Inheritance proceedings The goal of my Master's thesis is to describe in detail the course of the inheritance proceedings. Even though, the overall rule states that inheritance is assumed at the moment of decedent's death, the inheritance proceedings must take place. It is therefore a procedure set by law that is presided by a notary as a court commissar who is authorized by a competent court. During the proceedings, the notary locates decedent's inheritors, his assets and debts. With conclusion of the proceedings, all decedent's property relations are assorted in order. Simply it can be said, the conclusion of the inheritance proceedings is a division of decedent's assets and debts among all heirs. This thesis is divided into five chapters. The first chapter describes the history of the inheritance proceedings and the position of a notary as a court commissar in the period in between the First Republic to the contemporary practice. Furthermore, the contemporary inheritance proceeding is characterized as well as its function and legal framework, including its demarcation as a non-adversarial process. The second chapter deals with matters of court's authority and competence for the inheritance proceedings. 59 Liquidation of the inheritance in Czech and Austrian legislation This diploma thesis is focused on the over-indebtedness of the estate in two countries, namely in the Czech Republic and in the Republic of Austria. Its main goal is to analyse the current situation, compare the differences between the two countries and point out the problems of current legislation. In this thesis, there was mostly used descriptive method, in combination with the comparative method. The Austrian legislation was chosen for comparison because of the history that unites the two countries. Austria-Hungary, of which both countries were part, provided the basis for the current standards of both countries. The text of the diploma thesis itself is divided into two main parts. The first of them is focused on legislation in our territory. At the beginning, the reader is acquainted with the development of legislation, which ends with the currently valid laws. Furthermore, the estate proceeding is described, thus its process, the main institutes and the position of the notary as a court commissioner. Corporate bodies are essential for the development of companies activities, and their minutes provide a means of evidence and proof of the deliberations and resolutions adopted therein. In certain conlict situations, the presence of a notary public is required in the meetings in order to verify the legality and validity of the resolutions adopted. This is why the General Corporations Law provides for the possibility that the notary public witnesses the general shareholders meeting, but omits it in the case of the board of directors. In this context, the amendment of article 170 of the General Corporations Law expressly incorporates the possibility of counting with the presence of a notary public in the board of directors in order to certify the authenticity of the resolutions and implement immediately the decisions adopted by both corporate bodies. / Los órganos sociales son esenciales para el desarrollo de las actividades de las sociedades y sus actas constituyen un medio de constancia y prueba de las deliberaciones y acuerdos adoptados en ellos. En ciertas situaciones confictivas, se amerita la presencia de un notario en las reuniones para dejar constancia la legalidad y validez de los  acuerdos adoptados. Por ello, la Ley General de Sociedades preveía la posibilidad de que el notario presencie las juntas generales de accionistas, pero lo omitía en el caso del directorio. En este contexto, la modiicación del artículo 170 de la Ley General de Sociedades incorpora de manera expresa la posibilidad de contar con la presencia de un notario en el directorio para certiicar la autenticidad de los acuerdos y poder ejecutar de inmediato las decisiones de ambos órganos sociales.

A notary in inheritance proceedings The aim of the study is to describe the activity of the notary as a court commissioner in inheritance proceedings and to compare Czech and Slovak legislation on this issue. In our legislation the inheritance proceeding is mandatory, as well as court commissariat, which means that when the court learns of the death of the person promptly starts the inheritance proceedings and instructs the court commissioner with the acts in proceedings. Court commissioner has de facto the control of the inheritance proceedings in his hands and with small exceptions he makes all acts in the proceeding. I chose this theme because I am interested in notary in general and court commissariat is one of the most important activities of the notary. This study is divided into three parts: 1.part- Notary in the inheritance proceedings in Czech Republic, 2. part- Notary in the inheritance proceedings in Slovak Republic, 3.part-final summary and the comparison. The parts are further divided into chapters and subchapters. I and II. part are structured similarly, but differ in scope. Suinteresuotiems asmenims, siekiantiems sudaryti hipotekos ar įkeitimo sandorį, ir tuo pačiu norintiems, kad nebūtų apribotos įkeičiamo turto savininko teisės laisvai valdyti, naudoti ir tam tikrais atvejais disponuoti įkeičiamu turtu, neišvengiamai teks susidurti su tokį jų sandorį tvirtinsiančiu notaru, teisėtą civilinę apyvartą privalančiu užtikrinti valstybės įgaliotu asmeniu. Notaras, vadovaudamasis visais su hipotekos ir įkeitimo teisiniais santykiais susijusiais teisės aktais bei atsižvelgdamas į aktualią teismų praktiką, privalo: įsitikinti, kad įkeičiamas turtas priklauso suinteresuotam asmeniui nuosavybės ar patikėjimo teise; įsitikinti, kad hipotekos ar įkeitimo sandoris apskritai gali būti sudarytas; taip pat užtikrinti, kad hipotekos ir įkeitimo lakštas yra užpildytas laikantis teisės aktų reikalavimų. Atlikęs minėtuosius veiksmus, surinkęs visus šiam sandoriui būtinus dokumentus, notaras, laikydamasis Lietuvos Respublikos notariato įstatyme įtvirtintų reikalavimų, tvirtina sandorį. [toliau žr. visą tekstą] / Each concerned person willing to enter into a mortgage/ pledge agreement, under which no rights of the ownership (to control, use and at times to dispose) shall be restricted, will inevitably come across with a notary – a person duly authorised by the state to ensure the legitimate civil circulation. A notary, while following the statutory regulations and case law on mortgage and pledge, is obliged to: ascertain the collateral is definitely owned by/ trusted to the concerned person; ascertain that the mortgage/ pledge agreement can be concluded at all; ensure the mortgage/ pledge bond is filled properly. As follows, after receiving the necessary documentation, a notary confirms the agreement according to the requirements of the Notary Act of the Republic of Lithuania. Since the registration is a stringent condition for mortgage and pledge to take effect, the notarial confirmation of the agreement is more likely regarded as an initial step. Whereas the hypothecary judge is the one to scrutinize the works already performed by the notary. As one might expect, the above mentioned system of double-checking has more disadvantages than advantages. The role of the notary in secure electronic commerce

