. L’armateur est l’acteur clé dans ce domaine. Son investissement dans le maintien et le développement des connaissances techniques, dans l’encadrement de l’exploitation du navire et dans la mise en place d’une stratégie de gestion des facteurs humains adaptée, est déterminant pour maîtriser les compétences de son personnel navigant et prévenir les dommages qui résulteront de leurs erreurs. Il est très intéressant de constater que le droit maritime tient compte de cet investissement pour déterminer le régime de responsabilité civile auquel l’armateur sera soumis lorsqu’il devra répondre des actes dommageables de ses préposés. Son implication dans la mise en place de stratégies de gestion humaine adaptées lui permettra d’accéder à de larges aménagements ou exonérations de responsabilité. Le régime très protecteur dont il bénéficie sera en revanche progressivement levé, en fonction des manquements personnels retenus à son encontre. Le droit maritime participe donc, d’une certaine manière, à responsabiliser les armateurs. La réalité est en fait plus nuancée car les difficultés pour lever ce régime spécifique sont nombreuses. Les protections qui lui sont accordées pourront alors apparaître comme un facteur démobilisant dans l’objectif de maîtriser l’élément humain, pourtant essentiel pour la sécurité maritime / The complexity of operating a vessel requires that crew members have in depth knowledge in a wide variety of areas. The International maritime training that has been standardized by the STCW convention is one of the elements that helps to guarantee their ability to make the maritime expedition a success. But it is not enough. The shipowner is the key actor in this area. His personal investment to maintain and develop technical knowledge, to supervise vessel operation and to implement an appropriate human factor strategy, is crucial for controlling the competencies of his crew to prevent potential damages that could result from human errors. It is very interesting to see that maritime law considers this investment in determining the civil liability regime to which shipowners will be subject for the damages caused by negligence of his crew. His involvement in implementing efficient human strategies will allow him to benefit from wide exemptions or limitation of liability. The very protective civil liability regime he enjoys will nevertheless be lifted, at least partially, for his own omissions that contribute to the damage. Maritime law therefore encourages, in a certain way, shipowners to get involved in vessel crewing. The reality is actually more nuanced because the difficulties to lift this specific regime are various. The protections that are granted to a shipowner will then appear to be a demobilizing factor in controlling the human element, which is essential for maritime safety

L'amélioration de l'application et de l'interprétation uniformes des conventions internationales relatives au contrat de transport : le cas de la faute qualifiée / Improving the uniform application and interpretation of international conventions on the contract of carriage : the case of qualified misconduct

Les conventions internationales de droit uniforme du commerce international ont pour but d'adopter un ensemble de règles qui soient communes et directement applicables aux rapports juridiques existant entre les différentes parties à un contrat commercial international. L'uniformité de ces conventions peut cependant être rompue en raison d'interprétations divergentes dont certaines de leurs dispositions font l'objet de la part des différents juges nationaux. C'est en particulier le cas des dispositions relatives à la faute qualifiée dans les conventions internationales de droit uniforme relatives au contrat de transport. Pour réduire les divergences d'interprétation en ce domaine, il a été proposé de changer la formulation de cette faute qualifiée qui après avoir été formulée au moyen d'un standard, l'a donc été au moyen d'une définition. Cette thèse s'est dans un premier temps intéressée à l'étude des résultats obtenus en matière d'uniformité d'interprétation de cette faute qualifiée sous l'empire du standard, puis sous celui de la définition. Cela a permis de mettre en évidence le fait qu'au-delà de la rédaction de la faute qualifiée au moyen d'un standard ou d'une définition, les divergences d'interprétation apparaissaient ou pouvaient apparaître à cause notamment de divers éléments perturbateurs qui ont été identifiés et au sujet desquels un premier niveau de propositions de solutions a été fait. Cependant, ces propositions de solutions, qui consistent globalement à adopter une interprétation en tenant compte des divers éléments perturbateurs de l'uniformité de l'interprétation qui ont été identifiés, doivent être mise en œuvre au moyen de mécanismes dont la création est nécessaire. C'est ce que cette thèse a proposé dans un deuxième temps.En effet, ces mécanismes ont pour objet la délivrance de recommandations interprétatives aux sujet des dispositions conventionnelles faisant l'objet, au moins potentiellement, de divergences d'interprétation. Ces recommandations sont à destination des juridictions des Etats parties aux conventions concernées et bénéficient d'un statut sui generis qui justifie qu'elles soient prises en compte par le juge. Si c'est la faute qualifiée dans les conventions internationales de droit uniforme relatives au contrat de transport qui a servi de support et de fil conducteur pour cette étude, les éléments de solution proposés ont toutefois vocation à s'appliquer, selon le même schéma, dans d'autres domaines que celui du droit des transports, régis par des conventions internationales de droit uniforme du commerce international. / The purpose of international conventions of uniform international trade law is to adopt a set of rules that are common and directly applicable to the legal relationship between the parties to an international commercial contract. The uniformity of these conventions can, however, be broken by divergent interpretations of which some of their provisions are the subject of the various national judges. This is particularly the case of the provisions relating to misconduct described in the international conventions of uniform law relating to the contract of carriage. In order to reduce differences of interpretation in this area, it has been proposed to change the wording of this qualified fault which, after having been formulated by means of a standard, has thus been made by means of a definition. This thesis was at first interested in the study of the results obtained in terms of uniformity of interpretation of this qualified fault under the influence of the standard, then under that of the definition. This made it possible to highlight the fact that beyond the drafting of the qualified fault by means of a standard or a definition, the divergences of interpretation appeared or could appear because of various disruptive elements which have been identified and for which a first level of proposals for solutions has been made. However, these proposals for solutions, which generally consist in adopting an interpretation taking into account the various disruptive elements of uniformity of interpretation that have been identified, must be implemented through mechanisms that are necessary to create. This is what this thesis proposed in a second step. The purpose of these mechanisms is to issue interpretative recommendations on conventional provisions that are the subject of at least potentially divergent interpretations. These recommendations are addressed to the courts of the States Parties to the conventions concerned and enjoy a sui generis status which justifies them being taken into account by the judge.If it is the misconduct described in the international agreements of uniform law relating to the contract of carriage which served as support and guideline for this study, the proposed elements of solution are however intended to apply, according to the same scheme, in other fields than transport law, governed by international conventions of uniform international trade law.