The profession of the notary is at a cross roads. The Notary operates in a world of paperbased transactions where the use of traditional signatures and seals are mandatory. The practices and procedures which have evolved over centuries simply cannot be applied directly in a digital environment. Establishing a framework for the authentication of computer-based information in today's commercial environment requires a familiarity with concepts and professional skills from both the legal and computer security fields. Combining these two disciplines is not an easy task. Concepts from the information security field often correspond only loosely with concepts from the legal field, even in situations where the terminology is similar. This thesis explores the history of the Notary, the fundamental concepts of e-commerce, the importance of the digital or electronic signature and the role of the emerging &quotCyber" or &quotElectronic" Notary (E-Notary) in the world of electronic commerce. The research investigates whether or not the functions of the &quotNotary Public" can successfully evolve in the world of E-Commerce, and if so what are the ramifications. This thesis comprises a survey and critical analysis of proposed architectures and implementations for &quotElectronic Notary Services" in an Internet based, electronic commerce environment. It includes an analysis of relevant historical and legal factors relevant to these emerging technologies. Given the highly dynamic nature of this topic, this thesis does not propose or recommend a single architecture or implementation but emphasises the need for further research not only into technological factors but also into the real legal and social needs that affect the role of the E-Notary. The approach undertaken was an analytical approach to the available current documentation against input from leading practitioners included practicing Notaries from Australia, the United States and the Court of Faculties - London.

The aim of this diploma thesis, "Notary in the Legal Order of the Czech Republic" is to provide clear and comprehensive information on the status of notaries (also known as "notaries public" or "public notaries") and notarial activities within the Czech Republic. Given that notaries represent one of the most important and respected legal professions, I consider it appropriate to focus increased attention on them. The thesis is divided into nine main parts. In the first part, the introduction, I explain why I've decided to address the given topic and present a brief summary of my thesis. The second part provides a short excursion into the history of the notarial practice in the Czech lands, providing the most significant legal rules governing the status of notaries and the performance of notarial activities. The subject of my Master's degree thesis is the issue of proceedings relating to decedent's estate. The main aim of this thesis is to describe the course of this proceedings with respect to current legislation. In general, the inheritace rights arise at the very moment of decedent's death. Nevertheless, the decedent's estate proceedings must still take place. A notary (as a court commissioner) is therefore tasked to locate potential inheritors, assets and debts of the decedent's estate. The goal of the proceedings is to devide relevant assets and debts among located heirs. My thesis is devided into four individual parts. First of them consists of two chapters, which are dedicated to history and sources of law. The second part deals with general aspects of decedent's estate proceedings. Decedent's estate proceedings The diploma thesis describes different stages of decedent's estate proceedings and it is also focusing on the biggest changes in legal regulation, which have been implemented by Act no. 292/2013 Coll., Code on Special Court Proceedings. This thesis is divided into five chapters. In the first chapter is defined, why decedent's estate proceedings is so important for society and by which legal principles is affected. In this chapter it is also mentioned from which legal sources decedent's estate proceedings draws. The second chapter provides a brief historical introduction into the issue of decedent's estate proceedings.