I denna uppsats undersöks hur föräldraförmågan konstrueras i rättsfall och hur olika domstolsinstanser med fokus på Högsta förvaltningsdomstolen, argumenterar för bifall respektive avslag för vård enligt LVU 2§ vilket handlar om föräldraförmågan. Genom en kvalitativ dokumentstudie undersöks sju domstolsavgöranden från förvaltningsrätten, kammarrätten och Högsta förvaltningsdomstolen där fokus ligger på Högsta förvaltningsdomstolens beslut. En hermeneutisk analysmetod används för att analysera materialet samt att socialkonstruktionismen som teori genomsyrar hela uppsatsen. För att fördjupa analysen tar vi stöd av tidigare forskning och vetenskapliga artiklar. Den tidigare forskningen innehåller studier som förklarar termen föräldraskap och vad som ingår i detta men även forskning kring tvångsomhändertagande av barn enligt LVU. Uppsatsens ämne uppkom efter debatter och kritik kring socialtjänstens arbete våren 2022. Det har i dessa debatter hävdats att socialtjänsten omhändertar barn utan giltiga skäl. Resultatet i vår uppsats visar dock på raka motsatsen. Resultatet visar på att en bristande föräldraförmåga inte föranleder ett omhändertagande utan snarare att flera brister i kombinationen med varandra utgör grund för LVU. Uppsatsens resultat visar att en förälder kan klassas som en tillräckligt bra förälder trots bristande föräldraförmågor. Det uppsatsens resultat dock visar på, vilket samstämmer med tidigare forskningen är att ett det krävs en hel del brister i föräldraskapet och omfattande problematik för att skäl för ett LVU enligt 2§ ska föreligga.

Questa tesi di dottorato ha l’obiettivo di analizzare i processi attraverso cui individui ed organizzazioni costruiscono la loro posizione e la loro valutazione nel contesto di field istituzionali culturali e creativi. La tesi contiene tre capitoli che rappresentano tre distinti lavori di ricerca. Le analisi empiriche svolte sono incentrate sui settori del cinema (primo capitolo), della quality television (televisione ‘di qualità’, serie televisive) e della musica indipendente negli Stati Uniti. In tutti i lavori di ricerca sono stati utilizzati database longitudinali e metodi quantitativi e qualitativi. Nel primo capitolo, si analizza come gli scandali personali (di natura sessuale e non sessuale) influenzino la costruzione della peer recognition. Si prendono anche in considerazione gli effetti degli stereotipi legati al genere e dei comportamenti orientati alla valorizzazione delle diversità (solidarietà femminile), per comprendere come questi influiscano sulla peer recognition, insieme agli scandali, nell’ambito della valutazione degli attori di Hollywood (candidatura all’Oscar), nel lasso temporale 2003-2018. Nel secondo capitolo, viene teorizzato il processo di nascita e di consolidamento di un field interstiziale (interstitial issue field), attraverso l’analisi del caso del field nato tra la musica indipendente e la quality television negli Stati Uniti, dal 2003 al 2018. Si delineano le caratteristiche della infrastruttura istituzionale del field emerso, si definisce il ruolo lavoro degli attori istituzionali (institutional work) e degli spazi interstiziali (interstitial spaces). Nel terzo capitolo, i field istituzionali della musica indipendente e della quality television sono ulteriormente esaminati, tra il 2013 e il 2018, attraverso una indagine della collaborazione tra i due field, nell’ utilizzo di un album indipendente nella soundtrack di episodi di una serie televisiva. La ricerca mira a comprendere gli effetti della collaborazione sulla valutazione di un prodotto del field della musica indipendente (album indipendenti) che collabora con un field più ‘commerciale’ (quality television). / This doctoral thesis aims at shedding light on the processes by which individuals and organizations negotiate their structure, position, and evaluation, within the context of creative and cultural fields. It contains three chapters that represent three research studies. The empirical analyses undertaken throughout the research pieces are focused on the fields of cinema (first chapter), quality television, and independent music (second and third chapter) in the United States. For all of them, longitudinal databases are employed, and both quantitative and qualitative methodologies are utilized. In the first chapter, the role of personal (sexual and non-sexual) scandals for peer recognition is investigated. The research focuses on how scandals, gender stereotypes, and engagement in diversity-valuing behaviors (female solidarity) affect peer recognition for Hollywood actors (nomination of actors for an Oscar), in the time frame 2003-2018. In the second chapter, the process of emergence and consolidation of an interstitial issue field is theorized, by exploring the case of the field that emerged between indie music and the quality television in the United States from 2003 to 2018. In the analysis, the features of the institutional infrastructure of the emerged field, with the role of institutional actors and of interstitial spaces, are taken into consideration. In the third chapter, the fields of independent music and quality television in the US are further examined, between 2013 and 2018, by focusing on the patterns of evaluation of one field’s products (independent music, independent albums) when this field interacts with the other (quality television) – that is, when independent albums are featured in quality television episodes.
